PREFACE
TO THE 2010 EDITION
1. The first Edition of this Brochure was released in December, 1998 by Lt Gen B K N
Chhibber, PVSM, (Retd), the then Hon‟ble Governor of Punjab and Chief Administrator, Union
Territory of Chandigarh. About 150 copies of the Brochure were printed by kind courtesy of
Lt Gen GL Bakshi, PVSM (Retd) and Late Lt Col AB Singh (Retd), Sigs and distributed to all
members of the 9th JSW and Affiliate Courses Association.
2. During April/May 1999 Lt Gen SK Bhatnagar, PVSM, AVSM, the then DGOS & Senior Col
Comdt very kindly volunteered to publish and distribute copies of the Brochure to all retired AOC
Officers and their next of kin/widows. This involved printing and distribution of approximately 1400
copies, which was a tremendous and commendable effort. An update of the Brochure as on 1st Sep
1999 was also published in the Oct 1999 issue of “Ord Talk”. Lt Gen SK Bhatnagar, PVSM, AVSM
once again kindly consented to publish and distribute the next Edition of the Brochure, which was
released in December 2000 at the Seventh AOC Reunion. In 2005 Lt Gen TA D‟Cunha, PVSM, ADC
the then DGOS & Sr Col Comdt very kindly agreed to undertake the publication and distribution of
2000 copies of the revised 2005 edition of the brochure. He also very kindly arranged for the release
of the 2005 Edition at the Eighth AOC Reunion.
3. Keeping up the excellent tradition of the Army Ordnance Corps, DGOS & Senior Colonel
Comdt has very kindly consented to publish and distribute this revised edition of the Brochure for
which I am personally grateful. It is due to such magnanimity that copies of this Brochure have
been provided free of cost so far to every one.
4. There was a tremendous and heartening response from a large number of Officers who received
the earlier editions of the Brochure. Demands for copies of the Brochure were also received from a
large number of retired officers from other Arms & Services and duly met. Some suggestions were
also received which have been incorporated in this Edition.
5. The „HELP CALL‟ family of Som Vihar has continued to function well. It is hoped that friends
who have received the Brochure in other areas/stations are making efforts to start similar self help
ventures for mutual aid.
6. The information given in this Brochure has been collected and collated from various sources
and is as accurate as possible. However, it will need to be updated from time to time. Any
suggestions for improvement are most welcome and will be appreciated and may be sent to the
undersigned.

INFORMATION FOR RETIRED/RELEASED OFFICERS
AND THEIR NEXT OF KIN
Medical Treatment
1. As one grows older, the availability and affordability of good medical treatment, is becoming
a cause of concern. The entitlements and alternatives are discussed in succeeding paragraphs.
Medical Care Of Ex-Servicemen (ESM) – Pre-April 2003
2. While in service all ranks of the Armed Forces and their eligible dependents were entitled to
full and free medical treatment. However, ESM were, on retirement, only entitled to a medical
allowance of Rs. 100.00 per month for purchase of medicines or in lieu could avail free “out-
patient”, treatment in service facilities. Limited “inpatient” facilities, after paying hospital stoppages,
were also provided, mostly as a welfare measure, and were subject to numerous restrictions and
stipulations. Such treatment did not cover major diseases. Moreover in non Military stations a
pensioner had to make his own arrangements. The problem of overloading of the service
Hospitals/MI Rooms due to the requirements of ESM pensioners was further compounded in 1998,
when “Non-Pensioners” were also authorized to get limited medical facilities in Service facilities
(subject to certain conditions). Retired service pensioners lacked a comprehensive Medicare scheme,
as available to their counterparts in the Central Services. This was a cause of great dissatisfaction of
the ESM and their Next of Kin. This resulted in a number of appeals, petitions and even a Public
Interest Litigation being filed in the Supreme Court on 09 May 1999 by the Confederation of Ex-
Servicemen Associations.
3. To provide some relief to ESM pensioners a privately funded Medical Benefit Scheme
(MBS) was introduced in Apr 91 under the Army Group Insurance Fund and a similar one by the Air
Force in 1993. However, these catered for high cost treatment for specified diseases and also had a
ceiling on the costs. More over only the members of the schemes were eligible for such benefits.
Ex Servicemen Contributory Health Scheme (ECHS
4. As a consequence of the above, a Medicare scheme for ESM Pensioners called the Ex-
Servicemen Contributory Health Scheme (ECHS) was finally sanctioned on 30 Dec, 2002, to
come into effect from 01 Apr 2003. ECHS is a comprehensive scheme of medical care of ESM
pensioners and their eligible dependents/next of kin, settled any where in the country and covers all
diseases including cardiac, cancer, renal, joint replacement and many others. This was to be achieved
through a network of 227 Polyclinics and empanelled Service/Civil hospitals. It was planned that all
the Polyclinics will be established and other arrangement made by Mar 2006. The scheme would then
take another two years (upto 2008) to refine and fine tune their functioning. The scheme is wholly
financed by Govt of India from Public funds, through the Army budget, with marginal contributions
from retiring and retired service pensioners, varying from Rs. 1800.00 to Rs. 18,000.00.
5. However due to a tremendous increase in the ESM, in 2010 approx 119 additional polyclinics
have been sanctioned. Also to cater for some outlying areas where the ESM population is less than
2500, some Mobile Polyclinic have also been planned.
6. All service personnel (eligible for pension) retiring wef 01 Apr 2003 and their entitled
dependents will automatically and compulsorily become members of the ECHS. For those who
retired prior to 01 Apr, 2003 or their widows/family pensioners, becoming a member of the ECHS
was voluntary/optional. Those who do not join the scheme will continue to get Rs. 100/- pm as
medical allowance and will continue to avail limited medical facilities as hither to fore. However,
they shall not be permitted to use any ECHS facility. The option of joining the ECHS was to be
exercised latest by 31 Mar, 2008 when the option to enter the scheme will terminate. Members of the
ECHS and their dependents are issued Smart Cards which have to be produced for availing treatment
facilities. As such they are advised to carry the smart card at all times. At present ECHS beneficiaries
when moving to another station temporarily, need to take an authorization letter from the designated
dependent polyclinic from drawing medicines at the new station. In order to obviate this requirement,

the ECHS has planned to issue upgraded “ALL INDIA” cards to the existing members. The cost of
each upgraded card will be Rs 135/-. Please contact your designated Polyclinic/Stn HQ/Regional HQ
for further details and procedure to be followed.
7. Since ECHS is in the initial stages, a number of changes to rules of emergency treatment,
referral procedures, issue of medicines etc are likely to be made from time to time. The existing
Referral Policy of Direct Referral to empanelled facilities is working satisfactorily in Non Military
Stations. However, in Military Stations the referral to Empanelled facilities is only available once the
Service Hospitals give non availability certificate of treatment facilities/bed space. This is creating
avoidable problems for an ESM patient who is sent from one place to the other. The other problem is
that the Polyclinic function only between 0800 hrs to 1600 hrs except Sundays and Gazetted
Holidays. What happens to the patients outside these timings and days? Frequent changes of the
“Empanelled Facilities” also creates avoidable confusion for the ESM, since in an Emergency, they
do not know, where to go. You are advised to contact your local Polyclinic/Station HQ/Regional
Centre for any personal complaints/queries or at the ECHS Website:

8. Refund of Contribution to ECHS. As per the direction/judgment dated 22nd
Aug 2006
passed by Hon‟able Supreme Court the ESM who retired prior to 1st Jan 1996 were exempted from
payment of contribution for becoming members of ECHS scheme. This is contained in Govt of India,
Ministry of Defence letter No 17(10)/06US(WE)/D(res) dated 13 Apr 07. However, inspite of
repeated reminders the Govt of India have not yet issued any orders for refund of the contribution
already made by ESM who retired prior to 01 Jan 1996.
VETERANS ABOVE 75 YEARS WILL BE ATTENDED OUT OF TURN AT THE
RECEPTION, FOR CONSULTATION AND FOR ISSUE OF MEDICINES
AT THE POLYCLINICS
Medical Entitlement For Non Pensioners
9. As a result of a change in definition from Ex-Service Pensioner to “Ex-Servicemen” vide AO
8/98, Non Pensioners and their families are entitled to limited medical facilities in the nearest MH.
This is subject to obtaining Medical Entitlement Cards from AG‟s Branch (MP 5 & 6) in terms of AO
10/97. The Medical Entitlement Cards will be in two Parts and will have to be carried/produced by
the individual when reporting to the Service Hospital for treatment. Part II will be validated by
Station Headquarters, once every 3 years, after the initial issue. For further details AG‟s Branch
/MP5(b), Army HQ, West Block III, RK Puram, New Delhi-110066 (Tele No. 26195669) may be

