Re: BY-LAWS of LOCAL 746, KIMGSBURG. CALIFORNIA

We have examined the proposed By-Lews of Local 746, Kingsburg, California, and find them legal and in compliance with the International Con-stitution in all hut the following respects:

On page 1 in the Seventh Principle there is reference to these laws being a "Constitution and By-lews". Since only the International Union mey have a Constitution this reference should be changed to read merely "By-laws".

The qualifications for membership in Article I I , Section 1 should also provide that the applicant for membership must be 18 years of age or over. This same seotion refers to "man", singularly, and "women", plural. The two nouns should be made to colaoide in number.

Section 6 of Article I I referring to "organization inimical to the teachings and beliefs of the American Federation of Labor" does not convey the rule of Article I I , Section 3 (a) of the International Constitution as was intended. The Constitution bars Mabsrs of the Coanuniat P*rty and other subversive organization. Therefore we reconcend that the Local

substitute the following phrase in all three sentences of Section 8 :

nNo member of the Communist Party or other subversive organization".

According to Article XXI, Section 1 of the International Constitution, nominations of officers must take piece in November or December and election at the next meeting thereafter. Therefore, the provision for nominations and elections in June in Article IV , Section 1 and in Artiole V, Section 2 should be changed to read either November or Deoember, end the terms of offioe in Article V, Section 1 should be changed to run from such month, other than July, as will not be incon-sistent with a November or December election.

The qualification for eligibility for office in Artiole IV , Section 2 (a) requiring a member to be a resident of certain counties is in excess of those in Article I I , Section 4 of the International Constitution and should be deleted.

Section 2 (b) of Article IV should be more explicit in providing that the candidate shall have been in good stending 2 years prlpr to nomination. The pro-vision in this section concerning when dues roust be paid in order for a member to be in gooa standing is contrary to Article X , Section 6 (o) of the International Consti-tution which provides dues must be paid on or before the 1st of the current month in advance. Therefore, this provision should be changed to provide dues must be paid on or before the first of each month. Similarly Artiole X I , Section 1 must be chenged to so provide.

In the duties of the Secretary-Treasurer, Article Y I I , Section 5 (D) and (q) provision is made for quarterly audita. To be in compliance with Artiole X H I ,

Section 1 (p) and (q) these should be changed to monthly-audits.

Article X I , Section 3 is confusing, A mem-ber must always pay dues whether he has worked in a cer-tain month or not. Therefore, this section should be deleted.

Due to the ban on secondary boycotts and union unfair practices in the Taft-Hartley Act, the pro-visions in Article X I I I , Sections 1 and 3 are dangerous. We recommend thet Section 3 be deleted and the last olause in Section 1 be changed to read:

"Members should strive to sup-port businesses fair to labor by pur-chasing Union made goods and patronizing union houses whenever possible."

No mention of a penalty should be made.

Reference is made to "this Constitution" in Article XV, Section 1 (a) and ( c ) . These references should be changed to "these By-laws".

Section 17 under Rules of Order should be changed to quote the whole of Section 17 of Article XXIII of the International Constitution.

This is a letter asking for an amendment to our Constitution and By-Laws for local § 7 4 6 to wit :

Page 11 of Constitution, Article XI entitled:INITIATION FEES AND DUES

also ARREARAGES:

Section 1 to be Amended to read: "The initiation fee of this Union shall

be seven dollars and f i f ty cents ( $ 7 . 5 0 ) to accompany all applica-

t i o n s . The dues of this Union shall be three dollars and f i fty

cents ( $ 3 . 5 0 ) per month. Members on check off system shall be considered in good standing. Members paying cash shall stand delinquent after the 15th . of each month and will not be in good standing.

