1. Introduction BSNL operates a countrywide IP based network for providing Internet services. These services are offered through BSNL's 432 Internet nodes located throughout the country. BSNL has introduced IP based Virtual Private Network Services (IP-VPN) to organizations having multi-location offices using the existing network infrastructure. This service would enable organizations to reduce their connectivity cost and simplify the networking of their multi-location offices. 2. Virtual Private Network A Virtual Private Network is a network that provides the characteristics and security of a dedicated private network using a shared public network infrastructure. 3. Technical Description of the Service Being Offered

Different locations of the organization would be interconnected so as to form a Closed User Group/Intranet. The members of the CUG/Intranet would be able to communicate only amongst themselves in Any-to-Any logical architecture. The architecture is logical in the sense that though the connectivity to the organization at different locations, will be provided from the NIB nodes as usual, but the logical architectures as mentioned above, would be created through access lists on routers. The organizations can opt for private IP address based IP-VPN or NAT based IP-VPN. This service would be on best effort basis. Internet connectivity would not be provided to the IP-VPN Customer. However any organization desirous of having Internet connectivity can take a normal Internet leased line for this purpose. The organization can then extend Internet connectivity to the members of IP-VPN by making necessary provisions (including connectivity and routing) at their end. The service would be available at 64 Kbps, NX64 Kbps and 2 Mbps. The provision for IP-VPN security through firewall, encryption, encapsulation etc. will have to be made by the organization at their end. The service will be provided at 45 Type “A” & Type “B” nodes of NIB and Type "C" nodes of NIB having Cisco Routers. The service would be provided subject to availability of router ports.

4. Target This service will be used primarily by those organizations intending to interconnect their offices at multiple locations and setup corporate Intranet. ISPs are barred from subscribing to this type of service. The organizations desirous of subscribing to IP-VPN service will have to take prior approval as per guidelines for CUG from Jt. DDG(Commercial) 5. Requirements for Service Provisioning

Availability of ports for providing the local leased lines Assignment of private IP address pool per customer Assignment of public IP addresses to the corporate, in case of NAT based IP-VPN Strict regulation of private IP addresses assigned, to ensure the uniqueness of private IP addresses across the NIB network. Configuration of access lists and routing for IP-VPN, IP addresses on NIB Routers, as per Routing Policy and customer requirement. Availability of technical manpower at Nodes and Data Networks for NIB network monitoring to ensure high availability of service to IP-VPN customer.

7.1. Role of Data Networks • • •

7.2. Role of Circle (including Nodes)

(In view of limited access rights of router, available to NIB Node-in-charges of “A” and “B” locations, the configuration of access lists for IP-VPN service at these locations will be done centrally) Monitoring of the NIB nodes, inter-nodal trunks, IP-VPN local leased lines and availability of customer IP-VPN network on 24x7 basis Close coordination with Node Incharges of those NIB Nodes where other IP-VPN sites of the customer are located to ensure high availability of the customer IP-VPN network. Monitoring the availability of ports, bandwidth utilization on inter-nodal links. Seeking approval from Data Networks for inter-nodal bandwidth upgradation as per existing procedure. Provide first line support to the customer

7.3. Additional Role of Node where customer centrally registers for IP-VPN Service (To be designated as Node Incharge Responsible for particular customer VPN)

Carry out registration formalities on behalf of all the VPN Sites of the customer. Ascertain the availability of ports on NIB routers and feasibility of providing local leased line at each VPN Site of the customer Ascertain the availability of internodal bandwidth as per VPN architecture chosen by the customer Issue Demand Note for the customer and Advice Note/Work Order for all the Nodes for implementation of the VPN Network. Completion of other commercial formalities including payment collection from time to time. Coordination with Data Networks and other Nodes for commissioning of VPN Network. Single point of contact for VPN customer for commercial and technical issues. Advising other Node Incharges of action in case of commercial and billing issues of IP-VPN customer including non-payment of bills etc.

