    Date: June 1, 2020 RESOLUTION NO. 2020-124

    Resolution Declaring Racism a Public Health Crisis

    WHEREAS, the Mayor and Council of the Borough of Leonia has a demonstrated track

    record of promoting racial equity, inclusion and diversity in all aspects of its municipal

    government; and,

    WHEREAS, racism is a social system with multiple dimensions: individual racism that is

    internalized or interpersonal; systemic racism that is institutional or structural, and is a

    system of structuring opportunity and assigning value based on the social interpretation of

    how one looks; and,

    WHEREAS, racism unfairly disadvantages specific individuals and communities, while

    unfairly giving advantages to other individuals and communities, and saps the strength of

    the whole society through the waste of human resources, and the Borough of Leonia’s

    collective prosperity depends upon the equitable access to opportunity for every resident

    regardless of the color of their skin; and,

    WHEREAS, racism causes persistent discrimination and disparate outcomes in many areas

    of life, including housing, education, employment and criminal justice; and an emerging body

    of research demonstrates that racism itself is a social determinant of health; and,

    WHEREAS, communities of color, working class residents, and those that suffer from

    disabilities, are more likely to experience poor health outcomes as a consequence of their

    social determinants of health — health inequities stemming from economic stability,

    education, physical environment, food and access to health care systems; and,

    WHEREAS, a contemporary example of such disparity is highlighted by the coronavirus data

    in the United States, which shows that African-American COVID-19-related deaths in the

    U.S. have occurred at more than twice the level of COVID-19-related deaths of Caucasian

    patients;

    Date: June 1, 2020 RESOLUTION NO. 2020-124 NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Leonia

    that the Borough of Leonia does hereby declare racism to be a public health crisis, and that

    the Mayor and Council shall also;

    1. Promote equity through all policies approved by the Mayor and Council. 2. Enhance educational efforts aimed at understanding, addressing and dismantling

    racism and how it affects the delivery of human and social services, economic development and public safety.

    3. Continue to advocate locally and through the New Jersey State League of

    Municipalities, New Jersey Conference of Mayors and all other appropriate associations for relevant policies that improve health in communities of color.

    4. Support local, state, regional, and federal initiatives that advance efforts to dismantle systemic racism.

    5. Further work to solidify alliances and partnerships with other organizations that are confronting racism and encourage other local, state, regional and national entities to recognize racism as a public health crisis.

    6. Support community efforts to amplify issues of racism and engage actively and authentically with communities of color wherever they live.

    7. Promote and support policies that prioritize the health of all people, especially people of color by mitigating exposure to adverse childhood experiences.

    8. Encourage racial equity training among all community partners, vendors and contractors.

    9. Call upon Bergen County Executive Tedesco and the Bergen County Board of Chosen Freeholders to declare racism as a public health crisis and to enact equity in all policies in the County of Bergen.

    10. Call upon Governor Murphy, State Senate President Sweeney, and State Assembly Speaker Coughlin to also declare racism as a public health crisis and to enact equity in all policies of the state of New Jersey; and,

    BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to Governor

    Murphy, Senate President Sweeney, Assembly Speaker Coughlin, Senator Weinberg,

    Assemblywoman Huttle, Assemblyman Johnson and Bergen County Executive Tedesco, for

    their review and potential action.

    I hereby certify that the above resolution was duly adopted by the Mayor and Council of the Borough of Leonia at a meeting of said Borough Council on June 1, 2020.

    BOND ORDINANCE TO AUTHORIZE THE INSTALLATION OF A SYNTHETIC TURF

    MULTIPURPOSE ATHLETIC FIELD AT LEONIA HIGH SCHOOL FOR JOINT USE

    WITH THE LEONIA BOARD OF EDUCATION IN, BY AND FOR THE BOROUGH OF

    LEONIA, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO

    APPROPRIATE THE SUM OF $3,000,000 TO PAY THE COST THEREOF, TO MAKE

    A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH

    APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION

    NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS.

    BE IT ORDAINED by the Borough Council of the Borough of

    Leonia, in the County of Bergen, State of New Jersey, as follows:

    Section 1. The Borough of Leonia, in the County of

    Bergen, State of New Jersey (the "Borough") is hereby authorized to

    install a synthetic turf multipurpose athletic field at Leonia High

    School in, by and for the Borough for joint use by the Borough and

    the Leonia Board of Education (the "Board of Education"). Said

    improvement shall include the installation of field lighting and

    all work, materials and appurtenances necessary and suitable

    therefor. Said project shall be undertaken by the Borough and the

    Board of Education as a joint recreation project under a shared

    services agreement between the Borough and the Board of Education.

