4.2 The Committee RESOLVED to exclude the press and public when

considering agenda item 4. 5 and 6. Cllr Herbert asked that it be noted that he did not agree with the majority decision of the Board to exclude the press and public for agenda items 5 and 6 as he considered that these reports related to non-individual matters and he took the view that these should be debated in public.

5. Shared Combined Authority and Local Enterprise Partnership

5.1 The Monitoring Officer advised that the Board had agreed that the

Combined Authority would become the Accountable Body for the Local Enterprise Partnership, and that there would be a joint Chief Executive for the Combined Authority and the Local Enterprise Partnership. Therefore, this was not a new role; the current Chief Executive would be taking on additional responsibilities and as a result, the job needed to be re-evaluated

in the light of those new responsibilities.

5.2 Paul Smith, the HR Advisor, advised that he had been commissioned by the Combined Authority to evaluate the original job description of the Combined Authority’s Chief Executive role. At that time he had used the Hay model which involved benchmarking across the sector. The grade was determined at Hay Grade 1 level. The grade had not changed but the Committee were asked to determine the appropriate level of payment within the grade band.

5.3 The Committee debated whether to defer the report. Some members considered that the Committee was not in a position to determine the level of remuneration as the additional responsibilities of the role were unclear. The additional responsibilities would become clearer over the coming months following the transfer of responsibilities of the local enterprise partnership functions to the Combined Authority.

5.4 It was noted that the Mayor had agreed to pay an honorarium to the Chief Executive until the level of remuneration was determined and this would continue until the Committee had agreed the level of remuneration.

5.5 The Committee RESOLVED that the revised job description and remuneration of the Chief Executive be deferred for six months when the full extend of the role would be understood.

6. Terms and Conditions of the Combined Authority Staff

6.1 The Committee RESOLVED to defer the report. 7. Greater Cambridgeshire Greater Peterborough Local Enterprise

Partnership

7.1 The Committee RESOLVED to: (a) Note the statutory provisions regarding staff transfers under TUPE;

(b) Agree that whilst former Local Enterprise Partnership staff remain on

their existing terms and conditions this would also include membership of the Local Enterprise Partnership Pension Scheme;

(c) Agree that staff who transfer would move onto Combined Authority

terms and conditions in the following events:

(i) If they successfully apply for a new role within the Combined Authority or

(ii) If they individually request to move onto Combined Authority terms and conditions of service

28 MARCH 2018 PUBLIC REPORT

RECRUITMENT OF SENIOR ROLES

1.0 PURPOSE 1.1. At its meeting on 28th February 2018 the Board resolved to implement a senior

management structure comprised of Legal Counsel and Directors for Infrastructure, Business and Skills, Strategy and Planning and Finance. It was also resolved, in accordance with its terms of reference, that responsibility for determining the job descriptions and associated salary ranges and recruitment to the roles would be the responsibility of the Employment Committee.

1.2. This report seeks the approval of the Employment Committee to the job descriptions, salary grades for the posts and the proposed recruitment process as set out in this report for the Directors.

(i) The process for engaging with search consultants to source quality candidates and;

(ii) to establish Employment Committees or sub-committees for each Director role; ; (iii) to agree the membership of each sub-committee including the Chair;

(iv) delegation of the long and short listing of applicants to the Chief Executive in consultation with the Mayor and Portfolio Holder responsible for the work areas being recruited to

(v) the job descriptions as detailed in Appendix 2

(vi) the salary grades level as detailed in the report.

2.0 BACKGROUND 2.1. On 28th February 2018 the Board approved a senior staffing structure designed

to provide a framework for delivering the objectives of the Combined Authority and the Local Enterprise Partnership, as set out at Appendix 1.

2.2. The Board noted that an Employment Committee would be called to approve

the job descriptions and salary grades for the roles, to recruit into the roles where there are vacancies and to agree the full staffing structure. The Employment Committee has powers to determine the terms and conditions of employment.

2.3. The Employment Committee is responsible for appointing to Director and their

direct report roles under its terms of reference. Consequently, a proposed Recruitment Procedure specific to this particular exercise has been drawn up and is detailed alongside an indicative timetable as detailed in this report. These proposals are consistent with the Combined Authority’s Constitution, Officer Employment Procedure Rules and employment law. Recruitment

2.4. Recruiting into these roles could be challenging. The market for roles in Combined Authority senior managers is far from mature and the nature of the roles will mean that a blended approach of recruiting high calibre people from both public and private sectors will be necessary. Traditionally, it has proven difficult to recruit candidates to public sector roles from the private sector and many of these appointments have been less than successful because of culture and organisation priority issues. It will therefore be crucial that a strong and effective induction programme is in place.

