Kent O’Brien, CEO of Global Strata, on the 8 things to know about Strata Law.

The property market by numbers

1 What is it?The division of property into

units and common areas and their registration is known as Jointly Owned Property (JOP), which is also known as Strata Ownership in other parts of the world.

2 What does it do?Strata Law defines the rights

between individual property owners and their residential communities.

3 What does it offer?Government supported rules and

regulations that direct the creation and implementation of residential property owners’ associations, allowing them to control the amount they pay for the maintenance and service charges.

Home Help

4 To whom is it relevant?A person or a business who

owns a property and a real estate broker who is selling properties located in either a jointly-owned apartment building or villa in a master community.

5 What are the relevant laws in Dubai which offer directions to

property owners?Jointly-owned property law No. 27 (2007), introduced to lay the foundation for Strata Law within the UAE; this law explains the relevant concepts, terminology and definitions used within Strata Law. Civil code No. 5 (1985) allows for the sub-division of buildings, the creation of homeowners’ associations, and the existence of Strata laws.

6 What recent laws were introduced by RERA which

help in establishing owners associations?‘Direction for General Regulation Concerning Jointly Owned Property’, which deals with the owner’s rights and the developer’s requirements. ‘Direction for Jointly Owned Property Declaration’, which deals with property-related subjects such as: community rules, site plans, titling information and so on. ‘Direction for Association Constitution’, which explains the functions and powers of the homeowners’ group, its board and manager. And ‘Direction Concerning Preparation of Survey Plans’, which handles accreditation, registration, duties, suspension and cancellation of registered surveyors.

7 What are the essential need-to-know facts for the owners who

form the associations?Firstly, the homeowners’ rights as a member of their group and the obligations to other owners. Secondly, homeowners’ financial obligations to the group, voting rights of the individual and how service charges for the property are divided amongst the group. Also, the rights, obligations and functions of the homeowners’ group, which includes things like procedures for group meetings, the signing off of budgets and the appointment of service suppliers, And lastly, what the developer is responsible to disclose to the homeowner and what laws are in place to ensure that it is disclosed.

Arabian RanchesTara and Andy Parkinson open the door to their

Mediterranean-style villa and tell us why, 11 years on, it’s still their pick of places to set up home in Dubai

We love this place…

Tara, what brought you to Dubai and how does it compare to life in the UK?When Andy and I first moved here no one had really heard of Dubai, but I’d lived in Arab cultures before and was ready for a change. I remember packing up our flat in the UK; it was pouring with rain outside and I just thought, ‘I have to get out of here!’ We arrived, like everyone, thinking we would be here for two years but it really took that time to get organised and settle in. By then, there was no way we could think of going back – I had a great job but ultimately it was the lifestyle and sunshine that made us stay. I’ve never regretted it.

You’ve been here for 11 years now, why did you choose to buy a home in the Arabian Ranches? We bought this property five years ago and it was really the first development to take on a European look. There also seemed to be a lot of teething problems during the building of earlier developments like The Lakes and The Meadows, which builders appeared to have learnt from and not repeated here. As a result, I think the villas are of an altogether better quality. Coupled with that has to be the schools and facilities. It’s very safe too, with paving all the way round the development so you can go on lovely walks every which way and feel very safe; all in all it’s a really nice place to live.

How does it compare to other areas of Dubai that you’ve lived in? We rented for seven years in different locations, including The Lakes (which was fantastic) and along Sheikh Zayed Road but buying here makes it the first place we can really call home. We can do little touches ourselves and not have to worry about being kicked out by a landlord! We’ve always said that if we were single now we’d live in JBR or the Marina (which wasn’t there before we had children) but now we have Holly, Jake and Luke, the Arabian Ranches is definitely a real family settlement that’s lovely for children.