    Section 2. The sum of $3,000,000 is hereby appropriated

    to the payment of the cost of making the improvement described in

    Section 1 hereof (hereinafter referred to as "purpose"). Said

    appropriation shall be met from the proceeds of the sale of the

    bonds authorized and the down payment appropriated by this

    ordinance. It is anticipated that a $100,000 grant from the County

    of Bergen Open Space, Recreation, Floodplain Protection, Farmland

    and Historic Preservation Trust Fund shall be received by the

    Borough to finance the cost of the improvement described in Section

    1 hereof. Said grant funds shall be applied as set forth in

    Section 10 hereof. Said improvement shall be made as a general

    improvement and no part of the cost thereof shall be assessed

    against property specially benefitted.

    Section 3. It is hereby determined and stated that (1)

    said purpose is not a current expense of said Borough, and (2) it

    is necessary to finance said purpose by the issuance of obligations

    of said Borough pursuant to the Local Bond Law (Chapter 2 of Title

    40A of the New Jersey Statutes Annotated, as amended; the "Local

    Bond Law"), and (3) the total estimated cost of said purpose is

    $3,000,000, and (4) $150,000 of said sum is to be provided by the

    down payment hereinafter appropriated to finance said purpose, and

    (5) the estimated maximum amount of bonds or notes necessary to be

    issued for said purpose is $2,850,000, and (6) the cost of such

    purpose, as hereinbefore stated, includes the aggregate amount of

    $300,000 which is estimated to be necessary to finance the cost of

    such purpose, including architect's fees, accounting, engineering

    and inspection costs, legal expenses and other expenses, including

    interest on such obligations to the extent permitted by Section 20

    of the Local Bond Law.

    Section 4. It is hereby determined and stated that

    moneys exceeding $150,000, appropriated for down payments on

    capital improvements or for the capital improvement fund in budgets

    heretofore adopted for said Borough, are now available to finance

    said purpose. The sum of $150,000 is hereby appropriated from such

    moneys to the payment of the cost of said purpose.

    Section 5. To finance said purpose, bonds of said

    Borough of an aggregate principal amount not exceeding $2,850,000

    are hereby authorized to be issued pursuant to the Local Bond Law.

    Said bonds shall bear interest at a rate per annum as may be

    hereafter determined within the limitations prescribed by law. All

    matters with respect to said bonds not determined by this ordinance

    shall be determined by resolutions to be hereafter adopted.

    Section 6. To finance said purpose, bond anticipation

    notes of said Borough of an aggregate principal amount not

    exceeding $2,850,000 are hereby authorized to be issued pursuant to

    the Local Bond Law in anticipation of the issuance of said bonds.

    In the event that bonds are issued pursuant to this ordinance, the

    aggregate amount of notes hereby authorized to be issued shall be

    reduced by an amount equal to the principal amount of the bonds so

    issued. If the aggregate amount of outstanding bonds and notes

    issued pursuant to this ordinance shall at any time exceed the sum

    first mentioned in this section, the moneys raised by the issuance

    of said bonds shall, to not less than the amount of such excess, be

    applied to the payment of such notes then outstanding.

    Section 7. Each bond anticipation note issued pursuant

    to this ordinance shall be dated on or about the date of its

    issuance and shall be payable not more than one year from its date,

    shall bear interest at a rate per annum as may be hereafter

    determined within the limitations prescribed by law and may be

    renewed from time to time pursuant to and within limitations

    prescribed by the Local Bond Law. Each of said bond anticipation

    notes shall be signed by the Mayor and by a financial officer and

    shall be under the seal of said Borough and attested by the Borough

    Clerk or Deputy Borough Clerk. Said officers are hereby authorized

    to execute said notes in such form as they may adopt in conformity

    with law. The power to determine any matters with respect to said

    notes not determined by this ordinance and also the power to sell

    said notes, is hereby delegated to the Chief Financial Officer who

    is hereby authorized to sell said notes either at one time or from

    time to time in the manner provided by law.

    Section 8. It is hereby determined and declared that the

    period of usefulness of said purpose, according to its reasonable

    life, is a period of ten years computed from the date of said

    bonds.