Financial Assistance For Medical Treatment
10. All Ex Servicemen who are not members of any medical scheme including AGI, AFGI and
ECHS and suffering from serious diseases, are given financial assistance by the Kendriya Sainik
Board for treatment in civil hospitals, in case they cannot be treated in MHs and have not availed of
similar assistance from other sources. For details and updated amount, please contact either the office
of the Regional Sainik Board or HQ Kendriya Sainik Board, West Block IV, RK Puram New Delhi-
110066 (Tele 26192361-62).
All Ex-Servicemen and widows who are in receipt of pensionary benefits of any kind and are
entitled to become ECHS members, are Not eligible for the above financial assistance from the
Armed Forces Flag Day Fund with effect from 31 Mar, 2004.
Assured Decent Last Rites Schemes (ADLRS).
11. This is a voluntary scheme where in an ESM/NOK are required to register themselves with
the ADLRS office located in the dependent CSD Canteen. They will be assured of an Hon‟able
Funeral. The ADLRS staff will assists in organization of Decent Last Rites. An expenditure upto Rs
2500/- can be made by the CSD Canteen Staff besides laying a wreath on behalf of the COAS.
Alternately Rs 2500/- will be paid to the family/NOK. In case NOK is unable to inform the staff of

ADLRS before the funeral the amount can be claimed subsequently from the dependent CSD
Canteen by providing proof of the death within a reasonable period. (Auth : B/45322/174-2005/VIP

Army Group Insurance Fund
12. One of the best things to have happened in the Army was the creation of the Army Group
Insurance Fund (AGIF). It is an efficient and well run organization, where everyone is extremely
sympathetic and prompt in providing assistance. There is continuous effort to improve the benefits
for the members. The organization provides benefits as given in succeeding paragraphs.
13. Extended Life Insurance Cover After Retirement. All extended Insurance (EI) cover
certificate holders of the AGIF who retired prior to 01 Apr 94 (started for eligible officers retiring
after 01 Jan 1981 and JCOs/OR after 01 Apr 81) were covered for a period of 15 years from the date
of retirement or 70 years of age, which ever is earlier, without amending the certificates already
issued. In case of officers who have retired after 01 Apr 94, the period of cover was 20 years or 70
years of age, which ever is earlier. W.e.f 31 Dec 2004 the benefit was increased to Rs.4 lakhs with
period amended to 75 years of age or 25 years from the date of retirement, whichever is earlier. This
has now been further improved with EI cover of 6 Lakhs and age of 75 year or 26 years from date of
retirement whichever is earlier wef 30 Jun 2009. A detailed letter from AGI Bhawan is attached at
Appx „B‟.
General Insurance Corporation (GIC) – For Non Pensioners
14. Even though some assistance is available from the MH or Kendriya/Rajya Sainik Board for
some specified fields of treatments, there can be so many situations, where the cost of treatment can
be prohibitive. To provide for such an eventuality, it is advisable for all Non Pensioners , to take a
Mediclaim Insurance Policy cover for themselves and their families. Due to recent liberalisation,
such cover is now available up to the age of 80 years. A number of schemes are now available. The
premium amount is calculated on the basis of age and amount of insurance cover. Premium amount
upto a maximum of Rs 15,000/- (Rupees Fifteen thousand only) is fully deductible, from the income
for the year, under Section 80 D of the Income Tax Act (Rs 20,000/- for Senior Citizens).
Cancer Insurance – For Non Pensioners
15. Cancer is a dreaded disease. Besides being agonizingly painful, the cost of its treatment is
frighteningly high. Prudence demands that everyone should provide for a such a large financial
contingency, which God forbid, may arise in one‟s lifetime. Even if one may be already covered
under a Medical Insurance Policy, such a cover may not be sufficient for long term treatment and also
where the monetary limit is exhausted. A number of schemes are available which provide once-in-
life-time payment for treatment of cancer. Outline details of two schemes in Delhi are given below:-

A one time donation of Rs 7,000/- for self and Rs 6,000/- per person for additional members
of the family provides for treatment of full life. For further details contact the above Society.

16. The above centre is running a scheme known as Cancer Rahat Yojana. Under the scheme a
donation of Rs 7,000/- covers a person for a sum of Rs 2 Lacs. The cover goes upto Rs 10 lacs for a
donation of Rs 35,000/-. Spouse and dependents can become members at concessional rates.
However, certain terms and conditions are required to be met at the time of submitting application.

Those diagnosed for Cancer prior to becoming member are not eligible to join the Scheme. For
details contact the above Society.
17. The amount donated by the Donor for cancer insurance is exempted from Income Tax to the
extent of 50% under Section 80-G of Income Tax Act, 1961, for the above schemes. Similar schemes
may be available in Hospitals near your place of residence. A perusal of the list of hospitals on the
approved list of Army Group Insurance Fund can be of help. A deliberate effort to get cancer
insurance cover will definitely be worthwhile.
Emergency Identification
18. While helping a person involved in an accident, rescuers look for any mark of identification
and anything which says “In case of emergency”, “call so and so”. Many people carry that, but
doctors on the scene wish that people should carry medical ID Cards as well. Such cards display
major medical information which the ill or injured person may not be able to convey. Lack of
information leads to a waste of time which is crucial when it is a matter of life or death.
19. Consider the possibilities : A epileptic who goes into a daze before a fit can be mistaken for a
drug addict. A woman who is not so obviously pregnant may get treatment that affects the baby. Lay
rescuers sometimes ignore a person in a diabetic coma as drunk. Even contact lenses can damage the
eyes if left for long on an unconscious person. If doctors are unaware that the victim is a heart patient
taking anti-clotting drugs, they may not be able to stop his bleeding. A person with a penicillin
allergy may die if it is given during an emergency. The possibilities are scary.
20. A simple home made emergency card can prove to be life saver. All you need to say is

*Drug Allergies............, *Medicines taken regularly............, *Blood Group....... . Retired persons
may also include *PPO No. and ECHS Card No. Always keep this card with you in your

Blood Donation
21. If you are planning to undergo surgery, your best safe guard against infection is to be your
own blood donor. This procedure known as “Autologus Transfusion” ensures that patients do not
face any risk of getting any diseases through donated blood that may be contaminated. However, for
emergencies, always keep handy an updated list of prospective and willing blood donors. This is
particularly important for those having Negative (-) blood groups like B (-) or AB (-), etc.

22. A large number of serving and retired AOC pers have settled in various parts of the country.
The Dte Gen of Ord Services strives to render all possible help for donation of blood to the serving
and retired officers, and PBOR of the AOC. This SOP has been issued to streamline the arrangements
of „BLOOD DONATION‟ to both serving and retired officers, and PBOR of the Corps.
23. The responsibilities for blood donation to the serving Officers and PBOR will rest with
Ordnance units to which they are posted. However, the detailed responsibilities for blood donation for
both serving and retired offrs and PBOR are elucidated below :-

Ambulance Services
24. All major hospitals have ambulance services to cater for emergency evacuation. The charges
vary from one hospital to the other and also depends on the type of service provided (with or without
physician and nurse accompanying the ambulance). Always keep the “Emergency Telephone
numbers” of the hospitals of your choice handy, for use in an emergency.
25. In an extreme emergency, where time is of essence and where arrival of an ambulance
or other help is likely to be delayed, „Do Not Wait‟. Call a taxi from the nearest taxi stand and
go to the hospital. The taxi driver can even help you if required. This may save your life.
Documentation
26. Please inform/get in touch with AG‟s Branch, MP5(b) for the following :
(a) In case of officers getting married after retirement CDA(P) is also to be informed for
endorsing the name of wife on the PPO for family pension benefit. AGIF should also be
informed for change of nomination for Extended Insurance Policy and the ECHS for
amendment to ECHS card.

necessary documents for future use.
27. Payment of Platinum/Demise Grant : Army Officers Benevolent Fund.
(a) All retired officers are eligible to receive the Platinum Grant of Rs.50,000/- on
attaining the age of 75 years. However, in case the retired officer passes away before
attaining the age of 75 years, his NOK is entitled to the receive the same amount as
Demise Grant from AOBF. An application as per Appx „C‟ is to be sent to AOBF, for
the Platinum Grant. Also connect with Para 70.
(b) While the platinum grant amount of Rs 50,000/- is subject to income tax, the
Demise Grant paid to the Widow is exempted for the same.
(c) Payment will be made on the following sliding scale based on number of years of

Restoration of Commuted Portion of Pension
28. Armed forces personnel who have commuted the admissible portion of their pension are
entitled to have the commuted portion restored on expiry of 15 years from the date of retirement.
Each pensioner is required to apply on the form as per Appx „D‟ to the Pension Disbursing
Authority/Bank/Post Office who will restore the commuted portion of the pension as mentioned in the
Pension Payment Order (PPO) and will also pay the arrears, if any.
Execution of „Will‟
29. „Will‟ is a legal expression of disposal of one‟s possessions as per his/her wishes after their
death. If a person dies without making a „Will‟, it is termed as „INTESTATE‟. The „Will‟ is
governed by Indian Succession Act 1925. Also refer to Army Order 4/91. There are two types of
„Wills‟ - General „Will‟ and Privileged (Special Rights) „Will‟. A „Will‟ executed by a Serving
soldier, airman or naval person, is called a Privileged „Will‟ and is, usually, not questioned by Law.