Page 16 , to be changed to include ARTICLE XX, INSURANCE ** DEATH AND

DISABILITY INSURANCE

The Union shall enter into a contract with a duly accredited

and licensed l i fe insurance corporation, licensed to do business

in the State of California , said contract to cover the membership

of the Union for l i fe insurance, death and disabil ity , double

indemnity, et cetera. In any event, the coverage shall be in the

sum of not less than one thousand dollars($1000) to each and every

member in good standing. Any and all moneys created and presently

in existence for benefit purposes shall , upon the passage of this

insurance plan, immediately revert to the general fund of the Union

Dear Sir and Brother!

We are in receipt of your letter of July 10, 1951, asking for the approval of an amendment to your by-laws, having to do with the initiation fee and monthly dues and insurance.

I refer you to my letter to President Robert Levin dated June 11 , 1948, in vhich I returned, approved, copy of your proposed by-laws, subject to certain corrections which were listed.

At this writing we have not received copies of the printed booklet of your by-laws. Since this approval was given to you a little over three years ago it is difficult to believe you have not had these made up for distribution to your membership. You will note we requested three (3) copies of the same in the last paragraph of our letter of June 11 , 1948.

We do not like to approve amendments to by-laws when we do not hold a copy of the entire set of by-laws and ask that you send us the desired three copies at onca, at which time we will give your amendment of July 10th immediate attention.

You will find a detailed copy of our by-laws enclosed in the large envelope. We trust this will meet with your approval. The group life insurance plan has been an issue with our local for about three years and a permanent set of booklets containing our by-laws has not been printed for our membership.

A very satisfactory group insurance plan has been put

into effect for our membership ana we feel now we have a more

or less permanen^of by-laws to publish in booklet form that

is of a more satisfactory use. These booklets will be printed

as per the approved Amendments proposed in the letter dated:

July 10, 1951.

We are sorry that this insurance problem has taken so

much time for settlement. WB appreciate your prompt action

upon our proposed amendments.

1 . In Article I I , Section 1 , add the following:

"No member of the Communist party or other subversive organization, nor any person who subscribes to their doctrines, shall be allowed to hold membership or be admitted to membership in tne local union as set out in article I I , Section 3(a) of the International

3 . In Article / I I . Section 5 ( a ) , Line 2 , delete tne words "'a suitable surety bona and substitute t e following:

(1) Article I I , Section 1 , add the following:

(5) Copies of all bonds must be sent to the office of the General Secretary-Treasurer.

(6) Article XI - Delete the sentence: "Members on check off system ahall be considered in good standing".

As when you pay on an insurance policy it is your sole responsibility to see that your premium does not go delinquent the same is true of dues. I t i3 the member's responsibility and no one else.

I f an employer sends in the check off after the first of the month such members as are listed thereon are NOT IN GOOD STANDING and must start their good standing all over again the following month.

Advise such of your members who desire to be in continuous good standing to get an extra month's dues into the office as no nan or woman Is eligible to run for any office within the gift of the Local Union or the International Union who has not had his or her dues paid before the first of the current month, in advance, for a consecutive period of two years prior to nomination.

(7) Delete Section 8 of Article >'IV.

(8) Article XIX: add the following -

"A copy of the amendment shall be forwarded to the General Office for approval. I t shell become effective immediately upon rcceipt of that approval".

(8) Under Rules of Order, Section 11 , line 2 , delete tte word "Constitution".

When these by-laws have beer, made up in printed booklet form please send three copies to this office for our files and future reference.

I also requ®«t that you include at the end of your by-laws the name of the International official approving these and date of said approval.

W e , the members of the Cannery Workers 1"<hhI

Processors, Drivers and Helpers Union No. 710 of

Kingshurg, California, in order to form a more perfect

organization, provide for the Mutual defenses and

promote our general welfare, have determined that

the following principles and objectives shall guide us.

First: Whatever right belongs to one member shall

belong to all members alike us long a* they remain in

good standing in the Union, anil wherever words de-

noting the masculine gender are used herein, vi 'h

words shall also be deemed and construed to include

the feminine gender.

Second: The right of each member to re<-eive fair

and (ust remuneration for his labor and to gain suffi-

cient leisure for mental cultivation and physical ri-ere-

ation.

