Amendments 2-3

• Amendment 2 is controversial…Why?– National Rifle Association believes that citizens have

the right to bears arms with little or no government interference.

– In both Heller v. DC, McDonald v. Chicago SCOTUS ruled that no level of government can forbid law-abiding citizens the right to bear arms.

– Other limitations have been upheld, though including waiting periods, background checks, etc.

• Amendment 3 forbids the Quartering of soldiers during peacetime. Why included?

Amendments 6-8

• These rights protect you from the court system and its officials. Are sources of procedural rights.

• Amendment 6: Speedy, public trial; Attorney, Use & face witnesses; Know Charges

• Amendment 7: Guarantees civil jury trial for matters over $20.

• Amendment 8: Prevents cruel & unusual punishments; excessive bail and fines.

Amendments 9-10• Amendment 9 protects what is called your

unenumerated rights. These rights are those retained by the people that are not listed in the document. Examples?

• Amendment 10 protects and reserves rights not given to the federal government nor denied to the states to the states. These are called Reserved Powers (see Venn diagram, p. 33). Examples?

• Brainstorm all of the needs you would have to provide if you were forced to quarter soldiers.

• How would the right to bear arms look to a vulture?

• If you were a lawsuit, what would you smell?• Suppose you controlled the curriculum, what

courses would you change?• I only know about the 1st Amendment, explain

the 9th Amendment to me.