    Section 9. It is hereby determined and stated that the

    Supplemental Debt Statement required by the Local Bond Law has been

    duly made and filed in the office of the Borough Clerk of said

    Borough, and that such statement so filed shows that the gross debt

    of said Borough, as defined in Section 43 of the Local Bond Law, is

    increased by this ordinance by $2,850,000 and that the issuance of

    the bonds and notes authorized by this ordinance will be within all

    debt limitations prescribed by said Local Bond Law.

    Section 10. Any funds received from private parties, the

    Board of Education, the County of Bergen, the State of New Jersey

    or any of their agencies or any funds received from the United

    States of America or any of its agencies in aid of such purpose,

    shall be applied to the payment of the cost of such purpose, or, if

    bond anticipation notes have been issued, to the payment of the

    bond anticipation notes, and the amount of bonds authorized for

    such purpose shall be reduced accordingly.

    Section 11. The capital budget is hereby amended to

    conform with the provisions of this ordinance to the extent of any

    inconsistency therewith and the resolutions promulgated by the

    Local Finance Board showing full detail of the amended capital

    budget and capital program as approved by the Director, Division of

    Local Government Services, is on file with the Borough Clerk and is

    available for public inspection.

    Section 12. The Borough intends to issue the bonds or

    notes to finance the cost of the improvement described in Section 1

    of this bond ordinance. If the Borough incurs such costs prior to

    the issuance of the bonds or notes, the Borough hereby states its

    reasonable expectation to reimburse itself for such expenditures

    with the proceeds of such bonds or notes in the maximum principal

    amount of bonds or notes authorized by this bond ordinance.

    Section 13. The full faith and credit of the Borough are

    hereby pledged to the punctual payment of the principal of and the

    interest on the obligations authorized by this ordinance. Said

    obligations shall be direct, unlimited and general obligations of

    the Borough, and the Borough shall levy ad valorem taxes upon all

    the taxable real property within the Borough for the payment of the

    principal of and interest on such bonds and notes, without

    limitation as to rate or amount.

    Section 14. This ordinance shall take effect twenty days

    after the first publication thereof after final passage.

    AN ORDINANCE AMENDING CHAPTER 49 “POLICE DEPARTMENT”

    ARTICLE 11A “RULES GOVERNING EMPLOYMENT OF POLICE OFFICERS

    IN EXTRA-DUTY CAPACITY WITHIN THE BOROUGH” SECTION 11-2 “COSTS

    OF EMPLOYMENT; MINIMUM EMPLOYMENT TIME”

    OF THE CODE OF THE BOROUGH OF LEONIA

    NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of

    Leonia, as follows:

    Section 1.

    Chapter 49 “Police Department” Article 11A “Rules Governing Employment of Police

    Officers in Extra-Duty Capacity Within the Borough” §11-2 “Costs of Employment; Minimum

    Employment Time” of the Code of the Borough of Leonia is amended and supplemented in its

    entirety, as follows:

    §11-2 Costs of police extra-duty employment; Minimum extra-duty employment time.

    It shall be understood that all employers or applicants requesting employment of police

    officers for extra duty shall be responsible for the costs of a police officer's employment at the

    established hourly rate of $100 per hour plus $50 administrative surcharge per hour to cover

    costs, including, but not limited to medical insurance, workers' compensation, disability

    insurance, vehicle depreciation, etc. The total cost per hour to the requesting employer or

    applicant shall be $150 per hour. The minimum employment time for each police officer shall

    total a minimum of four hours, consistent with contractual terms and agreements. No fees will be

    charged if the employer or applicant cancel an assignment prior to the twenty-four-hour period

    before the start time of the extra-duty employment. A cancellation of any assignment by said

    employer or applicant within a twenty-four-hour period of the start time of the extra-duty

    employment shall result in payment of costs representing four hours' pay at the rate established

    herein and the administrative surcharge as established herein for four hours. If any assignment is

    cancelled after a police officer(s) arrives at the location of the assignment, that police officer(s) is

    entitled to four hours' pay at the established hourly rate, and the employer or applicant shall also

    be responsible for the administrative surcharge as established herein for four hours.

    Section 2.

    amendment to the membership for their consideration; and

    WHEREAS, these revised bylaws must be ratified by at least three

    fourths of the member towns before they can become effective.

