TENDERING INFORMATION TI.01 DELIVERY AND OPENING OF TENDERS

A. Bid documents must be returned in a sealed envelope clearly marked “Belanger Street Reconstruction” complete with bidder’s Company name and Bid reference number to the exterior drop box at the Municipality of West Nipissing town hall, 101-225 Holditch Street, Sturgeon Falls, Ontario P2B 1T1, before 9:30 AM (local time) on Thursday, May 20, 2021 (the “Official Closing Time”).

The drop box will be opened immediately after the official closing time. Only bids

collected from the drop box will be accepted.

B. Bids will be opened immediately after Bid Closing time. Only the names of the Bidders, bid price and the required bid security will be disclosed. Bid opening will be available via live stream on the Municipality’s web site.

C. Tenders shall be completed on the detachable Form of Tender included with the

Contract Documents. (yellow pages) D. Contractor questions will close Thursday, May 13, 2021 at 4:00 pm.

TI.02 DISCREPANCIES

A. If a Tenderer finds discrepancies in, or omissions from the Contract Documents, or if the Tenderer is in doubt as to their meaning, the Tenderer shall notify the Engineer, who may issue a written addendum. Neither the Owner nor the Engineer will make oral interpretations of the meaning of the Contract Documents.

B. Should the Tenderer not agree that the materials and methods specified, or

designed on the Drawings, will provide an installation to meet the requirements of the project, the Tenderer shall notify the Engineer in writing, stating the reason for the objection and may submit a suggested alternative. In such an event, the Engineer may choose to issue an addendum.

C. Addenda issued during the tendering period shall be allowed for by the Tenderer.

Addenda shall be issued by facsimile transmission from the office of the Consultant. No other copy will be sent out.

TI.03 EXAMINATION OF SITE

A. The Tenderers shall visit the site of the Work before submitting their tender and shall by personal examination satisfy themselves as to the local conditions that may be encountered during construction of the Work. They shall make their own estimate of the facilities and difficulties that may be encountered and the nature of the subsurface materials and conditions.

B. The Tenderer shall not claim at any time after submission of their tender that there was any misunderstanding of the terms and conditions of the Contract relating to site conditions.

TI.04 HARMONIZED SALES TAX (HST)

A. This project is taxable under the Harmonized Sales Tax.

B. In calculating unit prices, DO NOT include ANY tax payable by the Contractor on all goods and services required to complete the Work.

C. The HST payable by the Owner is not to be included in the unit prices. It will be

added to the net amount of each progress payment, and will be paid to the Contractor.

T1.05 INFORMAL OR UNBALANCED TENDERS

A. All entries in the Form of Tender shall be made in ink or by typewriter. Entries or changes made in pencil shall, unless otherwise decided by the Owner, be invalid or informal. Tenders which are incomplete, conditional, illegible or obscure, or that contain additions not called for, reservations, alterations (unless properly and clearly made and initialed by the tenderer's signing officer) or irregularities of any kind, may be rejected as informal. Tenders that contain prices which appear to be so unbalanced as likely to affect adversely the interests of the Owner may be rejected.

Whenever in a tender the amount tendered for an item does not agree with the extension of the estimated quantity and the tendered unit price, the unit price shall govern and the amount and the Total Tender Price shall be corrected accordingly, unless otherwise decided by the Owner.

A discrepancy in addition or subtraction in a tender shall be corrected by the Owner by adding or subtracting the items correctly and correcting the Total Tender Price accordingly, unless otherwise decided by the Owner. Where an error has been made in transferring the amount from one part of the Form of Tender to another, the amount shown before transfer shall, subject to any correction as provided for above, be taken to be correct and the amount shown after transfer and the Total Tender Price shall be corrected accordingly.

If a tenderer has omitted to enter a price for an item of work set out in the Form of Tender, they shall, unless they have specifically stated otherwise in their tender, be deemed to have allowed elsewhere in the Form of Tender for the cost of carrying out the said work and, unless otherwise agreed to by the Owner, no increase shall be made in the Total Tender Price on account of such omission.

The Owner reserves the right to waive formalities at their discretion.

TI.06 PROOF OF ABILITY

A. The Tenderer shall be competent and capable of performing the various items of Work. The Tenderer shall complete the following statement sheets, which shall form a part of the Contract Documents:

1. Tenderer's Experience on Similar Projects with a list of specific examples

completed within the last 5 years. 2. Subcontractors to be employed in the project and the value for the

subtrades listed.

3. i) Tenderer's Senior Staff to be employed, including designating an on site superintendent of the project. The Site Superintendent can be changed only on the approval of the Engineer.

ii) Tenderer's Equipment to be used.

B. The Tenderer may be required to furnish additional statements covering other

matters, including financial resources. TI.07 TENDER DEPOSIT

A. The tender shall be accompanied by a tender deposit in the form of a certified cheque or a Bid Bond payable to the Owner in the amount of $25,000.00.