A person making a will is called a „Testator‟. Only execution of the General „Will‟ is being discussed
in succeeding paragraphs.
30. Why to make a „Will‟
(a) It is never too early to execute a “Will” and every one is advised to do so at the
earliest.
(b) When an individual gets married/ remarried he should consider executing a “Will” in
favor of his wife.
(c) No one should be compelled to make a “Will” if for any reason, he is not inclined to
do so.
(d) On the death of an individual, if no „Will‟ is made i.e. “Intestate” then the
individual‟s properties are equally distributed amongst his or her heirs. In such a case the
individual‟s spouse or unmarried children or an ailing relative is likely to suffer unintended
financial loss.
(e) Provident fund, Gratuity, LIC claims etc are generally nominated. However, the
nominated person is entitled to receive the amount only on behalf of the rightful heirs, who
will ultimately not get these amounts if the same is not specifically stated in the „Will‟.
(f) House or other immovable properties, even if held in joint names, the same can be
claimed by other heirs unless it is specifically so mentioned, in the „Will‟.
(g) Even if there is only one heir and no „Will‟ is made, other relatives can stake claim
on the properties by taking advantage of the provisions of law. In some cases even the sole
heir is called upon to prove his or her bonafides in the court of law.
(h) More often than not, the „Will‟ is the only tool to ensure proper and dignified
treatment in the old age.
(j) There are many occasions in one‟s life, when one feels highly obliged towards some
one in particular or one feels like giving a helping hand to some individual or a social
organisation or even for a religious cause. One of the best ways to give expressions to your
feelings is to allocate a suitable asset through the medium of your Will.
(k) On occasions, if all the offspring‟s are not enjoying the same financial status, a
suitable balance can be sought through the medium of the „Will.‟ Even for a disabled child
adequate provision can be made through the „Will.‟
(l) Every lady can and she should make a suitable „Will‟ of her possessions as per her
desire. Particularly, the ornaments and other household items are considered as STREE
DHAN or the Lady‟s Wealth and the lady is free to dispose off the same as per her wish.
31. Attributes of a „Will‟
(a) A „Will‟ should be clear-cut, unambiguous and precise.
(b) The „Will‟ should not have been made under duress.
(c) No stamp paper or stamp duty is required. Plain white paper and preferably black
pen should be used.
(d) There is no special style or word phrasing necessary, but the language should be
unambiguous. Mostly the „Will‟ is drafted by persons who have little knowledge of law and
often have little command over the language. In such cases, it is better to consult a solicitor.

(e) As far as possible the „Will‟ should be self written in own handwriting and signed.
The illiterates should place left hand thumb impression on the document.
(f) If the person making the „Will‟ is sick, the same should be signed in the presence of a
Doctor. A suitable certificate from the doctor stating that the individual making the „Will‟
was in full control of his faculties and capable of conscientious thinking while signing the
same, should be endorsed on the „Will‟.
(g) The signing of the „Will‟ should be witnessed and signed by at least two individuals,
recording their names and addresses. The witnesses, as far as possible, should be younger in
age than the person making the „Will‟ and should not be beneficiaries of the „Will‟.
(h) It is not compulsory to register the „Will‟. There is a provision for registration of the
„Will‟ either by the Testator (maker of the „Will‟) or by the person nominated as the executor
of the „Will‟ and there is no time restriction for the same. The main advantages of registering
the „Will‟ are, that the same is considered authentic and if the original is lost, then a certified
copy of the same can be obtained from the Registration Office. Another advantages is that
those seeking mutation, in case of registered „Wills‟ will no more need to avail “No
Objection Certificates” from other legal heirs of the property. A sealed envelope containing
the copy of the „Will‟ is to be handed over to the Registration Office for safe custody. On
demand of a copy, the envelope is opened and the „Will‟ is first copied in the register. A
copy of this document, duly certified, is then handed over.
(j) The „Will‟ can be changed or modified by the maker at anytime. However, if a new
document is made or a correction slip is attached (called a CODICIL) the original formalities
must be followed. In the case of a new document, it should be clearly stated that, “This
„Will‟ supersedes the earlier „Will‟ made on - (date)”. In absence of such a mention the new
„Will‟ may be considered as void.
(k) To ensure that the arrangements made in the „Will‟ are properly carried out, a person
or a bank may be nominated in the „Will‟ as the Executor of the „Will‟. Suitable
remuneration for the Executor and his expenses should be catered for in the „Will‟.
(l) Format of a specimen „Will‟ is attached at Appx „E‟
32. What can be „Willed‟.
(a) All the properties acquired from own earnings e.g salaries, business, investments,
shares, provident fund, gratuity, LIC claims etc qualify for disposal as per one‟s „Will‟, and
the same cannot be challenged by the heirs.
(b) As per Hindu law, a Hindu lady is the bonafide owner of the immovable properties in
her name in addition to all the ornaments and household goods received by her from her
parents, her husband, her in laws etc and is free to dispose off the same as per her own desire.
(c) An individual generally „Wills‟ his entire possessions to his or her spouse on death.
Properties gained through hereditary rites are liable for equal distribution to the direct heirs.
It is convenient to mention details of such properties as well as the direct heirs in ones „Will‟.
(d) When some self acquired properties are held in joint names, the portion of the
properties owned by an individual can be disposed off through the „Will‟.
(e) It is convenient to attach a detailed list of the entire belongings, with the „Will‟. It is
inevitable that such a list will undergo certain changes in due course of time. A suitable
mention of action to be taken in such an eventuality can be incorporated in the „Will‟.

33. When the „Will‟ can be Declared as Void
(a) If it is established that the „Will‟ itself or some portion of it has been written under
duress.
(b) If there is over writing and changes which are not authenticated by the maker of the
„Will‟ and the witness.
(c) If the „Will‟ is not duly signed by the witnesses.
(d) If the provisions made in the „Will‟ are impossible to comply with or not legal or are
derogatory to social harmony.
Obtaining a “Probate of Will”
34. Probate means to determine judicially the validity of a „Will‟ and is granted by a District
Judge when a „Will‟ exists. For this, the person in whose favor the „Will‟ is made or the executor of
the same must make an application to the District Judge of competent jurisdiction in accordance with
Section 264 of the Indian Succession Act, 1925. The District Judge, in turn will send a copy of the
application to the Judge in whose jurisdiction the late Testator had fixed residence. In order to obtain
Probate of „Will‟, there are two legal requirements. Firstly, to establish in the civil court of law, that
the „Will‟ in question had been made voluntarily and signed by the deceased Testator in the presence
of independent witnesses, and secondly, to ascertain that there was no subsequent „Will‟ executed by
the deceased. To establish the first requirement, those who have signed as witnesses are required to
appear in the civil court and give evidence to authenticate the „Will‟ in question. Once this is done,
the court promulgates notice in Govt. Gazette and local newspapers, to whom it may concern, to
produce before the court within the given period, any „Will‟, if held by any one claiming to be made
by the so named Testator. When the „Will‟ in question is not contested by any other member of the
family, a Probate of „Will‟ is issued by the court. In case witnesses to the „Will‟ have predeceased or
are not traceable then the nominees have to obtain succession certificate for claiming the estate of the
deceased. If the „Will‟ is registered with the Registrar/Sub Registrar, it obviates the requirement of
presence of witnesses to appear before the Magistrate to authenticate the „Will‟ and obtaining of
probate of „Will‟ is made easier.
35. In case of a „Will‟ made by a Hindu, Sikh, Jain or Buddhists, probate is mandatory for
immovable properties situated in West Bengal, Pondicherry, Chennai and Mumbai. Probate is not
necessary in other states of India especially so if the will is a valid registered document. However if
the court has to issue a decree against a debtor of the testator (Insurance Policy or a bank deposit),
probate of the „Will‟ is essential. However if no executer is appointed in the „Will‟ the question of
grant of probate does not arise. Further, non-registration of a „Will‟ does not come in the way of
obtaining a probate.
Obtaining of Succession Certificate
36. Succession in legal language means the order in which or the conditions under which one
person after another succeeds to property, dignity or title. Application for grant of a succession
certificate is required to be made to the District Judge. The Petition is said to be signed and verified
by or on behalf of the applicant in the manner prescribed by the Code of Civil Procedure. The
Petition must contain the date and time of death of the deceased, the ordinary residence of the
deceased at the time of his death and if any such residence was not within the local limits of the
jurisdiction of the judge to whom the application was made, then the details of the property of the
deceased within those limits. In addition, the petition should also contain the details of the family or
other near relatives of the deceased and their respective residences, the right in which the claim and
the debts and the securities in respect of which the certificate is applied for. On receipt of the
petition, the District Judge shall fix a day for the hearing and cause notice of the application and of
the day fixed for hearing. On the day fixed for the hearing, the District Judge shall proceed to decide
in a summary manner the right to the grant of certificate. When the judge decides that the right to the
properties belong to the applicant, he shall make an order for the grant of certificate to the person

