During these very challenging economictimes, BASF’s executive committee, board of directors and staff have committed them-selves to doing two things for all of you – our members:
• Helping you find new business development opportunities by sponsoringforums with high-level County staff to guide you in finding government contract work; and
• Retaining the value of your project’s entitlements, including building permits.
I am very proud to say that since January,BASF has sponsored seven business devel-opment forums to help you find new work ingovernment contracts. We have had speak-ers meet with members in various forumsfrom city, Miami-Dade or Broward County,and either state or federal agencies or gov-ernments.
In addition, some meetings included“how-to” sessions, focused on teaching ourparticipating members about the new area ofgovernment contracting. We learned directlyfrom County directors about how to becomea certified County vendor, when and where tolook for requests for proposals from the mul-tiple County agencies which seek privatesector professional services and goods. This
extended to learning about the details ofsubmitting your firm’s credentials to do work for the two premier sporting eventsMiami-Dade County is host to, the SuperBowl and Pro Bowl.
Second, we have helped you retain thevalue of your project’s entitlements, includingthe extension of your building permit(s). Thiswas a three-step process: extending buildingpermits initially, extending administrative approvals related to a project, and finally, extending approvals adopted subject to apublic hearing.
A year ago, BASF Legislative Committeemembers and staff went into action with excellent results: A few months later, theMiami-Dade County Commission adopted its first local ordinance to extend buildingpermits for six months. A provision wasmade to extend this ordinance effort anothersix months if needed.
Additionally, the BASF leadership and staff pushed for the adoption of the GrowthManagement Bill (SB 360), to adopt this concept on a statewide basis. Thus, in thelegislation, a provision was included to extend all permits for a two-year period. Also, this bill included a key provision whichallows charter schools to be used as anotheroption for mitigating school concurrencydeficits. This was an important issue for our
members, as theystruggled with the adoption ofmandatory schoolconcurrency.
The next step in our governmentaffairs plan to helpyour project retain its value is to extend thevalidation date of all related administrativeapprovals associated with your project’sbuilding permit. This would include suchitems as concurrency reservations building,water and sewer plans, WASD agreements,paving and drainage permits, etc. The finalstep is retaining all approvals obtainedthrough a public hearing, including certainDERM permits, zoning approvals, etc.
Finally, we value your continued membership. As you can see, we are working very hard to retain your confidencein us by helping you find new ways to stay in business – and to retain the value of yourexisting assets.

Toni Pacelli-Hinkley, executive vice president of the Builders Association of South Florida, won national attention recently by earning an AssociationExcellence Award (AEA) presented by the NationalAssociation of Home Builders (NAHB) Executive Officers Council (EOC). Pacelli-Hinkley won for Best Government Affairs Program for convincing aschool board to correct data and calculation flaws in adopting a legally justified impact fee. She washonored at the annual NAHB EOC Seminar held this year in Louisville, KY.

