Minutes of Meeting
The Board of Professional Engineers and Professional Land Surveyors held a regular
meeting on August 27, 28, and 29, 2009 at the Hilton Homewood Suites, 7957 Spectrum
Way, Boise, Idaho, to conduct Board business. The meeting convened at 8:00 a.m. on
Thursday, August 27, 2009 with the following Board members present: William J.
Ancell, Gary Young, James H. Milligan, John W. Howe and David Bennion. Also
present was David L. Curtis, Executive Director, Jim Szatkowski, Deputy Director,
Jennifer Rowe, Administrative Assistant and Mike Kane, Board Attorney.
i. Are there any new agenda items?
Mr. Ancell asked the Board to add a general discussion of disciplinary matters to the
agenda.
I. READI�G OF MI�UTES
1. Approval of minutes of the June 11-13, 2009 Board meeting as distributed.
Moved by Mr. Young, seconded by Mr. Milligan to approve the minutes for the June 11-
13, 2009 meeting as amended. Motion passed unanimously.
2. Approval of minutes of the July 31 & August 1, 2009 Board retreat as distributed.
Moved by Mr. Young, seconded by Mr. Howe to approve the July 31 & August 1, 2009
minutes as amended. Motion passed unanimously.
III. U�FI�ISHED BUSI�ESS
3. The subcommittee consisting of Mr. Bennion, Mr. Young, and Mr. Szatkowski
are working with the Board of Architectural Examiners to clarify the definitions
of engineering and architecture. The Board previously approved proposed
legislation on this topic. The AIA Northern Chapter unanimously voted to oppose
this legislation. Members of the subcommittee from the Board of Architectural
Examiners feel they have enough votes to support the proposed legislation. Mr.
Curtis and Mr. Szatkowski met with ACEC-Idaho relating to this subject. The
Board of Architectural Examiners is scheduled to meet on September 18, 2009 to
vote on this subject which will not allow time to submit this for legislation this
year.

Moved by Mr. Young, seconded by Mr. Howe to continue this discussion and authorize
staff to withdraw legislative idea of incidental practice of architecture and engineering in
order to allow sufficient time for the subcommittee to work out details and concerns that
have been expressed by stakeholders. Motion passed unanimously.
5. Mr. Howe and Mr. Young in conjunction with ISPLS to drafted amendments to
surveying laws which the Board edited & approved at the retreat. Mr. Howe and
Mr. Young met with ITD and ISPLS on August 20, 2009 to discuss this topic.
ITD’s policy will be that the surveyor that does the initial documentation will be
retained to complete the full survey. This policy will put ITD more in line with
the upcoming law changes. Mr. Howe gave an update on this subcommittee’s
progress to the ISPLS Board of Governors at their last meeting.
Moved by Mr. Young, seconded by Mr. Howe to continue this matter. Mr. Kane will
meet with Mr. Young and Mr. Howe before the November meeting to discuss his notes
on the surveying law changes. Motion passed unanimously.
6. Review of Proposed Administrative Rules as published in the Administrative
Bulletin. A public hearing was held and a representative of ACEC-Idaho attended
to speak in favor of the changes.
Moved by Mr. Milligan, seconded by Mr. Young to authorize staff to publish proposed
rules as pending rules. Motion passed unanimously.
7. Review of legislation to be submitted to DFM for 2010 Legislative Session.
Moved by Mr. Howe, seconded by Mr. Young to authorize staff to submit the final
version to DFM for preparation as an RS. Motion passed with Mr. Bennion absent.
IV. �EW BUSI�ESS
3. Allen Johnson, P.E. from the Idaho Dept. of Agriculture would like to clarify the
Board’s policy on non-federal employees being given design authority through
NCRS. Federal courts ruled that subcontractors on federal projects are exempt
and federal law preempts state law. This topic will be continued when Mr.
Sampson meets with the Board on Friday.
4. Nestor Fernandez asked the Board whether Storm Water Prevention Plans need to
be stamped?
Moved by Mr. Bennion, seconded by Mr. Young to authorize the creation of a
subcommittee consisting of Mr. Ancell, Mr. Szatkowski, and Mr. Milligan and additional
stakeholders to study this matter and report back to the Board. Motion passed
unanimously.
5. Joe Canning requested clarification from the Board on the QBS process and
whether it is required for federal entities. The Board discussed state law applying

