SUBJECT: Request for “inclusion” in the Maryland Commercial Vehicle Licensing exclusion for fire and emergency apparatus operators.

PRESENTATION DATE: May 3, 2016

PRESENTATION BY: R. David Hays, Director, Division of Emergency Services; James Sprecher Jr, President, Washington County Volunteer Fire and Rescue Association (WCVFRA).

RECOMMENDED MOTION: Move to request that Washington County, MD participate in the Maryland Commercial Vehicle Licensing Regulation Exclusion for Fire and Emergency Apparatus Operators (over 26,001 lbs.).

REPORT-IN-BRIEF: Participation in this program will allow exclusion of the requirement to obtain a Maryland Commercial Vehicle Operators Permit for fire and emergency apparatus operators. All fire and emergency apparatus operators will receive operator training that will be provided by the individual fire and emergency services departments. The recommendation from the chief of a department will be forwarded with a request for the issuance of an emergency vehicle operator’s card. Emergency Vehicle Operator Cards will be issued by the designated County Program Administrator (WCVFRA).

DISCUSSION: Prior to July 1, 2014, all operators of fire and emergency apparatus over 26,001 lbs. were required to obtain a Maryland Non-Commercial Vehicle Operators Permit. This process in general worked well for the licensing of firefighters, EMT’s and paramedics who were residents of Maryland. What the previous regulation did not do well (and in many ways proved challenging) was the regulation and licensing of Non-Maryland residents who volunteered, or worked in the State.

FISCAL IMPACT: There are no initial or recurring expenses.

Open Session Item SUBJECT: Contract Award (PUR-1309) - Construction/Building Inspection Services Requirements Contract PRESENTATION DATE: May 3, 2016 PRESENTATION BY: Karen R. Luther, CPPO – Director of Purchasing and Scott Hobbs, Deputy Director of Engineering & Construction Management – Engineering RECOMMENDED MOTION: Move to award a primary contract, based on the responsive, responsible proposal with the lowest price proposal amount; and, as permitted in the Request for Proposals (RFP), to award a stand-by contract based on the responsive, responsible proposal with the next lowest price proposal amount, at the specified unit costs and estimated hours (no minimum or maximum guaranteed). REPORT-IN-BRIEF: The services under this contract consist of providing construction/building inspection services, as well as field and laboratory services for various projects located throughout the County. The projects may include maintenance and construction of roads, traffic signals, bridges, drainage structures, waterlines, sewer lines, buildings or any similar public improvements projects. The duration of the contract shall be for a period of one (1) year tentatively to begin June 1, 2016, with an option by the County to renew for up to four (4) additional one (1) year periods. Under the terms of the contract, other political jurisdictions within the County may utilize the services provided as a result of this contract. This is a requirements contract; therefore, services will be utilized on an as-needed basis at the respective hourly unit prices for each class of inspector and at the unit price for each test as specified in their Price Proposals with no guarantee of a maximum or minimum number of hours or tests. The RFP was advertised (1) on the County’s web site with access to downloading the RFP, (2) on the State’s “eMaryland Markeplace” web site, and (3) in the local newspaper. Access to/download of the RFP document was performed by seventy-four (74) persons/firms, four (4) firms were represented at the pre-proposal conference. Four (4) firms responded with proposal submittals. The meeting of the Committee was held on Thursday, April 14, 2011 to review Qualifications & Experience Proposals. As a result of evaluation of their Qualifications & Experience Proposals, only two (2) firms were determined to be responsive to the RFP; therefore, the Price Proposals of those two (2) firms were opened and evaluated (see attached Proposal Tabulation Sheet). The Coordinating Committee was comprised of the following members: Deputy Director of Engineering & Construction Management – Construction (Chairman Designee), Deputy Director of Engineering and Construction Management – Engineering, Deputy Director of Environmental Management, Construction Inspector – Division of Engineering and Construction Management, and the Director of Purchasing.

