Bankruptcy 101 – An Introduction toConsumer Practice
An overview of the basic concepts of Chapter 7 and Chapter 13. This session will introduce the consumer practitioner to basic terminology and reveal the mysteries of exemptions, dischargeability, the automatic stay—and much more!
Top Consumer Cases of the Year
Get a summary of the most signifi cant cases affecting consumer bankruptcy practice. This session will focus on the most interesting and controversial bankruptcy rulings decided in the past year.
Top Commercial Cases of the Year
This panel will address decisions over the last year that are of importance to attorneys with a commercial bankruptcy practice. Among the cases to be discussed will be opinions of the Supreme Court, the Third Circuit Court of Appeals, and other important decisions from outside the Third Circuit. Handling a Chapter 7 Case
This is a basic session designed to highlight issues that regularly arise in a Chapter 7 case. The presentation will provide a perspective from attorneys representing the different sides of a straight bankruptcy case and will provide new practitioners with the essential foundations of Chapter 7.
Consumer Protection Litigation for the Bankruptcy Practitioner
A consumer debtor’s assets may include potential claims under the FDCPA, Fair Credit Reporting Act and other Federal consumer protection laws. In this session, bankruptcy practitioners will be provided with an overview of the elements of a claim, how to spot claims, remedies available, and defenses to these claims.
Objections to Discharge/Nondischargeable Claims
This panel will discuss recent decisions involving objections to discharge and nondischargeable claims. Among the cases to be discussed will be opinions related to timeliness issues, excusable neglect, the relation back doctrine, gap period extensions, defalcation by fi duciaries, student loans and the failure to keep suffi cient fi nical records.
Successor Liability and Sales
I have to pay what?! What debtors, creditors and asset buyers need to know about pension and employee benefi ts. This session will explore the sale of assets “free and clear” under Section 363 of the Bankruptcy Code and circumstances where successor liability may survive a Section 363 sale, including liability for pension and employee benefi ts.

The Intersection of Bankruptcy and Family Law
From pre-fi ling considerations to bankruptcy discharge and beyond, this topic will discuss the intersection of family law matters in bankruptcy and include such topics as treatment of equitable distribution claims in bankruptcy, the application of the automatic stay and automatic stay violations, exemptions and dischargeability.
Chapter 13 for the Higher Income/Higher Indebted Debtor
Given the fact that the debt limits in Chapter 13 are now $383,175 for unsecured debt and $1,149,525 for secured debt, it is inevitable that debtors will include individuals with signifi cant assets, liabilities and income. These debtors will have issues that are not garden variety in relation to what has been typical in the Chapter 13 practice in earlier times. Valuable homes, luxury cars and private schools are issues that we should be ready to address with the Trustee, creditors and Court in these cases.

Essentials of Chapter 13 Practice (Including Model Chapter 13 Plans)
This session will provide an overview of the “road to confi rmation” and beyond in Chapter 13: how to effectively manage your case beginning prior to the Meeting of Creditors and up to and after confi rmation of a plan, including unexpected “bumps in the road.” It will include a discussion of the use of Model Chapter 13 Plans. The session will offer the perspectives of a seasoned Chapter 13 attorney, the UST and the Chapter 13 Trustee.
Student Loans: Bankruptcy and NON-Bankruptcy Options
Through the use of hypotheticals, this session will explore the current student loan landscape from both the creditor and debtor perspective. The panel will guide you through the current caselaw regarding dischargeability of private and federal student loans in a Chapter 7and Chapter 13 context and discuss non-bankruptcy options including deferment, forbearance and income contingent repayment programs for federal student loans as well as settlement options available from private lenders.
Taxes and Bankruptcy – Prepetition Strategies and Post-Petition Consequences
This session will cover the basics and latest in tax preparation strategies, post-petition consequences and bring IRS insight, especially how the IRS processes proofs of claim and responds to Chapter 13 plans and what it does with setoffs, some discharge issues, and automatic stays.
Trends in Commercial Bankruptcy
We will analyze In re Fisker Auto. Holdings, Inc, the state of the law after Fisker. and the risks and opportunities Fisker presents to debtors, secured creditors and creditor’s committees. There is an increasing trend on the appointment of independent directors and independent committees on the eve of bankruptcy. What are the reasons and are the independent committees necessary? We will cover a case study of Offi cial Committee of Unsecured Creditors v. UMB Bank, N.A., et al., (In re Residential Capital, LLC, et al.) and the challenges and opportunities the decision presents.