The Tenderers shall keep their tenders open for acceptance for 45 days after the closing date. Withdrawal during this period will result in forfeiture or enforcement of the tender deposit or Bid Bond. Upon being notified that the tender has been accepted, the Contractor shall execute copies of the Agreement, supply bonds and insurance documents as specified, and start Work as specified.

Failure to execute the copies of the Agreement, or to supply bonds and insurance documents, within one week of the date of acceptance of the tender, will automatically mean the forfeiture or enforcement of the tender deposit. Tender deposits of unsuccessful Tenderers will be returned not later than two weeks following Tender close. The tender deposit of the successful Tenderer will be returned once the Performance Security is in place.

TI.08 AGREEMENT TO PROVIDE PERFORMANCE SECURITY

A. Every tender shall be accompanied by one of the following: ▪ An “Agreement to Bond” completed by a surety company lawfully doing business

in the Province of Ontario for a Performance Bond in the amount of 100% of the Total Tender Price and a Labour and Material Bond in the amount of 50% of the Total Tender Price.

Or B. An undertaking from a bank lawfully doing business in the Province of Ontario

stating that an Irrevocable Letter of Credit in the amount of 100% of the Total Tender Price.

TI.9 ACCEPTANCE OF TENDERS

A. The lowest or any tender need not necessarily be accepted by the Owner. B. If the total tender price exceeds available funding the Owner will negotiate with the

low bidder to adjust tender quantities. In the event that these negotiations are not successful the Owner will negotiate with the next lowest bidders as necessary.

C. Award Contract is subject to sanitary sewer ECA approval from MECP.

TI.10 EQUIVALENTS

A. When an article is specified by its trade or other name (whether such name is followed by the phrase 'or equivalent' or not), the Tenderer shall base his tender price on the supply of the named article and no other.

The Tenderer may submit with their tender, suggested equivalents to those articles specified by trade or other names. Such submissions shall show the name of the article specified, the name and description of the suggested equivalent, and the total revision to the tender price that would result if the equivalent were accepted.

TI.11 ROAD CLOSURES

A. Both vehicle and pedestrian access will be provided to all properties between the hours of 6:00 p.m. to 8:00 a.m. Monday to Fridays and on weekends. Pedestrian access should be provided to all properties at all times during construction.

B. Road closures during construction shall be signed appropriately with detour signs to

direct traffic around the work site.

TI.12 GEOTECHNICAL INVESTIGATIONS

A. A minor geotechnical investigation containing 2 test pits along Belanger Street were completed by Jacques Whitford. A digital copy of the geotechnical summary is made available to the Contractor upon request. TP 3: In front of house #294 (NBL) Asphalt 1” Granular A 2” Granular B/ sand fill 16” End of TP @ 32” TP 4: In front of house # 294 (NBL) Asphalt 2” Granular A 8” Granular B/ sand fill, with some construction debris (asphalt etc…) 36” End of TP @ 36”

B. The geotechnical investigation was made to determine the nature of the subsoil for

design purposes. No responsibility is assumed for the accuracy and completeness of the information presented.

TI.13 PRE-QUALIFACATION OF CONTRACTOR

A. Contractor or all sub-contractors working for the contractor must pre-qualify with the Municipality of West Nipissing health and safety officer before starting work. Risk Management and Mitigative measures Policy and Procedure regarding COVID – 19 shall be submitted and approved.

TI.14 HEALTH AND SAFETY

A. COVID-19: Contractor shall provide the Municipality with a current physical distancing policy and mitigative risk management strategies implemented to avoid exposure to COVID – 19. B. PANDEMIC: The Municipality reserves the right to cancel and/or postpone this contract at any time as a result of the current and ongoing COVID – 19 Pandemic.

We, the undersigned, having examined the site of the Work, having carefully investigated the conditions pertaining to the Work and having secured all the information necessary to enable us to submit a bona fide tender, and having inspected all the Contract Documents and Drawings, hereby agree to enter into a contract and to perform all the Work in accordance with the Contract Documents and Drawings to the satisfaction of the Engineer for the total tender price of INCLUDING H.S.T:

FT.02 CONTINGENCIES

A. We agree that the tender price includes the contingency sum of $50,000.00 and that no part of this sum shall be expended without the written direction of the Engineer, and any part not so expended shall be deducted from the tender price.

FT.03 QUANTITIES

A. The tender price is compiled from the Schedule of Tender Prices included hereinafter. The quantities in the schedule being approximate, we agree that the final valuation will be made on the basis of actual quantities measured during and on completion of the Work at the prices in the schedule.

FT.04 ADDITIONS A. We agree that the valuation of additions to the contract shall be made as follows:

1. The unit prices in the Schedule of Tender Prices shall apply where appropriate.

2. If the prices in subsection 1 are not appropriate, valuation will be made by one of the following methods:

(i) The Engineer may ask the Contractor for a quotation for the proposed work.

(ii) If the quotation referred to in (i) above is not accepted by the Engineer, payment

will be made on a Time and Material Basis according to GC 8.02.05. of the General Conditions.

FT.05 ADDENDA

A. We agree that we have received addenda to inclusive, and the tender price includes the provisions set out in such addenda.