    RESOLUTION AUTHORIZING THE ACCEPTANCE OF A GRANT FROM THE BERGEN JOINT INSURANCE FUND

    FOR BASE ACCREDITATION SERVICES AND EXECUTION OF A GRANT AGREEMENT

    WHEREAS, the Commission on the Accreditation of Law Enforcement Agencies (“CALEA”) and the State of New Jersey Associations of Chiefs of Police offer a program to obtain accreditation in order to attain the highest standards of police department management; and WHEREAS, the Bergen Joint Insurance Fund is seeking to encourage police departments to pursue such excellence by providing a grant in the amount not to exceed $25,000 to support the Leonia Police Department’s efforts to attain accreditation from New Jersey Chiefs of Police; and WHEREAS, the Chief of Police and the governing body believe that the attaining of such certification is consistent with the goals of the Leonia Police Department; and WHEREAS, the Chief of Police is committed to taking necessary action in order to support the accreditation process; and

    WHEREAS, the successful completion of the accreditation process from the New Jersey State Associations of Chiefs of Police will result in a reduction in liability insurance premiums from the Bergen JIF; and

    WHEREAS, in the long term the completion and retention of accreditation from the New Jersey State Associations of Chiefs of Police will help the municipality manage its liability and workers compensation insurance exposure. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Leonia,(Herein After the “Municipality”) in the County of Bergen, and State of New Jersey, as follows:

    1. The Mayor, Administrator and Chief of Police are hereby authorized to enter into a Grant Agreement with the Bergen Joint Insurance Fund for the receipt of funding in the amount of $25,000 for the NJ State Chief’s of Police accreditation program.

    2. The Municipality agrees to abide by the terms of the Grant Agreement to attain certification within two years of the date of the agreement. Upon accreditation being obtained, the Bergen JIF will use their normal accreditation discount to offset the grant costs.

    W I T N E S S E T H

    WHEREAS, the Bergen Joint Insurance Fund (hereinafter “JIF”) has advised that a well trained police

    department acting properly and in accordance with written policies that meet the highest standards is an

    effective form of limiting liability and reducing operating costs; and

    WHEREAS, such best practices are recognized by an accreditation from the New Jersey State Associations of

    Chiefs of Police in conjunction with the Commission on the Accreditation of Law Enforcement Agencies

    (“CALEA”) and the Jersey State Associations of Chiefs of Police.

    NOW, THEREFORE, it is mutually agreed to by and between the parties:

    1. The JIF is willing to provide a grant to support member police departments in the process – which may

    include funding such serves as: provide necessary administrative services, training, advice and guidance in

    order to position a Police Department to obtain the accreditation.

    2. The grant that the JIF is willing to provide is in an amount of $25,000.

    3. In consideration for receiving this grant from the JIF, the Mayor and Council and the Chief of Police

    shall agree that they will complete the accreditation process within two years of the date of this Agreement.

    4. The Mayor and Council agrees that if it were to fail to fulfill the accreditation process within the two

    year time period, it will reimburse the JIF for the cost of providing said grant for such services to the Police

    Department.

    5. The Mayor and Council agrees that if it were to fail to fulfill the accreditation process within the two year

    time period , The Grant must be paid back to the Bergen JIF within a 3 year period, after the two year attempted

    accreditation process expires.

    6. The Mayor and Council agrees to abide by the terms of the Grant Agreement to attain certification within

    two years of the date of the agreement. Upon accreditation being obtained, the Bergen JIF will use their normal

    accreditation discount to offset the grant.

    7. If the Municipality does not achieve certification within the two year period, the amount of the Grant is

    due payable to the Bergen JIF within a three year period.

    8. If the Municipality leaves the Bergen JIF before the grant is repaid in full, the amount of the grant is due

    immediately to the Bergen JIF upon the date of termination to the JIF.

    9. The Municipality understands that the JIF shall not be responsible nor will it commit to provide any

    additional funding to maintain said accreditation, however it is encouraged that the Police Department continue

    to renew its accreditation on an annual basis.

    10. By signing this Agreement the Mayor and Council and Police Chief agree to undertake whatever steps

    are necessary to obtain accreditation certification from the New Jersey Chiefs of Police. The Chief of Police

    and governing body of the Municipality agree to assist and support such efforts.

