Welcome to the second edition of our new format newsletter. Adawasbornon1stMarch1928inBilston.Shehadthreesiblings,twobrothersand1sister.AdamarriedKenandgavebirthtotheirsonwhosubsequentlygaveAdaandKentwograndchildren.Kenunfortunatelypassedawayin1998.

Adaclassesherhobbiesasbeingafulltimewifeandmother,goingtochurchandknitting.ShealsoenjoyswatchingthenewsonT.V.,readingthenewspapersandtakesaninterestinsport.

Having a power of attorney ensures that you select who will act for you when you are unable to handle your affairs. Without one, the courts decide.

Upuntil1stOctober2007peopleneededEnduringPowerofAttorneytoactonbehalfofanyonewithoutcapacity.Ifyouhaveanenduringpowerofattorneydatingbeforethatdateyoucanstilluseit–registeringitassoonasthepersonitconcernsbeginstolosecapacity.

AnOrdinaryPowerofAttorney(O.P.A)isusedwhenapersonstillhasmentalcapacitybuttheymayneedassistancewhilsteg.theyareinahospitalforaperiodoftimeandneedsomeonetoactonhisbehalfduringthestay,ifthepersonishavingproblemsgettingouteg.totheirbanketcorifapersonneedssomeonetoactontheirbehalfbuttheyhavethepowertosupervisethepersonacting.AnO.P.A.isonlyvalidwhilstthatpersonhasmentalcapacity.

SinceOctober2007anyonewithcapacitywhowantstoprovideforthetimewhentheylosecapacitycanapplyfortheirown“LastingPowerofAttorney(L.P.A.)”.Thismeanstheychose,whilsttheystillhavecapacity,whowillmakeimportantdecisionsontheirbehalf,orwiththeirhelp,whentheystartlosingcapacity.ASolicitorisnotrequiredtosetuptheL.P.A.

Therearetwotypesoflastingpowerofattorney:

PropertyandFinancialAffairscoveringmanagingbankaccounts,payingbills,pensions/benefitsandsellingproperty.

HealthandWelfarecoveringdailyroutinesuchaswashing/dressingandeating,medicalcareandmovingintoacarehomeetc.

Ifyou’remarriedorinacivilpartnership,youmayhaveassumedthatyourspousewouldautomaticallybeabletodealwithyourbankaccountand

pensions,andmakedecisionsaboutyourhealthcare,ifyoulosetheabilitytodoso.Thisisnotthecase.WithoutanLPA,theywon’thavetheauthority.

ThepersonmakingtheL.P.Aisknownasthe“Donor”andtheycanappoint1ormorepeopletobe“Attorneys”ie.Peopletohelpthemmakedecisions.Thedonormustbe18+andhavementalcapacityatthetimeofmakingtheapplication.Theattorneyshavetobe18+andaregenerallyclosefamilyorfriendsorspouse/partneralthoughtheycanbeprofessionaleg.Solicitor.Theattorneyscannotbebankruptandmusthavementalcapacity.Theapplicationformscanbecompletedonlineorpaperformsand,uponcompletion,mustbesenttotheOfficeofthePublicGuardiantogetherwiththefeeof£82.00.Itcantakeupto10weeksfortheapplicationtobeprocessed.

WhenappointedasaDeputyyouwillreceiveacourtordersayingwhatyoucanorcan’tdoregardingthepersonwithoutmentalcapacityandyouwillhavetosendanannualreporttotheOfficeofthePublicGuardianeachyearexplainingwhatdecisionsyouhavemadeandwhy.

Thecourtwillusuallyonlyappointapersonalwelfaredeputyif:

• There’sdoubtwhetherdecisionswillbemadeinsomeonesbestinterests,eg.Becausethefamilydisagreeaboutcare.

• Someoneneedstobeappointedtomakedecisionsaboutaspecificissueovertimeeg.Wheresomeonewilllive.

Adeputyhastobe18+andisgenerallyacloserelativeorfriend.Againtherecanbemorethanonedeputy.YoucanhaveprofessionaldeputiessuchasSolicitors,AccountantsoraLocalAuthorityRepresentativesbuttheywillchargefortheirservices.IfyouaregoingtobecomeaPropertyandfinancialaffairsdeputyyouwillneedthenecessaryskillsforfinancialdecisionmaking.