Third: The right to be treated in a decent and

respectable manner by our employers, and at the s*ine

time conscious of the corresponding duties to them.

Fourth: T o try by all just means to promote har-mony in the performance of our duties.

Fifth: T o regulate our conduct as .1 Union and as

individuals so as to make our occupation what it has

a right to be—an honest ami honorable means of earn-

ing a decent and respe<table living

_ Sixth: T o assist other American Federation of Labor Unions whenever possible in the attainment of their just demands.

Section 5. ARTICLE III

Oificers and Committees

Section 1. The Elective Offiecrs of this Union shall

consist of a President, a Vice President, a Recording

Secretin, a Secretary-Treasurer and three Trustees.

Section 2. The Elective Officers shall constitute the

Executive Board of the Union.

Section i. There shall also he elected one Business

Agent.

Section 4. Delegates to all labor bodies must be elected.

Section 5. There shall be appointed b> the Presi-dent at the commencement of each term of office as apjviintcd officers, a Warden and Conductor, a Social Committee and such other committee* as he deems

necessary.

Section 6. All (Miners, Representatives, and Com-mittee members shall receive such compensation as is fix«i at the commencement of their term of office.

ARTICLE IV

Nominations Sett ion 1. Nominations for elective officers shall be

opened ou the first regular meeting in June and close

at the same meeting.

Settion 2. (a) No member of tliis Union shall be

eligible to hold office unless he i> an Amcric*a Citizen.

Section 2. ( b ) No im-ml<rr shall be eligible for < lection to any office in this Union who has not lieen in continuum good standing in this I'nion as m< mb» r tor two years prior to nomination. Dues must be paid on <>r before the First of each month to be considered ,n good standing.

ARTICLE V Elections

Section 1. All elective officers of this Union shall serve for terms of two years, from the first regular meeting in July or until their successors are duly elected and installed excepting Trustees; and Trustees elected at the first election thereafter shall serve terms as follows: one for three years, one for two years and one for one year, and Trustees elected at subsequent elections thereafter shall serve a term of three years unless elected to fill the unexpired term of a vacant office. No member shall hold more than one elective office.

Section 2. The elective officers and Business Agent of this Union shall be elected on the first Tuesday of June after nominations.

Section 3. An election Board consisting of three members appointed by president.

Section 4. At any time there is only one nominee for any office, the Chairman of the Local in meeting assembled sliall instruct the Secretary to cast one ballot for the nominee and declare elected.

Section 5. If any vacancy occurs the vacancy shall be filled by the Executive Board.

Section 6. The Election shall be governed by the Australian Ballot system, as follows: The names of candidates for each office will IK- listed in alphabetical order upon the ballot; lxioths shall be s<-t up in the polling place, partitioned .uid curtained so as to insure privacy for the voter while marking his ballot.

Section 7. Booths, l>allot l*>x, and the members of the Election Committee shall be in an enclosure. No other members of the Union and no strangers shall be allowed in such enclosures, unless the member is actu-ally engaged in casting his ballot; e*< epting that

Section H. The voter shall be issued a ballot by the Election Committee and mark the same in the booth fold the ballot so as not to expose any of the printed matter or marks and return the same to the Election Committee who shall deposit the ballot in the ballot box. The voter shall register his own name In a l>onk kept for that purpose, lie shall present his dues book which shall be stamped "voted." No ballot shall be accepted unless stamped with the official rubber stamp marked ( X ).

Section 9. The Recording Secretan shall furnish the Election Committee with .1 roster of the membership that they mav check off the voters so as to prevent any member from voting twice.

Section 10. Any member of the Flection Commit-tee, who shall tamper with the ballot box or make fraudulent returns, or any manner defeat the aims or integrity of the ballot shall he expelled.

Section 11. The proper stamped membership book

will he the only credential which entities a member

to vote.

ARTICLE VI

Installation

Section 1. The officers ol this Union shall he in-

stalled in their office at the lirst rcptlar meeting after

election.