FT.06 COMMENCEMENT

A. We agree to commence Work on-site within four (4) weeks of project award.

FT.07 COMPLETION

A. We agree to have all asphalt work completed by September 30, 2021. B. We agree to complete all work by September 30, 2021.

FT.08 LIQUIDATED DAMAGES

A. It is agreed by the parties to the Contract that in case all the Work called for under the Contract

is not finished or completed within the date of completion specified aforementioned, or as

revised in accordance with the General Conditions of Contract, a loss or damage will be

sustained by the Owner. Since it is and will be impracticable and extremely difficult to ascertain

and determine the actual loss or damage which the Owner will sustain in the event of and by

reason of such delay, the parties hereto agree that the Contractor will pay to the Owner the sum

five hundred ($500.00) as liquidated damages for each and every calendar days delay in

finishing the Work beyond the date of completion prescribed. It is agreed that this amount is an

estimate of actual damage to the Owner which will accrue during the period in excess of the

prescribed date of completion. The Owner may deduct any amount under this paragraph from

any monies that may be due or payable to the Contractor on any account whatsoever.

FT.10 WARRANTY

A. To cover rectification costs during the warranty period, the Owner will retain 2.5% (three) of

the value of Work done, such amount being held back in each progress certificate. Additional

monies will be held back as required by provincial statutes. Holdbacks held to cover

rectification costs will be retained for a period of twelve months after the date of Completion.

Re: Belanger Street Reconstruction In consideration of the Owner accepting the tender of and executing an Agreement with hereinafter referred to as "the Tenderer" for the construction of the above works subject to the express condition that the Owner receive the Performance and the Labour and Material Bonds in accordance with the said tender, we the undersigned hereby agree with the Owner, to become bound to the Owner as surety for the Tenderer in a Performance Bond in an amount equal to 100% of the total tendered price and Labour and Material Bond in an amount equal to 50% of the total tender price in the standard forms of the Canadian Construction Association and in accordance with the said tender, and we agree to furnish the Owner with the said Bonds within 7 days after notification of the acceptance of the tender has been mailed to us. AGREEMENT BETWEEN OWNER & CONTRACTOR

THIS AGREEMENT MADE ON THE Day of 2021 by and between: The Corporation of The Municipality of West Nipissing

(hereinafter called the “Owner”) - and -

(hereinafter called the “Contractor”) The Owner and the Contractor agree as follows: ARTICLE 1 - THE WORK A general description of the work is:

(a) Belanger Street Reconstruction including sanitary sewer replacement and street reconstruction.

(b) The Contractor shall, for the prices set out in the Form of Tender and except as

otherwise specifically provided, provide at no additional cost to the Owner all and every kind of labour, machinery, plant, structures, roads, ways, materials, appliances, articles and things necessary for the due execution and completion of all the work set out in these Contract Documents and shall forthwith according to the instructions of the Engineer, commence the works and diligently execute the respective portions thereof, and deliver the works complete in every particular to the Owner within the time specified in the Contract Documents.

ARTICLE 2 - CONTINGENCY ALLOWANCE In the event that the Form of Tender provides for and contains a Contingency Allowance, it is understood and agreed that such Contingency Allowance is merely for the convenience of accounting by the Owner, and the Contractor is not entitled to payment thereof except for extra or additional work carried out by the Contractor as directed by the Engineer and in accordance with the Contract Documents and only to the extent of such extra or additional work.

ARTICLE 3 - CONFLICT In case of any inconsistency or conflict between the provisions of this Agreement and the Contract Documents and Drawings the Provisions of such documents shall take precedence and govern according to subsection GC2.02 of the General Conditions as detailed following:

ARTICLE 4 - AMENDMENTS The Contract may be amended only as provided in the Contract Documents. ARTICLE 5 - CONTRACT PRICE The Owner covenants with the Contractor that the Contractor having in all respects complied with the provisions of this Contract, will be paid for and in respect of the work the sum of subject to Article 2 hereof and subject to such additions and deductions as may properly be made under the terms hereof, subject to the provision that the Owner may make payments on account monthly or otherwise as may be provided in the General Conditions attached hereto. ARTICLE 6 - ADDRESSES FOR NOTICES Notices in writing between the parties or between them and the Engineer shall be considered to have been received by the addressee on the date of delivery if delivered to the individual, or to a member of the firm, or to an officer of the corporation for whom they are intended by hand or by registered post; or if sent by regular post, to have been delivered within 5 Working Days of the date of mailing when addressed as follows:

ARTICLE 7 - CONTRACT DOCUMENTS A copy of each of the Specifications, General Conditions, Supplemental General Conditions, Special Provisions, Form of Tender, Tendering Information and Contract Drawings hereto annexed and together with Drawings 20-1471 C1, 20-1471 C2, 20-1471 C3, 20-1471 C4, 20-1471 C5, 20-1471 C6 is made part of this Contract as fully to all intents and purposes as though recited in full herein. ARTICLE 8 - EXPRESSED COVENANTS No implied contract of any kind whatsoever by or on behalf of the Owner shall arise or be implied by or inferred from anything in this Contract contained, nor from any position or situation of the parties at any time, it being clearly understood that the express covenants and agreements herein contained made by the Owner shall be the only covenants and agreements upon which any rights against the Owner may be founded. ARTICLE 9 - TIME OF THE ESSENCE Time shall be deemed the essence of this Contract. All Asphalt must be placed by September 30, 2021. All construction must be completed by September 30, 2021. ARTICLE 10 – CONTRACTOR’S RESPONSIBILITY The Contractor declares that in tendering for the works and in entering into this Contract he has either investigated for himself the character of the work and all local conditions that might affect his tender or his acceptance or performance of the work, or that not having so investigated, he acknowledges that his responsibility under the Contract is in no way reduced or limited thereby and, in either case, he is willing to assume and does hereby assume all risk of conditions arising, developing, or being revealed in the course of the work which might or could make the work, or any items thereof, more expensive in character, or more onerous to fulfill, than was contemplated or known when the tender was made or the Contract signed. The Contractor also declares that he did not and does not rely upon information furnished by any methods whatsoever by the Owner or its officers, employees or agents, being aware that any information from such sources was and is approximate and speculative only, and was not in any manner warranted or guaranteed by the Owner. ARTICLE 11 - SUCCESSION

The Contract shall apply to and be binding on the parties hereto and their successors, administrators, executors and assigns and each of them. IN WITNESS WHEREOF the parties hereto have hereunto set their hands and seals the day and year first above written or caused their corporate seals to be affixed, attested by the signature of their proper officers, as the case may be.

SPECIAL PROVISIONS

SUPPLEMENTARY SPECIFICATIONS TO O.P.S.S.

OPERATIONAL CONSTRAINTS

1. The Contractor is responsible to complete the contract within the milestone schedule specified.

2. Safe and reasonable access must be provided to local vehicle traffic and to pedestrian

through traffic. The Contractor shall ensure traffic regulatory signs and 911 signs are in place and secure at all times.

3. The Contractor is responsible for securing locates and providing coordination with all

utilities and agencies, including those which may not be listed below. The following utilities and agencies are known to be located in the construction limits:

• The Municipality of West Nipissing • Hydro One • Bell Canada • Union Gas

4. The Contractor shall follow the requirements for working with mechanical equipment in

the vicinity of active gas pipelines when undertaking working within the distances specified by Union Gas procedures.

5. Construction Layout

a) The Contractor will be responsible for the layout of all lines and grades from the plans at no extra cost to the Contract. Control information will be provided to the successful bidder by Tulloch Engineering in a digital format.

b) All discrepancies are to be reported to the Contract Administrator for resolve prior to proceeding with the work and at no extra cost to the Contract.

The Contractor will be required to maintain water and sanitary services for the duration of the project.

O.P.S.S. 180 DISPOSAL OF EXCESS MATERIAL 180.07 CONSTRUCTION

Suitable excavated earth shall be utilized within fill areas on site. The Contractor shall be responsible for the disposal of excess excavated materials from grading and trenching work. All excess materials shall be disposed of at locations identified by the Municipality and at the direction of the Contract Administrator. Materials shall be left in a neat and uniform manner. The Contractor is required to remove all sanitary sewer that is to be replaced. Removed sanitary sewer shall be disposed of at locations identified by the Municipality and at the direction of the Contract Administrator. Where Asbestos Cement Sanitary Sewer is encountered for removal it must be disposed of appropriately as a hazardous substance.

Disposal of Surplus Material and Excess Soil Management

For the purpose of this project, Sections 8 -16, 19 and 22 of O.Reg. 406/19 does not come into effect until January 1st, 2022.

The Owner shall be designated as the project leader for the purposes of O.Reg. 406/19.

The Contractor shall be designated as the project operator for the purpose of satisfying O.Reg. 406/19.

OPSS 180.02 - Canadian and Provincial Statues References, is amended by addition of the following. “O.Reg. 406/19 Onsite and Excess Soil Management”.

OPSS 180.04.01 - Submission Requirements, is amended with the addition of the following;

“ 180.04.01.08 – Qualified Person

The Contractor shall engage a independent qualified person with no direct or indirect interest in the project, as defined in O.Reg. 406/19 and submit his/her contact information to the Contract Administrator for information purposes.”

The qualified person shall in accordance with O.Reg 406/19;

i. Develop and apply site specific excess soil quality standards in accordance with the Soil Rules using the Beneficial/Reuse Assessment Tool;

ii. Complete and submit a declaration attesting to the accuracy of the information and the assumptions provided as inputs for Beneficial Reuse Assessment Tool; and,

iii. Complete and submit a copy of the output worksheet generated when using the Beneficial Reuse Assessment Tool.

180.04.01.09 – Re-Use Site(s), Receiving Site(s)

The Contractor shall submit to the Contract Administrator the address of the site for each location for which any excess soil, disposable fill, or waste is to be transported to, including but

not limited to re-use sites, landfills, temporary storage areas, processing and/or waste transfer facilities. All sites, as noted above shall be appropriately licenced and with environmental compliance approvals as appropriate to the receiving situation.