8. Resources Required for provisioning and maintenance IP-VPN Services

8.1. At Data Networks •

Additional two SDEs/ADEs preferably having CCNP certification and the following skill-set

Configuration of Cisco devices Computer savvy

Additional 6+1 JTOs to work in shifts with the following skill-set. These officers can be utilized for round the clock monitoring of existing services also.

Rectification of routine problems related to networking, routers, servers, billing,

authentication etc. Computer savvy

8.2. At Nodes (to be decided at the Circle level) • Trained Node-in-charge/s, Commercial and Marketing and other requisite staff to carry

out all the responsibilities as stated in para 7.2 and para 7.3 at each node or a group of nodes.

9. Limitations & Constraints

This service is available only for customer sites within India. Feasibility study has to be carried out by the Node Incharge responsible for the customer VPN. It is estimated that at each NIB location only 10-15 VPN leased connections can be provided in view of limitations imposed by availability of ports and possible degradation in router performance with the increase in the number of access-list entries. The organizations already having their network implemented with a specific IP addressing scheme (of private IPs) may not like to migrate to new private IP addressing scheme. In such cases, however, limited public IP addresses can be provided to the customer for configuring NAT.

10. Registration for IP-VPNs Customer will have to register for IP-VPN Service (covering all his sites) at one of the NIB Nodes where one of his sites is located. This site will be designated as the central site for this VPN customer with respect to all technical, commercial and billing related communication between BSNL and the customer. This site will be responsible for raising the bills for all the IP-VPN sites of the customer on behalf of all the nodes and realizing payment against bill centrally. In view of the above, policy, a procedure for the internal revenue settlement between different Circles/SSAs will have to be worked out. 11. Tariff for IP-VPN The tariff for IP-VPN service has been finalized vide BSNL C.O. letter no. 106-27/2002-Comml dated 18th September, 2003. The same can be downloaded from the Intranet Website. The details of commercial conditions and VPN configuration change charge are as per Table-1 given below:-

TABLE-1 • Customer is permitted to change the number of sites, change from Private IP based VPN to NAT

based VPN or vice-versa, after paying VPN configuration change charge of Rs 10,000/- per IP-VPN site for all the sites covered in new configuration. Customer will also be liable to pay any additional total port charges which become applicable due to change in configuration. In case of reduction in total port charges due to this change, no refund would be made to the customer and the difference will be adjusted in future bills.

• Minimum period of hire of VPN service (covering all the sites where customer desires services) is Six months. Port charges are payable on quarterly basis in advance

• Service Tax as applicable would be charged • Advance deposit for new connection equivalent to six months port rental charges for all the IP-VPN

sites shall be payable before commissioning and the subsequent advance quarterly port rental for all the IP-VPN sites shall be charged after 3 months period thereafter

• Advance deposit shall be refunded/adjusted at the time of disconnection only. No interest shall be payable on advance deposit.

• Subscriber has to give three months advance notice, for disconnection, failing which subsequent quarter rental shall be forfeited

• At the time of up-gradation of the port speed, the port rental for upgraded speed shall be charged from the date of up-gradation. The advance quarterly port rental shall be charged as per quarterly port rental at upgraded speed and the advance rental already paid at old speed shall be adjusted.

• Per port VPN tariff is same for Private IP address based VPN and NAT based VPN. • Per site leased line charge for extending the connectivity from BSNL node to customer premises shall

be charged as per the prevailing leased line charges. 12. Application Form and Terms & Conditions for VPN Services The application form for the IP-VPN service is attached at Annexure-2

Access List Templates for IP-VPNs IP Addressing Plan Let the customer be assigned one /16 . This /16 would be used by the customer for numbering all its sites. Refer fig 1, given at the end of this Annexure 1. Private IP Address based VPN Example 10.1.0.0/16 is assigned to the customer and customer assigns the following address blocks to each of its sites. allowed from any site of the VPN to any other site of VPN. 7. For private IP address based IP-VPN, the customer will have to implement the private IP addresses in

his network as provided by BSNL. 8. In case the customer is already having private IP address based scheme implemented in its network

and is not willing to change that scheme, then customer can opt for NAT based VPN service. In NAT based VPN service, each site of the organization would be provided with a public IP address from BSNL side, the customer would then have to implement NAT at each of its site.