to state projects and the Brooks Act applying to federal projects. 10.01.02.009.05
relating to Selection on the Basis of Qualifications may need to be amended to
allow disciplinary action to apply to individuals in violation of the Brooks Act.
Moved by Mr. Howe, seconded by Mr. Milligan to write to Mr. Canning and notify him
that responding to a federal RFP with a price proposal would not be a violation of the
Board’s Rules of Professional Responsibility as they are currently written. The Board
will research this matter further to see if the Rules need to be amended. Motion passed
unanimously.
Moved by Mr. Milligan, seconded by Mr. Howe to direct Mr. Kane to research the matter
and suggest changes to the Administrative Rules to include the federal RFP issue and
notify Mr. Canning of any action taken. Motion passed unanimously.
Mr. Naylor joined the meeting.
17. Mr. Ancell requested that the Board add a discussion about the procedure for
going into disciplinary action to the agenda. Mr. Ancell questions if we are
missing a step in the process. Should the Board look at these matters in more
detail before a Consent Agreement is negotiated? It seems that the respondent
does not have enough options or does not fully understand that they have the
option of a hearing. Mr. Kane & Mr. Naylor discussed their current processes
relating to Consent Agreements and Hearings. No action was taken.

FY09.06 Petty, Joel, violations of ROPR. An Administrative Hearing has been
scheduled for this matter. Mr. Naylor filed a motion to issue his own
subpoenas for the witnesses. Mr. Kane recommended granting the motion
to allow Mr. Naylor and Mr. Petty’s attorney the ability to issue their own
subpoenas.

Motion filed by Mr. Naylor. Motion passed unanimously.
Mr. Naylor left the meeting. Mr. Russell joined the meeting.
FY09.20 Marks, Colleen, Survey Practices. A preliminary investigation was

IV. �EW BUSI�ESS
6. Kelli Ogborn submitted some questions to the Board on the policy for 3rd time test
takers. Would a master’s degree count as the additional one year of experience?
Could graduate level courses (in the master’s program) count for the 8 semester
credits? The Board concluded that a Master’s degree can only be counted as
experience for the PE or PLS and that experience is not a requirement to take the
FE exam.
Moved by Mr. Milligan, seconded by Mr. Young to authorize the Chair to write to Ms.
Ogborn and inform her that graduate work is only allowed to substitute for experience for
PE or PLS exam, not the FE exam. Graduate courses do not normally address the topics
that are subjects on the FE exam, therefore they are not acceptable for meeting the
requirements of the law. Since experience is not a requirement for assignment to the FE
exam, the Board is not concerned about the additional year of experience referenced in
Idaho Code Section 54-1214, and will consider passage of a year’s time to satisfy this
requirement. This policy also requires 8 semester credits of college level courses related
to the exam. These courses should relate to the deficiencies that can be determined by
evaluating the diagnostic reports from the examinations on which she did not receive a
passing grade. Motion passed unanimously.

7. In Idaho, an applicant that has failed any examination twice will need to meet
additional education and experience requirements before a 3rd assignment is
granted. If an individual takes the exam in another state and passes, will they be
eligible for licensure in Idaho via comity?
Moved by Mr. Milligan, seconded by Mr. Young to authorize the Chair to send a letter to
Ms. Hyde informing her that if a candidate fails the exam twice in Idaho, then passes the
exam in another jurisdiction, he or she would have to obtain an additional year of
experience after the second failure and successfully complete an additional 8 semester
credits of college courses related to the exam in order to have the credentials necessary
for comity licensure. Motion passed unanimously.
9. Gerald Lambert of Lamtronics Engineering asked that the Board consider his
request to use the word “engineering” in his business name.
Moved by Mr. Young, seconded by Mr. Howe to deny the request to use the word
“engineering” in the business name. The Board recommends that Mr. Lambert change
the company name omitting the word engineering. Motion passed unanimously.
13. Apex Manufacturing Solutions asked that the Board consider their request to use
the name Allied Systems Engineering in Idaho. They do not perform engineering
in Idaho.
Moved by Mr. Young, seconded by Mr. Howe to deny the request to use the word
“engineering” in the business name. The Board recommends changing the company
name to omit the word engineering. Motion passed unanimously.

