This has always been the projects position, which OCC was informed of in November 2014 following similar discussions. The reconstruction works to this existing structure consist of the removal and installation of the bridge deck, with the abutments remaining in situ below the springing points. The deck is being replaced with a standard Network Rail conarch design. The bridge parapets will be reconstructed in a similar position, with Staffordshire Brindle Brown Brick being used to provide a sympathetic finish. I believe you have discussed this with from the project last week and he has sent through further details for your information yesterday (21 July 2015). All reconstruction works will take place within the Limits of Deviation as set out in the Order. These works are being undertaken to strengthen the existing bridge structure and allow sufficient clearance for the double track to be laid with W12+ gauge and will result in a similar structure being viewed by members of the public, whilst allowing the safe operation of the railway. The Order specifically allows for these reconstruction works, which are referred to as part of Works No. 2 in Schedule 1 of the Order, where its notes the undertaking of: ‘remedial works to bridges OXD42, OXD44, OXD46 and OXD49’ These reconstructions works were assessed as part of the original Environmental Statement (ES Vol.1, Chapter 2, paragraph 2.2.5), where it states: ‘In Phase 1, the single track through the Wolvercot Tunnel and First Turn bridge will be relaid. In Phase 2 the track bed will be lowered through the tunnel and bridge, with new retaining structures and reconstruction of the bridge. This will provide sufficient clearance for double track to be laid with W12+ gauge.’ The Inspector did not consider it necessary to describe the works to OXD49 as constituting a new structure or as one to be substantially reconstructed as set out in the Revised Design and Access Statement, January 2011 (Inquiry Document CD/1.19/1). Therefore these works do not require a discharge application to be submitted under Condition 5 of the Deemed Permission as the Condition specifically refers to the works as set out in this document, stating: ‘The design, layout and appearance and external materials of the stations and the bridges shall conform generally to those set out in the Revised Design and Access Statement, January 2011 (Inquiry Document CD/1.19/1)’. In addition, the general works powers conferred by articles 5(4) and 5(5) of the Order, also authorises Network Rail to carry out works which may be necessary or expedient for the purposes of, or for purposes ancillary to the construction of Work No.2. We are clearly concerned about the project as a whole, but of particular concern at the moment is First Turn Bridge. We note from the project website that these works are now described as “REFURBISHMENT AND REBUILD” (my underlining) http://www.bicestertooxfordcollaboration.com/diversions-and-notices/demolition-rebuild-first-turn-road-bridge-25jan-22nov-14.html We have email of 1st December 2014 (attached) which sets out NR’s view that the works are authorised under the TWA but we have doubts about this. In our view, remedial works to the Bridge are authorised by the deemed planning permission, but there has been no Prior Approval for the rebuild. On the basis of a very brief and cursory last minute consultation on

materials (by who came into the office to show me the proposed bricks for the pedestrian side of the 2m parapets which I found objectionable) we became aware again of the local concerns that will be raised by this. I have been asked by a Councillor and a resident specifically for details of the materials and I want to be clear on the authorisations for this rebuilding work before I reply. We would ask please for a response to our email below by 28th July if at all possible so that we can review it at our team meeting that week and advise Members accordingly. I have included in this email too as the issue concerns all sections of the scheme in the Oxford area. As you are aware, this project is the subject of extreme scrutiny. We anticipate a further round of detailed questions from Councillors and local residents as the project ‘moves south’, and indeed we are already in receipt of questions around the proposal to bisect Section I. In order to deal with anticipated questions we feel that we need absolute clarity on each element of the scheme.

