COMPLAINT
1. This complaint is filed pursuant to 52 U.S.C. § 30109(a)(1) and is based on information and
belief that the super PAC VoteVets (ID: C00418897) and the authorized committee of
presidential candidate Pete Buttigieg, Pete for America, Inc. (ID: C00697441), have violated
the Federal Election Campaign Act (“FECA”), 52 U.S.C. § 30101, et seq.
2. On February 5, 2020, a senior official at Pete for America tweeted, “Pete’s military
experience and closing message from Iowa work everywhere especially in Nevada where it’s
critical they see this on the air through the caucus.” One week later, VoteVets—the only
super PAC supporting Buttigieg’s campaign at the time, and therefore the only group that
could reasonably be expected to follow through on the “critical” request—aired over
$639,000 in broadcast ads in Nevada, slated to run through the caucus, touting “Pete’s
military experience” and highlighting the theme of unity that Buttigieg had used as his

“closing message” in the final stretch of the Iowa caucus. In short, Buttigieg’s campaign
committee—which can only accept individual contributions of up to $2,800 per election—
requested and suggested that the super PAC VoteVets use unlimited contributions to
purchase ads in Nevada highlighting specific campaign themes, and VoteVets followed
through on that request. It is immaterial that the request was made publicly, since there is no
“publicly available” exception for communications created, produced, or distributed at the
request or suggestion of a candidate or his agent.
3. As a result, there is reason to believe that VoteVets made, and the Buttigieg campaign
accepted, over $639,000 in illegal and excessive in-kind contributions in the form of
coordinated communications, 11 C.F.R. § 109.21, and in violation of FECA’s source
prohibitions and contribution limits.
4. “If the Commission, upon receiving a complaint . . . has reason to believe that a person has
committed, or is about to commit, a violation of [FECA] . . . [t]he Commission shall make an
investigation of such alleged violation . . . .” 52 U.S.C. § 30109(a)(2) (emphasis added); see
also 11 C.F.R. § 111.4(a).
5. Campaign Legal Center (“CLC”) is a nonpartisan, nonprofit 501(c)(3) organization whose
mission is to protect and strengthen the U.S. democratic process through litigation and other
legal advocacy. CLC participates in judicial and administrative matters throughout the nation
regarding campaign finance, voting rights, redistricting, and government ethics issues.
FACTS

6. Pete Buttigieg is a candidate for the Democratic presidential nomination.1 His authorized
campaign committee is Pete for America.2
7. VoteVets is a “hybrid” committee with a “non-contribution” account that accepts
contributions in unlimited amounts from individuals, corporations, labor organizations, and
other political committees that may be used only for independent expenditures, as well as a
separate hard-money account subject to contribution limits and source prohibitions for
making contributions to federal candidates.3 VoteVets pledged to the Commission that the
funds maintained in its non-contribution account “will not be used to make contributions,
whether direct, in-kind, or via coordinated communications, or coordinated expenditures, to
federal candidates or committees.”4
8. On December 4, 2019, VoteVets endorsed Buttigieg for president,5 and gave $5,000 to Pete
for America from its hard-money contribution account.6
9. Between January 23, 2020 and February 5, 2020, VoteVets reported $1.7 million in
independent expenditures supporting Buttigieg in the New Hampshire presidential primary.7

At the time, it was the only outside group reporting significant independent expenditures in
support of Buttigieg.8
10. On Feb. 5, 2020, Michael Halle, a senior strategist for Pete for America,9 tweeted, “Pete’s
military experience and closing message from Iowa work everywhere especially in Nevada
where it’s critical they see this on the air through the caucus”:10
The “closing message from Iowa” appears to refer to the Buttigieg campaign’s widely
reported “closing message of unity” in Iowa, which was a contrast with opponents’ messages
and a marked shift from the campaign’s own previous strategy.11

11. That same day, POLITICO reported, “Buttigieg’s campaign did not deny that the tweet was a
hint to his backers”:
“Pete is the only candidate who isn’t a millionaire or billionaire. And if the largest progressive veterans group wants to help spread the word about his service, we welcome it,” said Chris Meagher, a Buttigieg spokesman, in a statement shared with POLITICO.12
12. One week later, on Feb. 12, 2020, VoteVets purchased $600,000 of pro-Buttigieg television
ad buys in Nevada, with a $39,652 associated production cost, according to the committee’s
independent expenditure reports and Federal Communications Commission (“FCC”)
records.13 At least one version of that Nevada ad, according to a copy obtained by the New
York Times, featured a Nevada-based veteran emphasizing Buttigieg’s military experience
and characterizing Buttigieg as a unifying candidate:
I was a combat marine veteran in Vietnam. We knew we were in it together; we had each other's back. Our country now is way more divided than when I first come home from Vietnam. That's why I'm for Pete Buttigieg for President. He served in Afghanistan. He's good for the working men and women of this country. He'll turn the page on all this division and hate. One team, one America, Pete's the one who can do it.14
13. Although VoteVets’ independent expenditure reports failed to disclose the primary state in
which the communications were disseminated, published reports indicate that the ads ran in
Nevada,15 and FCC records show VoteVets placing hundreds of thousands of dollars in ad
buys in Nevada on February 12, 2020. For example:

