Pursuant to California Rule of Court, Rule 8.240, Appellants

California Chamber of Commerce and Larry Dicke, respectfully

request that this appeal be given calendar preference in processing the

case and in setting the date of oral argument.

This Court has discretion to grant calendar preference "on a

non-statutory ground (e.g., economic hardship)." (Advisory

Committee Comment, Rule 8.240.)

The economic hardship is that, until this Court decides this

appeal, California businesses on whose behalf the appeal is brought

will - in order to stay in business - have to spend millions of dollars at

forthcoming ARB cap and trade auctions to purchase, from the State,

GHG emissions allowances that, Appellants assert, are unauthorized

and constitute unconstitutional taxes because they were not approved

by a two-thirds vote of the Legislature. This is a type of economic

hardship contemplated by Rule 8.240 if this Court decides the charges

are unlawful.

The case was fully briefed on May 6, 2015. The auction

regulations, the validity of which are at issue in this litigation, provide

for quarterly auctions with the next set for May 18, 2016.

Accordingly, Appellants ask this Court to adopt an expedited

internal schedule for evaluating the appellate briefs and setting the

date of oral argument.
