Limited Warranty

● FOR THE PURPOSE OF THIS LIMITED WARRANTY, THE TERM “KOKO PARTIES” SHALL INCLUDE KOKO’ S PARENT, SUBSIDIARY, AFFILIATED ENTITIES, AND AUTHORIZED DISTRIBUTORS, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS.

● KOKO WARRANTS THAT BESTORQUE WILL BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP FOR A PERIOD OF TWELVE (12) MONTHS FROM THE DATE OF INSTALLATION AT THE CUSTOMER SITE. WITHIN SEVEN (7) DAYS AFTER FINDING THE DEFECT, THE CUSTOMER MUST NOTIFY OUR CUSTOMER SERVICE DEPARTMENT IN WRITING. UNLESS ANY NOTICE IS GIVEN AS PROVIDED HEREIN, THE CUSTOMER SHALL BE DEEMED TO HAVE ACCEPTED AND WAIVED ALL CLAIMS FOR SUCH DEFECTS.

● KOKO DOES NOT MAKE AND HEREBY DISCLAIMS ANY WARRANTY IN RESPECT TO THE PRODUCTS OTHER THAN AS EXPRESSLY PROVIDED ABOVE, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

● The above Limited Warranty is conditioned upon proper use of BESTORQUE in the application for which it is intended, and no warranty shall apply to: (i) any product modification, installation, service or repair made other than those under this Limited Warranty; (ii) product damage caused by accident, neglect, or any cause other than ordinary use; and (iii) damages, losses, and injuries resulting from the sale, installation, and use of BESTORQUE in violation of the Limitations on Sale, Installation, and Servicing as follows:

● THE SOLE RESPONSIBILITY OF KOKO PARTIES UNDER THE FOREGOING WARRANTY SHALL BE LIMITED, AT ITS SOLE OPTION, TO THE REPAIR OR REPLACEMENT OF DAMAGED OR DEFECTIVE PRODUCTS OR REFUND OF THE PURCHASE PRICE FOR SUCH PRODUCTS. ANY ONE OF THE FOREGOING ALTERNATIVES CONSTITUTES THE FULL AND EXCLUSIVE REMEDY FOR THE CUSTOMER UNDER THE LIMITED WARRANTY SET FORTH HEREIN. KOKO SHALL HAVE THE RIGHT TO REQUIRE THE RETURN OF ANY DAMAGED OR DEFECTIVE PRODUCTS BEFORE IT WILL BE OBLIGATED TO REPAIR OR REPLACE SUCH PRODUCTS OR REFUND THE PURCHASE PRICE FOR SUCH PRODUCTS.

● REPAIRS OR NEW PARTS PROVIDED UNDER THE ABOVE WARRANTY NEITHER RENEWS NOR EXTENDS THE ORIGINAL WARRANTY PERIOD.

● IN NO EVENT SHALL KOKO PARTIES BE LIABLE FOR INDIRECT DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS), EXEMPLARY DAMAGES, OR PUNITIVE DAMAGES. THE PROVISIONS OF THIS PARAGRAPH SHALL APPLY REGARDLESS OF THE FORM OF ACTION, DAMAGE, CLAIM, LIABILITY, OR LOSS ASSERTED, WHETHER IN TORT OR CONTRACT, STATUTORY, OR OTHERWISE.

● THE LIMITED WARRANTY PROVIDED HEREIN IS NOT TRANSFERABLE AND IS LIMITED TO THE ORIGINAL PURCHASER OF BESTORQUE FROM KOKO OR ITS AUTHORIZED DISTRIBUTOR.

● Without limiting the foregoing and by way of example, KOKO shall not be liable for any of the following failures or damages caused to BESTORQUE, regardless of whether before or after the expiration of the warranty period:

・Failures resulting from the customer’ s design or manufacture of installation parts・Failures or damages resulting from operation and maintenance outside of the instructions and/or warnings described in this manual・Failures or damages resulting from repair or modification by anyone other than KOKO or its authorized distributor or agent・Failures or damages resulting from abuse, misuse, mishandling or misapplication of BESTORQUE・Failures or damages resulting from operation or maintenance exceeding the limits set forth herein ・Failures or damages resulting from use of spare parts, accessories or consumables other than those recommended by KOKO・Failures or damages resulting from natural disasters, including without limitation, earthquake, typhoon, flood, fire. ・Failure or damages resulting from operating conditions or error for which KOKO is not liable・Failures or damages resulting from the environment BESTORQUE is installed in, including, without limitation, electromagnetic environmental stress・Failures or damages resulting from resale or transfer of BESTORQUE・Failures or damages resulting from normal wear, rust, corrosion, lack of proper maintenance, or deterioration・Failures or damages resulting from causes not attributable to KOKO

THE PROVISIONS OF THIS PARAGRAPH SHALL APPLY REGARDLESS OF THE FORM OF ACTION, DAMAGE, CLAIM, LIABILITY, OR LOSS ASSERTED, WHETHER IN TORT OR CONTRACT, STATUTORY, OR OTHERWISE.

● THE LIMITED WARRANTY PROVIDED HEREIN IS NOT TRANSFERABLE AND IS LIMITED TO THE ORIGINAL PURCHASER OF BESTORQUE FROM KOKO OR ITS AUTHORIZED DISTRIBUTOR.

● Without limiting the foregoing and by way of example, KOKO shall not be liable for any of the following failures or damages caused to BESTORQUE, regardless of whether before or after the expiration of the warranty period:

・Failures resulting from the customer’s design or manufacture of installation parts・Failures or damages resulting from operation and maintenance outside of the instructions and/or warnings described in this manual・Failures or damages resulting from repair or modification by anyone other than KOKO or its authorized distributor or agent・Failures or damages resulting from abuse, misuse, mishandling or misapplication of BESTORQUE・Failures or damages resulting from operation or maintenance exceeding the limits set forth herein ・Failures or damages resulting from use of spare parts, accessories or consumables other than those recommended by KOKO・Failures or damages resulting from natural disasters, including without limitation, earthquake, typhoon, flood, fire ・Failure or damages resulting from operating conditions or error for which KOKO is not liable・Failures or damages resulting from the environment BESTORQUE is installed in, including, without limitation, electromagnetic environmental stress ・Failures or damages resulting from resale or transfer of BESTORQUE・Failures or damages resulting from normal wear, rust, corrosion, lack of proper maintenance, or deterioration・Failures or damages resulting from causes not attributable to KOKO
