I will not ‘waiver’ in getting you the answer to your question when you ask us about the ‘rules’ in any aspect of contractor’s licensing. Finally, we wrap up with a ‘back to the future’ answer for a NV LLC…
Q: Our corporation is going to be applying for a new license and our Officers all live in Michigan. I read that if they get fingerprinted outside of CA the process can take months longer than if they do it in California. They will be out in CA next week to meet with the client that they will be doing a project for (once they are licensed of course). Can they get fingerprinted at that time? Do they just save the receipts and submit them with the application?
A: No one can be fingerprinted until you apply for the license and get the notification from the CSLB to get fingerprinted. The CSLB will send out Live Scan Request forms, which they will be required to take with them to get printed.
Q: I thought Waivers had went away, but recently read a couple of articles indicating that when applying for additional classifications that a Waiver may still be an option? What are the rules regarding this?
A: Waivers can still be an option in certain circumstances, but it has become increasingly difficult to qualify. Waiver requests are reviewed on a case-by-case basis and there are no hard and fast “rules”. That being said, in order to qualify for a possible Waiver, you have to show at least four years of work experience in the
trade you are applying for. Secondly, the additional classification must be closely related
to the classification you currently hold. Contact my office to discuss this further.
Q: I am forming a Nevada Limited Liability Company (LLC) as a “C-1D” (Plumbing) contractor. I’ve been told that California won’t accept my NV LLC if I attempt to obtain my California contractor’s license. Is this true?
A: It depends on what you mean by California not accepting your NV LLC. Up until January 2012 California did not issue contractor’s licenses to LLC’s. They do now. As you may know, there is a reciprocal agreement between California and Nevada for certain classifications. Reciprocity allows for a Waiver of the trade exam if you meet all the requirements, however the Plumbing classification is not one of the reciprocal classifications. In sum, your LLC can obtain a license in CA, however you will be required to take the exams, show your work experience, and meet all of the other LLC requirements. For plan years beginning on and after January 1, 2014, employers should carefully evaluate arrangements under which they reimburse employees for premiums, or are otherwise involved in the purchase of individual health insurance policies that provide non-excepted medical coverage (i.e., coverage that is subject to health care reform’s mandates) for employees. These arrangements create significant compliance concerns under health care reform. Furthermore, these individual policies should not be paid for or reimbursed on a pre-tax basis under an employer's cafeteria plan. As described in more detail (left).
Caution for Individual Policy Reimbursement
The IRS uses a FAQ on Employer Health Care Arrangements to highlight
the potential liability for employers that, rather than establishing a group
health plan, merely reimburse employees for the cost of their individual
health plan premium.
Q1. What are the consequences to the employer if the employer does
not establish a health insurance plan for its own employees, but
reimburses those employees for premiums they pay for health
insurance (either through a qualified health plan in the Marketplace
or outside the Marketplace)?
The IRS makes it clear that the consequence is that the employer may face a
penalty.
Specifically, as explained in Notice 2013-54, employer reimbursement plans
are considered to be group health plans and therefore subject to the market
reforms, including the prohibition on annual limits for essential health
benefits and the requirement to provide certain preventive care without cost
sharing. Notice 2013-54 clarifies, however, that employer reimbursement
plans cannot be integrated with individual policies to satisfy the market
reforms.
Consequently, the employer may be subject to a $100/day excise tax per
applicable employee (which is $36,500 per year, per employee) under Code
Sec. 4980 D.

Governor Brown Reaches Budget Agreement with Legislative Leaders,
Calls Special Sessions to Fix Road and Health Care Financing
Governor Edmund G. Brown Jr. today announced a budget agreement with Assembly Speaker Toni Atkins and Senate President pro Tempore Kevin de León, consistent with prudent May Revision revenue estimates, that saves billions of dollars and pays down debt, while directing more resources to schools and low-income Californians.
Governor Brown also announced that he is calling two special sessions to fix how California funds roads, highways and other infrastructure and the state’s core health program – Medi-Cal.
“This is a sound, well thought-out budget,” said Governor Brown. “Yet, the work never ends and in the coming months we’ll have to manage our resources with the utmost prudence and find more adequate funding for our roads and health care programs.”
Budget Agreement: More Money for Schools: The agreement makes significant investments in schools – $14.3 billion for the K-12 system and community colleges, including $6 billion to continue to implement the Local Control Funding Formula which targets increased resources to students who face the greatest challenges.
Counteracting the Effects of Poverty: The agreement implements the first-ever California Earned Income Tax Credit ($380 million) to help the state’s poorest working families.
Paying Down Debt: The agreement pays down billions in debts, including completely paying off school deferrals ($1 billion) and debts owed to local governments since 2004 ($765 million). The agreement also completely retires $15 billion in Economic Recovery Bonds used to cover budget deficits as far back as 2002, as well as $3.8 billion in mandate debt owed to K-14 schools.