Miami-Dade County Ordinance regarding Omnibus Development Approvals Extensions nears completionBASF Members and staff have been working closely with senior County staff in preparing what will likely be a local ordinance to extend building permitsand related project documents and agreements, for a two-year period. The ordinance will be similar to permit extension languge in Senate Bill 360(Growth Management legislation), but implemented with local provisions. BASF is working to ensure the extensions areeasy to obtain for the builder, and easy toadminister for County staff. Once adopted,the ordinance would take the place of theCounty’s current building permit ordinance,which suspends the validation date for all permits for six months. School Concurrency now mandatory in Miami-Dade – after many months of concern and legal wrangling, school concurrency is now mandatory for all residential projects in the County. TheCounty’s implementing ordinance will be heard in the next month and will be incorporated into the County’s current concurrency review (tentative and final plat) by the end of this year. The SchoolBoard’s concurrency management computer program has been in use by several cities, for the past 4-5 months. An applicant can get a non-binding “snap-shot” of available school capacity by submitting a request through the city in which a project is located, not directlyfrom the School Board. The report is non-binding until the time of final plat, at which point classroom capacity is reserved for a project. Further, the Growth Management bill includes a new mitigation provision which allows a builder to proffer a charter school in the event the School Board does not have
adequate public classroom capacity for a particular project. However, the SchoolBoard must approve the offer of a charterschool for mitigation purposes. Growth Management Bill continues toraise questions – While many builders were very pleased by the passage of Senate Bill 360, various questions remain.BASF’s interest relates mainly to two key issues: the statewide, two-year buildingpermit extension provision, and anotherprovision which specifically states thatcharter schools can be used as suitablemitigation in the event a school district has no additional classroom capacity for a particular project (see above).
However, controversy continues on theissue of interpretation of transportation concurrency provisions, among other things.The City of Weston, together with a growingnumber of other local governments, has filedsuit against the Legislature based on twobroad issues in the legislation. The first allegation is that the Legislature handeddown yet another unfunded mandate, requir-ing local governments to raise local propertytaxes to comply with a state statute. Thesecond allegation states that the legislationviolates the “single subject” rule, in that thelegislation includes unrelated subjects in one omnibus bill. BASF and FHBA will be closelymonitoring the Court proceedings on thisissue and will report on them regularly. EAR 2010 Update getting started now…Miami-Dade County Planning and Zoning Department staff began their Evaluation and Appraisal Report (EAR) process last month.The seven-year review of the County’s Comprehensive Development Master Plan,(CDMP), required by statelaw, will be an even more important one this time,because of the numerousgreen building and greenhouse gas reduction
initiatives under-way (see articlebelow). BASF’sEAR Committee Co-chairs, attorneys AlanKrischer and Graham Penn,held their first meeting in early September, to lay outBASF’s plan for reviewing the CDMP and to start formulating BASF’s EAR recommen-dations. All interested members invited to participate in this working group.Climate Change Advisory Task Force – this group, which has been active for the past 18 months, is preparing its draft recommendations for consideration by the County Commission. The group’s purpose is to prepare a menu of recommendations to reduce green house gas emissions from which the County Commission can choose for future adoption. The basis of this effort was that Miami was included in a list of 10 global cities which would suffer seriousconsequences from sea-level rise due to unregulated greenhouse gas emissions.
BASF members have attended numerous committee meetings, and have received positive reaction to industryrecommendations.
In particular, BASF members are focused on ensuring that any recommen-dations are reasonable, and can be implemented easily and cost-effectively.This is just one of numerous on-going andproposed “green” efforts at the Countylevel. BASF members have been appointed
to Mayor Alvarez’s Sustain-ability committee, a related -but different - effort. Althoughnot a complete list of theCounty’s Green efforts, other

Builders Association of South Florida representatives recently met with members ofCongress to discuss four key issues affectingthe economy and our industry. With the NAHB,the BASF is working with a coalition of otherbusiness groups to seek support for billspending in both chambers of Congress thatwould eliminate the $15 million cap and allow2009 losses to be eligible for the expandedNOL (Net Operating Loss) carryback. They also discussed the critical need to address theappraisal concerns with guidelines for usinggenuinely comparable properties and establishan appeals process, the encouragement of financial institutions to fund viable new
projects and to take steps to avoid foreclosureon AD&C loans by accommodating loan modifications and workouts, and the need to extend the first-time homebuyer tax credit
and time frame to include anyone buying a primary residence before the end of 2010.
master plans to comply with state statutoryrequirements to reduce green house gasemissions through local government MasterPlans, (HB 697), Governor Crist’s Executive Order to the Florida Building Commission to improve energy efficiency standardswithin the Florida Building Code and the County’s involvement in “Cool Communities” based on the National Association of Counties’ plan. To start educating themselves on these and related green building issues, BASF members organized their own Green Buildings Committee, which convened in late August. Members will be meeting
with senior County staff to ensure County staff recognizes the potentially major impact any green standards could have on the housing industry, and to make sureany future recommendations are kept simple and streamlined. Miami 21 adopted at first reading – although the first vote of this massive zoning code change failed on a tie vote in early August, the September 4 publichearing on the proposal passed by a vote of 4-1. BASF members and staff spoke at both public hearings, expressing concern about these key issues: inadequateprovisions for non-conforming uses
and non-conforming structures, limited green building standards; and code writtenin a “non-user-friendly” new language, all of which increase the potential for Bert J. Harris takings lawsuits. At the second hearing BASF endorsed the concept as an overlay for a specific time-frame, to try the code out beforeadopting it for the entire city. In the end, the City Commission must consider this for second reading and final adoption,which date has not been scheduled yet.BASF’s issues remain unresolved, but members and staff keep pushing for improvements to this complex code.