Can I ask you please to provide a complete and comprehensive single bundle of the railway works - both proposed and already taking place within this administrative area - setting out the authorisations for each element such that no part would amount to a breach of planning control? This should be supported by copies of original documents and plans such that this complete and comprehensive bundle could be presented as a single entity to a person with no prior knowledge enabling that person to conclude that no breach of planning control would be effected. This would be a resource to which we could direct local residents; and might form the basis of a request by us for Counsel’s opinion. Obviously that would include sections I2 and J and what appears to many to be the replacement of First Turn Bridge. We ask for provision of this single source bundle because we are anxious to avoid delays and, I repeat, we are aware that either NR or the Council or both could be challenged to justify its position. I would hope that it can be presented to the August West Area Planning Committee. I note from the covering letter that the purpose of this application is: “to facilitate a revised construction programme within the area previously defined as Section I.” I have a general understanding of what you mean by this, as follows:

one team from NR is carrying out the works from Bicester down to where the works connect with the main line opposite Stone Meadow (the point at which you now propose to bisect Section I. In effect that team is constructing Section H and the proposed Section I1); and

another team (based in Reading I think) is carrying out work in and around Oxford Station and up to Stone Meadow (so, including Section J and proposed Section I2) much of which NR is claiming to be permitted development.

For certainty however, can I ask you please to confirm or correct my understanding as outlined above; and elaborate on your covering statement by outlining for me the implications and timetable for conditions approvals and construction in Sections: I1, I2 and J? Is it still the position of NR that works in J and now I2 are permitted development? An early reply would be greatly appreciated so that I can be clear on the implications of this change and progress the application accordingly. Kind regards, Fiona

Fiona,  We are obviously aware that residents opposing tonight's Condition 19 discharge request are saying that HS2 spoil trains will run through Wolvercote. I note that the officer's report is clear in that HS2 issues are not relevant to the consideration.   But for context, I thought you would be interested in the attached paper from HS2, which is in the public domain, and describes the thinking on the routing of spoil trains. You will see that it is true that Calvert waste terminal is intended to be used as a destination for the spoil trains, but it is explicitly not the intention to route them via Oxford. You can read this in paragraph 3.7 which whilst it mentions East West Rail does so in the context of access from Bedford. Paragraph 3.9 helpfully rules out routing the spoil trains via Reading, which in railway geography terms means they will not go through Oxford either.   It may be worth distributing this to members before tonight’s meeting?  For what it is worth the only discussions the project has had with HS2 is for the route Princes Risborough – Aylesbury – Calvert.  Kind regards

Dear Fiona/David,  In relation to the Section H Noise SoA Discharge (15/00956/CND) please find attached Network Rails initial proposal for the installation of Tatasteels SilentTrack (silent rail) technology as set out in Condition 2 of the Decision Notice dated 30 June 2015.    Once OCC have confirmed that they are satisfied with the approach outlined in the attached letter, a trial location can be agreed to provide the best quality of data.   As discussed I will be leaving ERM next week so I would ask that all correspondence on this issue (and anything else related to the EWR project) is directed to both    ) and

All I have looked again at this possibility and have spoken to . The WILD units referred to primarily are safety rather than environmental control devices. Their main purpose is to prevent derailment, train damage and rail damage. However, since the latter is important for overall noise and vibration minimisation (keeping the rail roughness to a minimum) their use should be supported. Also, by identifying seriously damaged wheels and/or uneven loads there is a greater chance of removing potentially very noisy/vibration-causing trains. Whether this justifies an informative given that they already are in use is less certain. However, if this is desired here are some words: Wheel Impact Limitation Devices should be used wherever practicable as part of an effective preventive system so as to reduce the likelihood of rail damage and to identify rolling stock with seriously defective wheels and/or uneven loads which would be most likely to generate unusually high noise and vibration levels.   From: Sent: 08 June 2015 15:59 To: STEVENS David Cc: BARTHOLOMEW Fiona; Subject: RE: IE comments relating to the NSoA David,  The project is happy to action   comments 3.2, 4 and 5.2.  As the NSoA as submitted forms the basis of the Committee Report it is probably sensible to address the comments by way of a separate written statement.  Following the decision on the Section H SoA on the 16th June a written statement can be provided setting out:  3.2 ‐ the detail of non‐statutory insulation as defined in the regulations; 4 ‐ relates to contiguous facades and can again be dealt with by way of a statement; and 5.2 ‐ step by step process with timescales for installation of non‐statutory insulation  Point 6 appears to relate to ERMs original responses to public comments.   It is not considered beneficial to amend these responses now . If further clarification is sought by individual residents we would be happy to respond.    I hope this is satisfactory.    Regards