Saving for a Rainy Day: The agreement saves $1.9 billion in the state’s Rainy Day Fund as required by Proposition 2, bringing the balance to $3.5 billion.
The budget agreement maintains the fiscal framework of the May Revision, including the General Fund revenue forecast, overall spending levels, a $1.1 billion operating reserve, Proposition 2 debt payments and Rainy Day Fund deposits. By redirecting spending and using identified savings, including a reform of the Middle Class Scholarship program and correcting an error in the estimate for Medi-Cal, the budget agreement can afford additional spending, including:
• $40 million to expand Medi-Cal to cover all low-income undocumented children effective May 1, 2016 ($132 million when fully implemented).
• $265 million to fund 7,000 additional preschool slots and 6,800 child care slots, plus a rate increase for all providers.
• $97 million over the January budget for the California State University to expand enrollment and focus on
increased success.
• $226 million on a one-time basis to restore the 7 percent reduction in service hours for In-Home Supportive Services.
• $500 million (Proposition 98) for a one-time teacher effectiveness block grant.
Fixing California Roads, Highways and Other Infrastructure
Caltrans, the state’s Transportation Department, maintains 50,000 lane-miles of highway and nearly 13,000 state-owned bridges. While the repair, maintenance and efficient operation of the state’s highway system are vital to the state’s continued economic growth, current funding fails to adequately fund this necessary work. The state’s current fuel excise tax is sufficient to fund only $2.3 billion of work—leaving $5.7 billion in unfunded repairs each year.
The Governor proposes that the Legislature enact permanent and sustainable funding to maintain and repair the state’s transportation and critical infrastructure, improve the state’s key trade corridors and complement local infrastructure efforts.
Shoring Up Health Care Financing
The Governor also called a special session to address the financing of the state’s core health program – Medi-Cal. The state’s recent expansion of health care coverage under the Affordable Care Act has resulted in more than four million additional Californians receiving coverage through Medi-Cal.
Since 2005, the state has levied a tax on Medi-Cal managed care plans. The revenues are matched by the federal government and used to both increase payments to Medi-Cal providers and offset health care costs that would otherwise be paid from the General Fund. This funding mechanism has helped the state pay for the increased number of Californians receiving coverage under federal health care reform.
The state’s current managed care organization (MCO) tax structure fails to comply with new federal requirements that such a tax be broad-based and not limited narrowly to Medi-Cal plans. The current structure, which expires at the end of fiscal year 2015-16, generates $1.1 billion. The Governor’s January budget proposed a modified MCO tax that would be levied on a per-enrollee basis and cover most health care plans regulated by the Department of Managed Health Care.
In the special session, the Governor proposes that the Legislature enact permanent and sustainable funding to provide at least $1.1 billion annually to stabilize the state’s General Fund costs for Medi-Cal, sufficient funding to continue the restoration of the 7 percent of In-Home Supportive Services hours and funding for additional rate increases for providers of Medi-Cal and developmental disability services. The funding could come from the proposed MCO tax and/or alternative sources and is necessary to prevent over $1 billion in program cuts next year.

Safety Tip of the WeekTEAMWORK
As a supervisor or an employee you have a responsibility to prevent accidents. Safety is a cooperative undertaking requiring a total safety consciousness on the part of every employee. No one likes to see someone injured, but if an accident occurs, in addition to treating the victim, prompt reporting must take place and corrective action taken to prevent additional problems. Proper planning, a good safety program, the right tools, and communication combine to prevent accidents.
Good housekeeping must be practiced at all times in and around your work areas. Return unused material to the proper storage place. Personal Protective equipment must be worn when the task requires it. Clothing and footwear should be suitable for the job. Set the example -- do what is right and never take chances or short cuts -- they cause accidents and injuries.
Alcohol and drums have no place on a construction worksite. They will impair your motor skills and judgment. Guns and other weapons must be left at home Employees should be alert to see that guards are kept in place and properly adjusted. Never handle electrical equipment unless you have been trained to do so. Follow lockout/tag out procedures wherever applicable for routine servicing, repair, or relocation of electrical, hydraulic or pneumatic equipment.
Any good coach knows all the rules and all the players, and has a plan to get the team moving forward. A well planned job will have the same effect -- a crew that pulls together to safely accomplish whatever has to be done. Teamwork, planning and safety training go a long way in having a safe work environment. Know your limits -- ask for help -- take as much training as the company offers -- and look out for the other person. If you do all of the above, you know that your job will be safer for you and your co-workers.
One last thing to remember -- never ignore near-miss accidents. Find out what happened so you can make sure it doesn’t happen again, to you or any other member of your team!