A chapter in the history of our industry has regrettably closed with the passing of Estelle FreedmanGould. Estelle was the wife of Emil Gould – a pioneering Miami developer, the fifth president of theBASF (1948), a former FHBA president and a Hall of Fame inductee of both organizations.
Yet, as some say, behind every great man, was an exceptional woman – and nothing could be truer of Estelle. Her contributions for the growth of BASF, and of the Miami community as a whole, cannot go untold. An avid supporter of the University of Miami and countless visual and performing arts organizations, Estelle’s generous donations have trulyshaped Miami into the thriving destination it has become.
We are proud to say that her legacy of giving lives on with her children. The Gould’s contribute annually to scholarships at the FHBA level and recently provided for all local legislators to obtain copies of the National Green Building Standard.Estelle’s joyous and ever-animated spirit will be missed. Rather than mourning her death, the BASF celebrates her life.

Recently, Floridians learned that theHometown Democracy amendment has beencertified for the 2010 ballot as Amendment 4.As this controversial proposal is debated in communities throughout Florida, it is important that we answer the question: What, exactly, is Amendment 4?
Those behind this proposed rewrite ofFlorida's Constitution argue that Amendment4 will only require voters to decide changesto a local government's land use plan map. A closer review of the amendment languagedoes not support this claim.
Amendment 4 states that an amendmentto ``a comprehensive land use plan'' mustfirst be approved by voters. But there is no definition of ``comprehensive land useplan'' or ``land use plan'' in the growth management statutes or regulations.
Amendment 4 defines the term ``local government comprehensive land use plan''but that term doesn't appear anywhere elsein the petition. The Amendment 4 authorscall it ``a plan to guide and control future landdevelopment in an area under the jurisdictionof a local government.''
Based on long experience reviewingdozens of local comprehensive plans, I can tell you that each part of those plans is intended to ``guide and control future land development.''
A property's land use depends on support-ing infrastructure, every component of whichis controlled by a separate element of thecomprehensive plan. Since each of these elements ``guide and control future land development,'' Amendment 4 will require a referendum on every plan amendment.
That means citizens would be expected to vote on hundreds, potentially thousands of technical land use amendments, such as transportation revisions and periodic amendments of capital improvements, which schedule infrastructure (roads, parks, water and sewer) expenditures over a five-year period.
Are voters really expected to review1,000-page comprehensive plans and hundreds of technical amendments? In a representative democracy, that's the job of our elected officials. If they do it poorly, we should vote them out of office.
Amendment 4 is vague and confusing, but one thing is clear: Its language is extremely broad.
The scope of this amendment exceedsany current requirements for comprehensiveplans in Florida and could easily apply to zoning approvals unrelated to comprehensiveplan amendments. Under Amendment 4, at a minimum, we will be asked to vote on every change to a local comprehensive plan. At worst, Floridians will be voting ongarden variety zoning changes, too.
Local jurisdictions will inconsistently interpret Amendment 4, with chaos reigninguntil lawsuits and expensive legal challengesestablish policy. At a time when Florida is suffering economically and budget woes burden taxpayers, can we afford this ``fix'' to growth management? If Amendment 4 is the cure, I'd rather be sick.