Hi Fiona, I have just received my draft copy of this baseline report this morning so it will now be reviewed by Network Rail and I would hope to submit to OCC in the week beginning 13 July. We have already met and presented the findings to from Natural England who was happy with all. Conditions 31 and 32 do not state the timeline for this submission. This is subject to the baseline being completed which was affected by the rather extreme weather and flooding in 2014 which delayed the start of the process. Network Rail has not made any formal planning applications for approval of noise and vibration mitigation under Condition 19 in section I; and they have not disclosed to me when they expect this to occur. I don’t know why they have not been taking the measurements that you anticipate. To date therefore there has been nothing on which the Council has needed to undertake public consultation in section I. In respect of any submissions in section I, I will certainly be asking them to hold pre-application public consultation as they did prior to submission of the Noise Scheme of Assessment for section H. This would of course then be followed by our own formal public consultation after receipt of the application/s. NR said they would be undertaking both noise and vibration studies for the Waterway after Easter - we don't know if this has happened - no one has seen any evidence of equipment being used to measure either noise or vibration near to their houses. NR promised they would hold a public meeting and engage in a public consultation process at both the meeting in my house and in the meeting held by Nicola Blackwood. Is there any news or proposals for this yet please? Residents of the Waterways are particularly concerned about the changes proposed for Oxford North Junction which moves it North to be directly outside houses. It would be helpful to be able to have something in the diary to allow proper consultation with communities in section I. I look forward to hearing from you

Fiona  Despite our positive conversation about giving you a list of drawing numbers, this is proving very difficult in practice.   The Atkins alignment design, which is part of a complex CAD model,  has not yet been updated for example to show the move of the switch position from Bladon Close to Lakeside. Alignment design drawings that we have are quite out of date.   The noise model contains an up to date set of alignment data for the track centre line, which can be placed on a set of plans. These will look like the A3 set of TWA Order plans, with the pink and green land boundaries etc.  We have given them the following drawing numbers and they are dated May 2015:   0221083_SecH_Sheet24_Ver1 0221083_SecH_Sheet25_Ver1 0221083_SecH_Sheet26_Ver1 0221083_SecH_Sheet27_Ver1   I don't have another practical solution, but I think this is satisfactory for the purpose of a planning condition.  Can I suggest the following wording for the condition: 'The double track railway in Section H shall be built as shown on ERM drawings reference: 0221083_SecH_Sheet24_Ver1  to )221083_SecH_Sheet27_Ver1 inclusive.'  Give me a call if this isn't satisfactory.   Regards

Dear Fiona,  In response to the below we would agree with the position which Oxford City Council (OCC) put forward in both Committee Reports and as part of the members briefing on the 11 June 2015, that the objections from   

and   use assumptions around future train types and movements which do not form part of The Chilterns Railways (Bicester to Oxford Improvements) TWA Order Scheme 2012 (the Scheme).    I believe it is important to note that both OCC and the project have requested to see the legal opinion as quoted in the letter from    but that this has not been provided to date.    However by way of response her letter specifically includes a quote from the parties legal advisor stating that ‘…the new information now available regarding future schemes might be relied on to challenge the statement that that there is no indication that there would be an intensification in the use of the stone train’ (our underline added). Also, 