9. Internet connectivity would not be provided to the IP-VPN Customer. However any customer desirous of having Internet connectivity can take a normal Internet leased line for this purpose. The organization can then extend Internet connectivity to the members of IP-VPN by making necessary provisions (including connectivity and routing) at their end.

ANNEXURE-I

Broad Terms and Conditions of BSNL’s IP-VPN Service over Sancharnet

1. BSNL shall

a. Endeavor to provide reliable & efficient services to its customer. b. Update its IP-VPN Service, provide new facilities, modify & delete certain features without

prior intimation. c. Upgrade its network capacity, bandwidth, speed & add new nodes & reconfigure its network

as per need. 2. BSNL may revise the tariff for its IP-VPN Service from time to time on its sole discretion. 3. Value Added Telecom service providers shall get necessary permission/license from Dy. Director

General (VAS), Department of Telecommunications, Sanchar Bhawan, 20 Ashoka Road, NEW DELHI-110 001 [Tel: 23716874 - Fax: 23353303].

4. Customers desirous of subscribing to IP-VPN Service will have to take prior approval as per

guidelines for CUG from Jt. DDG(Commercial). 5. ISPs are not permitted to subscribe to this service 6. The customer understands and acknowledges that :

a. Only Telecom Engineering Center (TEC) approved Interface Equipment would be used for accessing IP-VPN Service.

b. Necessary License Fee is payable to DoT/BSNL for connecting Modem/other Interface equipment etc. as applicable.

c. Interactive voice and fax messaging is not permitted through BSNL's IP-VPN Service. d. Sending unsolicited messaging, harassing or threatening transmissions using BSNL's IP-VPN

Service is not permitted. e. Probing for means of gaining unauthorized access to computers or networks is not permitted. f. Forgery of any identification or obscuring of hostnames, usernames, IP addresses, or any

message header information in any data, is not permitted. g. Internet contains unedited materials, some of which may be sexually explicit, offensive &

provocative over which BSNL has no control. The customer maintains that any objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not created, stored, downloaded, accessed, transmitted or retransmitted by him or any other person using his facilities.

h. He has to fully comply with the provisions of the Indian Telegraph Act, 1885, Indian Telegraph Rules made thereunder and Information Technology Act 2000 and any amendments or replacements made thereto from time to time.

i. He is responsible for any risk arising out of the use of BSNL’s IP-VPN Service. j. He is not permitted to connect his VPN network to PSTN/PABX. k. Inter-VPN group communication is not permitted.

7. Payment of bills - It will be the responsibility of the subscriber to make advance payment of BSNL IP-

VPN Service. BSNL would disconnect the service in case of non-receipt of advance payment without giving any notice to the subscriber.

8. Disclaimer :- While every effort is made by BSNL to provide highest quality of services to its

customers of IP-VPN Service, the linking, quality and speed of data transmission is entirely dependant on the telephone line/ leased line connectivity as may be permitted by MTNL/BSNL systems. Accordingly, BSNL shall in no event be responsible to the customer in any manner whatsoever for any failure, defect, delay in connectivity or accidental loss of connectivity of the customer with BSNL network or the deficiency in data transmission between the customer and BSNL

network, or for any inconvenience, damage or loss that may be caused to any one or of any kind arising therefrom. The IP-VPN Service is provided by BSNL on "AS IS and AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability of fitness for a particular purpose.

No advice or information given by BSNL, its affiliates or their respective employees shall create a warranty. Neither BSNL nor its affiliates warrants that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free of viruses, worms, Trojan horses or other harmful components. Under no circumstances shall BSNL, its affiliates or its contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from customers, use of or inability to use the service or to access the Internet or any part thereof, or customers reliance on or use of information, services or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.

9. Force Majeure - If at anytime, during the continuance of BSNL IP-VPN Service, the performance in

whole or part, of any obligation under it shall be prevented or delayed by reason of war, hostility, acts of the public enemy, civil commotion, sabotage, fire, flood, explosion, epidemic, quarantine restriction, strikes, lock-out or act of GOD etc., the subscriber shall not have any claim for damages against BSNL in respect of such non-performance or delay in performance of BSNL IP-VPN Service.