BASF would like to express its deepest sympathy to the family of Manuel “Manolo" Capó, founder and CEO of El Dorado Furniture. Manolo passed away peacefully on July 10, 2009 at the age of 83.
Known for his inspiring story, Manolo fled Cuba in 1966, with his two sons, Carlos and Luis. After arriving inMiami, Manolo was determined to replicate the family-ownedfurniture manufacturing business which was once the largeston the island. He named the Miami store after the small sailboat that freed the Capós from Cuba, “El Dorado.” Althoughtoday the corporation has 11 stores in South Florida and astaff of 1,000 employees, legacy and working closely with his
family on a daily basis was his proudest moment.
Manolo was a determined entrepreneur, a symbol of the Cuban-American community andabove all else, an honest and compassionate family man. His memory and mission will live on in his wife of over six decades, Aida, his seven sons, his twenty grandchildren, his eleven great-grandchildren and the many employees and customers whose lives he touched.

FROM ITS INCEPTION AS AN ALTERNATIVE TO THE STANDARD
MIX-AND-MINGLE, HAVANA NIGHT NOW IS RECOGNIZED AS ONE
OF BASF’S ALL-AROUND AND MOST POPULAR SIGNATURE EVENTS.
A fitting location for the widely anticipated social affair, more than
250 members gathered at the exclusive Miami City Club, at the
Miami City Club, in downtown Miami. Guests arrived in their best
pressed linens, displaying an array of colorful guayabera chic
outfits – attire described by blending traditional Cuban form and
stylish Miamian demeanor.
All bets were on as nearly all of the night’s attendees took to
the clattering tables for some fierce competition. Dominos is the
name of the game at Havana Night. Some played a focused
game while enjoying the scents and tastes of a first-class, hand
rolled cigar – an even better combination than the winning sets.
Meanwhile, the familiar and comforting tastes of classics like
oven roasted chicken, and rice and beans had members coming
back for seconds. An assortment of tasty salads and bread
were also served. Yet, a true Havana Night could not be complete without two
very important elements: music and dance. The sounds of Frank
Diaz and Havana Soul filled the room as its eight piece orchestra
performed the best in salsa and charanga-style music. Zhantra
Entertainment’s world-famous conga dancers got everyone to their
feet, accompanying each beat with their smooth and sultry moves.
“Havana Night was truly sensational,” said Ashley Bosch, BASF
president. “It’s no wonder that we had more sponsors this year
than any other. We are very proud to offer our members an event
that not only provides networking opportunities, but also lets
them have a fantastic time.”

In 1984, Adonel Concrete president LuisGarcia had a vision. Now 25 years later, hehas seen that vision become reality. AdonelConcrete today is considered the largestindependently owned concrete company inSouth Florida.
“I was fortunate thatmy parents, Adolfo andNelly, believed in mydream when I approachedthem with the idea ofstarting my own concretebusiness,” said Garcia.“They gave me full supportand provided me the seedmoney to go forward.”
The choice of a company name waseasy for Garcia. “I wanted to thank myparents so I named Adonel after them. It was my way of honoring them.”
Garcia’s purchase of a concrete pumping machine in 1984 marked the beginning of Adonel. Initially, he rented the machine and earned $35 per hour.Within five years, there were 25 employeesand it was among the area’s largest concrete pumping companies.
Soon thereafter, Garcia opened a concrete finishing company that focusedprimarily on leveling floors. It also becamesuccessful with more than 70 employeesat its peak. Garcia soon realized that thecompany had a major void.
“We pumped the concrete and we finished the concrete, but we didn’t supply it. I bought four acres of land in
Doral and built Adonel’s first concrete plant in 1995.”
While the company experienced majorgrowth during the years, Luis Garcia pointsout that Adonel’s business philosophy
has remained the same– set goals andwork very hard.
“In life, some peopleonly dream of owning a flourishing business,
but others not only dreamabout it, they wake up
early every morning with determination and the will to
work hard in order to build their success,” Garcia said.
He often reminds his employees of theimportance of knowing their customersand how best to meet their needs.
We adapt and innovate whenever, wherever, and keep delivering quality and value,” Garcia said. “It’s so importantto understand the marketplace.”
In early 2005, Adonel opened its secondplant in Homestead. The following year, Adonel’s expansion continued with theopening two state-of-the-art plants in Palm Beach County. Built on 5 ½ acres, these two plants can produce in excess of 4,000 cubic yards of cement daily.
The expansion northward has continued as Adonel recently opened two new plants
in Fort Pierce, bringing the company’s totalto eight. Today, Adonel Concrete serves allof South Florida from the Treasure Coast toFlorida Keys.
Adonel has come a long way since the days of one pickup truck and a concrete pumper. It paid attention to quality products, reliable delivery and superior performance. It conducted business fairly and with sound businesspractices. It took the time to be a goodneighbor in the communities it serves. And so it grew to become a strong, independent business in a dynamic corner of The Sunshine State. For all of those reasons, and the responsive approach they bring to future opportunitiesand challenges, Adonel looks forward to another 25 years of service to South Florida.