Businets Agent Section 2. It shall be the duty of the Business Ag"n!

to devote all his time as may be ncccssary in looking after the interest and welfare of the Union. He shall negotiate with the employer in a gentlemanh and conservative manner and endeavor to iudme all men working under the jurisdiction of tins Union and not members of the organization to join the Union. The Business Agent wdl !*• empowered to appoint col-lectors as needed. He shall recommend lo the Execu-tive Board and President the names of members in Hood standing and who can qualit) under the By-Laws of the Union for appointment as Vvsistant Busi-ness Agents when necessary. Such recommendation when approved by the Executive Hoard shall be re-ferred to the President for appointment, an 1 then presented to the membership for final :ipi>ro\ tl. The Business Aaent and Assistant Ag» tits shall renort in full at all regular meetings on the prowess and work-inns of the Union and shall receive instructions on all business transactions requiring attention. and working rules and that any agreement between this Union and the employers is carried out and report all violations at the first meeting. They shall see that members keep themselves in good standing and shall be empowered by the Union to collect and receipt the money, whieh they must turn over to the Secretary Treasurer within forty-eight (48) hours; they shall attend all meetings of this Union and other Lal>or Bodies as directed by the Executive Board, or the President may assign them. Every Business Agent or Assistant Business Agents shall furnish a satisfactory Bond, the amount to lie determined by the Executive Board, as security of the funds anil property of the Union in his charge, the premium 011 such bond to IK- paid by the Union, and a copy of said Ixind must be filed with the General Secretary Treasurer.

Vice President

Section 3. The Vice President shall assist in pre-serving order and in the absence of the President, preside at the meetings of the Union and the meetings of the Executive Board. The Vice-l'r<-sident shall assist the Conductor and see that no one enters the meeting without giving the password. Me shall he the keener of the password and shall disclose it only to members in good standing.

Recording Secretary

Section 4. The Recording S»-crctary shall attend to all correspondence. The Kivording Secretary shall keep a full, correct and impartial account of all meet-ings of the Union. He shall see that all applications are propcrlv filled out and notify candidates when they are elected for membership. He shall act as Secretary of the Executive Board and shall draw and sign together with tin- Trustees, all orders on the Secretary-Treasurer when proper Iv ordered by the Union and shall have charge of the seal. He shall

perform such other duties as the Union may from

time to time assign to him and at the expiration of

his term of office turn over every thing belonging to

the Union, in his possession to the Union.

Srcrctary-Trcasiircr

Section 5. ( a ) The Secretary-Treasurer, immediate-

ly upon taking the office of Secretary-Treasurer, shall

procure a suitable surety Bond, and a copy of the

same must bo filled in the General Office at Indian-

apolis.

( h ) The Sec retary-Treasurer shall deposit all

money of this Local in a reliable Bank designated by

the Trustees in the name of this Local at least twice

a month or oftener.

(e ) The Secretary-Treasurer must pav all bills by

check, countersigned by the proper officials of the

local Union.

( d ) The Secretary-Treasurer must balance bis day

book and cash book monthly, showing the exact bal-

ance on hand with the Local Union on the first dav

of the coming mouth, and have their bank book

balanced on the last day of the month or get a bank

statement from the bank on the last day of the month,

showing the exact amount of monev in the Bank, so

that the Trustees of the organization may verify the

bank statement and the books of the Local at any

time.

( e ) The Secretary-Treasurer must keep the Inter-

national bookkeeping system, consisting of a day

book, ledge r and cash book.

( f ) The Secretary-Treasurer must keep the voucher

properly sign' <1 by the President and Hccorduig Sec-

retary for all bills that are ordered paid by the Local

Union.

( g ) The Secrrtary-Treasurer must kc«p the appli-

cations of all new members initiated hied monthly.