A Word of Caution
37. (a) The existence of pin holes in a „Will‟ is likely to give rise to a inference that some
documents were attached to the „Will‟ and thus may create difficulties at the time of proving
the „Will‟ and obtaining a probate in a court of law if and when the necessity arises. All are
therefore advised in their own interest not to pin or tag the „Will‟ executed by them. It should
also be ensured that a certificate is given in the „Will‟ that no attachments exist to the „Will‟.
In case the details of properties (movable/ immovable) are many, specific mention of such
attachments should be made in the text of the „Will‟.
(b) Of late a tendency, to treat the parents/elderly dependents with a degree of
callousness and contempt, is becoming rampant in our society. It is therefore, advisable
for the Testator to make full provision for life for total financial independence for self
and spouse while executing the „Will‟.
Living „Will‟
38. Many friends and colleagues have asked me to frame some guidelines on what they can do to
safeguard their interest while they are still alive.
39. Rapid advances in medical science have given longevity to human beings through improved
diagnostic techniques and treatment procedures. However, in many cases old age, which is never
isolated from sickness, is a problem by itself. With the concept of “Nuclear” families becoming the
rule, old people, who in the Joint family system could expect to be looked after by other members,
now have hardly any one that they can bank upon to look after them. Moreso when they are living by
themselves and are isolated.
40. A „Will‟ made under the Indian Succession Act, 1925 caters for the distribution of assets
created by the Testator, after his death. However what happens, when the person is still alive, but has
little or no control over his faculties. Euthanasia as a concept of painless exit is still being debated in
societies all over the world. Perhaps a clear cut answer, which is morally, legally and ethically
acceptable, may never be found.
41. To cater for such a situation, that is till death, it is felt that making a separate „Will‟ called
“LIVING WILL‟ could be considered. This „Will‟ should include all the wishes/desires of the person
and how he would like these to be carried out, when he is unable to do so himself, till his death. This
„LIVING WILL‟, only relates to person himself and will not have any effect on the „Will‟ made
under the Indian Succession Act, 1925.. The contents of the „LIVING WILL‟ should be known to the
immediate family members or in their absence to close friends since they will be needed to execute
the provisions of the „Will‟. Such a „Will‟ should preferably be witnessed by the spouse and by at
least one child (son/daughter) or a close friend and kept with them.
42. A suggested format of the „LIVING WILL‟ is attached at Appx „F‟. Changes in the format
may be made to suit your own particular circumstances. Legal/Medical advice, if considered
necessary, may also be obtained before finalizing the „LIVING WILL‟.
43. Organ Donation
(a) Organ donation means gifting someone a life. When one donates an organ, it
means a pledge, during their lifetime, that after their brain death, their organs can be
transplanted to help terminally ill patients, giving them a new lease of life. For a human
being, there can be no action more noble than to volunteer to become a organ doner. So
please volunteer at the earliest. For further details contact ORBO (Organ Retrieval

26588360 or call 24 hrs Help Line Tele No. 1060. Army Hospital (R&R) and other
Service Hospitals can also be contacted for details/guidance. The form of pledge for
organ donation used by Army Hospital (R&R) Delhi Cantt is enclosed as Appx „G‟.

(b) Where the offr or his spouse have pledged to donate their organs, immediate
action should to taken to inform such organization in case of death. The eyelid should be
closed and the body should be kept in a room where the fan and cooler have been
switched off and if possible the Air Conditioners have been switched on.
What Your Spouse/NOK Should Know
44. You might have made enough money to make your family comfortable for the rest of their
lives, but will they get what is rightfully theirs. Have you ever bothered to think what would happen
to your family after you have departed from this world. In modern life matters are not as simple as
they should be. Every aspect needs a document, a written statement. May be you do have them, but
where are they? Are they easily accessible? Even the educated and working ladies generally do not
take any interest in financial matters. They take pride in saying that my husband looks after
financial/bank matters. Please tell your Spouse/NOK where/how to locate and to operate the
following while you are alive. Also prepare a file containing all letters which are required to be sent
by the widow/NOK to various authorities, with all columns completed less date and cause of death
being left blank. The widow should be able to only fill these blank columns, date the letter , sign and
post the same. Separate envelopes duly addressed should also be attached with each letter. This action
will be of immense help to the widow in her time of grief.
(a) Your „Will‟
(b) Details of Bank Accounts and BANK LOCKERS (including key number)
(c) Bank/Post Office Accounts and lockers should be in joint names. Facilities of nomination
should be availed. Nominee should be other than joint operators.
(d) Fixed Deposits should be held jointly. Date of payment of interest as well as of maturity
should be noted in a Diary or on a calendar for timely action.
(e) Cumulative Time Deposits of Bank/Post Office, PPF etc. Pass Books should be got updated
regularly.
(f) Birth Certificate.
(g) Motor car/scooter papers and insurance papers for these.
(h) Income Tax/Wealth Tax files.
(j) Policy files – LIC, GIC, Health/Mediclaim/Fire/House-hold Accident etc.
(k) Pension Papers, if superannuated.
(l) Property files – Real Estate, Flat ownership etc.
(m) Property Tax papers.
(n) Telephone file – first original Bill, where in rent equivalent to twelve months has been
retained as security, should be preserved.
(o) Deposit receipts for Gas/Electricity/Water etc.
(p) Passport, Driving License, Identity Card, ECHS Card, Canteen Smart Card, Sainik Board
Ex-Serviceman Identity Card, Club/Institute membership cards etc (photo copies thereof to be
kept separately).
(q) Medical file including relevant test reports and medicines taken regularly.
(r) Share certificates, their allotment advise for ascertaining capital gains.
(s) Rent papers (Receipts, Lease document and any related correspondence).
(t) Pending litigation papers and court decision, if any.

(u) Details of loans, if any, taken for House-building/purchase of car etc and their repayment

(v) Details of CREDIT CARDs with dates of validity.
(w) Any other matter of interest to your family/NOK.
Note :- It is essential to train your Spouse/NOK to be able to deal with above mentioned
matters individually and independently or with the help of some friend or relative in whom
she has faith. As a matter of policy, it is better to have all the relevant documents in
joint names.
45. Sale and Disposal of NSP Weapons and Exemption From Payment of Fee for Grant
or Renewal of Arms License .
(a) NSP Weapons.
(i) Serving/Retired Officers, JCOs and Serving Class I Civilian Gazetted
Officers are entitled to purchase NSP weapons ex-Ordnance as per SAO 4/S/2006.
Entitled persons will be allotted only one NSP weapon during his entire service
including post retirement period. Any officers/JCO who has been convicted under
Army Act or those who are below 21 years of age will not be entitled for allotment
of any NSP weapon. The weapon will be allotted by Standing Allotment Committee
and approve by the MGO. Application for allotment of NSP weapon should be fwd
to IHQ of MoD (Army) (OS-15A).
(ii) Resale of NSP weapon will be governed by Army Act 1959, Chapter II with
prior sanction of the Standing Allotment Committee. NSP weapon purchased ex-
Ordnance will be sold at reasonable rates to entitled persons as given in (i) above. If
sanction to sell/transfer as mentioned above is not accorded by the Standing
Allotment Committee, the weapon will be returned to COD Jabalpur by the
allottee under information to the Civil Licensing Authority.
(iii) On demise of an Individual the legal heirs of the deceased weapon
holder may apply to the Standing Allotment Committee for retention of the
weapon as family heirloom on sentimental reasons. If sanction for retention is
not granted, the weapon will be returned to COD Jabalpur.
(b) Under the provisions of GSR-993 dated 13 Jul, 1962, notified by Govt of India,
Ministry of Home Affairs, Ex-Servicemen (who are entitled to wear the uniform on special
occasions as per Defence Services Regulations) are exempted from paying fees for grant or
renewal of Arms License, for certain specified categories of weapons (along with
ammunition). So do check with the concerned local licensing Authority and avail of this
concession. Also do carry your Ex-Servicemen Identity Card as well as a copy of the Pension
Payment Order (PPO) for verification, if required.
Reverse Mortgage .
46. If the retired officer owns a property and lives in it, the banks offer what is known as
“Reverse Mortgage” to maintain dignified living style. That is the bank will pay the officer a regular
monthly (income tax free) amount for his life time. This cumulative amount will not be recovered
from the offr or his spouse at any stage till their demise or till they vacate the property. The bank will
recover the dues either from the legal Heir or by disposal of the said property. If interested, please
consult your bank for more details.
Pension Payment To Joint Bank Accounts With Spouse Allowed.
47. Government has decided to permit credit of pension to a joint account operated by
pensioners. This will be with his or her spouse, in whose favor an authorization for family pension
exists in the Pension Payment Order (PPO). The joint account of the pensioner could be operated

either by „Former or Survivor‟ or „Either or Survivor‟ basis subject to the certain terms and
conditions. They are as follows:
(a) Once pension has been credited to a pensioner‟s bank account, the liability of the
Government/Bank ceases. No further liability arises, even if the spouse wrongly draws the
account.
(b) As pension is payable only during the life of a pensioner, his/her death shall be
intimated to the bank at the earliest. This is to be done within one month of the demise, so
that the bank does not continue crediting monthly pension to the joint account even after the
death of pensioner. If however, any amount has been wrongly credited to the joint account, it
shall be recoverable from the account and/or any other account held by the pensioner/spouse
either individually or jointly. The legal heirs, successors, executors, etc., shall also be liable
to refund any amount, which has been wrongly credited to this account
(c) Payment of Arrears of Pension (Nomination) Rules 1983 would continue to be
applicable to this account. This implies that if there is an „accepted nomination‟ in accordance
with Rules 5 and 6 of these Rules, arrears mentioned in the Rules shall be payable to the
nominee.
48. Existing pensioners desiring to get their pension credited to a joint account, are required to
submit an application to the branch bank, from where they are drawing their pension in the devised
form, copy attached at Appx „H‟.

