Clery Act – Requirements

• Oregon State must:• Collect, classify and count crime statistics;• Issue campus alerts;• Publish an annual security and fire safety

report;• Maintain a daily crime and fire logs;• Disclose preventative, emergency and

response polices and resources

Who is a Campus Security Authority?

• CSAs are determined by the FUNCTION of their position.• “Officials” whose function:

• involves relationships with students• has significant responsibility for student and campus activities

*Does not include support staff such as clerical, maintenance or food service workers

• A campus police department or campus security department.

Department of Public Safety and Oregon State Police

• Any individual or individuals who have responsibility for campus security but who do not constitute a campus police department or campus security department.

Individuals who monitor access into facilities, act as event security or provide campus escorts. For example, SafeRide.

• Any individual or organization specified in an institution’s statement of campus security policy as an individual or organization to which students and employees should report criminal offenses. For OSU: Department of Public

Safety and Oregon State Police

• An official of an institution who has significant responsibility for student and campus activities, including but not limited to, student housing, student discipline and campus judicial proceedings. Resident Advisors, Faculty Advisors

for student groups, Athletics coaches and more.

Victims or witnesses of criminal activity may not feel comfortable reporting to the Department of Public Safety or law enforcement.

In these situations, they may make the report to someone with whom they have built a relationship. For example, a resident talking to their Resident Advisor or an athlete talking with their coach.

• The final regulations forVAWA were published inOctober of 2014 amendingthe Clery Act.• Added Domestic Violence,

Dating Violence and Stalking tothe list of Clery crimes.

• Requires institutions toprovide victims of sexualassault with a list ofresources available tothem.• A list of resources at Oregon

It does not matter whether the individuals involved in or reportingthe crime are associated with Oregon State University. As long asthe CSA believes the report was made in “good faith,” it should bereported.

A crime is “reported” when it is brought to the attention of a CSA or the DPS Dispatch Center by a victim, witness, other third party or even the offender.

• As a CSA, once a criminal offense has been reportedto you, it is your obligation to report it to thereporting structure of Oregon State Universityimmediately.

The Department of Public Safety Dispatch Center 541-737-7000 (Emergency) 541-737-3010 (Non-

emergency)

Also, for non-emergencies, CSA’s may make a reportusing a online form from the HR Compliance website:http://hr.oregonstate.edu/clery-compliance/webform/report-crime

*Even if you are unsure whether an incident is a Clerycrime, or if its criminal in nature, a report should be made.

If a crime occurs that represents a serious or continuing threat to students or employees, a Timely Warning Notification must be distributed community wide.

• Therefore, as a CSA if you receive a reportit is important that the information isreported to the reporting structureimmediately.

Timely Warning Notifications are sent to keep the community informed. Information on how to say safe in the situation at hand will be provided with the notice.

Oregon State University must disclose statistics to the Department of Education in the following geographic categories:

If a crime occurs outside our reportable geography, it is not disclosed tothe Department of Education even if it involves Oregon State University students or employees.