What are the local facilities like here? Well, in the centre of the compound next to JESS (Jumeirah English Speaking School) are the main local shops, which include a supermarket, nail bar, hairdressers, coffee shops and a selection of takeaways: a lot of mums pop there after the school run so it’s a great, sociable little place and really the hub of the development. In terms of schools, there’s also Repton on Emirates Road, where many children from the area go; both schools teach an English curriculum. Motor City has just opened up now as well, and with it a large Spinneys, so the facilities seem to be getting bigger and better for locals.

How about leisure and entertainment? Arabian Ranches originally got its name

because it’s built next to the Dubai Polo Club, which is where we go horse-riding – Holly is obsessed with horses! We’re members there and there’s also a gym and swimming pool you can use. All of the houses are built around the Arabian Ranches Golf Club too, and families can meet up at the clubhouse and go for something to eat. On top of that, each compound has its own park and pool. Now that it’s cooler, you can wander down there at around 4pm and all the children play together.

Back to the house, you created a fabulous, lush garden from scratch – how did you go about it? Our outdoor area was just a massive sandpit when we moved in! We found a designer who created the look we had in mind and then outsourced the work. It took about six months in total. Newcomers should chat to a gardener as only certain plants can survive the climate; our banana plants and bamboo didn’t survive the intense heat. Furniture wise, we went to Rattan House on Sheikh Zayed Road – they even made all of the cushions for our sunken area to match our sofas. We opted for rattan as it’s meant to be weather-resistant, whereas wood is quite high maintenance.

You gave your kitchen an ultra-modern overhaul too, how did you achieve it?

BH Cover interview October.indd 13 10/7/2010 10:58:17 AM

Page 16: Better Homes October'10

October 2010

A company called Under One Roof did the whole thing; I can’t say enough great things about them. They did absolutely everything from ripping out the ceiling and entire kitchen to attaching all of the appliances and painting the finishing touches. It was very basic before, like many Dubai homes, but we really wanted a modern look with a Spanish-style to match the rest of the house. At first we were scared to have a dark kitchen but were assured that with the spotlights and shiny surfaces (which reflect the light) it would be fine; and it was. It is a bigger expense but well worth it and we’re thrilled with the workmanship. It took around three weeks from start to finish – we just went on holiday and left them to it!

Your home has a modern, Mediterranean feel throughout – where did you shop to get the look?

We bought a lot of things from The Paddy, in Jumeirah’s Village Mall, such as the long, bamboo table in our lounge and our wall art, too. Our four-poster bed and sofas are from The One; the boys’ bedroom furniture is from Flamant in Mall of the Emirates, as is Holly’s – with some extra pieces from The White Company. Our shutters really add to the Mediterranean feel. I’d always loved them and they’re great for keeping rooms cool and dark for the children – plus they really create that Med look. It’s very difficult to make a feature of the arches in our villa with curtains, so this was a fab alternative. It took around six to eight weeks for the finished look as the windows are measured and the materials shipped in from the States.

Overall, what would you say are the best things about life in the Ranches?

Number one has to be that it really is a ‘finished’ development. All of the landscaping is complete, all of the paths connect to one place and there are no roadworks or digging anywhere; it’s all done, which is what makes it a good quality place to live. It’s so funny because in Dubai when it rains there can be leaks everywhere – we were prepared for it... but we haven’t had one leak! We were amazed. A lot of people buy rather than rent here too, so seem to take more pride in their villa’s appearance.

So, is there anything missing? We do need another health club; the polo club is great for riding but the gym is quite small. That would be a great addition. But, all of the everyday things you need are here. I’ve said to Andy that with Spinneys opening I barely need to leave the Ranches now!

Arabian Ranches An all-you-need-to-know guide to daily life in this idyllic community

Love Thy Neighbourhood

Renting and buying

Enter the Arabian Ranches and you’ll discover sprawling properties with a distinctly Mediterranean feel. It’s quite a compound too; with a total of ten different villa communities, from the luxurious detached Terra Nova villas with up to seven-bedrooms a piece, to the Portugese-style three-bed Alvorada family villas – to name but two. Whichever gets your vote, two things are a certainty: individual style so often absent in Dubai compounds and complete developments (no roadworks here). Private gardens and, in some cases, swimming pools, make it perfect for families, plus ex pats can buy as well as rent. Located on the Emirates roads leading to Dubai and Abu Dhabi, the Ranches are in an ideal position for that daily commute, school run or city trip.