180.04.01.10 – Declaration

The Contractor shall submit to the Contract Administrator a declaration attesting that excess soil shall only be collected and transported in accordance with Section 17.(3) of O.Reg. 406/19.

180.04.01.09 – Transportation Records The Contractor shall submit to the Contract Administrator the following:

1. The location (by Station + Offset or other approved identifier) of where the excess soil was loaded for transport.

2. The date and time the excess soil was loaded for transportation. 3. The quantity of excess soil in the load. 4. The name of an individual who may be contacted to respond to inquires regarding the

load, including inquiries regarding the soil quality, (typically the designated qualified person).

5. The name of the corporation(s), partnership(s) or firm(s) transporting the excess soil, the name of the driver(s) of the vehicle(s) and the number plates issued for the vehicle(s) under the Highway Traffic Act.

6. The location at which the excess soil is to be deposited.

Submittal of the above documentation shall be provided on a material ticket with a summary provided daily for the records of the Contract Administrator. Both hardcopy and a .pdf electronic version shall be supplied.

180.04.01.09 – Discovery of Contaminated Material

The project operator (Contractor) shall prepare and submit a procedure and ensure it is applied with respect to what must occur if any person working in the project area makes an observation during soil excavation within the project area, including any visual or olfactory observation, that suggests that the soil may be affected by the discharge of a contaminant. At a minimum, the project operator shall include with their procedure the following:

1. All soil excavations in the project area must immediately cease upon the observation being made, until such time as the project leader directs that soil excavations may be resumed.

2. The project leader or the operator of the project area must immediately be notified of the observation.

3. The project leader or the operator of the project area, upon being notified of the observation, must, before directing that soil excavations may be resumed, ensure that all necessary steps are taken to ensure that, i. All excavated soil or excavated crushed rock that is affected by the discharge of

a contaminant is identified and is segregated from other excavated soil or excavated crushed rock in the project area,

ii. The portion of the project area that is affected by the discharge of a contaminant is determined, and

iii. Any excess soil from the portion of the project area is disposed of in accordance with this Regulation.

O.P.S.S. 206 GRADING 206.07 CONSTRUCTION

Contractor will be required to sub ex out all organics as determined in the field during construction.

206.07.02 Drainage Contractor shall cleanout existing ditches as detailed in the Contract Drawings.

The Contractor shall clean the ditch of all organic and settled material. All ditch cleanout work detailed in the Contract Drawings shall provide positive drainage and no ponding of water.

O.P.S.S. 310 HOT MIX ASPHALT – CONSTRUCTION 310.08.01 SAMPLING OF MIX FOR ACCEPTANCE TESTING

GENERAL

One random sample for every 500 tonnes (maximum) of each mix shall be obtained, packaged appropriately, labelled and delivered to within 48 hours to a CCIL certified asphalt-testing laboratory. Individual random samples of mix shall be:

▪ a sample minimum mass of 10 kg, to be tested to determine

compliance for asphalt cement content, gradation of extracted aggregates, and air voids.

METHOD

The 10 kg samples shall be obtained by plate samples only. LOCATION, PACKAGING AND LABELLING

The Contract Administrator will determine the location of each random sample and inform the Contractor just prior to the sample being taken by the Contractor. Samples shall be placed into a suitable container that will protect the sample characteristics during transport and until testing. Samples shall be labelled, as appropriate, with the contract number, date, lot number, sublot number, mix type, station location, offset from the centreline of the roadway and time of sampling.

When the mass of a plate sample is less than the desired quantity, the sample shall be discarded and a new one taken immediately. The transverse location of the sample shall be the same as that of the discarded one.

DELIVERY AND RECORDS

Samples shall be delivered as specified in the Contract. When samples are delivered to a laboratory that is not owned by the Owner, the Contractor shall maintain records that contain the date, time of delivery, and the printed name and signature of the authorized receiving individual. At the time of delivery of each sample to such a laboratory, the Contractor shall sign records of the testing laboratory to confirm the date and time of delivery.

310.10 BASIS OF PAYMENT 310.10.04 Payment Adjustment for Changes in the MTO Performance Grade Asphalt

Cement Price Index

This contract will not be subject to the PGAC – price index.

O.P.S.S. 314 GRANULAR MATERIALS 314.09 MEASUREMENT FOR PAYMENT

Payment for Granular “A”, Granular “B” and Select Free Draining Fill will be by the tonne.

O.P.S.S. 401 TRENCHING, BACKFILLING, AND COMPACTING 401.07 CONSTRUCTION

Trenching, backfilling, and compacting shall include the support, protection, and reinstatement of all servicing, storm sewer, and utilities daylighted in sewer pipe excavation.

O.P.S.S. 407 MAINTENANCE HOLE INSTALLATION 407.03 DEFINITIONS

The use of the terms manhole and maintenance hole are interchangeable for the purposes of this contract.

