Attn: All Governors, Clerk 1. Parent View

Parent View is Ofsted’s new on-line questionnaire that allows parents and carers to give their views on their child’s school at any time of the year. Ofsted will use the information to help make decisions about which schools to inspect and when. The results will also be available to inspectors at the point of inspection. Parents' and carers’ perceptions are crucial in coming to a view about the effectiveness of a school. These views will form an essential element of the jigsaw of information Ofsted uses as part of their overall assessment of a school

particularly when it comes to making decisions about which schools to inspect and when. The 12 questions were carefully chosen to ensure that they cover a range of issues which are important to parents but are equally designed to provide Ofsted with the right information to support decisions about inspection. Parents and carers are not able to reply using free text and Parent View does not replace the current arrangements for raising a complaint or notifying the appropriate body regarding concerns about the safety or wellbeing of a child. Parent View also gives head teachers and schools a direct route into gathering the views of their parent group. Results are published in real-time and available on the website for schools, parents/carers and the general public to view. A range of measures, including a registration process with password, have been put in place to ensure the security of the website is robust, and will treat schools fairly, while making sure it is accessible for parents to use. Systems are also in place to flag any potential signs of misuse and appropriate action will be taken where this is clear. If you have any concerns over how Parent View is being used at your school, your headteacher/principal should email [email protected]. If Ofsted suspects a particular survey for a school is being misused it will suspend the page presenting the results while it investigates. Ofsted want to encourage all parents and carers to give their views and would appreciate schools encouraging parents and carers to use the site by giving the Parent View web-address and logo on their newsletters and website. Attn: Chair, Clerk, Head 2. Data Dashboard The School Data Dashboard is an on-line tool launched by Ofsted on 27 February 2013. It provides a snapshot of school performance at Key Stages 1, 2 and 4. The dashboard can be used by school governors and by members of the public to check the performance of the school in which they are interested. The School Data Dashboard complements the Ofsted school inspection report by providing an analysis of school performance over a three-year period. Data can be filtered by key stage or by topic:

o Expected progress o Attainment o Attendance o Narrowing the gap between disadvantaged and other pupils

CONSULTATION ITEMS

Attn: Chair, Head 3. Ofsted launches consultation on the inspection of local authority school improvement functions Plans to introduce a new framework for inspecting the school improvement functions provided by under-performing local authorities have been published. Under the proposed framework, Ofsted will evaluate how effectively local authorities discharge their school improvement functions, particularly in areas where schools are not yet good or are not improving quickly enough. Ofsted wants to introduce the local authority inspections to ensure that all children and young people have access to a good quality education irrespective of where they live. In a speech to delegates at the North of England Education Conference last month, HM Chief Inspector, Sir Michael Wilshaw, said that despite year on year improvements, it was unacceptable that 30 per cent of schools, educating 2.3 million children, fell short of being good. He said that Ofsted was committed to investigating the reasons why parents living in local authority areas with the same demographics and levels of deprivation had such widely varying opportunities of finding a good school.

Local authorities will be judged on how well their education and training functions promote improvement, high standards and the fulfillment of educational potential of children and young people in schools.

During inspections, Ofsted will consider:

o the effectiveness of corporate and strategic leadership of school improvement

o the extent to which the local authority knows its schools and other providers, their performance and the standards they achieve and how effectively support is focused on areas of greatest need

o the effectiveness of the local authority’s identification of, and appropriate intervention in, underperforming schools and other providers

o the impact of local authority support and challenge over time and the rate at which schools and other providers are improving

o the extent to which the local authority brokers support for schools and other providers

o the effectiveness of strategies to support highly effective leadership and management in schools and other providers

o support and challenge for school governance

o the use of funding to effect improvement, including how it is focused on areas of greatest need.