Shopping and a bite

Stroll through the pedestrianised community to its hub: an oh-so-convinient

Village Community Centre with outlets. Drop your laundry at Eezi Clean, pick up essentials at MediLink Pharmacy, entertain yourself with a new read from Booksplus, or treat little ones to a creature from Pets Delight. Stop off at one of its eateries while you’re there, like Costa Coffee, MBCO (a fave for fresh sandwiches, smoothies and more) or, for fast food, Burger King and Pizza Hut. Alternatively, Motor City is moments away and its new strip of shops are beginning to open, which cues more places for Ranchers to spend their dirhams. Notably, a Spinneys (www.spinneys-dubai.com) – perfect for that big food shop – and a London Fish & Chips that’s sure to be a hit with Brits.

Leisure time

Horse-riding and golf enthusiasts will be in their element with the Arabian Ranches Golf Club (www.arabianranchesgolfdubai.com) and Dubai Polo & Equestrian Club (www.poloclubdubai.com) on the doorstep.

Whether you’re playing or not, there’s a Spanish-style Clubhouse to socialise in. Head to the Ranches Restaurant and Bar ( ) and savour international fare on the terrace. Plus, with luxurious suites, there’s somewhere for relatives to stay if your villa’s full up. If riding’s your sport, the polo club has it all; from showjumping and dressage arenas to desert hacking. Stay fit another way at the club’s pool and gym or head over to Exhale (www.exhaledubai.com) for yoga and Pilates. For a relaxing revamp, try Tips & Toes ( ) or Shima Beauty Lounge ( ) – both of which can be found in the Village Community Centre.

Schooling

Those with little ones will be pleased to know there’s an established, English-speaking nursery with qualified staff just moments away at the polo club; Jebel Ali Village Nursery (www.jebelalinursery.com). Plus, from October th its newest facility Little Ponies will be open to tiny tots. If they’re ready for school, there are three local options, two of which teach an English cirriculum. First up is residents’ favourite Jumeirah English Speaking School (www.jessdubai.com), which takes students through their primary and secondary years. Second is Repton (www.reptondubai.com) on Emirates Road for three- to -year-olds. Alternatively, head to Motor City and check out the American Bradenton Preparatory Academy (www.bradentonprepdubai.com), for kids of nursery age up to grade .

JULIE D’BELLE, OPERATIONS MANAGER-STR & PROPERTY MANAGEMENT

Rentals for short-term leases are higher than long-term contracts for a variety

of reasons. However, of late, prices have become more competitive. The

average monthly rent for a studio in Dubai Marina starts from AED6,500; a one

bedroom from AED8,000; and a two bedroom from AED 10,000. In Old Town, rates are higher,

with studios priced at AED 8,500, a one bedroom at AED10,000 and two bedrooms from AED

15,000. But how about a signature villa on the Palm? Yours for AED5,600 per day.

Sum up the look of your home in just three words Fresh, romantic and subtle

Your favourite spots to shop for interior goodies in Dubai? I find it hard to leave Zara Home without at least one thing – it’s a great shop for reasonably-priced yet attractive accessories. I love

And So To Bed – I’m yet to own a bed from there but it’s still the perfect place to dream about! I know it’s a cliche, but my store Little Luxuries is really an extension of my own home so I’m my own best customer.

One thing I love to bring home is... Flowers. There’s one florist in paticular

on Jumeirah Beach Road called Shakespeare Flowers which does some wonderful blooms.

No house should be without... Tea-cups and a range of teapots to match.

The place I love most at home is... My garden; all of the greenery is sometimes enough

to trick the mind that it’s not over degrees outside!

The interior look I most admire is... Those that don’t take too much work.. I admire many styles but I think high-maintenance themes can remove the natural joy a space can create. My favourite look would be in a relaxed style.

