Bill Requiring Contractors to Report Judgments and Settlements to CSLB Amended

You may recall an article we ran back in late April about SB 465 (Hill and Hancock) which would have required contractors to “report to the registrar within 90 days of the date that the licensee had knowledge of any civil action settlement or administrative action resulting in a settlement worth $50,000 or more, or a binding arbitration or administrative action resulting in binding arbitration worth $25,000 or more.” The bill was introduced as a reaction to the June 16, 2015 balcony collapse at the Library Gardens Apartments in Berkeley, CA which killed six students and injured seven others. The company that constructed the apartment complex, Segue Construction Company, had a history of questionable work. Notably, over the prior three years, the company paid out $26.5 million dollars in construction defect settlements. Senator Hill’s ‘thought’ in introducing the bill was, if the CSLB had known about this contractor’s past, it would have suspended or revoked his/her license and the tragedy would never have occurred.

Unfortunately for the authors, as the bill moved through the legislative process it became clear that since construction is such a litigious business, thousands of contractors annually are involved in lawsuits that exceed the minimum limits that were set in the bill. This would have, in-turn, resulted in an ‘overload’ of work for the CSLB staff. So too the question was asked, would the information that the CSLB received ultimately have prevented other Berkeley-type tragedies; how big of a problem was the bill trying to ‘fix’ in the first place; and, most importantly, was the collapse of the balcony a workmanship issue or a design flaw of the architect or someone else within the construction process that built it originally?

Politics is the art of compromise, and given the authors’ realization that since the bill had previously failed to pass out of the Assembly Business and Professions Committee and ‘only’ remained alive for reconsideration by the committee (meaning without amendments the bill was doomed), the authors accepted amendments which now make the bill much more feasible and allows the authors to come back in several years after more is learned from a mandated study contained in the current language. Highlights of the latest amendments include requiring the CSLB:

1). By January 1, 2018, to enter into an interagency agreement with the Division of Occupational Safety and Health (DOSH) and other state or local agencies, as necessary, to ensure information relevant to CSLBs duty to protect the public is reported to the board in a timely manner 2). Within 90 days to have contractors report to the Registrar of the CSLB in writing the occurrence of any conviction of any felony or conviction of any crime that is substantially related to the qualifications, functions, and duties of a licensed contractor. 3). To report to the Legislature, the results of a study determining if the CSLB's ability to protect the public would be enhanced by regulations requiring licensees to report judgments, arbitration awards against them, or settlement payments of claims for construction defects they have made in excess of a certain amount to be determined by the board. The information provided to the board would be from both contractors and consumers on a voluntary basis. 4). To keep all records or documents obtained during the course of the study to remain exempt from public disclosure 5). Requires the California Building Standards Commission to convene a working group to investigate existing building standards associated with the construction, inspection, and maintenance of exterior elevated elements, and recommend any statutory changes or changes to the Building Code by 1/1/18.

DIR Posts Prevailing Wage Changes for Public Works Projects That Use Ready-Mix Concrete

The Department of Industrial Relations (DIR) is advising companies that use ready-mix concrete for public works projects of changes to prevailing wage laws. The changes apply to public works contracts that were advertised for bid or awarded on or after July 1, 2016.

Amendments to Assembly Bill 219 became effective on July 1. The amendments made the following changes to Labor Code section 1720.9:

• A company hauling or delivering ready-mix concrete for a public works contract shall:

o Register as a public works contractor.

o Submit a certified copy of the payroll records required by subdivision (a) of Section 1776 to the party that engaged the company and to the general contractor within five working days after the employee has been paid, accompanied by a written time record that shall be certified by each driver for the performance of job duties.

o Ready-mix concrete companies’ requirement to submit payroll online to DIR using its electronic certified payroll reporting system is temporarily on hold.

• Nothing in section 1720.9 shall cause any company to be treated as a contractor or subcontractor for any purpose other than the application of this chapter of the Labor Code.

The amendments do not apply to public works contracts that were advertised for bid or awarded prior to July 1, 2016.

While it sometimes feels like a disaster movie living here, people in the Golden State aren’t shaken easily, and are often rebuilding after fire, flood or earthquake. This opens the door for scammers and they have been warned! First, we ‘plumb’ the depths of license rules for a business buyer…

Q:  I am in the process of purchasing a business that has a Contractor’s license with a “C-20” (HVAC) and “C-36” (Plumbing) classifications.  My experience is with hydronic piping and cooling towers.  What type of license would be required to perform this work?  I want to make sure I’m covered with the seller’s license.

A:  The “C-20” classification would be most appropriate classification for the type of work you are describing.  A Plumbing Contractor (“C-36”) can do the piping aspect of the project but not the cooling tower. You need to show at least 4 years of full time work experience in the trade you are applying for in order to qualify for the license. We can assist you if you need help.

The Board has sent a strong warning in a recent news release. It’s been a destructive fire season in many areas of the Golden State and the CSLB is warning unlicensed scammers that victimizing property owners a second time is a crime. Consumers are advised to check out anyone preparing to bid work.  The Contractors State License Board (CSLB) is warning consumers about the dangers of hiring unlicensed contractors following a disaster, whether it is earthquake, fire, flood or mudslide. Unscrupulous, unlicensed contractors often prey on victims of natural disasters.

It is a felony to contract without a license in a declared disaster area.

Consumers can protect themselves by using CSLB’s resources. “Although it’s understandable that property owners want to begin rebuilding quickly, it’s important not to rush the process and hire the first contractor who comes along,” said CSLB Registrar Cindi Christenson. “Take your time and protect yourself against con artists who will take your money and run—or incompetent contractors who will perform shoddy work. Hire only licensed contractors and check their qualifications.”

Safety Tip of the WeekCRANES AND OVERHEAD WIRES

There are many dangerous situations on a construction site, but operating hoisting equipment close to overhead wires is more than just dangerous, it's a matter of life and death! The following guidelines should help us prevent potentially deadly contact:

Keep cranes a safe distance from power lines. For lines rated 50 kV or below, minimum clearance between the lines and machines or loads must be 10 feet plus 0.4 inch for each 1 kV. over 50 kV., or twice the length of the line insulator, but NEVER less than 10 feet.

Use a qualified signalperson when the crane is within boom's length of a line. The signal- person must warn the operator when the machine is approaching the lines since the operator may not be able to accurately judge the distance. The signalperson should have no other duties while the machine is working near the power line.

Do not rely on ground rods for safety. They provide little or no protection. People touching the crane or load will still draw enough current to kill, even with the best ground rods in place. In addition, don't rely on proximity warning devices, hook insulators, insulating boom guards, swing limit stops, etc. as each has serious limitations.

Except for the operator, keep all personnel away from the crane when working near power line Don't allow anyone to touch the load, crane, or crane hook until the signalperson indicates that it is safe to do so. Exercise caution when working near overhead lines having long spans. These tend to swing laterally in the wind and contact can occur.

Use caution when moving cranes. Uneven ground can cause the boom to weave or bob into lines. Ensure a route is plainly marked when cranes must travel beneath power lines. 'Rider' poles should be erected on each side of the crossing approach to guarantee that the boom will be lowered to a safe position. Avoid using tag lines except when it is possible for the load to spin into the power line. All rope will conduct electricity.
