Fish habitats are established and regulated under the Fisheries Act 1994. DEEDI (formerly DPIF) are a referral agency for any application related to a fishery or fish habitat matter. While it is fine to implement into a Planning Scheme, it takes the ability away from DEEDI to asses the application independently from Council as experts in the matter. This is not appropriate for a Planning Scheme to regulate as Council do not employ experts in fishery matters or deal with offsets.

1.2.3

Development does not occur within an erosion prone area that is also within a coastal management district; or within a storm tide inundation hazard area, as shown in map 4, except in accordance with relevant policies of the state and regional coastal management plans.

A State Planning policy for Air/Noise (SPP) is currently being developed by the EPA. It will contain a hierarchy of planning and management tools to protect sensitive land uses from the impacts of air and noise emissions.