407.07 CONSTRUCTION

Maintenance Holes shall include steps and frost straps according to the applicable OPSS and OPSD’s and the frame grate and riser rings according to the applicable OPSS and OPSD’s. Maintenance Holes shall include all necessary service and existing storm main connections.

Connecting to the existing manhole, ditch inlet, catchbasin and installing new catchbasin shall include any necessary service connections, mainline connections, plugging abandoned pipes or knock outs and all necessary re-benching requirements. The Contractor will be required to locate the existing services. The Contractor will be required to adjust the existing Maintenance Hole lid elevations in accordance with OPSS 408. If required, the limits of insulation will be determined in the field though a change order. Manintenance Holes shall include Mueller Model AJ633SR Adjustable maintenance hole lids or equivalent approved by the Contract Administrator. See attached Mueller Canada Adjustable Model AJ633SR detail.

407.09 MEASUREMENT FOR PAYMENT Measurement for payment for all Sanitary Maintenance Holes will be by the each. There will be no measurement for payment for adjusting existing Maintenance Hole frame and grates to the design grades. All costs for adjusting existing frame and grates shall be included in the Hotmix Asphalt Unit Price Item. If required, riser rings will be paid for separately.

O.P.S.S. 410 PIPE SEWER INSTALLATION 410.05 MATERIALS

Sanitary Sewer Pipe shall be polyvinyl chloride gasketed sewer pipe SDR35 conforming to OPSS 1841.

410.07 CONSTRUCTION

Pipe shall be laid within 10mm ± of the design grade. 100 mm Ø sanitary services shall be connected into existing sanitary services with reducers, long radius sweeps and spool pieces as necessary. Service extensions shall extend onto private property to connect into existing services. The Contractor is required to provide sanitary sewer services to all serviced homes or buildings at all times for the duration of the project. Payment for any temporary services shall be part of the unit price for services. The contractor will be required to complete Closed-Circuit Television Inspection of the sanitary sewer as per OPSS 409.

The contractor is responsible for all required dewatering for any type of pipe, structure, service or applicable component of the sanitary and storm system installation. Dewatering to be in accordance with OPSS 517. Insulation of pipe sewers is required where depth of cover is less than 2.0 m. Sewer insulation shall be in accordance with the contract documents. Pipe sewer shall be installed with laser alignment.

410.09 MEASUREMENT FOR PAYMENT There will be no separate item for payment of Closed-Circuit Television Inspection. Full compensation for all Closed-Circuit Television Inspection will be included in the unit price item for installing sanitary sewers. Payment for maintaining sewage and storm water drainage flows during construction i.e. pumping or temporary services, as required, shall be part of the unit pipe price per meter. There will be no measurement for payment for dewatering. The costs associated with dewatering for any type of pipe, structure, service or applicable component of the sanitary and storm system installation shall be included in the applicable unit price items. The removal and proper disposal of existing AC sanitary sewer pipe necessary for the installation of new sanitary sewer pipe shall be included in the contract unit price for the installation of sanitary sewer and service laterals, unless otherwise provided for in the contract documents. Measurement for the installation of all pipe sewer types will be by the liner meter installed.

O.P.S.S. 510 REMOVALS 510.01 SCOPE

This specification covers the requirements for removals of watermain pipe, sewer pipes (including asbestos cement) and culverts. All removals shall meet the requirements of OPSS 510.

510.07 CONSTRUCTION

The Contractor is required to remove asphalt to facilitate construction under the Item – Asphalt Removal. Edges of asphalt removal shall be saw cut creating a clean vertical face.

510.09 MEASUREMENT FOR PAYMENT Unit of measurement is lineal metres removed and disposed of existing watermain, sewer (including AC) and culverts.

510.10 BASIS OF PAYMENT

O.P.S.S. 804 SEED AND COVER 804.07 CONSTRUCTION

The cover application type shall be hydraulic mulch. The permanent seeding mix type shall be a standard lawn mix approved by the Contract Administrator, with a fertilizer rate and nurse crop rate according to the Standard Roadside Mix. The mix design shall not include clover.

The item is for the mobilization and demobilization to the work site. 2.0 CONSTRUCTION

The Contractor will mobilize the equipment and materials to the site to allow the completion of the project. At the completion of the project the Contractor will demobilize from the site removing all excess materials and repairing all disturbed areas.

3.0 MEASUREMENT FOR PAYMENT

There will be no measurement for payment. Payment will be by lump sum. A payment of 60% will be made for mobilization and 40% for demobilization.

4.0 BASIS OF PAYMENT

Payment at the Contract Price for the above tender item shall be full compensation for all labour, equipment and material to do the work.

i. Performance Bond equal to 100% of Total Contract Price ii. Labour and Material Bond equal to 50% of Total Contract Price

Proof of bonding shall be provided to the Contract Administrator prior to entering into the Contract.

3.0 MEASUREMENT FOR PAYMENT

There will be no measurement for payment. Payment will be by lump sum. Full payment for this item will be made with the first progress payment.

4.0 BASIS OF PAYMENT

Payment at the Contract Price shall include full compensation for all requirements to provide the bonding as stipulated.