Better Interiors News, views and ideas to help style your home

If you’re a slave to fashion you’ll go ga-ga for the latest interior range to hit the UAE: a bold and beautiful collection from Jean Paul Gaultier. The famous French designer has turned his hand to design of a different kind; cue bedroom sets, quirky furniture and accessories to match. Get your furniture fix from Roche Bobois on Sheikh Zayed Road. Visit www.roche-bobois.com

There’s no better way to make a (room) entrance

than with a dramatic chandelier – and this

month we’re pining for this Gothic-style design

by Judy’s Selection. With 18 mini shades it’s sure to light up a room in the

most stylish of ways. Hang it from ultra-high ceilings or make a statement in

a simple room. Available at Carpe Diem, Jumeirah

Beach Road.

BACK TO BASICS When you set foot in your new home it’s natural to want to do everything at once, but don’t: start with the basics and add your decorative fancies after. Kitchens and bathrooms need to be fully functioning for you to have a liveable space; your bedroom needs a bed for you to spend the night; windows need covers for privacy. Go for the necessities first and decorating will be a pleasure, rather than a chore.

SOMETHING OLD, SOMETHING NEW It’s tempting to disregard all of your old furniture in favour of an entirely fresh start but save those of sentimental value to avoid regrets and mix them with new additions you love. Old photos in new frames, for example, is one way to decorate rooms and add a touch of familiarity at the same time.

ECLECTIC THEMES If your move to the UAE is from overseas, consider the style of your old home versus the new and plan your décor accordingly. You may think that English country-cottage style furniture, for example, is not befitting an ultra-modern apartment. However, there are ways to fuse the two – think shabby chic – so don’t discard any items you love

– they may take on a new lease of life in a different setting.

MARITAL MATTERS If you’re moving in with your partner for the first time you may find you have opposing taste when it comes to décor. If you do like different styles, why not compromise by taking care of a room each, or employ an interior designer who will have the expertise to fuse your tastes together?

DON’T IGNORE THE DETAILS If you have any alcoves in your living room make use of them. Install shelving inside to line your favourite books or photo frames and you’ll create a practical space with a homely feel.

LESS IS MORE Want a colour scheme that will never go out of style? Then don’t over-complicate things. Monochrome remains a favourite as it’s simple to do, easy to maintain and looks super-sophisticated in no time. Its timeless quality will work well teamed with modern Dubai homes and their typically plain walls and flooring, too. Our tip? Layer lots of different shades, from charcoal and black to white and cream to achieve a less stark look.

New Home, New LookDecorating a new pad from scratch can be a daunting task so take a look at our tips and trends to revamp yours in no time

If you are buying all of your furniture from scratch and are stuck on what to get, think in pairs. The symmetrical positioning of two matching lamps, arm chairs and cushions in your lounge will give an instant ‘hotel look’. Such a mirror image is fuss-free and fabulous, leaving you with a very stylish setting.

SHABBY CHIC Before you throw out that wooden table and deluxe, tailored chairs you don’t think will match in a million years, think again. Shabby chic is a phrase we should all be thankful for; it allows you to mix luxe details with more relaxed items for a glam yet lived-in look that’s very ‘now’.

MAKE A MOODBOARD It’s a favoured technique among interior designers, so why not make like a professional and create your own moodboard? The idea is to create a board which will help you to visualise how fabrics, patterns, textures or colour will work when combined in one room. Pick up curtain samples, paint colours and place them together. Such a visual tool will help you land a look that works for you.

PERFECT YOUR PATTERNS When introducing bold prints, follow a golden decorating rule: mix large with medium and medium with small, but not large with smalll – the two extremes will look odd. It’s also a good idea to have one key colour in common in order to bring the look together without being too ‘matched’.

THE PAINT TEST In varying light, paint colours can appear different to what they may have done in the shop, so, before putting brush to walls buy a tester pot. Next, paint the inside of a box and you’ll have a mini room which you can move around and see how the colour looks in a D space.