    BOROUGH OF LEONIA ORDINANCE NO. 2020-06

    AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 290

    “ZONING” OF THE CODE OF THE BOROUGH OF LEONIA TO CLARIFY CERTAIN DEFINITIONS AND BULK STANDARDS

    FOR VARIOUS ZONES

    WHEREAS, the Zoning Officer has reviewed the Code of the Borough of Leonia as it relates to zoning and has made certain recommendations for clarification of definitions and certain bulk standards; and WHEREAS, the Mayor and Council of the Borough of Leonia believe it is in the best interests of the Borough to amend the Ordinance accordingly. BE IT ORDAINED by the Mayor and Council of the Borough of Leonia, County of Bergen, State of New Jersey, as follows: Section 1. Chapter 290 “Zoning” Article II “Definitions” Section 290-3 of the Code of the Borough of Leonia is amended and supplemented, by the addition of the following terms: “Building Coverage” is the horizontal area measured from the exterior walls of all principal and accessory buildings on a lot. For a residential property, building coverage shall specifically include any attached or detached garage, as well as any other principal and accessory building. “Lot Coverage” is all parts of a lot that are covered by buildings, parking areas, driveways, pools, walkways, paved, ancillary surfaces such as patios and tennis courts, as well as decks and any other impervious surfaces, with the exception of retaining walls.

    “Height” is amended and supplemented in its entirety, as follows: In Districts A and B, height shall be determined pursuant to 290-8(A) and 290-20(D)1. Height shall be the vertical distance measured from the average original grade around the building to the highest point, provided that no part of the building shall be higher than 40 feet to any one point. In all other districts, the permitted height of the building shall be as determined pursuant to the district regulations and shall be measured to the average grade to the highest point of the building plus 8 feet to accommodate rooftop appurtenances, including rooftop stairs, solar panels, chimneys, HVAC equipment or elevator shafts.

    Section 2.

    Chapter 290 “Zoning” Article IV A “Districts” Section 290-8 “Area, Yard and Building Requirements” Subsection C. “Rear Yard”, Subsection E. “Minimum Lot Area and Frontage”, and Subsection F. “Maximum Coverage” are hereby amended and supplemented, as follows:

    §290-8 Area, Yard and Building Requirements.

    C. Rear yard. There shall be a rear yard of not less than 25 feet. A building on a lot extended through from street to street shall, in lieu of a rear yard, conform to the front yard requirement on each street. On corner lots, the rear yard shall be determined to be opposite the street address listed in the Borough tax records.

    On corner lots, the frontage calculation shall be the frontage which street address is listed

    in the Borough’s tax records. Buildings on corner lots shall meet the front yard setback requirements of each street, a rear yard and one side yard.

    E. Minimum lot area and frontage. There shall be a minimum lot area measured within a

    distance of 100 feet of the front street line. The lot area and the lot width at the street line shall not be less than the following:

    F. Maximum coverage. The total Building Coverage shall not exceed 25% of the lot area.

    Chapter 290 “Zoning” Article XIII “General Regulations” Section 290-45 “Accessory Structures” Subsection A(1) is hereby replaced in its entirety, as follows:

    §290-45 Accessory Structures A.(1) Accessory structures shall not exceed one story nor 15 feet in height. No shed on a

    property shall exceed 10 feet in height or have an area greater than 120 square feet. Section 4.

    Chapter 290 “Zoning” Article XX “Administration and Interpretation” Section 290-107 “Certificates of Occupancy” is hereby replaced in its entirety, as follows:

    §290-107 Certificates of occupancy A. A certificate of occupancy shall be required in all cases involving the erection or

    alteration of any building or structure, the use or change in use of any building, structure or dwelling unit, or the use of any land or the change of tenancy or ownership of an building, structure or dwelling unit.

    B. Application for and issuance of a certificate of occupancy shall be pursuant to the terms

    and provisions of the Building Code of the Borough of Leonia, with all amendments thereto.

    Section 5. The Borough Clerk is hereby directed to give notice at least ten days prior to the hearing on the adoption of this ordinance to the Bergen County Planning Board, and to all others entitled thereto pursuant to the provisions of N.J.S.A. 40:55D-15. Upon adoption of this ordinance, after public hearing thereon, the Borough Clerk is further directed to publish notice of the passage thereof and to file a copy of this ordinance as finally adopted with the Bergen County Planning Board, as required by N.J.S.A. 40:55D-16 and with the Borough Tax Assessor. Section 6. Should any section, part or provision of this ordinance be held unconstitutional or invalid, such decision shall not affect the validity of this ordinance as a whole, or any other part thereof. Section 7. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