Precautions to be taken for Safety .
49. It is suggested that older persons, specifically those staying alone should observe the
following precautions :-
(a) Get police verification of your domestic help done. Also keep a photograph and
finger prints of your servant.
(b) As far as possible, avoid employing foreign nationals as it is difficult to verify them.
(c) Install a “Magic Eye” and door chain on the entrance door. Instruct your servants not
to open the door without your permission.
(d) A stranger could mean danger. Do not let in strangers, even for a glass of water.
(e) Verify over telephone, the genuineness of strangers, who drop in with a relative‟s
reference.
(f) Be in regular touch with neighbours and relatives.
(g) Preferably install an alarm system to alert neighbours in an emergency.
(h) Avoid any unnecessary show of wealth.
(j) Avoid employing unknown persons as masons, carpenters, painters, plumbers etc.
Treat with suspicion, their reappearance without being called.

50. Before an Earthquake
(a) Keep a torch, a portable transistor radio, and some eatables eg. Chocolates or biscuits
in a handy place.
(b) In your home, keep corridors clear of furniture and toys.
(c) Attach shelves, gas cylinders, vases, and flowerpots etc. to the walls.
(d) Place heavy or bulky objects on the floor or the lowest shelves.
(e) Every family member should know how to switch off the electricity, water and gas
supply.
51. During an Earthquake
(a) Keep calm, do not rush to the doors or exits, never use the lift, and keep well away
from windows, mirrors, chimneys and furniture.
(b) Protect yourself by staying under the lintel of an inner door, in the corner of a room,
under a table or even under a bed.
(c) If you are in the street, walk towards an open space. Keep away from buildings,
electric wires and slopes.
(d) If you are driving, stop the vehicle away from buildings, slopes, electric wires and
cables and stay in the vehicle.
52. After an Earthquake
(a) Keep calm, switch on the transistor radio and obey any instruction that may be
broadcast.
(b) Turn off water, gas and electricity.
(c) Expect aftershocks.
(d) Do not smoke or light any matches nor turn on any switches. Use a torch.
(e) Try to put out a fire, if any, if you cannot, call the fire brigade.
(f) Avoid places where there are loose electric wires and do not touch any metal objects
in contact with them.
(g) If people are seriously injured, avoid moving them unless they are in danger. Await
rescue teams and also tell them if you know about any people buried in the debris.
(h) Eat something. You will feel better and more capable of helping others.
(j) If your home is badly damaged, you will have to leave it. Collect water containers,
food, any ordinary and special medicines (for persons with heart complaints, diabetes etc.)

54. Information about the death may be communicated by the family members/friends of the
family or by the designated unit to the DGOS/OS 14 (Tele No. 011-23019146/47), ADGOS (CN&A)
(Tele : 011-23012165) and OS-10-A(iii) (Tele: 011-23019309). Details of the officer, address of the
next of kin and likely date time and location of the funeral should be intimated to designated
authorities as mentioned in Sub para (a) and (b) above. Necessary help for settling the dues of the
deceased will be provided by Dir OS (Adm) in case of Retd Officers and nominated Ord unit in case
of PBOR. In addition to the above Death/Demise Grant out of the AOC C&W fund will be paid as
follows :-
(a) Demise Grant For Retd AOC Offrs. In case of death of a retired AOC Offr, a
sum of Rs 4000/- is paid to the NOK in lumpsum. This amount is paid by OS-14 for offrs
who reside in Delhi and NCR and for others, it is paid by AOC Centre.
(b) Death Grant For Serving AOC Offrs. In case of death of a serving offr, a sum of
Rs 18000/- is paid to the NOK by AOC Centre Secunderabad. This amount is paid in 12
installments @ Rs-1500/- per month.
Immediate Action to be taken by family / friends.
55. (a) If the deceased had registered with a Organ Retrieval Banking Organization
(ORBO) for donation of organs, they should be informed immediately to do the needful.
Also see Para 43.
(b) Inform relatives and friends.
(c) Decide the time, date and place where funeral is to be done and inform all
concerned including the local unit responsible for providing assistance in organizing funeral
services, for necessary action.

(d) Obtain Death Certificate from the Hospital/Attending Doctor or a Registered Medical
Practitioner.
(e) Arrange a vehicle/Hearse for carrying the body.
(f) Arrange material required for the cremation.
(g) Obtain a cremation certificate from the cremation ground authority.
(h) The certificates mentioned at (d) and (g) above are to be submitted to Municipal
Authorities (Registrar of Births and Deaths) for issue of the Death Certificate.
Note : Please check and ensure that there are no spelling or other mistakes in the death
certificate. All details must be correctly recorded.
PLEASE OBTAIN AT LEAST 25 TO 30 OR MORE COPIES OF THE DEATH
CERTIFICATE FROM MUNICIPAL AUTHORITIES WHO MAINTAIN REGISTER OF
BIRTH/DEATHS. THE WIDOW/ NEXT OF KIN SHOULD ALSO GET ABOUT 30 COPIES
OF THEIR PHOTOGRAPHS DULY ATTESTED.
Actions after the Funeral
56. Even though death is inevitable, our families and we are least prepared for such an eventuality. In
most cases the Widow/Next of Kin do not know what should be done to get the dues and avail of
other benefits. Officers are advised to maintain a file on “Action to be taken” with details duly filled
in and explained to the Next of Kin, so that they can initiate correspondence to avail of the under-
mentioned entitlements :-
(a) Family pension.
(b) Army Group Insurance Fund Benefits under extended insurance scheme (If
applicable).
(c) Army Officers Benevolent Fund.
(d) Canteen facilities.
(e) Benefits (if any) from Regimental/Corps Funds.
(f) Benefits (if any) of Personal Accident policies issued with Medi Claim Policies, Car
Insurance Policies, Household Insurance Policies, Credit cards etc.
57. Enhanced, special and liberalized benefits are granted only on application by the entitled and

Intimation of Death
58. Death of an Officer is to be intimated/informed at the earliest to a large number of authorities
as per the suggested list given below :-
(a) In the case of death due to an accident, lodge an FIR at the nearest Police Station at
the earliest. This will be required for claims on Insurance Companies as well as for
processing payment of compensation by the concerned authorities.

(e) Directorate of the Regt/Corp concerned (Coord Section).
(f) Inform Regional Head Quarter of ECHS.
(g) Various clubs for either transfer of membership to the widow or for refund of
security deposits. A suggested specimen letter to the clubs is enclosed as Appx „L‟.
(h) Municipal authority for transfer of property tax details/AWHO/NOIDA Authority
etc. as applicable for the transfer of House/Flat in the name of the widow and for change of
mutation.
(j) Telephone authority for transfer of telephone connection.
(k) Electricity Authority, Water supply Authority for transfer of name for the Meter
Connection.
(l) Rationing Authority for change of name of Head of Family in the Ration Card.
(m) Income Tax Authority for finalising the Tax return of the deceased. A suggested
specimen letter to the ITO is enclosed as Appx „M‟.
(n) Bankers for encashment of FDR‟s, Pension, Loans etc.
(o) RTO for change of ownership of car/scooter.
(p) Licensing Authority of the Police for transfer of Private Fire Arms.
(q) LIC/GIC, if applicable, in respect of the insurance policies.
(r) If proper WILL exists, approach court having jurisdiction for “Probate of WILL”,
and Succession Certificate for mutation of property, transfer of shares etc. Also see Para 29 to
37.
(s) Zila/Rajya Sainik Welfare Board for Widow Identity Card. Specimen letter at
Appx „N‟. Information about Rajya Sainik Board, Delhi is at www.rsbdelhi.nic.in .
(t) Concerned post Office for settlement of deposits of Saving Bank Account, NSS,
NSC, PPF etc.
(u) Obtain Medical Treatment Entitlement Card (if not earlier obtained by the officer)
from AG‟s Branch MP 5(b). Specimen letter is attached at Appx „A‟ and Annexure 1 to
Appx „A‟.
Procedure for Claim of Benefits
59. Ordinary Family Pension .
(a) Ordinary family pension at the rate of 30% of the last pay drawn by the officer is
entitled to the widow and after her death to eligible children. Son is entitled to Family
Pension upto 25 years of age/getting married or earning more than Rs 3500/- per month,
Unmarried/Widows/Divorced daughter are entitled to Family Pension for life or till re-