In a collaborative effort, the Builders Association of South Florida and the RealtorAssociation of Greater Miami and theBeaches hosted an educational forum at theDoubletree Hotel in Coconut Grove for its industry partners in recognition of nationalhomeownership month.
The all-day educational seminar focusedon topics important to first-time homebuyers,especially the Federal Housing Administration(FHA) recovery programs and eligibility for taxcredit use. In attendance were all areas of thehousing industry including builders, realtorsand mortgage brokers.
Expert presenters such as ArmandoFana, Miami Field Office Director for the U.S.Department of Housing and Development(HUD), led discussions about HUD’s programs under the American Recovery and Reinvestment Act, FHA appraisal requirements, an overview of current HUD homes and FHA financing options for multi-family housing. Other presenters included Judy Ayers Britton, Housing Program Specialist; Tony Britto, Account Liaison; Norka Arias, National Home Management Solutions; and Michael Otocki,Acting Director of Multifamily Housing.
“There was once a time where many of our members did not have to deal with financing issues on a daily business basis,”said BASF president-elect, Fernando Martinez. “However, times are different andin order for our market to move forward, each part of our industry must become edu-cated in the recovery programs available.”
In addition to vital industry knowledge,BASF realtor members received three hoursof CEU credit.

The Builders Association of South Florida (BASF) and the Florida Home BuildersAssociation (FHBA) recently hosted its firstever statewide educational tour, the Road to Recovery Road Show.
FHBA and BASF speakers provided educational presentations on timely topics
such as: the legal implications of Chinesedrywall, opportunities presented in the Federal Stimulus Bill, ways to improve lender relationships and developing business-building strategies in regard to new home sales, remodeling, commercialconstruction and products and services.
A preview to the upcoming SEBC andGreen Building Shows and legislative reports were also discussed. FormerSpeaker of the Florida House of Representatives, and current U.S. Senate candidate, Marco Rubio, waspresented with an award for leadershipon housing issues the previous year.
“Our statewide organization provides us with the resources necessary to do business in today’s

Super Bowl XLIV and the NFL Pro Bowl may be months away, but members of the Builders Association of South Florida just became eligible receivers for business this winter.
In early June, the executive staff threw a forward pass at itsmembers when it arranged for an exclusive one-on-one vendor registration session with the Super Bowl Host Committee’s, Director of Committee Outreach, Catherine Minnis.
Minnis told BASF members how to submit their credentials to bid for the millions of dollars in goods and services the ten-day football extra-vaganza will need. Members were showhow to navigate the Super Bowl’s local vendor website, and were provided with insider tips explaining the ease of the local vendor registration process.
BASF members also learned when local businesses register as a Super Bowl vendor it leads to opportunities for getting out of town contracts, too. Because the vendor list remains posted for more than a year after the event’s conclusion, the same out-of-town-businesses will return to the Super Bowl vendor list to seek bids for other services they’ll need in South Florida.