(k ) The Secretary-Treasurer shall report to the General Secretary-Treasurer on the first day of each month, the number of men tliat are In-ing carried on the hooks oi the Local Union as good standing members, and all new members who have In'cn initiated during the previous month and all members who have paid up their hack dues and again become in good standing. This report must be made on the monthly report blank that is issued by the General Secretary-Treasurer.

(1) The Secretary-Treasurer must pay to the Cen-

eral Secretary-Treasurer thirty ( 10 ' cents out of

every due collected by the Local Union.

(ni) The Secretary-Treasurer must report the

Muifi and addrewes of all new members coming into

the Local Union to the General Office.

( n) The Secretary-Treasurer shall s.-nd to the Gen-

eral Secretary-Treasurer a revised list quarterly of the

names ami addresses of all nirinUfs in good stand-

ins in the Local Union

(s) The Secretary-Treasurer shall keep correct ac-counts between each member of the Union. He shall issue all due Ixioks and withdrawal saxiL. lie shall make a monthly report of the number of members initiated, reinstated, suspended or expelled, and the number of members in good standing and read this report at the regular inn-ting of tin- Union for ap-proval. He shall also render a report of the financial condition of the Union at least one, a month at the regular meetings of the Union. dent and that all bills allowed liv this Union an paid by chocks. The Trustees shall be elected lor terms ol three ( 3 ) years, the second highest two (2 ) yeur* and the lowest one (1 ) year. They shall act as ail auditing committee and shall examine the bills at each meeting and shall verify the deposits and checks made by the Secretary-Treasurer. The control of the-rmal property shall be vested in the Trustees. Tin-Trustees shall IK- empowered to call a special meet-ing, if they deem it necessary to protect the property of the Union. They shall sec that the Recording Sec-retary. Business Agent, Sec retary -Treasurer and As-sistant Business Agents give bond in a surety com-pany, the premium in each instance shall be paid by the Union. It is the duty of the Trustees to send a copy of their monthly audit to the General Secre-tary -Treasurer's office.

Executive Board

Section 7. (a) Between regular meetings of the Union, the executive Board sliall attend to all matters referred to it by the Union and shall be empowered to act for the Union in all matters requiring decision before the next regular meeting of tlx- members of the Union. It shall suggest remedies for immediate and permanent benefits and shall make a report at all me»-tings. It has the right to authorize the Presi-dent to call a special meeting of the Union.

(b ) The Executive Hoard shall act as an Appeal Committee on grievance.

(c) Tile Executive Hoard shall consider the quali-fications of all candidates for admit*.on ami shall re-port to the Union a* to tlx- applicant's fitness to be-come a m> ml* r. Their report shall not lie final, Init si tall be subject to actum of tlu- Uniuo.

Section 1. ( a ) The Social Committee shall have charge of all entertainment.

ARTICLE X

Withdrawals

Section 1 An honorable withdrawal will In- issued to any member of this Union who temporarily or per-manently leaves the trade jurisdiction of this Local. In order to receive a withdrawal, the applicant must be in gi>od standing with this Union and must have a current month's dues stamp in his membership book.

Section 2. Any member of this I'nion going to work at another trade must take out an honorable with-drawal and cannot remain a momlvr of this Union.

Section X Upon withdrawal from this Union the member shall be issued a withdraw al card.

Section 1. This card entitles him to readmission to the Local Union from which this card was issued at any time.

Section 5. Any member of the International Union leaving our employment or going to work at another craft or occupation, must l>e given an honorable with-drawal card and cannot remain a member of the International Union, but before a withdrawal card is issued tlu' iudu idual must comply with all rules and laws of the Local and International Uniun.

ARTICLE XI

Initiation Fees, Dues and Arrearages Section 1. The initiation fee of this Union shall l><-

seven dollars and fifty cents <$7.50) fee to accoin uuuy all applications. The dues oi this Union shall not be more than three dollars and fifty cents ($3.50) pel month. Members paying cash shall stand delinquent after the 1st of each month, and will not be in good standing.