FY09.19a Ruen, Darius, violations of ROPR. A Preliminary Investigation was
completed.

be no apparent violation. The Board now considers this matter closed. Motion passed

Moved by Mr. Howe, seconded by Mr. Milligan to authorize staff to initiate the rule
making processes to exempt 005.04 in cases where the licensee is employed as an expert
witness and require compliance with the Idaho Rules of Civil Procedure instead. Staff
directed to initiate the rule making process to require timely response to requests for
information from the Board. Motion passed unanimously.

FY09.21 Engleson, Tom, Possible Unlicensed Practice. During the course of
investigating another matter, it came to light that Mr. Engleson did
engineering work for the Sourdough Point Owners Association and he is
not licensed in Idaho. A Preliminary Investigation was completed. The
Board authorized staff to negotiate a Stipulation and Consent Agreement
regarding Greta Gilman, P.E.’s work.

Moved by Mr. Young, seconded by Mr. Milligan to authorize the chair to sign a letter
thanking the respondent for the additional information The Board concluded that the
matter does not rise to a level that warrants final formal action, but the Board is
concerned over the apparent business practice of allowing a draft report of this type under
signature of a person not licensed in Idaho. In this case, the document was construed to
be a final work product by the client. The Board suggests that the respondent familiarize
themselves with 54-1215(3)(b) relative to this issue. Motion passed unanimously with
Mr. Bennion recused.
FY09.26 Bastian, J. Paul, Engineering Practices. Southeast District Health
Department asked the Board to conduct an inquiry into the unsealed soils
report of Mr. Bastian. A preliminary investigation was completed in this
matter.

the Southeast District Health Dept. thanking them for bringing the matter to the Board’s
attention and commending them for clarifying their procedures. After investigating the
matter, the Board concluded that inasmuch as the issue has been resolved through SDHD
and Mr. Bastian’s submittal of an acceptable report, it does not rise to a level requiring
formal disciplinary action. Motion passed unanimously.

IV. �EW BUSI�ESS
3. Allen Johnson, P.E. of the Idaho Dept. of Agriculture would like to clarify the
Board’s policy on non-federal employees being given design authority through
NCRS. Rob Sampson joined the meeting to clarify the NRCS policy and how it
works with engineers in the State of Idaho and non-federal employees. Mr.
Sampson stated that if NRCS has no interest in the project, the individual working
on the project would need to find supervision elsewhere, thus using the state
procedure for employees and subcontractors. Mr. Sampson explained the level of
oversight he provides for his federal projects as well as the approval levels on
NRCS projects.
Moved by Mr. Bennion, seconded by Mr. Young to send a letter to Mr. Johnson
indicating that there is no design authority from NRCS that can be conferred to non-
federal employees doing design work on non-NRCS projects. The Board directed Mr.

Kane to research the legality of delegation of design authority to non-federal employees
on projects funded by federal, state, and private funds. Motion passed unanimously.

FY08.23b: Bessaw, John W., P.E., violations of statutes and Rules of
Professional Responsibility
FY08.23c: Washington Group International, violations of statutes and Rules of
Professional Responsibility. An ORDER extending the time until
6 months after the end of litigation has been signed.
2. Mr. Patchin expressed his appreciation for the Board’s assistance in obtaining a
license.
3. Mr. Yeoman complied with the findings of the CPD audit.

4. ITD recently listed a position for a Transportation Technician Principal on the
state job board. The position looked as though it would require a PE. After
speaking with ITD, they agreed to change the position description.

