TRADEMARK AVAILABILITY SEARCH REPORTS (Optional)The searches and analyses, of optional character, when being carried through, not only verify the contained nominative

expressions in a trademark, but also eventual similarities and analogies arising from the Portuguese Language and graphical aspects arising from other stylized trademarks.

With this, it is possible to provide all the alternatives and to prevent conflicts with previously requested trademarks, noting that in Brazil, it is adopted the law of “first to file”, which is why it is advisable the previous search and written technical analysis of the availability of registration for searches in Brazil, which approaches aspects such as:

•Exact search: it searches for the identical expression and its correspondent in Portuguese Language;•Partial search: it searches for the identity between radicals (parts of the mark);•Search by affinity: search of identical expressions in classes with affinities, according to Brazilian PTO guidelines;•Logo search: Regardless of classes, it searches the identity between the design part of the mark;•Legal analysis of the registration feasibility and possible ways to be adopted.

Trademark Registration in Brazil

Patent Applications in BrazilPATENTS AND UTILITY MODELS, PLANT VARIETIES, ETC.Brazil, as one of the signatory countries of the Patent Cooperation Treaty - PCT, is able to grant patents by means of the use of this

mechanism. Notwithstanding the existence of the Invention Patents, whose validity lasts for 20 years, the Brazilian system also recognizes the Utility Models for the cases in which the object to be protected has a lower degree of inventiveness, guaranteeing to it exclusive protection for the period of 15 years.

Special mention to the care provided in the Technical Translation of Patent before complementary aspects that also are demanded by the Brazilian Institute of Industrial Property (INPI) in its own Norms and Regulations, mainly relating to the “unpatentable subject matter”, in restriction to some aspects allowed for the International Patent Classification (IPC).

With this apparatus, it is allowed the execution and monitoring of these rights in Brazil, providing where necessary:•PCT Patent Application or Unionist Priority;•Manifestations in administrative proceeding (Oppositions);•Previous search and analysis of the availability of registration with Technical OPINION.

Procedures of a patent registration in Brazil:To prepare and filing a patent application in Brazil, for regular applications as well as for PCT National Phase Entrance or by

using the Priority Rights, the following documents are required: •Disclosures, abstract, claims, and drawings of the patent;•Information related to any priority document;•Power of attorney duly signed by the owner/applicant(s) of the patent. Legalization is not required.•Information related to the owner/applicant(s) and the inventor(s), as address, marital status and profession.•International publication for PCT National Phase Entrances.

In Brazil, regulations and certifications previously granted by the competent authorities are required to the manufacturers, distributors, transporters and importers of diverse areas as medicine, cosmetics, foods, perfumes and hygiene products, equipment, and medical products (medical device) and disinfectant sanitizing.

Without these authorizations, some products cannot be commercialized in the Brazilian territory.

In 1986, VILAGE initiated its activities in São Paulo, Brazil. Its founders, Victor Andreas Quaglio (Industrial Property Agent), Sonia Carlos Antônio (Lawyer) and Geisler Chbane Bosso (Industrial Property Agent) had the idea to join Agents and Lawyers in one single company in order to form a solid structure to meet entrepreneurs who wanted to protect their patents and trademarks in the Brazilian territory.

Beginning, then, the trajectory of VILAGE PATENTS AND TRADEMARKS, focused on intellectual property in Brazil, facilitating the understanding of the natural wealth and the cultural and business diversity of this country as vast territorially.

In the mid-90s, Vilage started to make the protection of patents and trademarks for Foreign Agents and Foreign Global Companies, which made its Brazilian expertise to be recognized in other countries.

The expansion of the company followed the trade and economic development of Brazil, and today, Vilage counts with more than 100 professionals of diverse specialties: lawyers specialized in Industrial Property, engineers, designers, Industrial Property agents, chemicals, arbitrators and mediators, managers, publicists, journalists, arts professionals and international relations, pharmaceutical and counters.

The credibility conquered throughout the years was an essential factor for the strengthening of Vilage. We currently have 22 branches spread throughout the Brazilian territory, with its main headquarters in Rio de Janeiro and São Paulo, besides its own facilities in several states to meet national companies.

And in 2011, it was inaugurated its branch in London, England, the VILAGE BRAZIL INTELLECTUAL PROPERTY, specifically aimed at serving Industrial Property Agents and Foreign Lawyers interested in protecting the intellectual property of their clients in Brazil.

After our first successful international experience in 2012, our Company decided to extend its frontiers even more and it is a pleasure for us to announce the opening of our second international office in New York / USA.