Section 2. Members owing three ( 3 ) months dues shall stand suspended and may be reinstated only with the consent of the Executive Board. A reinstate-ment fee equivalent to three ( 3 ) months back dues for the current month together w ith $5.00. Suspended members who arc reinstated shall l>e in the status ol a probationary' member for six ( 6 1 months and shall not IK- allowed voting rights until the expiration of their probationary period.

ARTICLE X I I

Salaries Section 1. The salaries of Officers and Business

Agents shall be fixiil by the Executive Board, subj«vt to ratification by the memliership at the next regular meeting.

Section 2. Any Union member > ill.xl from his work on Union business shall be paid h s regular cannery rate by the Union.

ARTICLE XI I I

Duties of Members Section 1. The first duty of each member is to In-

ami Helpers, and to the objects of the American Fed-eration of l.alxir. "The members should strive to sup-port businesses fair to labor by purchasing Union made goods and patronizing union houses whenever possible."

Section 2. Every member must conform to and abide by rules concerning hours, wages, etc., as agreed upon by the Union. Any member found guilt) by the Executive Board of entering into a private or personal contract with his employer as to wages, hours, or conditions, for less than the minimum wages agreed to by the Union in its contract with the employer, shall be tried by the Executive Iioard.

Section 3. No member of this Union shall be per-

mitted to retain active membership in any other labor

organization.

Section 4. No members of this Union shall be per-mitted to perform work coming under the jurisdiction of another organization.

Section 5. Members of this Union shall ni>t take it upon themselves to inform the employer regarding the shortcomings and deficiencies of their fellow em-ployees. Members of the Union taking upon them-selves the duty of "stool pigeon," ' house detective," or general informer to the emplover, shall upon charges being placed and sustained In the Executive Board, be expelled from the Union, and denied fur-ther working privileges.

ARTICLE X IV

Fines and Assessments

Section 1. Any m< mber who retuses to show his dues book to the Business Agent or other authorized officer shall be fined ten ($10.(HI dollars for each offense. Due* Ixmks stamped pan! for the current month shall constitute the working card of this Local

Any member who, during a meeting, shall disregard the authority of the president, or per-sist in using improper language, or conducting him-self in a disorderly manner or entering the inciting under the influence of liquor or drugs, shall lie ordered from the hall, and if lie refuses to h ave, shall be forcibly ejected by the Warden and fined five ( $=5.00) dollars.

Section 4. All fines, assessments or other indebted-

ness must be paid before monthly dues are accepted

from any member.

Section 5. The following fee sluill lie charged by

Section 6. There skill lie a fine of one ($1.00) dollar levied against any elective officer who fails to attend an> regular meeting of this Union unless a valid reason for not attending is given previous to the meeting.

ARTICLE XV

Fair Trial

Charges may bo brought or filed against any mem-ber of this Union in accordance with the prm isions of the International Constitution, Article IS. Trials and Appeals.

Section 1. (a) A member or officer of this Union, charged with any offense constituting a violation ol these By-Laws shall, unless otherwise provided in these By-Laws, be tried by the Executive Bn.ud. If the member proposine the charge is a member of such Board, then the President o! the Local shall ap-point a disinterested member as a substitute.

( b ) Whenever charges arc preferred against any member or officer of this Union, tin charges shall be filed in writing in duplicate with the S< cretary of this Union. Joint Council or Cl< ucral Executive Board which is to try the case. No member or officer of this Local shall lie tried unless he or she shall be served by the Secretary personally or by registered mail, with a written copy of such charges specifying the nature of the offense of which he or sh" is accused. There-upon. the accused shall be required to «tand trial at the time and place designated, which shall not be less than ten (10 ) days from the date the charges art* served upon the accused. The accused may appear in person and with witnesses, to answer the charges preferred against him or her. He may select a mem-ber of this Local to represent him in the presentation of his offense.