a) On the Nevada station KTVN,16 VoteVets placed a $78,200 ad flight for the
period February 13 through February 21, 2020.17
b) On the Nevada station KOLO,18 VoteVets placed a $45,615 ad flight for the
period February 13 through February 21, 2020.19
c) On the Nevada station KRNV,20 VoteVets placed a $25,650 ad flight for the
period February 13 through February 21, 2020.21
d) On the Nevada station KLAS,22 VoteVets placed a $122,765 ad flight for the
period February 13 through February 21, 2020.23

conduct standard in 11 CFR 109.21(d)(1)”).
22. Commission regulations make clear that “agreement or formal communication between the
person paying for the communication and the candidate” or his agents “is not required for a
communication to be a coordinated communication. Id. § 109.21(e).
CAUSE OF ACTION
COUNT I: VOTEVETS MADE, AND PETE FOR AMERICA ACCEPTED, ILLEGAL AND EXCESSIVE IN-KIND
CONTRIBUTIONS
23. One week after a Buttigieg campaign official requested and suggested that VoteVets air
broadcast ads in Nevada highlighting “Pete’s military experience” and the unity-focused
“closing message from Iowa,” VoteVets bought over $639,000 in pro-Buttigieg ads doing
exactly that. As a result, there is reason to believe that VoteVets violated the law by making
excessive in-kind contributions to Pete for America in the form of coordinated
communications, and that Pete for America violated the law by accepting those excessive
contributions.
24. An entity makes a “coordinated communication” when the communication (1) is paid for, in
whole or in part, by a person other than the candidate or committee; (2) satisfies at least one
of the “content standards” in the regulation, for example by “expressly advocat[ing] . . . the
election or defeat of a clearly identified candidate for Federal office”; and (3) satisfies at least
one of the “conduct standards” in the regulation, such as being created, produced, or
distributed at the “request or suggestion” of the candidate or his agent. 11 C.F.R. § 109.21(a).
25. VoteVets’ communications in support of Buttigieg satisfy the “payment” prong because they
were paid for in whole by VoteVets. Id. § 109.21(a)(1).

26. The communications satisfy the “content” prong because they were broadcast public
communications25 that expressly advocated for the election of Buttigieg.26 Id. § 109.21(c)(2).
27. The communications satisfy the “conduct” prong at 11 C.F.R. § 109.21(a)(3) and (d)(1)
because they were created, produced, or distributed at the request or suggestion of
Buttigieg’s agent, Michael Halle, a senior strategist for Pete for America.27 On February 5,
2020, Halle tweeted, “Pete’s military experience and closing message from Iowa work
everywhere especially in Nevada where it’s critical they see this on the air through the
caucus.” Halle’s tweet is a “request or suggestion” because:
a) The message requested and suggested that the communications be created to
include specific content (namely, that the communications highlight “Pete’s
military experience” and the unity-focused “closing message from Iowa”);
b) The message requested and suggested that the communications be produced for
and distributed via a particular medium (“it’s critical they see this on the air,”
which can only refer to broadcast television);
c) The message requested and suggested that the communications be distributed in a
particular location (“Nevada”);
d) The message requested and suggested particular timing and duration for the
communications’ distribution (“through the [Feb. 22, 2020] caucus”); and

e) The message was directed to a specific audience: VoteVets, the only super PAC
or other outside group making significant independent expenditures supporting
Buttigieg at the time, and therefore the only group that could reasonably be
expected to follow through on the request or suggestion.28 Indeed, Buttigieg’s
campaign effectively acknowledged that the message was directed to VoteVets,
with a campaign spokesperson responding to questions about Halle’s tweet by
stating, “if the largest progressive veterans group wants to help spread the word
about his service, we welcome it.”29
28. The tweet from Buttigieg’s agent is susceptible of no reasonable interpretation other than a
request or suggestion for VoteVets—the only super PAC or other outside group supporting
Buttigieg’s candidacy at that time—to air broadcast ads in Nevada through the February 22,
2020 caucus touting “Pete’s military experience” and his “closing message from Iowa," and,
indeed, that is exactly what happened.30 Just one week after Halle’s tweet, VoteVets bought
over $639,000 in pro-Buttigieg ads in Nevada, slated to run through the February 22, 2020
caucus, touting his military experience, and arguing that Buttigieg would “turn the page on
all this division and hate,” which matched the theme that was widely reported as Buttigieg’s
“closing message” in the final stretch of the Iowa caucus.31