III. U�FI�ISHED BUSI�ESS
1. Review Strategic Plan Objectives.
Moved by Mr. Bennion, seconded by Mr. Howe to accept the Strategic Plan as provided.
Motion passed unanimously.
2. ISPE sent comments on the Discussion Paper on Board Compensation and
Desirable Non-Statutory Criteria for Board Member Nomination.
Moved by Mr. Bennion, seconded by Mr. Milligan to continue this item to the November
agenda for discussion on any updates. Motion passed unanimously.
4. John Howe received a question from Mr. Thompson about the CPD equivalent for
the CFed program. Feedback has not been received from OIT.
Moved by Mr. Howe, seconded by Mr. Bennion to direct staff to contact OIT and find out what
the course descriptions are and how many credits are offered for the program. Motion passed
unanimously.
8. Carl Porter wants to register to take courses at TVCC in the fall. He requested
that the Board review the courses and decide if they are acceptable.
Moved by Mr. Young, seconded by Mr. Milligan to notify Mr. Porter that the course
description he provided does not match general education courses in ISU program,
therefore the course is not acceptable. Mr. Porter is directed to review the FINAL
ORDER in this matter to find proper courses. Motion passed unanimously.
IV. �EW BUSI�ESS
1. Reports by Board Members and Staff of activities since the June Board meeting.
All Board Members, Mr. Curtis and Mr. Szatkowski attended the Board Retreat in
Riggins July 31 & August 1, 2009 and the NCEES Annual Meeting in Louisville,
KY. In addition, Mr. Young attended an Engineers/Architects subcommittee
meeting on July 28, 2009 and met with ITD and ISPLS relating to surveying law
changes. Mr. Bennion was appointed to the UP&LG committee at the NCEES
Annual Meeting; attended the Engineers/Architects subcommittee meeting, a
follow-up meeting with ACEC-Idaho and attended PNWER in Boise. Mr.

Milligan attended a Civil PE exam committee meeting, July 16-18, 2009 in
Clemson and attended PNWER in Boise July 13-15, 2009. At the NCEES Annual
Meeting he was appointed to the EPE committee as Vice Chair, and appointed to
the Engineering Education Task Force. Mr. Ancell attended PNWER in Boise.
Mr. Howe met with ISPLS and ITD regarding surveying law changes and
attended the ISPLS Board of Governors meeting in Sandpoint on August 22,
2009. At the NCEES Annual Meeting, he was reappointed to the EPS committee.
Mr. Curtis attended PNWER in Boise; met with the Water and Wastewater
Professional Licensure Board; held a public hearing for Administrative Rules and
made a presentation at Idaho State University to the faculty pertaining to
continuing professional development. Mr. Szatkowski attended the public hearing
on Administrative Rules; met with the Engineers/Architects subcommittee and
attended an ACEC-Idaho meeting. He was also reappointed to the Law
Enforcement committee at the NCEES Annual Meeting.
2. Staff presented an Expense Reimbursement Summary for the Executive Director
from May 23, 2009 to August 15, 2009 for the Board’s review.
Moved by Mr. Milligan, seconded by Mr. Bennion to approve expense reimbursement as
presented. Motion passed unanimously.
8. Jared Davis was assigned to take the exam in October 2008 but his exam date was
postponed. He wants to take the exam this October however, he does not feel that
he should be responsible for paying the additional fee that is required for the
exam.
Moved by Mr. Young, seconded by Mr. Milligan to deny waiver of fee increase. Motion
passed unanimously.
10. Mr. Howe and Mr. Curtis are invited to attend the APEGBC Annual General
Meeting October 15-17, 2009.
Moved by Mr. Milligan, seconded by Mr. Bennion to approve attendance of Mr. Ancell
(alternatively Mr. Young) and Mr. Curtis for the APEGBC Annual General Meeting.
Motion passed unanimously.
11. Josef Silny & Associates provided the Board with information about their foreign
credential evaluation services. The company would like the Board to consider
accepting their evaluations. In the past, Silny did not provide an EAC/ABET
credential evaluation but it seems that has been added to their product.

third time without having met the requirements.

16. Darrin Youngstrom requested that the Board reassign him to a third attempt at the
PE exam. He previously worked with Bill Ancell to get approval to be assigned
for a third time to the exam. The assignment was granted and he was assigned to
the April 2007 exam but did not appear for health reasons. Since that time, his
application was terminated due to lack of communication with the office. Mr.
Youngstrom requests that the Board allow him to be reassigned under his old
application instead of completing a new one which would make it necessary for
him to meet the new requirements of 54-1214 as it relates to third time test takers.