10. Arbitration of Disputes - That in case of any dispute or differences, breach & violation relating to the

terms and conditions the said matter or dispute, difference shall be referred to the sole arbitration of Chairman and Managing Director (CMD) of BSNL or any other person appointed by him. That the award of arbitrator shall be final and binding on both the parties. In the event of such Arbitrator to whom the matter is originally referred to is being transferred or vacates his office on resignation or other wise or refuses to do work or neglecting his work or being unable to act as Arbitrator for any reasons whatsoever, the CMD BSNL shall appoint another person to act as Arbitrator in place of outgoing Arbitrator and the person so appointed shall be entitled to proceed further with reference from the stage at which it was left by the predecessor. Subscriber will have No objection in any such appointment that arbitrator so appointed is an employee of the BSNL, same as above, the said Arbitrator shall act as under the Provision of the Arbitration and conciliation Act, 1996 or any statutory modification or re-enactment thereof or any rules made thereof.

11. Acceptable User Policy for Sancharnet Users This Acceptable User Policy (AUP) specifies the actions permitted by Bharat Sanchar Nigam Limited (BSNL) to its users of Sancharnet Internet Services, including IP-VPN, leased line, dial up and other services which may be introduced in future.. BSNL reserves right to modify the policy at any time. All subscribers of Sancharnet Services, directly or indirectly are required to engage in acceptable use only as per this policy as modified from time to time. a. Illegal use Sancharnet network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorisation, and material that is obscene, defamatory, constitutes an illegal threat, violates export control laws or anti national. b. Subscriber conduct Subscriber shall use Sancharnet services for lawful purposes only. Subscriber shall not post or transmit using Sancharnet services any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give right to civil liability or otherwise violate any law, or which, without the BSNL's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a

Subscriber that in the BSNL's discretion restricts or inhibits any other Subscriber from using or enjoying Sancharnet services will not be permitted. Subscriber shall not use Sancharnet services to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with the Sancharnet services . Subscriber shall not upload, post or otherwise make available using Sancharnet services any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.

c. System and Network Security

Violations of system or network security are prohibited, and may result in criminal and Civil Liability. The BSNL will investigate incidents involving such violations and may involve/will cooperate with law enforcement agencies if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:

Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.

Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.

Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.

Forgery of any identification or obscuring of hostnames, usernames, IP addresses, or any message header information in any data.

Harassing or threatening transmissions.

Probing for means of gaining unauthorized access to computers or networks.

Introducing or causing to be introduce any computer contaminant or computer viruses into system or network.

Introducing or causing to introduce any pornography material, e-mail etc.

d. Indemnification Subscribers agree to defend, indemnify and hold harmless the BSNL, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorney's fees, arising out of the use of Sancharnet Services by subscriber or any body else than the Subscriber, if any.

e. EMAIL

It is a condition of use of Sancharnet services that subscriber do not post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any local, state, national or international law; post or transmit any information, software or any other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder; post or transmit any information,

software or other material, which contains a virus or other harmful component; post, transmit or in any way exploit any information, software or other material for commercial purposes, or which contains advertising.

Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A subscriber shall not use another site’s mail server to relay mail without the express permission of the site. Posting a message and subscribing without intent to large number of news groups, forums, e-mail, mailing lists or other groups or lists is prohibited.

f. Enforcement of AUP for BSNL subscribers Indirect or attempted violations of the policy and actual or attempted violations by a third party on behalf of a Sancharnet subscriber or a subscriber's end user, shall be considered violation of the policy by such customer or end user. Any user found violating the above AUP is liable for action under the prevailing laws including termination of services. 12. BSNL shall have the absolute right to immediately terminate, any time, Subscriber contract in the

event of any conduct by Subscriber which the BSNL, in its sole discretion, considers to be unacceptable, or in the event of any breach by Subscriber of the terms and conditions.