Special Provision

1.0 SCOPE This special provision describes the provision of Environmental Compliance for the work associated with construction of the project. 2.0 REFERENCES

1.4 OPSD 219-220 − Excavated Sediment Trap in Ditch (if require) 3.0 REQUIREMENTS Contractor shall construct, supply, install, and maintain all items required for environmental compliance. This shall include, but not be limited to, light-duty silt fence, excavated sediment traps in ditches and straw bale flow check dams. This item shall also include the provision of water and calcium on granular road surfaces as directed by the Contract Administrator. Light-duty silt fence shall be installed and maintained on all flow paths where surface runoff may discharge from the construction works. Where silt fence is required, it shall be installed and maintained prior to construction works to prevent entry of sediment into the watercourse or existing drainage ditches. Where silt fence, straw bale flow check dams or sediment traps are required, they shall be installed and maintained in all ditch areas below proposed construction works to prevent entry of sediment into the watercourse or ditches. The Contractor in the field shall determine location of these installations. Geotextile covers shall be added to all catch basin structures to prevent sediment migration into storm sewers. Contractor is responsible to remove all sediment and debris entering storm sewers as a result of construction activity. Temporary erosion and sediment control measures shall be maintained and kept in place until 100% of all work within a sensitive areas has been completed and stabilized. A 25 metre stand-by supply of prefabricated silt fence barrier, in addition to silt fence barrier which may be specified elsewhere in the Contract, shall be maintained at the Contract site prior to commencement of grading operations and throughout the duration of the Contract. Locations for environmental mitigation measures may or may not be identified in Contract Documents.

1.0 SCOPE This special provision describes the requirement for traffic control signage, detour signage and project signage. 2.0 TRAFFIC AND DETOUR SIGNAGE The requirements for traffic control signage include permanent signage, detour signage and temporary construction signage. The requirements for detour signage includes the following: The Contractor will be required to provide detour and signing schematic prior to

Construction The Contractor shall be responsible for supply, installation, maintenance and removal of all temporary traffic control signage and detour signage required on the project. Traffic signage for temporary construction conditions and all detours shall meet the requirements of Ontario Traffic Manual Book 7, latest edition. Following the installation of traffic signage for temporary conditions, the Contractor is responsible to remove, store and reinstate any permanent traffic signage as required to facilitate the construction process. 3.0 PROJECT SIGNAGE The Contractor is responsible for maintenance of the signs over the duration of the project. The Contractor is responsible to reinstate the pre-existing street signs and posts, or at the option of the Owner, reinstall new signs and posts supplied by the Owner. 4.0 MEASUREMENT FOR PAYMENT There will be no measurement for payment. Payment will be by lump sum. Payment will be by percentage complete based on 50% payable with the initial installation of project signage and 50% payable upon substantial completion of the construction works. 5.0 BASIS OF PAYMENT Payment at the Contract Price for the above noted tender item shall include full compensation for all labour, equipment, and materials required to do the work, and for maintenance of the items during the duration of the Contract.

Special Provision

1.0 SCOPE

This special provision describes the provisional requirement for backflow preventers.

2.0 BACKFLOW PREVENTER

All 100 mm Ø sanitary services above the basement elevation of each residence shall be complete with a backflow preventor on the private residence side of the right-of-way property line. The backflow preventer shall be Mainline Adapt-A-Valve model numbers ML-4481C, ML-4Cass01 Normally Open (NO), and ML-8AAV LID/COL complete with green coloured lid, or equivalent approved by Contract Administrator. Contractor shall work with the Contract Administrator to identify houses requiring a backflow preventer, where services are below basement elevation.

3.0 MEASUREMENT FOR PAYMENT Measurement for payment of this item will be per each backflow preventer. Investigative work to determine homes requiring back flow preventer is included in the unit price.

4.0 BASIS OF PAYMENT

Payment for the item pipe subdrain shall be full compensation for all labour, equipment and material to do the work.

SP6 – 200 MM SUBDRAIN: Item E1

Special Provision

1.0 SCOPE

This special provision describes the provisional requirement for 200 mm subdrain.

2.0 200 MM SUBDRAIN

405.06 MATERIALS Subdrain pipe shall be 200 mm diameter perforated corrugated polyethelyne pipe with minimum stiffness of 210 kPa and wrapped with knitted polyester sock. Pipe shall have bedding and backfill of 19.0 mm clear stone Type 1. Subdrain trench shall be wrapped with non-woven geotextile equivalent to Terafix 270R.

Special Provision

1.0 SCOPE

This special provision describes the provisional requirement for Plastic Catch Basin complete with Cast Iron Grate.

2.0 PLASTIC CATCH BASIN WITH CAST IRON GRATE Plastic catch basins shall be Armtec BOSS 2000 HDPE Catch Basins complete with Cast Iron Lid or equivalent approved by the Contract Administrator. See attached Armtec BOSS 2000 Catch Basin Fabrication Specification Sheet detail.

3.0 MEASUREMENT FOR PAYMENT Measurement for payment of this item will be per each catch basin.

4.0 BASIS OF PAYMENT Payment for the item plastic catch basin with cast iron grate shall be full compensation for all labour, equipment, and material to do the work. This will include the catch basin, cast iron grate, embedment material and backfill material.