SUBJECT: William Neill Kefauver and John Wayne Canfield Conservation Reserve Enhancement Program (CREP) Easement proposal PRESENTATION DATE: May 3, 2016 PRESENTATION BY: Chris Boggs, Land Preservation Planner, Dept. of Planning & Zoning RECOMMENDED MOTION: Move to approve the William Neill Kefauver and John Wayne Canfield CREP Easement project, paid for 100% by the State, in the amount of $220,783.50 for 70.09 easement acres and to adopt an ordinance approving the easement purchase and to authorize the execution of the necessary documentation to finalize the easement purchase. REPORT-IN-BRIEF: Since 2010, Washington County has been funded to purchase CREP easements on 315 acres of land. The main focus of the program is to protect water quality by removing marginal agricultural land from production and replacing it with best management practices including riparian buffers, stabilization of highly erodible soils, and restoration of wetlands. Landowners who currently hold a 15 year CREP contract voluntarily agree to sell a conservation easement in perpetuity. The CREP easement program is administered by the Land Acquisition and Planning Unit and is funded from Program Open Space funds. The completed recorded easements are held jointly by the County and the Department of Natural Resources (DNR). DISCUSSION: For FY 2016, the State of Maryland is awarding CREP grants to eligible properties. The Kefauver-Canfield CREP Easement uses a portion of those funds. Easement applicants are chosen from those who are already enrolled in a 15 year CREP contract. FISCAL IMPACT: CREP funds are 100% State dollars, mainly from Program Open Space funds. In addition to the easement funds, we receive up to 3% of the easement value for administrative costs, a mandatory 1.5% for compliance/monitoring costs and funds to cover all of our legal/settlement costs. A survey was also needed for this project and the State will pay 100% of the survey cost as well. CONCURRENCES: DNR’s CREP Easement staff approves and supports our program. A final money allocation will be approved by the State Board of Public Works on a project-by-project basis. ALTERNATIVES: If Washington County rejects State funds for RLP, the funds will be allocated to other counties in Maryland. SUBJECT: Contract Renewal (PUR-1251) - Electrician Services at County Facilities

RECOMMENDED MOTION: Move to renew the contract for Electrician Services at County Facilities with Kube Electric Company, Inc. (KECI), of Williamsport, MD, per the rates included in its letter dated March 23, 2016. KECI is requesting an approximate 3% increase above the current hourly rates for work performed by an Electrician and an Apprentice during Regular Hours, Evening, Saturdays, Sundays, and Holidays as well as the rate for Consulting and Design Services. REPORT-IN-BRIEF: On June 17, 2014, the Board originally awarded a contract for the subject services to KECI, at the rates as indicated below and based on a Total Base Bid formula. The contract is a one (1) year contract that commenced on July 1, 2014, with an option by the County to renew for up to four (4) additional consecutive one (1) year periods thereafter. Using the formula with KECI’s proposed rates, KECI’s rates are lower than the two other bidder’s (Eastern Sales & Engineering of Baltimore, MD and Big D Electric, Inc. of Cumberland, MD) original Total Base Bid.

SUBJECT: Governor’s Office for Children FY17 Community Partnership Agreement Proposal Submittal

RECOMMENDED MOTION: Move to approve the submission of the FY17 Community Partnership Agreement proposal to the Governor’s Office for Children requesting $794,447 and accept funding as awarded. REPORT-IN-BRIEF: The Washington County Office of Community Grant Management, on behalf of and at the direction of the Local Management Board, requests approval to submit a Community Partnership Agreement Proposal to the Governor’s Office for Children for fiscal year 2017 in response to their FY17 Notice of Funding Availability. The proposal requests $674,447 in funding for five (5) programs impacting the well-being of children, youth and families in Washington County as well as support for County administrative expenses. In addition, the proposal requests $120,000 of new competitive funding made available for local planning and needs assessments related to addressing Governor Hogan’s four new goals for the Children’s Cabinet: Disconnected Youth, Youth Homelessness, Childhood Hunger, and the Impact of Parental Incarceration on Youth.

DISCUSSION: The funding requested by the Local Management Board includes the following programmatic strategies and their respective vendors –

o Rural Out of School Time Initiative (vendor to be determined) - $105,000 o Clinical Services and Community Outreach to Reduce Teen Pregnancy and STI

RECOMMENDED MOTION: Move to concur with the recommendation of the Washington County Public Schools (WCPS) to award the contract for Washington County Government’s #2 heating fuel oil to the responsive, responsible low bidder, A. C. & T., Company, Inc. of Hagerstown, MD for tank wagon deliveries at a bidder factor of $0.149.