marriage/earning more than Rs 3500/- per month. Now a days the PPO issued by CCDA (P),
Allahabad on retirement includes the joint photographs with spouse, name of the spouse
as well as family pension admissible in case of his/her death. In such a case the widow has
only to intimate the death of her husband to the Pension Disbursing Authority (PDA)
through a simple letter. This should be done at the earliest but not later than one month from
the date of demise of the officer. Copies of this letter should be endorsed to all concerned
authorities e.g CCDA (P), AG‟s Branch /PS 4( c), AG‟s Branch/ MP 5(b), AG‟s
Branch/CW-8(AOBF), AGI, IHQ of MoD (Army) (Coord Section of Regt/Corps Concerned)
and Min of Def (Pen-C). A specimen letter is attached as Appx „J‟. Based on this letter,
the bank is required to pay the family pension to the widow as indicated in the PPO, in the
Joint Account.
(b) Where the retired officer was drawing pension in a Joint Bank Account with his
spouse the widow can continue to draw her family pension entitlement through the same
account. The earlier requirement of opening a separate single account will not apply in such
a case.
(c) Where such an endorsement for entitlement for family pension does not exist in the
PPO, the widow has to submit an application for family pension on Form No MPB 501 copy
attached at Appx „K‟ to CCDA (P), Allahabad in triplicate through AG/MP-5(b) to enable
them to sanction the family pension. However, while awaiting formal sanction from
CCDA(P), Allahabad, the PDA will pay provisional pension to the widow in the single
account which the widow would be required to open, preferably in the same branch where
the officer had been drawing his pension. This account number is to be intimated by the
widow to the CCDA(P) as well as the PDA.
(d) Parents and brothers/sisters are not authorized ordinary family pension in case of
officers who die as Bachelors.
(e) Ordinary Family Pension at Enhanced Rate In case the officer dies within 7
years of retirement or before completing the age of 67 years, the widow is paid family
pension at Enhanced rate, which is double the rate of ordinary family pension as given above
for a maximum period of 7 years or till the officer would have attained the age of 67
years, whichever is earlier, subject to a maximum of 50% of the last pay drawn. With
effect from 01.01.2006 in case of death in harness, Enhanced Pension will be granted for 10
years.
(f) Ordinary Family Pension on Re-marriage. Wef 01 Jan 2006 Ordinary Family
Pension in case of childless widow will continue after re-marriage.
(g) Widows/war widows on re-marriage are authorized to continue drawing pension vide
Govt of India, Ministry of Defence letters No 08(i)2004/D(Pen-C) Dated 28 Jun 2005, letter
No 1(1)/2001/D(pen/Policy) dated 20 Jan 2009 and letter No 1(2)/97D(Pen-C) dated 31 Jan
2001. There will thus be no requirement of giving no-remarriage certificate to the bank for
drawing of ordinary family pension/special/liberalized family pension.
Grant of Family Pension for Life to Handicapped Children
60. A son or daughter of an officer, suffering from any disorder or disability of mind or
physically crippled or disabled, which renders him/her unable to earn a living even after attaining the
age of 25 years, is eligible for the grant of family pension for life, after the death of the Widow of the
Officer and where there are no other eligible children. The guardian should forward details of the
Handicapped child, to Army HQ/AG‟s Branch, MP5(b), West Block III, R.K.Puram, New Delhi as
follows:
(a) A Certificate from competent medical authority (not below to rank of civil surgeon)
specifying the nature of physical/mental disability and the degree of the disorder.

(b) A certificate from the medical authority to the effect that the handicapped child is not
in a position to earn his livelihood.
61. AG/MP5(b) after verification of the details will forward it to CDA(P), indicating that the
details of the Handicapped child have been taken on records. The acknowledgement from CDA(P)
will be sent to the Guardian, who should preserve it for production at the time of consideration of
claim of family pension to the handicapped child
62. Dependents Pension Admissible in case of officers who die as bachelors on account of
causes attributable to service. The rate is 50%of the notional amount of special family pension that
would have been sanctioned to the widow had the officer been married. Dependent parents and in
their absence, dependent brothers/sisters are eligible for this pension.
63. Special Family Pension In cases where the officer was in receipt of disability pension at
the time of his retirement and the cause of the death is held related to or aggravated by the disability,
the widow is entitled to special family pension of 60% of the last pay drawn subject to a minimum of
Rs 7000/-per month.
64. Disability Pension.
(a) The officer who retires / is invalided out, for a disability which is accepted as
attributable to or aggravated by military service, is entitled to disability pension
consisting of service element and disability element. In case of officers retained in service,
disability element will be granted / continued if disability is assessed at 20% or more. Service
element will be continue to be paid subsequently irrespective of the percentage of disability.
However, in respect of invalided out officers disability pension will be paid even for
disability assessed less than 20%. Officers who have forgone lump-sum compensation
in lieu of disability element/war injury element at the time of their retirement/discharge
whether voluntary or otherwise will he paid disability pension in addition to Retiring
Service Element / Gratuity. Disability Pension consists of disability and service element as
defined below :-
(i) Disability Element of Disability . Liberalized Pension. For pre 01 Jan
2006 retirees, the rate of disability element is as given below for 100% disability.
Disability element is proportionately reduced depending upon the percentage of
disability. No disability element is admissible in case the disability is less than
20% except in case of invalidment wef 01 Jan 2006.

65. Special Family Pension on Re-marriage of Widow. Special Family Pension which shall
be calculated at the uniform rate of 60 % of reckonable Emoluments irrespective of whether widow
has children or not on re-marriage of widow shall be regulated as follows :-
(a) Commissioned Officers.
(i) If she has child(ren) :-
(aa) If she continues to support - Full Special Family

66. Liberalized Family Pension .
(a) Admissible when death takes place during action in war, war like situation, CI Ops,
terrorist actions and battle inoculation exercises and is equal to last pay drawn for all ranks
for life. Liberalized Family Pension is admissible to the nominated heir until death or
disqualification. In case of the officer is not survived by widow but is survived by

child/children only, the senior most eligible child shall be eligible for Liberalized Family
Pension at 60% of Reckonable Emoluments of deceased officer till his/her
death/disqualification, where after it will pass on the next eligible child.
(b) Dependent Pension (Liberalized) in Respect of Commissioned Officers
(including MNS Officers, TA Officers and ECOs/SSCOs). Where an officer dies as
bachelor or as a widower without children under the circumstances mentioned in (a) above.
Dependent Pension (liberalized) shall be admissible to the parents without reference to their
pecuniary circumstances at the rate of 75% of Liberalized Family Pension for both parents
and at the rate of 60% of Liberalized family Pension for single parent. On death of one parent
dependent pension at the latter rate shall be admissible to dependant brother(s) and sister(s)
if otherwise eligible at the rate of 60% of LFP.
67. Grant of Liberalized Family Pension to War Widows who Re-married Before
01.01.1996 It has been decided to grant liberalized family pension (equal to reckonable emoluments
last drawn) to war widows who remarried before 1.1.96. The grant will be admissible from the date
of issue of Govt of India, Ministry of Defence, Department of Ex-Servicemen Welfare, New Delhi
letter No.8(1)/2004/D (Pen-C) dated 28.6.2005( Appx „O‟) .
68. Simplification of Procedure for drawal of Pension/Family Pension in r/o NRIs. The
procedure of drawal of pension/family pension in respect of NRIs has been further streamlined. The
family pension as notified jointly in the PPO in respect of retired pensioners commence on production
of death certificate. Till now the family pensioners had to be identified in person by the PDO before
authorizing release of family pension. Instructions issued in Mar 2006 vide
PC/PN/7994/431/B/D(pen/Sers/06 dated 08 Mar 2006 exempt the NRI pensioners/family pensioners
settled abroad from personnel appearance at the time of first drawal of pension/family pension
provided the Indian Embassy/Mission abroad issues an identification certificate to that effect.
Army Group Insurance Fund Benefits
69. In case the officer had opted for and was covered under the Extended Insurance Scheme, the
amount will be paid by AGIF on submission of an application as per Appx „J‟ (Para 58 (b) refers).
Army Officers Benevolent Fund- Demise Grant.
70. No formal Application is required. Widow/NOK has to intimate death of deceased officer to
AG‟s Branch/CW8(AOBF), who after verifying the records/details will send an amount of Rs.50,
000/- as Demise Grant. This will be based on the letter at Appx „J‟ (Para 59 refers). The demise
grant is exempted from Income Tax.
Canteen Facilities
71. (a) Widows of officers are entitled to avail of indigenous canteen stores less
specially allocated/short supply items. For this purpose, the entitled individuals are attached
to the nearest station/unit run canteen as convenient to Station HQ. Where smart Card have
already been issued to the spouse by the Canteen, action by Station HQ in such cases will not
be required.
(b) Widows of Officers including Hony Commissioned Officers are also authorized to
draw 3 bottles of liquor per month. The dependent CSD Canteen will issue the authorization
Card to the widow for this. (Auth : QMG Branch/CS Dte letter No 96129/Q/DDG CS dt
07 Oct 2008 refers).
Legal Assistance
72. This is being provided to the wives of serving personnel and widows in consultation with
legal Department of Army HQ. Similar facilities are also available at Command level.