2.5. In view of this, it is intended to engage specialist recruitment consultants for each role. This will ensure that the maximum coverage of the market is achieved for each role. As is normal for senior recruitment a microsite will also be produced giving candidates information about the Authority, the role and also the programmes and priorities. This is particularly important as many potential applicants will need to understand the unique role of the Combined Authority and the fact that this is not a traditional local authority. It is likely that the skills and expertise exist in house to produce this site.

Selection & Appointment 2.7. Once the recruiting and sourcing of candidates is completed, then each agency

will be asked to produce a summary of the profiles of each candidate against the selection criteria. This should include recommendations as to which candidate merits long listing.

2.8. Candidates will be evaluated on a multi-faceted approach, with the key factors

including: a) fit with organisational values and behaviours b) stakeholder management and political engagement skills c) technical skill d) overall fit of management team

2.9. Longlisted candidates will then be invited to undertake a number of assessments including a technical interview with a specialist recruiter and a specialist in the field of work for which they wish to be considered. There may also be additional tests as well as a one to one meeting with the Chief Executive and the Mayor.

2.10. The Board previously agreed that for each Director role that an Employment

Committee be established for interview purposes. The Employment Committee shall consist of six members to include: a) The Mayor as Chair b) The Statutory Deputy Mayor as Vice-Chair c) The Constitutional Deputy Mayor, d) Councillor Lewis Herbert (to maintain political balance) e) Two other Board members taken in rotation which must include the relevant

Portfolio Holder when interviewing for to a particular Chief Officer post. 2.11. Alternatively, the Employment Committee may set up sub-committees to

interview and appoint candidates consisting of four members. The Chair of each sub Committee will then be consulted in more depth on the progress of each specific role. It is recommended that this approach is taken.

2.12. It is proposed that the decisions on long and short listing should be taken by the

Chief Executive in consultation with the Mayor acting in his capacity as the Chair of the Employment Committee, and relevant portfolio holder for that Director appointment acting as the Chair of each sub Committee.

2.13. Following longlisting, a shortlist will be drawn up of candidates to go forward to

a final assessment and interview by the Employment Committee or a sub-committee.

2.14. Finally, each shortlisted candidate will be invited to attend an interview with the

appropriate sub committee where a final decision will be made as to who the successful appointee should be. It should be noted that whilst the Employment Committee has delegated authority to make these appointments, in the case of the Chief Finance Officer, the Board must formally approve the appointment (as was the case when the Legal Counsel was appointed as this role is the Monitoring Officer)

2.15. The Committee members will be aware that membership of the Employment

Committee is on a rotating basis. There is a core membership of the Mayor and Deputy Mayors (Statutory and Constitution), one opposition member (to ensure political balance) and then the portfolio holder relevant to the appointment being made will also be present as a voting member.

2.16. If it is decided to set up an Employment Sub Committee the membership is

suggested as follows: a) The Mayor as Chair b) The Statutory Deputy Mayor as Vice-Chair c) Councillor Lewis Herbert (to maintain political balance)

d) One other Board member which must include the relevant Portfolio Holder when interviewing for to a particular Chief Officer post.

Job Descriptions and Salary Grades

2.17. The Job Description for the following positions are attached at Appendix 2:

a) Finance Director b) Infrastructure Director c) Business and Skills Director d) Strategy and Planning Director

These roles have been informally evaluated at Hay Band 3, which has a salary range of £105,897 to £129,430. However, a formal valuation of the role is currently being undertaken and the Employment Committee will be updated at the next meeting if the grade changes or market supplements need to be considered to attract or secure the appropriate level of candidates. The recruitment process can proceed on the basis that final salary does not have to be determined until the appointment of the candidate.

2.18. These grades are deemed to be consistent with other comparable

organisations, although through the recruitment process market supplements may need to be considered to attract or secure the appropriate level of candidates. This will be discussed with the respective Employment Committee or sub committee as necessary. Deputy Directors and other Direct Reports

2.19. An Employment Committee will be set up in April to consider the proposals for Deputy Directors and any other direct reports to the Directors, including the job descriptions and recruitment processes. It is anticipated that a small lag of time at selection stage for this level, will enable the newly appointed Directors to be involved in the selection process for their own teams. The Employment Committee will, of course be the appointing body.