REPORT-IN-BRIEF: Washington County Government as well as the City of Hagerstown cooperatively bids heating fuel requirements with the WCPS. At its meeting on Tuesday, March 15, 2016, the WCPS awarded its contract for tank wagon loads to the responsive, responsible bidder, A. C. & T., Company, Inc. with the lowest bid of $0.149 per gallon over the weekly wholesale average price for #2 (high sulfur) heating oil as published in the Oil Price Information Service bulletin (OPIS, Pad 1, Baltimore gasoline and distillate reseller prices).

The contract is effective August 1, 2016 and ending July 31, 2017 with the option by WCPS to renew the contract for up to two (2) additional one (1) year periods, based on satisfactory product and service. WCPS may request a fixed price quote at any time to be exercised by mutual consent of the parties.

REPORT-IN-BRIEF: On January 13, 2009, the Board of County Commissioners voted to continue with ten year District Agreements so as to maintain the tax credit program, and as a means of landowners showing a commitment to agriculture while waiting for funding for an easement sale.

DISCUSSION: If approved the enclosed applicants will be restricted to agricultural use only on their farms for a period of ten years. In exchange the landowners will not pay county property tax on their agricultural land or buildings and they will receive a credit of up to $711 on their farm house. FISCAL IMPACT: The cost of tax credits for these properties for the ten year period equal about $12/acre/year for a total of about $159,600 for the full 10 year period for 1,330 acres. This will be in the form of property taxes not collected. CONCURRENCES: The Agricultural Advisory Board approved the Districts and found the applications to be consistent with the Comprehensive Plan. DISCUSSION: This program is similar to Maryland’s Enterprise Zone Real Property Tax Credit Program except for the following:

1. This Program is available to all businesses throughout the County; 2. Tax credits are offered for up to six (6) years for smaller projects and fifteen (15) years for larger

projects; 3. Qualifications require job creation and capital investment at varying scale; 4. The real property tax credit may be bundled with other County Tax Credit programs so long as

the combined credits do not result in a tax refund; and 5. The County will not be reimbursed by the State for any portion of the credit.

FISCAL IMPACT: The impact to County real property tax revenue would be dependent upon the extent and nature of the credits claimed.

DISCUSSION: The project involves intersection improvements including the installation of a traffic signal at Underpass Way and Railway Lane. The improvements involve adding dedicated turn lanes (westbound left and northbound right), ADA accessible sidewalks and ramps, audible pedestrian signals, concrete curbing, storm drain, stormwater management, asphalt paving, pavement markings, and signs. A traffic signal is warranted under existing conditions and will result in an acceptable level of service for all movements. This is a 150 consecutive calendar day contract and the project is tentatively scheduled to start in late May. The bid documents include Liquidated Damages in the amount of $500.00 per calendar day for work beyond the completion date. The intersection will remain open to traffic for the duration of the project; however one lane closures with a flagging operation will be on-going. Message boards will be utilized as needed to update the traveling public.

AN ORDINANCE TO APPROVE THE PURCHASE OF A CONSERVATION EASEMENT UNDER THE MARYLAND CONSERVATION RESERVE

ENHANCEMENT PROGRAM (CREP)

(Re: Kefauver - Canfield CREP Easement)

RECITALS

1. The Maryland Conservation Reserve Enhancement Program ("CREP") is a federal-State natural resources conservation program that addresses state and nationally significant agricultural related environmental concerns related to agriculture.

2. CREP provides financial incentives to program participants to voluntarily

remove cropland and marginal pastureland from agricultural production in order to improve, protect, and enhance water quality in the Chesapeake Bay watershed and replacing it with the best management practices including establishment of riparian buffers, grass plantings, forbs, shrubs and trees, stabilization of highly erodible soils, habitat restoration for plant and animal species, and restoration of wetlands.

3. Protection is provided through the acquisition of easements and fee estates from

willing landowners currently holding a fifteen (15) year CREP contract and the supporting activities of CREP Sponsors and local governments.

4. For FY2016, the State of Maryland (“State”) is awarding CREP grants to eligible

Counties (the "CREP Funds"). 5. William Neill Kefauver and John Wayne Canfield, are the owners of real

property consisting of 70.09 acres, more or less, (the "Property") in Washington County, Maryland. The Property is more particularly described on Exhibit A attached hereto.

