Although we all know most of our enquiries come through the websites, it is also so important not to forget‘good old fashioned estate agency’!When we first register any prospective buyer or tenant we do let them know they will be called as soon as aproperty first comes to the market, while its being prepared to go live. This tends to breed an ‘urgency to view’and that first viewer can often be the best one, paying the best price in order to ensure no-one else gets to seeyour property!

Feedback, especially ‘price related feedback’ is essential and where possible this will be done within 24 hours.

If your property is marketed at the right price from the beginning, a review should really not be needed. However,if required, at this point we may well ask you to come into our office so we can openly show you what we havebeen doing up to that point to get your property sold or let. Dependant on whether your property is for sale or tolet and also the interest achieved so far will determine the timescale of this review. At this stage we would considera fresh launch of the property including new photographs and write up to ensure it gets sold or let within the nextfew weeks.

EPCSince 1st October 2008, under the Energy Performance of Buildings 2007 (amended 2011) all sales and rental propertiesin England and Wales are required to have an Energy Performance Report.

EPCs are valid for 10 years (unless taken from a Sales Home Information Pack ‘HIP’, whereby they are only valid for 3years). The legal requirement for this is that an EPC needs to be commissioned prior to marketing (there is then areasonable endeavours obligation to obtain the EPC within 7 days, and an absolute obligation to obtain it within a further21 days), therefore we can begin marketing before the EPC has been obtained and advertise initially without the assetrating. HOWEVER, after 28 days of marketing if an EPC is not in place marketing must be suspended.

Inventory William Theakston strongly advise you to employ the services of an APIP (The Association of Professional InventoryProviders) qualified Inventory Clerks, to arrange an 'inventory and schedule of condition' and ‘check in’ at the outset of thetenancy, the cost of which is borne by the Landlord. At the end of the Tenancy the Inventory Clerk should be instructedto ‘check out’ the Tenant, the cost of which is borne by the Tenant.

TDS William Theakston are a member of the TDS which is run by The Dispute Service Ltd. It is an insurance-backedtenancy deposit scheme authorised by the government.

TDS has two main roles:• To protect deposits.• To help resolve disputes about deposits.

Tenancy deposit protection applies to all deposits for Assured Shorthold Tenancies that started in England or Wales onor after 6 April 2007. By law, a landlord or agent who receives a deposit for such a tenancy must protect the deposit.

The Agent or Landlord is responsible for ensuring:• That the Tenant’s Security Deposit is forwarded to or insured by an approved scheme to be held for the term

of the Tenancy• That the Tenant or the person paying the deposit (ie. parent or guarantor) receives the relevant Prescribed

Scheme Information• This all must happen within 30 days of receipt of the deposit

Insurance and Tenant ReferencingWilliam Theakston use Let Alliance for all aspects of tenant referencing, landlord and tenant insurance.

The property and it’s contents should be comprehensively insured to include 3rd Party Liability and Occupier risks &Public Liability, as well as cover furnished lettings if applicable. Your tenant should be given a copy of your insuranceschedule for buildings and contents, as this will form part of your tenancy agreement.

Failure to inform your Insurance Company that the property is let out could render the policy void. It is the Tenantsresponsibility to arrange and insure their own personal belongings.
