    Avoiding issues in property sales

    Whenahome is sold, there are all too often

    issues, arguments and sometimes even

    court cases about the fixtures and fittings

    which form part of the sale and which

    the owner is allowed to take away with

    him.

    A good estate agent, says Tony Clarke,

    managingdirectorof theRawsonProperty

    Group, will ensure that this does not hap-

    pen but, regrettably, he says, a small mi-

    nority of estate agents are still unaware of

    their duties in this respect.

    Most arguments relating to these issues,

    says Clarke, arise from those involved in

    the sale not knowing the law and/or not

    specifying which items the seller plans to

    exclude from the deal.

    In South African law anything which

    is a permanent and integral part of a prop-

    erty is assumed to be a fixture and to be

    included in the sale. Doors (alongwith the

    keys),windows, blinds andawnings, built-

    in cupboards,wall-to-wall carpets, kitchen

    and bar counters (and their seats), as well

    as plants in the gardenare all automatical-

    ly part of the sale.However, the seller does

    have the right to specify in the sale docu-

    ment that certain items will be excluded,

    just as he has the right, if the furniture is

    partof thesale, toexcludecertainspecified

    and pre-named items.

    Lightfittings,too,saysClarke,aregener-

    ally considered to be included in the sale,

    but special lights, such as glass or brass

    chandeliers, are regularly excluded. This

    is also legal provided that their removal

    from the property is written into the sale

    document.

    Difficulties can arise where equipment

    is concerned. For example, a freezer or

    washing machine might or might not be

    included in the sale. Similarly, pool filters

    or certain garden tools, as well as burglar

    alarms might be excluded from the sale.

    It is, therefore, he says, wise to assume

    nothing and to specify item-by-item and

    everypiece of equipment andallmajor fix-

    tures that the buyer will be taking over.

    If these matters can be sorted out at the

    outset andwritten into thedocument, says

    Clarke, there should be no reasonwhy the

    sale should not go through smoothly.

    experienced a 43% increase in year-

    on-year sales transactions in 2012 relative

    to 2011.

    A relative shortage of the well-located and

    bigger sized erven is experienced pointing

    to aneminent price shift in the estates proper-

    ty market. For the period 1 December 2011 to

    30 November 2012, total property sales in Val

    de Vie consisted of 84 own title (74 erven and

    tenhouses)and11sectionaltitle(horsestables)

    transactionstothevalueofR92,904millionand

    R1,26 million respectively. For the same peri-

    odsin2010and2011,respectively61and65sales

    transactionsto thevalueofR62,769andR72,865

    million were concluded up from 19 transac-

    tions in 2009 to the value of R22,99 million.

    Average sales prices obtain have remained

    fairlystablesince2010increasingfromR1,029

    million toR1,106million. This is, however, not

    atruereflectionofpropertypricesontheestate

    as Val de Vie is only 5 years old and by

    far the majority of property transactions dur-

    ing this period have been erven. According to

    Lightstone, the present average valuation for

    ValdeVieproperties isR3,79millionranking

    it as the 373rd most expensive estate in South

    Africa which is on par price wise with

    Oubaai Golf Estate (George) and Sandhurst

    Ext 4 (Johannesburg).

    The average value of Val de Vie property is,

    however, set to dramatically increase during

    the next few years, as more and more luxury

    homes are being developed on the vacant er-

    ven.Thenumberofavailableervenin themar-

    ket has dropped quite markedly especially

    thebigger andbetter located erven in the last

    few months. Val de Vie consist of 567 erven

    spread between the vineyard and open areas

    over an area of 1 771 384 m.

    Maureen de Waal (resident agent affiliated

    to CCH) has during the last four months

    achieved sales which have already corrected

    the historical price levels on the estate i.e.

    a house for R5,5 million (at more than R13 000

    perm andahouse forR11,25million (top sales

    price to be achieved up to now in the estate).

    She has over the last three years achieved

    the biggest market share on Val de Vie Estate,

    managing to capture a 38% share of total 2012

    sales 36 of the 94 sales transactions for the

    he Audi brand globally surpassed

    2011s record of 1 302 659 deliveries

    already in the 11th month of 2012,

    having already delivered 42 091 units

    more with another month to report.

    The brands strong growth spanned all re-

    gions of the world: China remains Audis

    biggest singlemarket, having already deliv-

    ered 370 559 vehicles from January to No-

    vember. Amid difficult market conditions,

    Audi ended the past month in Europe mar-

    ginally down on the strong prior-year level

    (-1,9 %). Audis sales total for Europe is up

    3,5 % for the period January through No-

    vember, having delivered 693 850 units. The

    brand also achieved a growth rate of 24,4 %

    (124 469 units) in the United States, surpass-

    ing the UK to become the third largest mar-

    ket for Audi.

    Worldwide sales growth for Audi in No-

    vemberwas fuelled by the brands SUVmod-

    els. Alongside the Q3, Q5 and Q7, the new

    A3 three-door version attracted extra cus-

    tomers to dealerships: The compact model,

    which went on sale in its first markets at

    the end of August, improved on its predeces-

    sors delivery total for November 2011 by al-

    most half.

    In South Africa, the Audi brand has en-

    joyeda record-breaking 2012 todate.Novem-

    ber was the 8th consecutive record month

    in 2012 and the third best-ever retail month

    for the brand in South Africa. Audi South

    Africahas therefore surpassed its recordan-

    nual deliveries to customers in November

    2012; the previous record of 14 531 was

    achieved in December 2011.

    Product introductions and innovations

    were kicked off early in the year with the

    introduction of the face-lifted Audi A5

    range, followed by the face-lifted Audi A4

    range in February. April saw the introduc-

    tion of the highly-anticipated Audi Q3 and

    the four-door Audi A1 Sportback. The third

    quarter of 2012 represented the sporty val-

    ue of the brand with the introduction of the

    potent Audi S6, S7 Sportback and flagship

    S8. The last quarter of the year saw the intro-

    duction of the new Audi A3 3-door, which

    has seen phenomenal interest.

    We posted an increase in sales across all

    our model lines with the Audi A4 leading

    standing retail results in 2012were achieved

    in partnership with the Audi Dealer Net-

    In the forthcoming year, Audi will intro-

    duce new product innovations, including

    the exciting re-introduction of the allroad

    concept to South Africa in the form of the

    Audi A4 allroad; the RS5 Cabriolet andAudi

    R8 product improvement to name a few. The

    Audi A3 Sportback will be a new product

    introduction later in the year.

    The year 2013 will also represent a hall-

    mark year for the Audi brand as it enjoys

    the launch of new RS models. The RS model

    range will now include the Audi RS4 Avant,

    RS 5 Coup and Cabriolet, TT RS Coup and

    Cabriolet, as well as the introduction of the

    RS7 Sportback and RS Q3 at the end of 2013.

    Geely beplan om aggressief in elke mark

    uit te breimet groter belegging, nuwemodel-

    le en beter opleiding vir al sy personeel om

    groter klante tevredenheid in al sy markte

    te bewerkstellig.

    Geely is in 2011 in Suid-Afrika as een van

    die handelsname in die Dacar-Motorgroep

    hervestig.