6. The County has agreed to pay the approximate sum of Two Hundred Twenty

Thousand Seven Hundred Eighty-Three Dollars and Fifty Cents ($220,783.50), which is a portion of the CREP Funds, to the Property Owner for a Deed of Conservation Easement on the Property (the "Kefauver - Canfield CREP Easement").

By virtue of the authority contained in Maryland Code Annotated, Tax-Property Article, § 9-323, State law authorizes the Board of County Commissioners of Washington County, Maryland, to grant a Real Property Tax Credit against Washington County real property tax imposed on real property owned or leased by a new or expanding business entity that creates new jobs, provided that the new or expanding business meets specific eligibility requirements. WASHINGTON COUNTY, MARYLAND JOB CREATION AND CAPITAL INVESTMENT REAL PROPERTY TAX CREDITS ORDINANCE

Section 1. Tax Credit. The Treasurer shall allow a Tax Credit against the County real property tax imposed on real property owned or leased by a Business Entity if the Business Entity qualifies for the Tax Credit under this Ordinance. Section 2. Definitions. In this Ordinance, the following words have the meanings indicated:

(a) Affiliate means a person that directly or indirectly owns at least 80% of a Business Entity or at least 80% of which is owned, directly or indirectly, by a Business Entity (as Affiliate is defined in Maryland Code Annotated, Tax-Property Article § 9-323(f), as from time to time amended).

(b) Assessment means the assessment assigned to the New or Expanded Premises by

the Maryland State Department of Assessments and Taxation.

(c) Board means the Board of County Commissioners of Washington County, Maryland.

(d) Business Entity means a person conducting a trade or business in the State that is

subject to the State individual or corporate income tax or insurance premiums tax (as Business Entity is defined in Maryland Code Annotated, Tax-Property Article § 9-323(f), as from time to time amended).

(e) County means Washington County, Maryland.

(f) Full-Time Position means a position requiring at least 840 hours of an individual’s

time during at least 24 weeks in a 6-month period (as Full-Time Position is defined in Maryland Code Annotated, Tax-Property Article § 9-323(f), as from time to time amended).

(g) New or Expanded Premises means commercial or industrial real property, including a building or part of a building that has not been previously occupied, where a Business Entity or its Affiliates locate to conduct business (as New or Expanded Premises is defined in Maryland Code Annotated, Tax-Property Article § 9-323(f), as from time to time amended).

(h) New Permanent Full-Time Position means a position that is a full-time position of

indefinite duration; located in Washington County; newly created, as a result of the establishment or expansion of a business facility in the County; and filled (as New Permanent Full-Time Position is defined in Maryland Code Annotated, Tax-Property Article § 9-323(f), as from time to time amended). Pursuant to Maryland Code Annotated, Tax-Property Article § 9-323(f), a New Permanent Full-Time Position does not include a position that is (A) created when an employment function is shifted from an existing business facility of the Business Entity or its Affiliates located in Washington County to another business facility of the same Business Entity or its Affiliates, if the position does not represent a net new job in the County; (B) created through a change in ownership of a trade or business; (C) created through a consolidation, merger, or restructuring of a Business Entity or its Affiliates, if the position does not represent a net new job in the County; (D) created when an employment function is contractually shifted from an existing Business Entity or its Affiliates located in the County to another Business Entity or its Affiliates, if the position does not represent a net new job in the County; or (E) filled for a period of less than twelve (12) months.

(i) Notification Date means the date on which a Business Entity provides written

notice to the Board that the Business Entity intends to claim the Tax Credit and when the Business Entity expects to meet the requirements for claiming the Tax Credit as specified in Section 4 of this Ordinance.

(j) Ordinance means this Washington County, Maryland Job Creation and Capital

Investment Real Property Tax Credits Ordinance, as from time to time amended.

(k) State means the State of Maryland.

(l) Tax Credit means the Tax Credit granted under this Ordinance to a qualifying Business Entity against the County real property tax imposed on the New or Expanded Premises.

(m) Treasurer means the County Treasurer or the Treasurer’s designee.