3.0 FINANCIAL IMPLICATIONS

3.1. It is envisaged that costs will be met from a combination of funding made available to the Combined Authority through the “single pot” – as it is now. The core funding for the Local Enterprise Partnership will be used to fund the Business and Skills Director post and the other roles in this Directorate. The Mayoral Capacity Fund will be used to finance specific roles associated with the delivery of major programmes.

4.0 LEGAL IMPLICATIONS 4.1. The proposals set out in this report are consistent with local government,

employment and procurement law and practice.

RECRUITMENT OF DIRECTOR OF HOUSING & DEVELOPMENT 1.0 PURPOSE 1.1. The Combined Authority Board agreed the senior staffing structure at its

meeting on 28 February 2018. The Board also agreed that the Employment Committee would be responsible for determining the role descriptions, salary ranges and recruitment to the Director (Chief Officer) and their direct reports (Deputy Chief Officers).

1.2. The Director of Housing and Development is a Deputy Chief Officer role

reporting to the Director of Infrastructure.

1.3. As this role is critical the Employment Committee are asked to consider this role ahead of the April paper which will propose all other Deputy Chief Officer roles.

2.0 BACKGROUND

2.1. The Combined Authority has put in place a number of initiatives / projects to advance its ambitions to further the housing agenda since March 2017. These have included: (a) Holding a Housing Summit bringing together members of the region's

housing industry to help develop future plans for the region's housing needs;

(b) Establishing programmes to allocate the £170m funding for infrastructure

and housing including the first phase of affordable new homes; (c) Stakeholder and market engagement across the region to develop the

forward programme and pipeline and identify major strategic, high impact sites.

2.2. Whilst these steps have begun to unpack the housing challenges facing the

Combined Authority, it has yet to develop a comprehensive Housing Strategy and to develop a programme of interlinked initiatives that deliver against the devolution deal commitments.

2.3. Over the last 6 months the Interim Housing Director has made progress in

some areas. However, with his departure in early February 2018, the Combined Authority wishes to proceed with recruitment to the role immediately to ensure that the Combined Authority can continue to make progress in delivering its Housing programme.

2.4. In order to expedite the recruitment process the Chief Executive has exercised

2.8. The Employment Committee is asked to approve a remuneration level for the Director of Housing and Development to include a market forces supplement, to bring the salary up to £130,000 to take into account the following market conditions:

(a) The Combined Authority is positioned as a key organisation in the transformation of the region; delivery of the Housing programme and the commitments for new homes and communities set out in the devolution deal represent a critical, high profile element of the Combined Authority’s work. Cambridgeshire and Peterborough Combined Authority is the only Combined Authority outside London to have devolved responsibility for housing. It is unlike a district or unitary authority, is not only accountable for the delivery of the Housing programme but also on attracting additional investment, stimulating the market and leading high value, large scale commercial deals and opportunities;

(b) The role requires a mix of strong commercial skills, experience of operating

in a senior business development capacity and excellent stakeholder and political management skills to work effectively with the Combined Authority Board and partner authorities and also with central government, commercial developers and housebuilders, housing associations and community land trusts, consultants and advisors, health, other statutory agencies, residents and others;

(c) The current market for similar comparator roles is highly competitive, it

includes both public and private sector organisations. Appendix 2 provides a snap shot of similar roles and remuneration levels. A proposed salary of up to £130,000 is comparable to such roles. It should also be noted that salaries in the Peterborough and Cambridgeshire area are significantly higher than other areas outside of London due to both the proximity to London and also general property prices.

2.9. It is therefore recommended that the Employment Committee approves a salary above the Hay grade 3

3.0 FINANCIAL IMPLICATIONS 3.1. 4.0 LEGAL IMPLICATIONS 4.1. Deputy Chief Officer roles are appointed by the Employment Committee under

the Officer Employment Procedure Rules (Constitution). 4.2. Salary levels are independently evaluated according to the Hay grading

structure. The Employment Committee terms of reference permit it to agree a market supplement for the role where there is evidence of significant demand and higher salary for comparable roles in the wider employment market.

4.3. Where the Employment Committee agree a market supplement, it should agree

the upper limit of the supplement and a period for review of the supplement to ensure that it remains valid in relation to the market so that no question of equal pay arises.

A. Purpose of the job

A1. As a Chief Officer, you will be responsible for the successful delivery of the Mayor’s priorities, the Combined Authority’s corporate objectives, and the business objectives of your Directorate.