THINK BIG If you’ve bought your property, you don’t have to take it as you find it – there is an array of companies

THINK PAIRS

BH Decorating tips October.indd 48 10/6/2010 12:35:52 PM

Page 51: Better Homes October'10

Better Interiors 49

in Dubai who can make that revamp a reality. Look at your property as a blank canvas and decide what’s most important to you: if your large bedroom is short on storage why not have a walk-in wardrobe created? If kitchens are your thing, can you knock the wall through into your misused maid’s room? Is your desolate garden fit for a swimming pool? Make such decisions early on and you can take your home from ‘ just so’ to the pad you’ve always dreamed of.

MAKE THE MOST OF IT Renting may mean that you’re not able to make big changes, so work with what you have. Most properties have plain walls and tiled floors so pick a fabulous accent colour or print and bring the room alive with vibrant accessories. If you want to go one step further, ask your landlord if you can paint or decorate one key wall.

VISUAL FEAST Having trouble envisaging where everything will fit? Make like a designer and draw a room plan (it doesn’t have to be a work of art). If you’re planning a multitude of rooms you’ll be surprised by how getting it down on paper will help shed clarity and un-muddle your mind – and it saves you shifting furniture for real.

WINDOW DRESSING Make your windows a priority; it’s one major detail that’s very easy to forget – until you move in, that is, and realise you can’t sleep because it’s too light and the neighbours have quite a view. Black-out blinds, shutters and curtains are all viable options, but be sure to plan ahead as the process can take longer than you think. Most companies will come and measure your windows and line and hang the fitted curtains accordingly.

New Home, New LookIf creativity’s not your strong point, follow this simple rule and you’ll achieve a well-balanced scheme that can’t fail to look great. Keep of your core elements in one colour (think walls and floors), of the room (try prints and furnishings) in a second hue and add a vibrant accent for the final (accessories like cushions are a good choice)

THE RULE

Naturally ChicWood and stone features mean that going back to nature never looked better. Both materials continue to stand the test of time in the style stakes and there’s now a plethora of bold bamboo, fake fur and horn accessories on the market. For a softer look, team it with floral hues like vintage rose or heather.

Grey Matter Swap summer’s trendy nude hues and go grey for winter. Fad-phobes can embrace it too, as this is a tone that can be matched up with all manner of colours throughout the year, from deep reds to bright limes and cool whites. Keep it simple with a signature piece or go all-out with painted walls.

Very Berry Purple is the perfect pick for the coming winter season so take tips from nature’s fruitiest palette. Plum, blackcurrant and cranberry shades will add a sense of depth, richness and warmth to rooms. Use it as an accent colour with cushions and throws and you can swap them for zestier hues when summer strikes again.

On Trend After inspiration? Check out this season’s key looks and revamp those rooms...

Practical solutions for your household dilemmas

LAMINATE Love the natural look but on a budget? Laminate

floorboards will evoke the wood look without the damage to your budget. The gloss-finish creates a contemporary look that’s family- and pet-friendly thanks to its easy-to-wipe surface.

WOOD Oak, pine, walnut... the options are endless and the result is

a stylish finish that will stand the test of time. When it comes to colour, forget fads and consider what reflects your long-term taste. Go dark for modern homes or light for a country feel.

MARBLE If luxury tops your list, marble will evoke a high-end look

fit for a five-star hotel. They’re practical as well as elegant – the tiles don’t heat up which means a cool and soothing effect beneath your feet. Incorporate a pattern in a key room or hallway for added drama.

LAMINATE FLOOR TILES One for the kids. The material is tough

enough to withstand abuse but you can replace one here and there if damage ensues. Not only that but you can add a playful edge by incorporating coloured or patterned tiles too.

CARPET For a super-soft and homely feel, lay carpets – a practical

option for parents who have tiny tots prone to falls. Remember that the rest of the room will soon be adorned with décor, so stick to neutral or dark tones and you’ll have a base colour that won’t overpower the rest of the room.