(n) WCDBD means the Washington County Department of Business Development.

Section 3. Qualifications for Tax Credit.

(a) To qualify for the Tax Credit under this Ordinance, before a Business Entity, whether existing or newly located in the County, obtains the New or Expanded Premises or hires employees to fill the New Permanent Full-Time Position(s) at the New or Expanded Premises, the Business Entity must provide written notification to the Board, through the WCDBD, stating:

(1) that the Business Entity intends to claim the Tax Credit; and

(2) when the Business Entity expects to meet the requirements specified for the Tax Credit in Section 4 of this Ordinance.

(b) A Business Entity does not qualify for and, therefore, is ineligible to apply for a

Tax Credit if: (1) the Tax Credit has otherwise been granted on the New or Expanded Premises

under this Ordinance for the taxable year in which the Tax Credit is claimed; or

(2) the Business Entity is a type of business entity that the Board, by resolution

before the Notification Date, has made ineligible for the Tax Credit; or the New Permanent Full-Time Position(s) is a type of position that the Board, by resolution before the Notification Date, has made ineligible for the Tax Credit; or the New or Expanded Premises is located in a geographic area that the Board, by resolution before the Notification Date, has made ineligible for the Tax Credit; or

(3) the Business Entity owes taxes to the County, including, but not limited to,

real property, personal property, income, and recaptured taxes under this Ordinance.

Section 4. Amount and Duration of Tax Credit; Pass-Through to Lessees.

(a) To qualify for the Tax Credit under Section 4(a) of this Ordinance, an existing Business Entity (1) must obtain at least an additional 1,500 sq. ft. of New or Expanded

Premises by purchasing newly constructed premises, constructing new premises, causing new premises to be constructed, or leasing previously unoccupied premises; and (2) must employ at least 1 individual in a New Permanent Full-Time Position during a 12-month period during which the Business Entity also must obtain and occupy the New or Expanded Premises. The Tax Credit to the existing Business Entity shall equal a percentage of the amount of real property tax imposed on the Assessment of the New or Expanded Premises as follows: (i) 52% during the first and second taxable years; (ii) 39% during the third and fourth taxable years; and (iii) 26% during the fifth and sixth taxable years.

(b) To qualify for the Tax Credit under Section 4(b) of this Ordinance, a new Business Entity locating in the County (1) must obtain at least 2,500 sq. ft. of New or Expanded Premises by purchasing newly constructed premises, constructing new premises, causing new premises to be constructed, or leasing previously unoccupied premises; and (2) must employ at least 5 individuals in New Permanent Full-Time Positions during a 24-month period during which the Business Entity also must obtain and occupy the New or Expanded Premises. The Tax Credit to the new Business Entity shall equal a percentage of the amount of real property tax imposed on the Assessment of the New or Expanded Premises as follows: (i) 30% during the first and second taxable years; (ii) 20% during the third and fourth taxable years; (iii) and 10% during the fifth and sixth taxable years.

(c) To qualify for the Tax Credit under Section 4(c) of this Ordinance, an existing Business Entity in the County or a new Business Entity locating in the County (1) must invest at least $10,000,000 in capital improvements to New or Expanded Premises in the County by purchasing newly constructed premises, constructing new premises, causing new premises to be constructed, or leasing previously unoccupied premises; and (2) must, as a result of the capital improvements, create 100 New Permanent Full-Time Positions. The Tax Credit to the new or existing Business Entity shall equal a percentage of the amount of real property tax imposed on the Assessment of the New or Expanded Premises as follows: (i) 100% for each of the first 5 taxable years; (ii) 75% in taxable years 6 through 10; (iii) 50% in taxable years 11 through 15; and (iv) 0% in taxable year 16 and each taxable year thereafter.

(d) In order to receive a Tax Credit as allowed under this Ordinance, the Business Entity, whether existing or newly located in the County, must continue to occupy the New or Expanded Premises and must maintain, as filled, the New Permanent Full-Time Position(s) for the requisite time periods, as applicable and as defined.

(e) The lessor of real property on which the Tax Credit has been granted shall reduce the amount of taxes for which a lessee Business Entity is contractually liable under the lease agreement by the amount of any Tax Credit granted pursuant to this Ordinance for improvements to the real property made by the lessee Business Entity.