(c) If the charges, or any portion thereof, are sus-tained. then the trial liody shall rend, r iudgment and impose disciplinary- action as provided for in these Rv-Laws. If the charges are not sustained, the same shall be dismiss- d and the accuu-d t -stored to full rights or membership or office in this Union.

(<1) Upon tiling of such charges. and if the same are of such magnitude and seriousness as to jeopardize the interest nt this Local, then and in the event the General President, if the matter is brought to lus attention, s.iv, if he deems it advisable, immediately suspend such member or officer from membership or office in this Union until a decision has been rendered in the case.

Section 2. Whi n a majority of the Executive Board lias come to a decision in the ease, it shall be final, unless an appeal is taken ns provided by the Con-stitution of the International Brotherhood of Team-sters, Chauffeurs, Warehousemen and Helpers.

Section .1. If charges are preferred against mem-bers or office rs of this I'nion and such charges are not sustained and the trial body is convinced that the same were not brought in good faith or were actuated by malice the trial body or the appellate body may impose such penaltv by the way of punishment as in its judgment is deemed proper under the circum-stances.

Section 4. Any mcml>cr under charges must bo con-sidered innocent until found guilty, lie can sit in the meeting and may remain until convicted of the charges.

Section 5. Any officer who is a parts to or directly interested in any trial shall not lie allowed to act as member of the Executive Board at any stage of the trial proceedings.

Section 6. Any olhccr or member of this Union who is found guilty of fraudulently or illegally using or detaining any propeit) eif this Union shall )><• dealt with according to the Laws of the State of California, in addition to such proceedings .is the Union may-take against him.

ARTICLE XVI

Strikes and Lockouts Section 1. In the event of a disagreement hotwith

memlvrs of the Union and an employer, which is not adjusted by the appropriate Grievance Committee or the Executive Board, the grievance must be presented at a meeting of this Union, and a special Committee shall be appointed by the President to confer with said employer for the purpose of secunni?, if possible, an amicable settlement and report its actions to the next special or regular meeting. Should the Special Committee fail to adjust the grievance, the Union shall, at a meeting, order a secret ballot to be taken, and it shall require a two-thirds majority of all mem-bers of the Union present to adopt .1 motion to strike. The ballots taken must be "Yes' or "No " written on paper ballots. If the motion to strike is adopted, the Union shall immediately notify the Joint Council and await approval of the General E\c> utive Board as provided in the Constitution of the International Brotherhood of Teamsters, Chauffeurs, Warehouse-men and Helpers.

Section 2. (a) The clerk shall have charge of all payrolls, which shall be in duplicate, receive signa-tures of members entitled to mone\. prepare and add up all payrolls and sign same before submitting them, fie shall also transact all strike business in regard to finances with the officials of the \mcrican F<dera-tion of Labor in conjunct ion with the President of this Union and prepare a weekh itement of all strike receipts ana disbursements ami submit the same to this Union. He shall have access to all receipts and vouchers in the possession of the receiver, for the purpose of making his reports.

( h ) The paymaster shall pa\ all strike benefits, tak-ing from the clerk a receipt for all amounts expended,

Section 3. No menilx-r of 11 local Union on strike shall be entitled to weekly benefits unless he reports daily to the Recording Secretary of this Union, who shall keep a proper form provided for this purpose, while the strike continues, and no mcmb< r who shall receive a week's work, three (3 ) days to lw a week, shall receive benefits nor !*• entitled to any benefits.

ARTICLE XVI I

Jurisdiction and Autonomy

Section !. The jurisdiction of the Cannery, Work-ers, Food Processors. Driver and Helpers Union. Local No. 710. of Kingsburg processing plants, storehouse's, warehouses, labeling rooms, lots or sheds adjacent thereto, where commodities or materials are processed or stored.

ARTICLE XVI I I

Meetings

Section 1. The regular membership m e ting of ties Union shall IK- held on the fir-t Tuesday of each month and meeting will start at S:00 p.m. o'clock.

Section 2. A quorum shall consist of at least seven ( 7 ) members for any regular or S|H-cial meeting for the transaction of business.