QUICK FIX RUGS Lay the right rug and you can enhance the look of a

room in seconds. Try woolly designs for a winter-warmer or, if you’re daring, animal prints for a glam, boudoir touch.

Tread carefullyBefore you scrap those tiles for good, read these practical tips from Rugland’s general manager, Farshid Niknam (www.aaf-me.com)

Choose your floors early Many people make the mistake of buying all their furniture beforehand but it’s much easier to install your chosen material before moving pieces on top.

Consider your timescale Your existing floor will affect the length of time it takes to remove, so be sure to get an estimate. Laminate or parquet, for example, will take longer to remove than carpets

and after the removal comes the new installation. Two days should be sufficient.

You can be eco-friendly Laminated parquet is made from wooden waste and MDF and will give floors the desired look and feel of wood but at a lower impact on the environment.

Vary the look Living areas work well with wooden or laminated parquet; bedrooms benefit from the warmth of carpets; while vinyl floors and hard surfaces are practical for kitchens and bathrooms.

Play it safe If you want carpets for your kids we recommend nylon which is 100% anti-allergic and anti-bacterial.

‘Lay the right rug and you can enhance the look of a room in seconds. Try woolly designs for a real winter-warmer’

CM Espresso machine AED,Can’t function without a morning coffee fix? Thanks to Italian brand Gaggenau you don’t have to. This month sees the launch of this little number (take your pick of stainless steel, aluminium or glass), which jollies up espressos, lattes, macchiatos and cappucinos at the touch of a button – no need to swing by the coffee shop on your way to work, then.

Fisher & Paykel Cool Drawers AED6,800 This is one cool product (pun intended): find all the features of a regular fridge but in drawer form. They’re temperature controlled, so you can stash everything from fruit to ice cream, before closing it to blend in seamlessly with the rest of your kitchen. Perfect for big families. Pick one up from Better Life stores.

LF Freestanding Cooker From AED, We love the stainless steel finish of LG’s latest gas cooker – which comes in not one but three models – so you can snag a funky, freestanding design to suit your budget. With hobs on top, rotesserie cooking, grilling and cooling all part of the package, there’s no need to rein in your cooking skills either.

Philips’ Energy Care Iron AEDFor those of you who aren’t opposed to tackling the ironing basket, Philips’ latest design (which we think is pretty easy on the eye, too) can tackle those creases. Its super steam power stops as soon as you lift it off the garment, so you won’t waste excess steam and energy while you’re at it.

Samsung’s Dishwasher AED1,980For spotless plates (literally) check out Samsung’s latest line of dishwashers. This one’s fan-driven drying system means you won’t end up with annoying spots and streaks, plus you can forget about leaks – it has a sensor underneath to prevent any emergencies, which means you can leave it on and go out.

THAI WOK Taster: This family-run spot

is just the place to dial up and satisfy that Pad Thai craving. Fresh ingredients mean you won’t open the box to greasy chain-style nosh. ROYAL ORCHID Taster: You can get it all here,

kicking off with classic appetisers like spring rolls and chicken satay, followed by Thai red and green curries or yummy noodles. Eat... turkey. If you’re an American in Dubai be sure to snag a big bird in time for Thanksgiving on November 4th. Spinneys is our tip of where to pick up a traditional Butterball turkey to feed the whole family.

Dine... al fresco. If, like us, you’re rejoicing at the arrival of October, abandon eating at the dinner table for dining outside. Turn the page and check out our barbecue menus for a touch of inspiration.

Treat... your family to a chic French dessert. The Madeleine Café & Boulangerie has just opened in The Dubai Mall, so turn up and take away a mouth-watering cake, or its signature Normandy apple tart.

INDULGE YOURSELFWe always knew chocolate was good for us – well, the dark stuff at least. Leave milkier alternatives on the shelf and pick up bars with over cocoa content. Why? The yummy cocoa bean is rich in flavinoids – aka antioxidants - which can help ward of the threat of high blood pressure.
