25. Term used: specific vehicle jack

In this Part — specific vehicle jack means a vehicle jack with a

nominated capacity of up to and including 8 tonnes manufactured before 1 July 2011 which is —

(a) limited in its application to a specific vehicle or model or model designation of vehicle; and

(b) intended to be used to lift the specific vehicle or model or model designation of vehicle at only the specific engagement points; and

This Part applies to vehicle jacks with a nominated capacity of up to and including 8 tonnes.

27A. Product safety standard for vehicle jacks prior to 1 July 2011

Prior to 1 July 2011, the product safety standard for a vehicle jack consists of —

(a) the standard set out in Schedule 5 Division 1 clause 1, as varied by Schedule 5 Division 2 Subdivision 1; or

(b) the standard set out in Schedule 5 Division 1 clause 2, as varied by Schedule 5 Division 2 Subdivision 2; or

(c) the standard set out in Schedule 5 Division 1 clause 3A, as varied by Schedule 5 Division 2 Subdivision 3.

27B. Product safety standard for vehicle jacks on and after 1 July 2011

(1) On and from 1 July 2011 the product safety standard for a vehicle jack, other than a specific vehicle jack, consists of the standard set out in Schedule 5 Division 1 clause 3A, as varied by Schedule 5 Division 2 Subdivision 3.

(2) On and from 1 July 2011 the product safety standard for a specific vehicle jack consists of —

(a) the standard set out in Schedule 5 Division 1 clause 1, as varied by Schedule 5 Division 2 Subdivision 1; or

(b) the standard set out in Schedule 5 Division 1 clause 2, as varied by Schedule 5 Division 2 Subdivision 2; or

(c) the standard set out in Schedule 5 Division 1 clause 3A, as varied by Schedule 5 Division 2 Subdivision 3.

2. Commencement

This order comes into operation on the day on which it is published in the Gazette.

3. Definitions

In this order — agreement means the Non Specification Gas Agreement of

7 March 2008 between the Griffin gas producers and DBNGP (WA) Transmission Pty Ltd (ACN 081 609 190), as at 1 January 2009;

DBNGP means the Dampier to Bunbury Natural Gas Pipeline; Griffin gas producers means — (a) BHP Billiton Petroleum Pty Ltd (ACN 006 918 832); (a) BHP Billiton Petroleum (Australia) Pty Ltd

(ACN 006 923 879); (b) Inpex Alpha Ltd (ACN 003 730 756); (c) Mobil Exploration and Producing Australia Pty Ltd

(ACN 004 588 827); production licence means petroleum production licence

WA-10-L under the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Commonwealth).

4. Exemption

(1) The Griffin gas producers and the agreement are exempt from the Act in relation to a supply of gas, produced under the production licence, that —

(a) will flow into the DBNGP; and (b) is in accordance with the agreement.

(2) The exemption ceases to have effect on 7 March 2015.

Shire of Northam FENCING AMENDMENT LOCAL LAW 2010

Under the powers conferred by the Local Government Act 1995 and under all other powers enabling it, the Council of the Shire of Northam resolved on 19 May 2010 to adopt the following local law.

1. Citation This local law may be cited as the Fencing Amendment Local Law 2010.

2. Principal Local Law In this local law, the Fencing Local Law 2008 published in the Government Gazette on 16 September 2008 is referred to as the principal local law. The principal local law is amended.

3. Insert new Clause 3.2 (1) After clause 3.1, insert—

3.2 Maximum height of Fences

A person shall not erect a fence that is greater in height than—

(a) 1800mm on a Residential, Rural or Special Rural Lot, or

(b) 2400mm on a Commercial or Industrial Lot.

(2) Existing clauses 3.2 through to 3.4 are re-designated “3.3” through to “3.5” respectively.

4. Clause 3.5 (1) amended Delete “clause 2.1” and insert “clauses 2.1 and 3.2” instead.

5. Clause 5.1 (2)(b) amended Delete “AS/NZS 3016:1994” and insert “AS/NZS 3016:2002 Electrical installations- Electricity security fences” instead.

6. Amend Clause 5.1(2)(b) Amend Clause 5.1(2)(b) by deleting “AS/NZS 3016:1994” and substituting with the words “AS/NZS 3016:2002: Electrical installations—Electric security fences”.

that is a shared fire service; or (b) a person from entering into an arrangement

MURDOCH UNIVERSITY STATUTE No. 26—STUDENT MISCONDUCT

1. This Statute comes into operation on the day it is published in the Government Gazette.

Regulations 2. Regulations will be made under this Statute for the discipline of students of the University. The Regulations will specify— (1) the misconduct for which a student may be disciplined by the University; (2) the procedure for dealing with allegations of misconduct made against a student; (3) the penalties that may be imposed on a student if any allegation of misconduct is upheld; (4) the capacity for an appeal against any finding of misconduct against a student; (5) any other matters which the Senate considers necessary to give effect to this Statute and the

Regulations.

Repeal 3. Statute No. 23—Student Discipline is hereby repealed.

Transitional Provisions 4. On the date the Regulations are made, any disciplinary action previously taken, commenced or implemented under Statute No. 23—Student Discipline shall be completed in accordance with the provisions of Statute No. 23. 5. Any allegations of misconduct made against a student after the date the Regulations are made, shall be dealt with under the Regulations notwithstanding that the matter giving rise to the allegations may have taken place prior to the date upon which the Regulations are made.

DETERMINATION OF FEES I, Reece Waldock, Director General for the Department of Transport, order that the Notice of Determination of Fees under the Shipping and Pilotage (Mooring Control Area) Regulations 1983 which was published in the Government Gazette No.105 dated 11 June 2010, be corrected by deleting the reference to the Department for Planning and Infrastructure and inserting instead the Department of Transport.