Benefits/Concessions Granted by Central/State Govts/Union Territories
73. In addition to pension and other benefits, widow/NOK of Ex-Service personnel have been
granted other concessions as given below:-
(a) Grant of Monetary Allowance attached with various post Independence Gallantry
awards.
(b) Air Travel Concession by Indian Airlines Corporation to War Widows, Permanently
War Disabled Ex-servicemen and their families and Gallantry award Winners.
(c) Issue of Rail Travel Concession Cards admissible to War Widows and Indian Peace
Keeping Force casualties in OP PAWAN.
(d) Reservations for employment in various organizations.
(e) Quotas in educational institutions for children of Ex-Servicemen.
Note :- These concession/benefits are announced by various authorities by time to time Officers/NOK
are advised to keep in touch with the Zila Sainik Board for the latest status of these.
74. In order to assist Widows/NOK in the rehabilitation process, a number of Welfare schemes
have been initiated at the State level. Financial assistance for various contingencies is also available.
The benefits are available to the Widows/NoKs from respective States Govts/ UTs, who can be
approached through the nearest Zila Sainik board. Detailed information, where required, may be
obtained from AG‟s Branch MP 5(b) or Kendriya /Zila Sainik Boards.
Other Concessions
75. (a) Gallantry Awards Winners.
(i) The pension received by an individual, who has been in service of the
Central or State Government and has been awarded Param Vir Chakra or Mahavir
Chakra or Vir Chakra or such other gallantry award as the Central Government may,
by notification in the official gazette specify in this behalf, has been declared
exempt from income tax.

(b) Some State Govts (e.g. Delhi) have exempted War Widows and Gallantry award
winners in Defence Forces from paying property tax on one self occupied residential
property. Special Rebate on Property Tax is also granted to ex-servicemen or their widows
by some states. Specific details can be checked from the respective Rajya Sainik Boards.
(c) Indian Airlines have extended 75% concession in fare to the recipients of pre-
independence (level I – comprising Victoria Cross, George Cross and level II- comprising
Distinguished Service Cross, Military Cross, Distinguished Flying Cross and George Medal)
Gallantry Awards.

(d) The Ministry of Railways have extended the privilege of issue of first class/II AC
sleeper complimentary passes to recipients of Gallantary Awards and widows of winners of
Gallantary Awards They are eligible to take a companion with them in the same class.
(e) Gallantry Award winners, war widows and Disabled soldiers will be provided
telephones on priority through Non-OYT/special category. They would be exempted from
paying the “Installation fee” and he given 50% concession in normal rental charges.
(f) Heart Patients, alone or alongwith upto one escort, are entitled to 75% concession on
fare in any class when traveling by train for heart surgery in a recognized Hospital and for
return journey also. A certificate issued by officer incharge of a recognized hospital on a
prescribed Performa is required to be obtained for this concession.
(g) Cancer Patients, alone or alongwith upto one escort, are entitled to 75% concession
on fare in any class when traveling by train for treatment/periodical check up in a recognized
Hospital and for return journey also. A certificate issued by officer incharge of a recognized
cancer hospital on a prescribed perform is required to be obtained for this concession.
(h) Thalassemia and Liver patients – same as (f) & (g) above.
Concessions for Senior Citizens
76. Senior citizens (those who are 65 years and above) have been given concessions by various
Govt. Agencies/Departments. Some of the important ones are listed below :
(a) Total exemption of income Tax on annual income upto Rs 2,40,000 as per Finance
Bill 2010/2011. Please update such exemptions annually based on the Finance Bill.

(b) 30% discount on rail fare for all classes of travel ( In case of ladies who are 60 years
old and above).
(c) 50% discount on basic air fare by Domestic airlines (Sahara Airlines gives this
discount to persons who are 62 years old, or above)
(d) Club subscription for Senior Citizens : Some clubs either charge reduced
rates or exempt Senior Citizens from payment of monthly subscriptions. Do check with your
club for this facility.
(e) Grand Citizen Award – Serviceman : An Ex-Serviceman (Pensioner or non-
pensioner) belonging to Delhi and registered with Rajya Sainik Board, on attaining the age
of 80 years will be given a one-time grant of Rs.5000.00 as Grand Citizen Award. Apply to
Secretary, Rajya Sainik Board, No.1 Rajpur Road, Delhi – 110054 (Tele Nos. 23991876,
23969260), on plain paper enclosing attested copies of the following documents :-
(i) PPO.
(ii) Ex-Serviceman Identity Card.
(iii) Proof of age, copies of service particulars /discharge certificate.
IMPLEMENTATION OF GOVERNMENT DECISION ON RECOMMENDATIONS OF 6TH
PAY COMMISSION
77. PENSION - Consequent to the implementation of the Government orders on the pension
for Pre 01.01.2006 retirees and their family pensioners the amount has been revised many times for
various ranks from those contained in Govt of India, Ministry of Defence and Deptt of Ex-
Serviceman Welfare New Delhi letter No 16(6)2008(P)/Pension dated 11 Nov 2008. Some changes
may still take place from time to time. The existing rates of pension and family pension are indicated
in Appx „P‟. The earlier pension rates were related to pay of serving officers. However, in case of 6th
CPC the pension in most cases is not related to pay of serving officers. The rates of pension for the
officers are at Appx „P‟ are for service of 30 years and above. The rates of Family Pension are also
given in the same appx against each rank. The rates of Pension and Family Pension for the PBOR are
given at Appx „Q‟.
78. The retiring pension for post 01 Jan 2006 is granted on completing a minimum qualifying
service of 20 years (15 years in case of late entrant). The linkage of full pension with 33 years of
qualifying service has been dispensed with from 01 Jan 2006. The retiring pension of commissioned
officers retiring/invalidated out on or after 01 Jan 06 will be calculated at 50% of emoluments last
drawn or average of reckonable emoluments drawn during last 10 months, whichever is more
beneficial. Post acceptance of 6th CPC recommendation, weightage factors have been withdrawn.
Dearness Relief (DR).
79. Dearness Relief is payable on the Basic Pension at rates which are revised twice a year i.e.
on 01 Jan and 01 Jul. Since 1.1.96 the Dearness Relief rates for pensioners are at par with the
Dearness Allowance for the serving personnel. Dearness Relief rates with effect from 01 Jan 2006
are given at Appx „R‟.
80. Based on the recommendations of the Fifth Pay Commission, it was decided that wef 01
Apr 2004, that when the Dearness Relief exceeds 50% Dearness Relief equal to 50% will be merged
with the existing Basic Pension and shown distinctly as Dearness Pension. Such Dearness Relief
converted to Dearness Pension would be deducted from existing Dearness Relief.
81. Grant of Fixed Medical Allowance. Armed Forces pensioners and their family pensioners
have been granted a fixed Medical Allowance @ Rs.100.00 p.m. for meeting day-to-day medical
expenses that do not require hospitalization, and those who opt for not utilizing Out-Patient
Department (OPD) treatment in Armed Forces Hospitals/ M.I Rooms. This is particularly applicable
to those who are residing in an area where facilities of Armed Forces Hospitals/ M.I Rooms are not

available. Existing pensioners as well as retirees upto 31 Mar 2003 had to exercise a one time option
in this regard and submit this undertaking on the prescribed form available with the Pension
Disbursing Authority (PDA). Based on this, necessary endorsement was made on their PPO‟s, as
well as on their Identity Cards. Payment of the Fixed Medical Allowance is made by the PDA to the
pensioners along with pension/family pension on a monthly basis. (Ministry of Defence Letter
No:1(1)/98/D (Pen-Sers) dated 15 June 1998). This allowance will be discontinued if an ESM joins
the Ex-Servicemen Contributory Health Scheme. Please also refer Para 10.
Reckonable Emoluments.
82. Unless otherwise specified the term „Reckonable Emoluments‟ shall mean:-
(a) For Officer. Pay in the pay band + Grade Pay + MSP + Non Practicing
Allowance (if any) + Dearness Allowance.
(b) For Personal Below Officer Rank (PBOR). Pay in the Pay Band + Grade Pay
+ „X‟ Group Pay (where applicable) + MSP + 50% of the Highest Classification Allowance
(revised rates effective from 01 Sep 2008) , if any, of the Group and rank at the time of
discharge/invalidment.
83. Additional Pension to Old Pensioners. The quantum of additional pension available to
the old pensioners shall be increased as follows :-
(Auth : Govt of India, Min of Defence (Army) letter No 17 (4)/2008 (2)/D(Pen/Pol)
dated 12 Nov 2008).
84. Recording of Date of Birth of Spouse . The Pension Sanctioning Authorities should
ensure that the date of the birth and the age of pensioner are invariably indicated in the pension
payment order to facilitate payment of additional pension by the Pension Disbursing Authority as
soon as it becomes due. The amount of additional pension will be shown distinctly in the pension
payment order. For example, in case where a pensioner is more than 80 years of age and his pension
is Rs 10,000 per month, the pension will be shown as (i) Basic Pension = Rs 10,000 and (ii)
Additional Pension = Rs 2,000 per month. The pension on his attaining the age of 85 years will be
shown as (i) Basic Pension = Rs 10,000 per month and (ii) additional Pension = Rs 3000/- per month.
85. In order to implement the above, the date of birth of the officers as well as his/her spouse,
whole name is mentioned in the PPO (as eligible to receive family pension) would required to be
recorded in the records of PCDA and issued as Corr PPO to the officers banker‟s as well as other
concerned authorities. While the date of birth of the officers is already recorded in the PPO, the date
of birth of the Spouse is not recorded in the PPO in most of the older cases. In order to do so
PCDA(P), Allahabad have issued detailed instruction for submitting a “LPC-Cum-Data Sheet for
grant of additional pension to pensioners/family pensioner over 80 years-Commissioned Officers”
vide their letter No G-1M/01/ICOs/VICPC/Comp/Vol-1 dated 11 Sep 2009. The complete letter is
enclosed at Appx „S‟ alongwith Annexure 1 to 7. The numbering of the Annexure may seem odd
but it has been done in line with the guidelines contained in Annexure 7. The “LPC Data Sheet” is at
Annexure 6 and instruction on filling the same are at Annexure 7.
86. The above mentioned Data Sheet duly completed will be submitted to PCDA through AG‟s
branch MP-5(b) in triplicate alongwith a copy of any of the following duly attested documents :-
(a) PAN Card.