SP8 – STORM SEWER REPAIR: Item E3

Special Provision

1.0 SCOPE

This special provision describes the provisional requirement for existing storm sewer repair.

This special provision describes the provisional requirement for Rumble Strip.

2.0 RUMBLE STRIP Where grinding of shoulder rumble strip in asphalt is required as determined by the Contract Administrator. Grinding of shoulder rumble strip in asphalt shall be completed in accordance with OPSS.PROV 342.

3.0 MEASUREMENT FOR PAYMENT Payment will be by the meter length measurement in the field.

Special Provision

1.0 SCOPE

This special provision describes the provisional requirement for asbestos cement hazardous waste removal and disposal.

2.0 ASBESTOS CEMENT HAZARDOUS WASTE REMOVAL AND DISPOSAL If concrete sanitary sewer pipe being removed is found to be asbestos cement concrete sewer pipe. The sewer pipe must be handled and disposed of as a hazardous substance in accordance with the applicable health regulations.

3.0 MEASUREMENT FOR PAYMENT Payment will be by the meter length measurement in the field as an incremental price difference for removal of existing sanitary sewer being asbestos cement sanitary sewer.

4.0 BASIS OF PAYMENT

Payment for the item asbestos cement hazardous waste removal and disposal shall be full compensation for all labour, equipment, materials, and hazardous waste landfill disposal fees to do the work.

SP11 – ADJUST HEIGHT OF DITCH INLET AND CATCH BASIN LID: Item E6

Special Provision

1.0 SCOPE

This special provision describes the provisional requirement for Ditch Inlet Adjustment.

Work under this provisional item shall include without limitation, all labour, material and equipment required for the excavating, locating, recording, backfilling and compacting at locations directed by the Contract Administrator, to determine actual locations of underground services or utilities.

2.0 SANITARY SEWER INVESTIGATION

Equipment shall consist of a minimum of a loader/backhoe combination (Caterpillar 416 or equivalent) and a compactor (either rammer or vibratory plate). The crew shall consist of a minimum of an operator for the loader/backhoe, a layout person and a labourer.

Work of this item shall be in accordance with OPSS 407, 410 & 412. Trench backfill shall be approved select native material compacted to 95% S.P.D.

Where trench dewatering is required work shall conform to environmental compliance as reviewed by the Contract Administrator. All work and costs associated with dewatering of the trench shall be part of this item.

3.0 MEASUREMENT FOR PAYMENT Payment for the item sanitary sewer investigation shall be by the hour and shall be full compensation for all related work.

4.0 BASIS OF PAYMENT

Payment for the item sanitary sewer investigation shall be full compensation for all labour, equipment, and material to do the work.

SP13 – WATERMAIN INVESTIGATION AND LOCATION: Item E8

Special Provision

1.0 SCOPE

1.0 SCOPE

This special provision describes the requirement for relocation of watermain. Where watermains are encountered that require adjustment to the necessary vertical and horizontal separations, watermain shall relocated as approved by the Contract Administrator. Minimum clearances to the existing sanitary sewer is 2.5 m horizontally and 0.5 m vertically.

2.0 RELOCATION OF WATERMAIN 441.05 MATERIALS

Watermain pipe and components shall be as specified on the Contract Drawings. 441.07 CONSTRUCTION

The Municipality of West Nipissing water and sewer personnel are required to be present when work is being completed on the existing watermains. Contractor is required to support all existing utilities to facilitate watermain construction. Insulation of pipe sewers is required where depth of cover is less than 2.0 m. Insulation shall be in accordance with the contract documents.

Will include approved manufacture’s fittings and couplers. Watermain pipe will be Class 150.

There will be no measurement for payment for adjusting existing valve boxes. All costs for this work shall be included in the applicable Hotmix Asphalt Unit Price Item.

4.0 BASIS OF PAYMENT

Payment for the item relocation of watermain shall be full compensation for all labour, equipment, and material to do the work.

SP15 – WATER SERVICE REPLACEMENT OF FLANGED FITTINGS TO COMPRESSION FITTINGS: Item E10

Special Provision

1.0 SCOPE

This special provision describes the requirement for replacement of water service flanged fittings with compression fittings at the main and curb stop. Flanged fitting replacement involves only those water services adjacent to sanitary service replacements.

2.0 WATER SERVICE REPLACEMENT OF FLANGED FITTINGS TO COMPRESSION

FITTINGS Contractor shall locate, expose, and replace existing water service flanged fittings at the main and curb stop with compression fitting Cambridge Brass model number 117NL or equivalent approved by Contract Administrator. Water service size is expected to be 19 mm (3/4”), Contractor is responsible to verify water service diameter prior to ordering replacement fitting.

The Municipality of West Nipissing water and sewer personnel are required to be present when work is being completed on the existing watermains.

Contractor is required to support all existing utilities to facilitate watermain construction.

3.0 MEASUREMENT FOR PAYMENT
