RECOMMENDATION: Planning Commission and staff recommend approval of a request to accept a lesser right-of-way dedication as depicted in Exhibits ‘A’ with the following conditions:
1. The requested lesser right-of-way dedication is limited to the area occupied by the houseand within the Master Street Plan right-of-way, as denoted by the applicant in Exhibit ‘A’.
2. ADM 18-6167 and LSP 18-6134 must meet all relevant and applicable development codesapart from what is requested in this variance.
BACKGROUND: The subject property is located at the northeast corner of Duncan Avenue and 15th Street. The property is zoned RMF-24, Residential Multi-family, 24 Units per Acre and is developed with a single family home built in the 1930’s. The applicant has submitted a lot split to create two new parcels from the subject property (LSP 18-6134).
Request: The applicant has proposed to split the parcel, which requires right-of-way dedication where current right-of-way widths are insufficient to meet the Master Street Plan pursuant to UDC 166.04(B)(2)(a). The existing house on the property is within the area required to be dedicated as right-of-way with the lot split. The applicant is asking for the area occupied by the house and within the Master Street Plan Principle Arterial right-of-way to not be dedicated.
Public Comment: No public comment was received for this item.
Staff Findings: Due to the house existing on this property since the 1930’s and the applicant’s intention to keep the house, staff is in support of the request to vary right-of-way dedication. Staff find that future improvements to 15th Street can work around the existing house.

DISCUSSION: At the April 23, 2018 Planning Commission meeting, this item was forwarded to City Council with a recommendation for approval, including conditions of approval, by a vote of 9-0-0.

• 166.04 - Required Infrastructure Improvements - Development In City Limits
(A) Generally. Required of developer. […]
(B) Minimum Improvements by Application Type. The property owner/developer shall be responsible for constructing the following minimum improvements.
(1) Property Line Adjustment. No improvements are required unless the action would create or exacerbate a nonconforming infrastructure situation such as cutting off a lot from public water, sewer, or street frontage. In such as case the property line adjustment may not be filed of record until the required infrastructure is first constructed to city specifications, or a variance or waiver is granted by the Planning Commission.
(2) Lot Split. (a) Dedication of Right-of-Way. Sufficient right-of-way dedication, to bring those
streets which the Master Street Plan shows to abut or intersect the property into conformance with the right-of-way requirements of the Master Street Plan for said streets; provided, the Subdivision Committee or Planning Commission may recommend a lesser dedication in the event of undue hardship or practical difficulties. Such lesser dedication shall be subject to approval by the City Council.
(i) Dedications. The City Council accepts all streets and alleys located in Fayetteville that have been previously approved and accepted as dedications by the Fayetteville Planning Commission/Subdivision Committee. The City Council confirms the acceptance of all such streets and alleys dedicated by developers/owners to the city which have been approved by the Fayetteville Planning Commission/Subdivision Committee. (b) Monuments and Lot Stakes. The surveyor shall cause, preserve, and/or replace
monuments and/or lot stakes marking the corners of a parcel to be set in accordance with Section 3.2, general procedures, of the Arkansas Minimum Standards for Property Boundary Surveys and Plats.
(c) Water, Sewer, or Street Frontage. Any lot that is created shall have adequate street frontage or street access that meets the minimum requirements of the zoning code, and access to public water and sewer as required by city and state code. If a lot split would create or exacerbate a nonconforming situation (such as cutting off a lot from public water, sewer, street frontage, or street access), the lot split may not be filed of record until the required easement is dedicated and/or the infrastructure is first constructed to city specifications, or a variance or waiver is granted by the Planning Commission.
(d) Parkland Dedication. Parks fees shall be assessed for each new residential unit that is constructed on the additional lot(s) in accordance with the parkland dedication requirements outlined in Fayetteville Unified Development Code Chapter 166. Re: Right-of-Way Variance on proposed Lot Split of 765-12486-000, current COF review Project #18-6134
All, please see the attached documents that best describe our requested variance. The property (parcel ID 765-12486-000) is located northeast of the intersection of W. 15th Street and South Duncan Ave, said parcel ID is proposed to be 0.30 acres, said parcel has an existing small house. The lot split attached has been reviewed by the city planning staff for most all other requirements (not approved yet).
Hence our request for the City’s variance on said Lot Split…
Per the City’s Master Street Plan Right-of-Way, approval of this Lot split would have the existing house within the requested R/W dedication area by a maximum of 9 feet x 34 feet, totaling 257 sq ft in all.
Standard approval of this lot is to dedicate 43.5’ from the centerline of 15th street to meet master street plan Right-of-Way, as well as 35’ from the centerline of S. Duncan Ave to meet master street plan Right-of-Way.
To best describe this is the PDF attached. The hatched area in blue is requested Right-of-Way along 15th street to meet master street plan Right-of-Way. The hatched area in red is requested Right-of-Way along South Duncan Ave to meet master street plan Right-of-Way. The hatched area in Orange is the requested Right-of-Way variance along 15th street we are requesting, the variance is described in a Survey Description on the Lot Split attached.

In closing our reasons of why this variance is helpful for both the owner & the City are below.
As I review the City’s Master Street plan along 15th, I’m hopeful we can agree this road will not be widened into the foreseeable future, however we are glad to donate the land shown, with a temporary reduction of the existing house area shown.
o We do not want to tear down an existing very nice house, that would not benfitanyone and stop this entire project immediately.
The original 0.40 acre lot will be reduced to 0.30 acres by dedicated Right of Way. Thus, the property owner is gladly dedicating 25% of currently owned property to the City to meet said Right-of-Way future Master Street Plan. Per the Lot Split requirements, no future drives will be allowed onto 15th street, and a single shared access entry off Duncan Avenue is a requirement, thus increasing safety. Current Zoning of the property is RMF-24. Per the city’s goal of promoting infill on RMF24 the site has the capacity of multiple more units that are well within the university’s walking area, if you will, that has a lot of infill being built on splits like this. Most importantly, we are asking for a temporary variance, in said ordinance we request the City to layout the verbiage stating no exterior add-ons to the existing building or new building permits on said lot 8B of this split are allowed that don’t meet current 47.5’ Right-of-Way as shown.
o Currently, the planning staff has a standard comment of…Development orRe-development on the proposed parcel must meet access management standards. Is this enough?