Section 3. Special meeting shall lie called at the

written request of twenty (20) members in good

standing.

Section 4. Unless a quorum is present, no business

shall be transacted.

Section 5. No business other than specified m the not lee oi said meeting shall be transacted at a special meeting.

Section 6. Visitors shall only be admitted to meet-

ARTICLE X IX Death and Disability Insurance

The Union shall cuter into a contract with u duly accredited and licensed life insurance corporation licensed to do business in the State of California, said contract to cover the membership of the Union lor life insurance, death and disal>ilit>. double indemnity, ct cetera. In any event, the coverage shall Ik- in a sum of not less than one thousand dollars ($ 1,000) to each and every member in good standing. A m ami all death benefits now in force and effi et shall he deemed terminated upon the passage of this insur-ance plan. Any and all monies creat -d and presently in existence for benefit purposes shall, upon the pas-sage of this insurance plan, immediately revert to the general fund of the Union.

ARTICLE X X

Amendments

Section 1. All amendments tn the*-- Hy-Laws must be in writing signed by twenty-five (21 1 members in good standing and read at three regular meetings, after the first meeting they must be pl.iced on the blackboard until final action, which shall be taken at the third meeting. A two-thirds majority vote of the members at the meeting shall he n>purcd to adopt an amendment. ting it to a votr. he shall ask: "Is the Union ready for the question?" Should no member rise to speak and this Union indicates its readiness, he shall rise to put the question. After he has ris< n no member shall be permitted to speak upon it.

Section 2. When the decision of the President is appealed from, he shall state his decision and the reasons therefore, from the chair. The party appeal-ing shall then briefly state the reasons for the appeal after which, without further debate, the question shall bo nut thus: "Shall the decision of the Chair stand as the judgment of this Union?"

Section 3. Every member, while speaking, shall ad-here to the question under debate, avoid all person-ality and indecoms language, as Well as any reflexion on the Union or any member thereof.

Section 4. Any member, while speaking. Iieing called to order by another, at the request of the Chair, shall cease speaking and be seated until the question of order is determined

Section 5. N'o memlwr shall speak more than once ou Uie question until all the tncmlH-rs wishing to speak have had an opportunity to do so, more titan twice without the permission of the Chair, nor more than ten minutes at one time.

nite time, seventh, to refer; eighth, to amend. The first four shall lie derided without debate.

Section 9. The motion to close debate may be made by two members and shall be put in this form: "Shall the debate now close?" And, if adopted, the Presi-dent shall proceed to take the question on the resolu-tions and amendments thereto, according to priority without further debate.

Section 10. The call for the previous question may-be made by su members and shall 1m- put in this form: "Sliall the main question be now put?" If adopted, the effect shall be to take the question on the original resolution to the exclusion ol all debate and all amendments which have not been adopted.

Section 11. All votes, other than amendment to the By-Laws or Kules of Order may be considor<-d at the same or next succeeding mi-eting upon a motion made and s«onded by two memliers who \ oted in the ma-jority; provided the Union agrees thereto; but after u motion to reconsidcr has once been lost, it shall not be r- nevved.

Section 12. Every memlier present shall vote on all questions before the Union unless personally inter-r e d . A motion to excuse a member Irom voting shall be put without debates.

Section 13. No member shall enter or leave the Union meeting during the reading of tin- minutes, ad-mission of new members, installation of officers, or the takins of a question by yeas and nays; and no member -.hall IK allowed to leave the Union meeting without the permission of the presiding olficor, under penalty of twenty-five cents fine.

Section 14 When a motion has been declared car-m-d or lost by acclamation, any memher, before the Union proceeds to other business, may call for a count, but the yeas and nays cannot be called unless

Section IT. No subject of a political or religious

Section 18. All business done in the Union shall be

strictly secret to all outside the Union.

Section 19 ( a ) All other proceedings m debate, not

herein pros idiid for, to be governed In Itohcrt's Rules

of Order.