(f) For Tax Credits granted under Paragraphs (a) and (b) of Section 4, and for Tax Credits granted under Paragraph (c) of Section 4, after the sixth and sixteenth taxable years, respectively, a Business Entity shall no longer be eligible for the Tax Credit under this Ordinance pursuant to the WCDBD certification granted for the previous years. The Treasurer shall not allow further Tax Credit after said taxable years, unless the Business Entity meets anew all qualification requirements under this Ordinance, applies to the WCDBD for recertification, and is approved by the WCDBD to receive a new Tax Credit for tax years subsequent to the sixth and sixteenth taxable year, as applicable.

(g) If, at any time during which a Business Entity claims the Tax Credit under this

Ordinance, the Business Entity fails to satisfy any applicable qualification requirement, the Business Entity’s eligibility for the Tax Credit under this Ordinance will be extinguished. The Treasurer shall not allow further Tax Credit under the certification. A tax credit, once extinguished, cannot be revived or reinstated.

Section 5. Recapture of Tax Credit.

(a) For each year that a Business Entity receives the Tax Credit under this Ordinance, the Business Entity shall be required to continue to satisfy all applicable requirements under this Ordinance. If, at any time during the Tax Credit period, a Business Entity does not satisfy all applicable requirements under this Ordinance, then the Business Entity shall not receive the Tax Credit for the taxable year during which the failure occurs. The Tax Credit shall be due and owing to the County upon notice from the Treasurer to the Business Entity that the Tax Credit must be repaid.

(b) Interest shall accrue on any repayable Tax Credit at the rate established for overdue property taxes beginning thirty (30) days after the notice from the Treasurer.

(c) Any un-repaid Tax Credit is a lien on real and personal property owned by the

Business Entity in the same manner as unpaid real property taxes under State and County law.

Section 6. Administration of Tax Credit; Time for Application.

(a) When a Business Entity believes that it meets all eligibility requirements for the

Tax Credit under this Ordinance and has complied with the qualification requirement in Section 3(a) by giving notice to the Board, the Business Entity shall request certification from the WCDBD, on an application form provided by the WCDBD, and shall provide sufficient information to show that all qualification requirements under this Ordinance and applicable State law have been met.

(b) Upon receipt of a request from a Business Entity for certification for the Tax Credit, the WCDBD shall:

(1) determine the eligibility of the Business Entity for the Tax Credit according to

the qualification requirements under this Ordinance;

(2) notify the Maryland State Department of Assessments and Taxation and the Treasurer that a Business Entity has been approved for the Tax Credit; and

(3) require submission of reports by the Business Entity for each year that the

Tax Credit is sought, and during any requisite time period after any year when the Tax Credit was provided, to verify that the Business Entity continues to satisfy all applicable qualification requirements under this Ordinance.

(c) As required by this Ordinance, a Business Entity must give notice to the Board

and submit application for certification to the WCDBD by no later than October 31 of the preceding calendar year to ensure that the WCDBD is able to verify the Business Entity’s eligibility and to notify the Maryland State Department of Assessments and Taxation and the Treasurer of the Business Entity’s eligibility for the Tax Credit by no later than December 31 of the calendar year preceding the taxable year beginning on July 1 when the Business Entity is eligible for and intends to claim the Tax Credit.

(d) Under no circumstance will this Ordinance permit bundling of a Tax Credit granted under this Ordinance with any other Tax Credit, either granted under this Ordinance or any other local ordinance, rule, regulation, or code, to result in a tax refund or other payment to a Business Entity.

(e) A person who submits a false or fraudulent certification application to the WCDBD, withholds information to obtain the Tax Credit, or provides any false or fraudulent information to obtain the Tax Credit under this Ordinance, must repay the

County all amounts previously credited for any and all years that Tax Credits were provided and all accrued interest and penalties that would apply to those amounts as overdue taxes. A person who, on behalf of a Business Entity or as an Affiliate, is found to have engaged in any conduct described in this sub-section, is liable for all court costs and expenses of the County in any civil action brought by the County against the person. The County may collect any repayable Tax Credit and otherwise enforce this Ordinance by any appropriate legal action.

(f) The Board may adopt regulations to administer this Ordinance.
