BLACK GOLD REGIONAL SCHOOLS STUDENT TRANSPORTATION TO SCHOOL-RELATED ACTIVITIES A. STUDENTS BEING TRANSPORTED IN A CONTRACTED OR TENDERED BUS Transportation is approved when the following guidelines have been met: 1. Permission has been granted in writing by the school principal. 2. Written permission has been provided by the parents or guardians of the students being transported. (Does not apply to independent students.) 3. The driver is Board approved for the size of the bus. 4. There is written proof the vehicle is covered by a minimum $2,000,000.00 third party liability insurance and that the insurance company has been informed of the intended use. Drivers must drive safely in accordance with the requirements of the Traffic Safety Act and Municipal Traffic Bylaws and must advise the principal of any suspensions of their licences, if they have more than six demerit points on their abstract, or changes in the status of their insurance coverage. The non-owned automobile portion of the Division’s insurance coverage will respond if: the Division is named in a law suit; and/or there was a judgment imposed by the courts due to the owners’ liability limit being inadequate; and/or the Division was judged to be partially responsible. In the event of an accident, the driver is to report the incident to his/her insurance company and to the school principal or designate. The vehicle owner’s coverage (primary coverage) applies before the coverage by the Board (secondary coverage), in the event of any related claim or action by other parties. Any damages to the owner’s vehicle are not insured by the Board. The driver should not admit liability on behalf of the Board or advise that the Board will pay for any damages incurred. If a driver attempts to negotiate a claim on his/her own, there is a possibility the Board coverage will be void. A. STUDENTS BEING TRANSPORTED

B. STUDENTS BEING TRANSPORTED IN A PRIVATE VEHICLE

BY AN EMPLOYEE OR VOLUNTEER

Transportation is approved when the following guidelines have been met:

1. Permission has been granted in writing by the school principal. 2. Written permission has been provided by the parents or guardians of the students being transported. (Does not apply to independent students.) 3. The driver of the vehicle is a minimum of twenty-one years of age and holds a valid Class 5 (or equivalent) driving license. 4. There is written proof the vehicle is covered by a minimum $1,000,000.00 third party liability insurance and that the insurance

company has been informed of the intended use. 5. Privately owned 15 passenger vans will not be used to transport students. 6. Any vehicle being used to transport a student who is under six years of age or less than 18 kilograms weight must have an

appropriately installed car seat and tether system. The driver must correctly secure the student in the car seat. Drivers must drive safely in accordance with the requirements of the Traffic Safety Act and Municipal Traffic Bylaws and must advise the principal of any suspensions of their licences, if they have more than six demerit points on their abstract, or changes in the status of their insurance coverage. The non-owned automobile portion of the Division’s insurance coverage will respond if: the Division is named in a law suit; and/or there was a judgment imposed by the courts due to the owners’ liability limit being inadequate; and/or the Division was judged to be partially responsible. VEHICLE DRIVEN BY AN EMPLOYEE OR VOLUNTEER

Transportation is approved when the following guidelines have been met:

1. Permission has been granted in writing by the school principal. 2. Written permission has been provided by the parents or guardians of the students being transported. (Does not apply to

independent students.) 3. The driver of the vehicle is a minimum of twenty-one years of age and holds the appropriate license for the size of the

vehicle (24 passenger or less - Class 4 minimum: more than 24 passenger - Class 2 minimum). 4. No student who is under six years of age or less than 18 kilograms weight may be transported in a Board-Owned

vehicle other than a school bus. Drivers must drive safely in accordance with the requirements of the Traffic Safety Act and Municipal Traffic Bylaws and must advise the principal of any suspensions of their licences, if they have more than six demerit points on their abstract, or changes in the status of their insurance coverage. In the event of an accident, the driver is to report the incident to his/her insurance company and to the school principal or designate. The driver should not admit liability on behalf of the Board or advise that the Board will pay for any damages incurred.

transported. (Does not apply to independent students.) 3. The driver of the vehicle is a minimum of twenty-one years of age and holds the appropriate license

for the size of the vehicle (24 passenger or less - Class 4 minimum: more than 24 passenger - Class 2 minimum).

4. No student who is under six years of age or less than 18 kilograms weight may be transported in a

Board-Owned vehicle other than a school bus. Drivers must drive safely in accordance with the requirements of the Traffic Safety Act and Municipal Traffic Bylaws and must advise the principal of any suspensions of their licences, if they have more than six demerit points on their abstract, or changes in the status of their insurance coverage.

D. STUDENTS DRIVING THEMSELVES TO SCHOOL-RELATED ACTIVITIES

him/herself. (Does not apply to independent students.) 3. The driver holds a valid Class 5 (or equivalent) driving license. 4. There is written proof the vehicle is covered by a minimum $1,000,000.00 third party liability

insurance and that the insurance company has been informed of the intended use. 5. Other students are not being transported in the vehicle. Drivers must drive safely in accordance with the requirements of the Traffic Safety Act and Municipal Traffic Bylaws and must advise the principal of any suspensions of their licences or changes in the status of their insurance coverage. The non-owned automobile portion of the Division’s insurance coverage will respond if: the Division is named in a law suit; and/or there was a judgment imposed by the courts due to the owners’ liability limit being inadequate; and/or the Division was judged to be partially responsible.
