commercial activity means any particulartransaction, act or conduct or any regularcourse of conduct that is of a commercial char-acter, whether or not the person who carries itout does so in the expectation of profit, otherthan any transaction, act or conduct that is car-ried out for the purposes of law enforcement,
public safety, the protection of Canada, theconduct of international affairs or the defenceof Canada.

Commission means the Canadian Radio-tele-vision and Telecommunications Commission.
Commissionerof Competitioncommissairede laconcurrence
Commissioner of Competition means theCommissioner of Competition appointed undersubsection 7(1) of the Competition Act.

(2) For the purposes of this Act, a commer-cial electronic message is an electronic mes-sage that, having regard to the content of themessage, the hyperlinks in the message to con-tent on a website or other database, or the con-tact information contained in the message, itwould be reasonable to conclude has as its pur-
pose, or one of its purposes, to encourage par-ticipation in a commercial activity, including anelectronic message that
(a)
offers to purchase, sell, barter or lease aproduct, goods, a service, land or an interestor right in land;
(b) offers to provide a business, investmentor gaming opportunity;
(c) advertises or promotes anything referredto in paragraph (a) or (b); or
(d) promotes a person, including the publicimage of a person, as being a person whodoes anything referred to in any of para-graphs (a) to (c), or who intends to do so.

Exclusion (4) An electronic message described in sub-section (2) or (3) that is sent for the purposes oflaw enforcement, public safety, the protectionof Canada, the conduct of international affairsor the defence of Canada is not considered to
be a commercial electronic message.

In the event of a conflict between a provi-sion of this Act and a provision of Part 1 of thePersonal Information Protection and Electron-
ic Documents Act, the provision of this Act op-erates despite the provision of that Part, to theextent of the conflict.

Purpose of Act 3. The purpose of this Act is to promote theefficiency and adaptability of the Canadianeconomy by regulating commercial conductthat discourages the use of electronic means tocarry out commercial activities, because that
conduct(a) impairs the availability, reliability, effi-ciency and optimal use of electronic meansto carry out commercial activities;
(b) imposes additional costs on businessesand consumers;
(c) compromises privacy and the security ofconfidential information; and
(d) undermines the confidence of Canadiansin the use of electronic means of communi-cation to carry out their commercial activi-
ties in Canada and abroad.
3. La prsente loi a pour objet de promou-voir lefficacit et la capacit dadaptation delconomie canadienne par la rglementationdes pratiques commerciales qui dcouragentlexercice des activits commerciales par voie

4. This Act is binding on any corporationthat is expressly declared by or under any Actof Parliament or of the legislature of a provinceto be an agent of Her Majesty, when the corpo-ration is acting as such in the course of any
commercial activity.

(c) the person to whom the message is senthas disclosed, to the person who sends themessage, the person who causes it to be sentor the person who permits it to be sent, theelectronic address to which the message issent without indicating a wish not to receiveunsolicited commercial electronic messages
at the electronic address, and the message isrelevant to the persons business, role, func-tions or duties in a business or official capac-ity; or
(d) the message is sent in the circumstancesset out in the regulations.

Definition ofexistingbusinessrelationship
(10) In subsection (9), existing business re-lationship means a business relationship be-tween the person to whom the message is sentand any of the other persons referred to in thatsubsection that is, any person who sent orcaused or permitted to be sent the message
arising from(a) the purchase or lease of a product,goods, a service, land or an interest or rightin land, within the two-year period immedi-ately before the day on which the messagewas sent, by the person to whom the messageis sent from any of those other persons;
(b) the acceptance by the person to whomthe message is sent, within the period re-ferred to in paragraph (a), of a business, in-vestment or gaming opportunity offered byany of those other persons;
(c)
the bartering of anything mentioned inparagraph (a) between the person to whomthe message is sent and any of those other
persons within the period referred to in thatparagraph;
(d) a written contract entered into betweenthe person to whom the message is sent andany of those other persons in respect of amatter not referred to in any of paragraphs(a) to (c), if the contract is currently in exis-tence or expired within the period referred toin paragraph (a); or
(e)
an inquiry or application, within the six-month period immediately before the day onwhich the message was sent, made by the
person to whom the message is sent to any ofthose other persons, in respect of anythingmentioned in any of paragraphs (a) to (c).

WARRANTS MANDATS
Warrant 19. (1) On an ex parteapplication, a justiceof the peace may issue a warrant authorizing a
person who is designated for the purpose of thissection and who is named in the warrant to en-ter a place if the justice is satisfied by informa-tion on oath that
(a) entry to the place is necessary to
(i) verify compliance with this Act,
(ii) determine whether any of sections 6to 9 has been contravened, or
(iii) assist an investigation or proceedingin respect of a contravention of the laws ofa foreign state that address conduct that issubstantially similar to conduct prohibitedunder any of sections 6 to 9; and
(b) if the place is a dwelling-house, entryhas been refused or there are reasonablegrounds to believe that entry will be refusedor that consent to entry cannot be obtainedfrom the occupant.