 e‐mail dated the 22 May 2015  which is referred to in   letter uses assumptions (set out in endnotes 1 and 2 of the e‐mail), around assumed future train types and movements related to the unapproved HS2 scheme.    In response, the Noise and Vibration Schemes of Assessment (SoA’s) for Section H have been prepared to meet the requirements of planning condition 19 and the Noise and Vibration Mitigation Policy (NVMP). The SoA's have taken proper account of the ‘reasonable planning assumptions’ about the type and frequency of train operations confirmed by the Secretary of State (SoS) when the TWA Order was approved in October 2012. It remains the projects position that it is outside the remit of condition 19 and the required SoA’s to assess scenarios such as those referred to in the attached letters, which use assumptions based on future schemes.     We believe it is important to point out the ‘reasonable planning assumptions’ which were employed as part of the submitted SoA’s are based on a body of evidence presented in the accompanying Environmental Statement submitted in support of the TWA application.  These planning assumptions allow for ‘normal’ passenger and freight services including those for East West Rail (EWR) Phase 2, from Bletchley through Bicester to Oxford, which could reasonably have been anticipated when the TWA Order application for EWR Phase 1 was considered at public inquiry.   These were discussed as part of two sittings of the public inquiry and accepted by the SoS noting their decision to approve the TWA Order and so are considered robust.    The impact of schemes such as HS2 will be assessed as part of their own Environmental Impact Assessment process but cannot be considered as part of the Scheme being considered here. I believe that both the project and OCC are in agreement on this point.    I hope the above provides an adequate response to the below but please do not hesitate in contacting me to discuss further.  Kind regards

We have asked to see their written legal advice. While this might be thought of as largely a legal matter I would be grateful for your view please, as soon as possible, as to the extent that these considerations are accounted for in the SoAs. In addition, the serious cracking in my home which appears to have resulted from the huge increase in stone trains during the past few months is not being addressed by Network Rail (although Andy Milne has seen some of the damage). This leads me to have no confidence that any damage they may cause will either be investigated or repaired by them and it remains unknown how the Construction Code of Practice would be enforced.   Fiona at OCC asked me to provide a responce to your latest enquiry.  The photography you sent of works near the tunnel north entrance shows a 500mm deep foundation for casting in place concrete filled pipes – this is required as part of the survey control for the Wolvercote tunnel work. The holes were all hand dug and did not involve the use of plant or machinery. We have sited the concrete pipework well out of the way of the future planned works so that we can have confidence with the accuracy of the data recorded at the survey stations.  This work is not directly related to the construction works proposed for strengthening and lowering the tunnel other than we are required to undertake baseline monitoring of the tunnel in advance of any works within the tunnel, and these need to be taken for a two‐week minimum period.

 Other preparatory works that have taken place in the tunnel in recent week involve placing monitoring markers and bat monitoring ahead of a bat exclusion exercise.  Actual construction work related to the East West Rail phase 1 works will not commence until we have received signoff on condition 19 of our TWAO.  I understand that the matter of the existing cracks in your property and their connection (or not) with the current use of the railway is sitting with Network Rail. This matter is not connected to our works although, going forward, we are currently conducting pre‐construction vibration surveys on a number of properties in Wolvercote, and you will be aware that your property is one of them.  As usual, please let me know if I can provide any additional information on the project.  Best wishes

 The reason for the confusion appears to be that a refinement was made to the barrier overlap much further north where the track side barriers change to barriers at the top of the cutting.  This happens in the area around Bladon Close (see below).   This was the only change on the side of the track facing   property. This is the change which was marked in the Scheme of Assessment in Table 5.1 which we assume is being referred to (see extract below).  This refinement did not affect noise levels at any receivers, and would be too far from   

 property to have an effect.