87. AG‟s Branch MP-5(b) after due verification and checking will fwd the Data Sheet alongwith

Nomination For Payment Of Life Time Arrears To Spouse.
88. Payment of Arrears is governed differently from payment of family pension, even if pension
account is held jointly with the Spouse. The rules do not permit payment of Arrears, if any, to the
Spouse unless there is a nomination for the same. The nomination form is required to be submitted to
the concerned bank in triplicate for distribution as under :-
(a) One copy for record of the bank.
(b) One copy to be forwarded by the Bank to PCDA(Pension), Allahabad.
(c) One copy duly acknowledged by the Bank, for record of applicant.
89. (Reference Rule -5 Payment of Arrears of Pension (Nomination) Rules,1993). A suggested
covering letter as well as blank nomination form is attached at Appx „T‟ and Annexure 1.
FOURTH PAY COMMISSION- ANOMALY IN PAY FIXATION
90. In accordance with recommendations of 4th Pay Commission and the decision thereon,
Defence Officers were granted an integrated Scale of Pay 2300-100-3900-150-4250-EB-150-5100. In
addition, Rank pay for Captain, Major, Lt Colonel, Colonel, Brigadier and their equivalent in the
Navy and Air Force was also granted.
91. Although the Rank Pay was sanctioned in addition to the basic pay, but while fixing the pay
in the integrated scale an amount equal to the rank pay was deducted from the total emoluments,
which resulted in financial loss to the officers with cumulative effect on Pay, DA, Pension,
Commutation, Leave encashment etc.
92. Hon‟ble High Court of Kerala at Ernakulam restored the benefits in the case of Maj AK
Dhanapalan Vs UOI in OP No 2448 of 1996. Ministry of Defence and Chief of Army Staff instead of
supporting other similarly affected Officers, had appealed against the judgment of Hon‟ble Mr Justic
CS Rajan, in the Division Bench of High Court of Kerala at Ernakulam vide WA No 518 of 1999
(B). The Hon‟ble Mr Justice KA Abdul Gafoor and Hon‟ble Mr Justice JM James had dismissed
UOI‟s appeal on 04 July 2003. Union of India then filed a SLP in the Supreme Court of India which
was dismissed by Hon‟ble Justice BP Singh and Hon‟ble Mr Justice SH Kapadia in July 2005.
93. The Union of India now has filed a revision petition in the Supreme Court of India against
the judgment mentioned in para 3 above. The date of hearing is awaited.

IMPROVEMENTS IN EXTENDED INSURANCE SCHEME
OF ARMY GROUP INSURANCE FUND
A compulsory Group Extended Insurance (EI) Scheme was introduced in the year 1981 with
the aim of providing insurance cover for the death without any maturity benefits for eligible members
after retirement / release upto a specified period. It is a term insurance scheme under which in case of
death of a member with in the period of cover, the nominee is paid the amount of insurance cover and
it has no survival benefits. For this scheme onetime non refundable single premium is deducted from
the maturity amount at the time of retirement/discharge/release from the eligible members.
The payment liability is worked on the basis of age of entry, likely mortality of the period of
cover, rate of interest and total payment liability. The subscription amount along with the interest
earned is just adequate to meet the liabilities of all its members. As the scheme works on a group
concept, the premia liability is kept as a low as possible. The scheme for Officers and PBOR, are
worked out and operated separately so that the benefits and subscription of each group remains within
that group only. The subscription paid by PBOR does not benefit the Officers and vice versa.
With the implementation of the Sixth Central Pay Commission recommendations, paying
capacity of members has increased. Accordingly, insurance cover for members during service has
also been increased, thereby increasing monthly subscription and the maturity benefits to the
members. Also there is enhanced awareness in the environment about inescapable requirement of
insurance cover even after retirement. Thus, the environment had been approaching AGIF for the
increase of Post Retirement EI Cover. The proposal was discussed during the Fifty Fifth Meeting of
the Board of Governors of AGIF held on 21 Apr 09. The Board of Governors has approved revision
in EI Scheme as given in the succeeding paragraphs.
EI Cover . EI Cover for the Offrs be increased from existing Rs 4 lac to 6 lac and the PBOR
from the existing Rs 2 lac to 3 lac.
Admissibility . The improved EI cover will be applicable from the prospective date to all eligible
members retiring/released/discharged from Army on and after 30 Jun 2009 and eligible for
membership of EI scheme as per the existing eligibility conditions .
Period of Cover . The members who are retiring/released/discharged on or after 30 Jun 2009
will be covered for a period of 26 years after retirement or 75 yrs of age whichever is earlier under the
revised EI Scheme.
One Time Non-Refundable Premium payable at the time of Retirement/ Release/ Discharge.
Based on the period of cover applicable, the following onetime non refundable premium as worked
out by the actuary will be deducted out of maturity benefit from the eligible members including Short
Service Commissioned Officers and MNS Officers at the time of retirement/Release/Discharge :-

Survival Benefits. It being a term insurance Scheme, the EI Scheme provides purely an
insurance cover for death during the period of cover and does not have any survival benefits, i.e. in
case the member survives beyond the period of cover, no survival/maturity benefits is admissible.
EI Certificate of Eligible Members. The detail showing period of cover, insurance amount and
onetime non refundable premium will be indicated in the EI certificates issued to the eligible
members retiring/released/discharge on and after 30 Jun 2009.
Coverage for Members Who Joined the Scheme Earlier. The existing EI cover and period
will continue as shown on the EI Certificate issued to members who have retired prior to 30 Jun
2009.
There is no other change in the existing terms and conditions under EI Scheme.
Review of Scheme. The AGI Board of Governors reserve the right to review the Scheme
periodically and modify it, as considered necessary.

No.CPAO/Tech/Amendments/Sch. Bok/2005-06/69 dated 09.06.2005 which contains the following
terms and conditions. Once pension has been credited to a pensioner‟s bank account, liability of the
government/bank ceases. No further liability arises, even if the amount is wrongly drawn by the
spouse.
(a) As pension is payable only during the life of a pensioner, his/her death shall be
intimated to the bank at the earliest and in any case within one month of the demise, so that
the bank does not continue crediting monthly pension to the joint account with the spouse,
after the death of the pensioner. If, however, any amount has been wrongly credited to the
joint account, it shall be recoverable from the joint account and/or any other account held by
the pensioner/spouse either individually or jointly. The legal heirs, successors, executors etc.,
shall also be liable to refund any amount, which has been wrongly credited to the joint
account.
(b) Payment of Arrears of Pensions (nomination) Rules, 1983 would continue to be
applicable to the joint account with pensioner‟s spouse. Thus if there is an „accepted
nomination‟ in accordance with Rule 5 and 6 of these Rules, arrears mentioned in the Rules
will be payable to the nominee.

1. In continuation of this Ministry‟s letter No PC 1(2)/97-D(Pen-C), dated 16 May 2001 on the
subject mentioned above, I am directed to convey the sanction of the President to grant Special
Family Pension to a widow whose Special Pension was stopped on her re-marriage before 01 January
1996. Such pension may be regulated in terms of para 5.8 of this Ministry‟s letter No 1(2)/97D(pen-
C) dated 31 January 2001.
2. The actual benefits arising out of this order will be payable from the date of issue of this
letter. No arrears shall be admissible.
3. Pension regulations of three Services will be amended in due course.
4. This issue with the concurrence of Defence (Finance) vide their UO No 200/Fin/Pen dated
07.01.2009