Rather than a four point scale to judge effectiveness (that is, outstanding, good, requires improvement or inadequate), Ofsted will instead assess the strengths and weaknesses, and the impact, of education and training functions and arrive at a conclusion of whether such functions are being exercised effectively or not. The findings of the inspections will be published in a letter and local authorities deemed not to be providing an acceptable standard of service delivery may be re-inspected. Review of School Funding Arrangements As you may be aware, the DfE has introduced new rules which required local authorities to revise their local funding formulas, changing the way schools and academies are funded in the next financial year. Consultation on the formula for Bristol schools has been taking place over the last year, and everything is on schedule for schools to receive their budget allocations by the DfE deadline of 15 March. Updates on the formula have been circulated to headteachers and chairs of governors, including an invitation to attend finance briefings where schools will be able to ask questions about the new formula and how their budget is calculated. On 12 February the DfE published its review of the introduction of the 2013-14 school funding arrangements. It is seeking to assess the impact of those changes and whether there have been any unintended consequences. The document outlines some of the concerns schools, schools forums and local authorities have already raised about the formula changes and the DfE is now seeking wider views. Attn: Chair, Clerk, Head 5. Dealing with Urgent Issues Most of the work of the governing body can be planned well ahead and fitted in to the cycle of termly meetings. However, it is inevitable that unplanned matters will come up during the year that will need to be dealt with. Wherever possible these should be added to the agenda for one of the scheduled termly FGB meetings. However, issues will sometimes arise that require more urgent attention.

Calling Additional Meetings The chair, usually in consultation with the headteacher, may request an additional, unscheduled meeting of the governing body. It is the duty of the clerk to convene a meeting if requested. Every member of the governing body has a right to at least seven clear days’ written notice of the date for a meeting and the agenda for the meeting. The chair of governors can determine a shorter period of notice, but not for a meeting where governors will be asked to consider the removal of the chair of governors, suspension of a governor or proposal to close the school. N.B. Extra meetings are normally called by the chair, in consultation with the headteacher. However, any three governors may formally request that an extra or special meeting be called by giving written notice to the clerk of the business being conducted. Contact should be made with the chair of governors as a matter of courtesy. The meeting must be convened as soon as is practicable. Power of Chair Of Governors to Act in Cases of Emergency Normally, decisions should only be taken at a meeting of the governing body or by a committee or an individual empowered to make that decision. However there may be times when a decision is so urgent that there is no time to call a meeting, in which case the chair of governors or the vice-chair of governors has the power to take decisions on their behalf. This power should only be used on very rare occasions as a last resort, when it can not be avoided. To test whether it is appropriate for the chair or vice chair to exercise these emergency powers, they should consider if a delay is likely to be seriously detrimental to the interests of the school, a pupil at the school, their parents, or a person who works at the school. Any emergency decisions made by the chair or vice chair should be reported to the full governing body as soon as possible and ratified at the next full governing body meeting. Other areas where the chair has specific powers are;

o Signing any legal documents on behalf of the governing body o Casting vote in the event of a tie o Signing the approved FGB minutes o Certain powers relating to pupil exclusions and federating with another

Governing Body o Review of the Headteacher’s Performance Management Statement in the event

of an appeal by the head Other matters that the legal chair will need to address in the first instance: o Receiving a formal 'notice of concern' issued by the local authority o Fulfilling the chair’s role in the event of allegations against staff or volunteers

working at the school (child protection issues) o Receiving correspondence addressed to the Chair of Governors.