Dear Fiona,  The project is sorry   is disappointed but we are confident that the mitigation proposed in the Noise Scheme of Assessment (NSoA) is adequate to achieve the standards set out in the agreed Noise and Vibration Mitigation Policy (NVMP) for the Scheme.  OCC’s discharge of Condition 19 (Noise) supported by the assessment of the NSoA by its Independent Expert for Noise ( ), we believe should reassure   that the standards set in the NVMP will be adhered to.    In answer to   queries,   firstly states that noise assessments were ‘not personally conducted along this stretch…’.  Individual noise assessments are not required to be undertaken as a predication methodology is used, based on agreed noise receptors from the Environmental Statement.  These receptors are agreed as the locations where noise impacts are most likely to take place.  The Soundplan model uses noise measurements taken at the agreed locations to predict noise impacts and takes into account features such as terrain and ground types.   The noise contours as shown in figure 5.1 of the NSoA are then predicted to ensure that all relevant properties are taken into account when determining the extent of the barriers and other mitigation.

  Thank you for your response.   To clear up any confusion, I am disappointed that houses 281 to 321 Woodstock Road will receive no protection from noise from Chiltern Railways, particularly as the noise assessments were not personally conducted along this stretch, but instead modelled on existing data from closer track points. Does this assessment really account for the flat fields running from the rail track across to the Woodstock Road properties?    I understand the assessments were based on measurements before vegetation was cut down along our side of the rail track. With a prevailing westerly wind, the rail noise could be very significant (it is already!) Has this been taken into account as well?   Do you know that Mike Gotch ‐ in his conditions to the WAPC, actually proposed acoustic barriers along the entire length of Section H, but was talked out of it by the argument of wasting money "protecting st Edwards fields".    We are talking about the small price of extending a fence 200 metres which will reduce rail noise by 5‐9dbls !?!    At the very least, I would like to request an independent noise assessment from this stretch of the Woodstock road please.   I look forward to hearing from you,

Dear  ,   I am pleased to forward to you the reply (below) that I have received from ERM (the consultants dealing with noise on behalf of Network Rail) in relation to your questions about railway noise and the noise barriers proposed in the Wolvercote area.    The noise contours show, as you suggested to me, that rail noise carries across the playing fields towards you property; but confirms that the distance of your property from the line of East West Rail is greater than would require barriers to meet the noise attenuation standard set down in the planning permission granted by the Secretary of State for East West Rail. This also confirms that existing rail noise (baseline noise level) was also taken into account in these predictions.   I am sorry that this is not the reply that you would have liked given the concerns that you expressed to me about existing noise from the main line which you fear will only get worse when the new line opens; but I

From: [mailto: ] Sent: 13 July 2015 17:10 To: BARTHOLOMEW Fiona; Cc: STEVENS David; Subject: RE: Noise barriers Section H   Fiona,   Please accept our apologies for not responding sooner.  We have now reviewed the situation at   property and have reviewed what changes were made between versions of the Scheme of Assessment between December and February.     The predicted noise contours in the Scheme of Assessment show the extent of the 45 dB LAeq, 8 hour contour (see extract below).  Beyond this contour there is no significant noise impact predicted (even ignoring baseline noise levels which is a worst case approach).  The receptors along Woodstock Road where   property is were further from the track than this contour.  Therefore, no significant impact is predicted and   property has never triggered the requirements for mitigation in the Noise and Vibration Mitigation Policy.     We have reviewed the figures in all versions of the Scheme of Assessment and there have been no changes in the barrier location at this southern end of the barrier.

  The reason for the confusion appears to be that a refinement was made to the barrier overlap much further north where the track side barriers change to barriers at the top of the cutting.  This happens in the area around Bladon Close (see below).   This was the only change on the side of the track facing   property. This is the change which was marked in the Scheme of Assessment in Table 5.1 which we assume is being referred to (see extract below).  This refinement did not affect noise levels at any receivers, and would be too far from   

 property to have an effect.

The call-in period to Planning Review Committee ends at 5pm on Monday so if the decision notice is issued after that (which it surely will be) and there has been no call-in, work can commence. The period for judicial review is 6 weeks after the decision notice is issued – work undertaken in that time is at risk.