Attn: Chair, Clerk, Head 6. Dealing with Conflicts of Interest It is important that governors and staff not only act impartially, but are also seen to act impartially. The governing body and school staff have a responsibility to avoid any conflict between their business and personal interests and affairs and those of the school. There is a legal duty on all governors to declare an interest likely to lead to questions of bias when considering any item of business at a meeting and for the governor concerned to withdraw, if necessary, whilst the matter is considered. Register of Pecuniary and Business Interests To help put this duty into practice, governing bodies are required to establish and maintain a register of pecuniary interests indicating, for all governors and the headteacher, any pecuniary or business interests. This should include, if appropriate, the company by whom they are employed, directorships, significant shareholdings or other appointments of influence within a business or other organisation which may have dealings with the school. They should include their own interest and those of any member of their immediate family (including partners) or other individuals known to them who may exert influence. Dated nil returns are also required. The completed register should be made available on request to members of the governing body, the headteacher, staff, parents and the Director Children’s Services. It is specifically the clerk’s responsibility to maintain the register of pecuniary interests for governors; however it is the responsibility of each individual governor to declare their interest. The register is not a substitute for declaring an interest at meetings. It is good practice to have a standing agenda item at the beginning of each meeting asking governors to declare any change to their register entry or interest in any specific items on the agenda for that meeting. Declaration for School Staff There is also a requirement set out in the Code of Conduct for School Staff that ALL staff complete a declaration of pecuniary or business interests. It is the responsibility of the headteacher to ensure this takes place, although the task is usually delegated to the school bursar, business manager, or other member of staff responsible for maintaining staff records. Internal Audit will expect to see a complete set of staff and governor declarations when they visit the school. There is often some confusion around what information needs to be declared on the pecuniary or business interests form and whether spouses/partners possible interest is relevant. It may be helpful to clarify the situation to governors with a covering letter when sending out the form. This letter also gives more guidance for governors on how to fill in the form. An example register, form and explanatory covering letter are included in the Term 4 2013 Governor Bulletin and are available on request from Governor Development Service.

Withdrawal from Meetings School Governance regulations also set out in detail the circumstances in which members of the governing body, or the headteacher, or any other person present at a meeting of the governing body, may be required to leave a meeting, or not take part in the discussion, or in the case of a governor, not vote. This might either be because they have a personal interest in the outcome of a decision, or because they are paid to work at the school. Personal Interest The general principle is that no one should be involved in a decision where his/her own personal interests may conflict with those of the school. For example, no person (including the headteacher) should be involved in a decision which:

o affects the award of a contract which could benefit that person or that person’s partner or family;

o affects that person’s employment, promotion or retirement, or the employment, promotion or retirement of one of that person’s partner or family.

Persons Paid To Work at the School Other than the headteacher, anyone paid to work at the school must withdraw from discussion and not vote on any matter relating to the pay or performance of anyone working at the school. Staff governors, in particular, need to consider their individual circumstances and position very carefully when matters arise such as a review of the school staffing structure. However, they need not withdraw where their interest is no greater than other members of staff. Staff governors can take part in general discussion on pay policy. Dispute over Withdrawal If there is any dispute as to whether a person should withdraw, the other governors present at the meeting must decide on this. If there is any reasonable doubt as to a person’s ability to act impartially he/she can be required to withdraw. Contact: Governor Development Service, 0117 903 1396: [email protected]

Governor Training provided by Bristol Anglican Diocese The Bristol Anglican Diocese have provided details of two forthcoming governor training sessions they are running that would be appropriate for Community schools and academies as well as Church of England schools. Please contact the diocese direct if you are interested in booking a place. Headteacher recruitment process training Thursday 17th October 2013, 6.15-6.30pm to 9pm The appointment of a new headteacher is the single most important task for a Governing Body to undertake. Unlike other appointments, governors cannot look to the current headteacher for assistance, as s/he must not be involved in the appointment of a successor. The recruitment and selection process requires a systematic approach. This is important because a selection panel must be able to demonstrate justice, fairness and an adherence to equal opportunities in all stages of the process. SMSC: Ofsted and Beyond Thursday 20th March 2014, 9-9.15am to 3.15pm This course is for all schools and Academies. Areas covered will be:

• A definition of SMSC • Ofsted Expectations • What outstanding Spiritual, Moral, Social and Cultural Development looks

Like • How the Spiritual, Moral, Social and Cultural overlap and are distinctive • Some practical ideas to take back and implement
