Press Note on Criminals Contesting Elections

December 5, 2002 Law breakers are now law makers. Nearly 140 candidates contesting the Assembly Elections have a criminal record. This is a very large number considering the fact that there are a total of 182 assembly constituencies. Over 60 are from the two major political parties, and the remaining from other parties and Independents. About 100 candidates themselves admit that they face criminal charges in various courts. They were forced to admit this after a Supreme Court judgement on May 2, 2002 in response to a public interest litigation filed by Association for Democratic Reforms (ADR), Ahmedabad and a new Ordinance on Electoral Reforms issued in August this year. Consider the two major parties alone. The list includes at least 5 Ministers and several sitting MLAs. At least 9 have murder cases against them under IPC Section 302, 12 have attempt to murder cases under IPC Section 307, 18 have cases for threatening to kill, 3 for rape and kidnap, 26 for other violent crimes, like dacoity, assault, rioting, arson and jail break, and 10 of financial fraud. Most have more than one case against them, and many are habitual offenders with over 10 cases against them. If we add the criminals candidates contesting as independents or from other minor parties, the situation is even more alarming. The law does not prevent them from standing for elections because they are not yet convicted. However cases drag on for years and are sometimes withdrawn or manipulated due to political pressure. Meanwhile the ordinary citizen continues to suffer due to the activities of such elected representatives. This includes grabbing the lion’s share of civil contracts, loans from Cooperative Banks, and kickbacks on other major projects. At the same time, the State’s economy continues to decline due to mismanagement. Gujarat Election Watch released two rounds of quarter page advertisements in over 20 newspapers, mostly in Gujarati, requesting people to send information on criminal activities of sitting MLAs and MPs, those who had lost the last election, and future potential candidates. The response was overwhelming and a very large number of letters were received at Post Bag No.5, Ambavadi Vistar Post Office, Ahmedabad 380015. It is clear that public sentiment is overwhelmingly in favour of a cleaner Government. Unfortunately, the voter is left with little choice since both parties persist in putting up criminals. Information on candidates was also collected from a variety of other sources. As a result of this, 101 candidates were identified. However after detailed scrutiny, the Committee decided to release only 28 of these names. The rest either did not contest or had frivolous and trivial charges against them. In addition to these 28 names, the Committee sent its volunteers to various returning officers and District Election Officers (Collectors) and obtained copies of around 1200 affidavits of candidates. Although the public has a right to obtain this information because of a Government Order issued by the Election Commission, the bureaucracy in many constituencies created

obstacles to people seeking this information. Even at present, the Gandhinagar office of the Election Commission is not releasing information to the public but asking them to go to the 182 returning officers. From these affidavits, the Committee has so far identified an additional 94 candidates with criminal records. The process of scrutiny will continue and a second list will be released in a few days. So far, the Committee has identified 34 criminal candidates from the BJP and 29 from the Congress. This works out to about 1 in 6 criminals for both the parties. One party emphasizes patriotism and the other says it is committed to a ‘brashtachar mukt’ Government. Perhaps criminals are the best examples of patriots and honest people these parties could find. This shows the utter contempt they have for the ordinary citizen. Politicians have already stalled the Supreme Court judgement on disclosure of assets and liabilities by promulgating an Ordinance. A Bill has now been introduced in Parliament which is identical to the Ordinance, but has not yet been passed. Legal experts say that the Bill undermines the fundamental right of the voter to know the relevant background of a candidate and might be unconstitutional. Similar Election Watches are now being planned in several other states including Tamil Nadu, Karnataka, Maharashtra, Uttar Pradesh, Madhya Pradesh, Orissa and West Bengal. A similar exercise was done in Andhra Pradesh a few years ago before the recent Supreme Court Judgement and Ordinance. Voters in Gujarat now have a unique opportunity to show the way for the rest of India. By keeping criminals out of office, they can not only give themselves a clean Government, but also ensure that the State’s economy is restored to its earlier pre-eminent position.

Gujarat Election Watch 2002

Election Watch for the forthcoming Gujarat assembly elections in 2002 was done by the Association for Democratic Reforms (ADR). The Association is non-partisan and non-political and all its members are Professors and Alumni of the Indian Institute of Management, Ahmedabad (IIMA), and the National Institute of Design (NID), Ahmedabad. ADR worked with other organizations interested in this issue. The main focus of the Election Watch was on criminals in politics since it is an important issue that every citizen is concerned about. The action plan is a follow-up of a public interest litigation (PIL) filed by ADR which resulted after nearly three years of effort in a landmark judgement by the Supreme Court on May 2, 2002. The judgement asked candidates for Lok Sabha, Rajya Sabha and State Assembly elections to declare their criminal background, assets, liabilities and educational qualifications. On August 24, 2002, the Government modified the judgement through an Ordinance. It retains disclosure of criminal background, but not the other items. There are two new positive outcomes. First, candidates have to file their criminal record including cases pending trial in an affidavit with the Returning Officer(RO). Second, any citizen can obtain a copy of the affidavit from the RO or the Collector. The Candidate can however to continue to contest unless he/she is convicted by a court of law. ADR’s action plan was as follows: (i) A panel of eminent, outstanding citizens of unimpeachable integrity was formed. This included

retired Justices, Directors of well known educational institutes, academics, public servants and others. This panel formed the public face of this activity and everything was done with their approval. Name of the Committee members is enclosed.

(ii) Collected information on elected representatives from the last elections in 1998 who are known to have a criminal record from police, media, lawyers, NGO’s. It was anticipated that broadly the same set of people would contest again. (iii) Also gathered information by issuing advertisements in the media and inviting the public to send information by mail to a Post Box Number (Post Bag No. 5, Ambavadi Vistaar P.O., Ahmedabad – 380 015). (iv) Wrote to the political parties and candidates asking them to clarify the facts. However very few (about 6) used this opportunity to reply to us. (v) Publicized the information through the media. (vi) Collected copies of about 1000 affidavits filed by candidates scrutinized them, and publicized the information along with what we have already collected. (vii) In Case of false affidavits we will file election petition to set aside the victory of such candidates. Advertisements asking the public to send information on criminal candidates by mail to a post box added to expenses. However, it got people involved, raised public awareness and put pressure on the political parties. Media cooperation is much more likely since information in the affidavits is self declared. The objectives of this election watch are to raise public awareness and put pressure on the political system to field better candidates. Gujarat is very much in the news and any progress on this issue will receive national coverage. Arranged a public meeting delivered speeches using words, and actions hurting the feelings of a community, inciting violence, disturbing peace, threatening member of a community and spreading fear by display of lethal weapons. There were several witnesses including police officers, crime, traffic and special branch officers. The event was video taped by the police

• Writ petition in the High Court on 8-7-98 for a land grabbing scandal involving Gordhan Zadaphia. Land belonging to the Bhikubhai Satya Bhikshuk Gruh (BSBG) was illegally occupied by political leaders and sold off to the Takshshila School. The Chief Justice of Gujarat passed adverse remarks. Sessions Court on 15-7-96 said land should be returned to BSBG under Case No. 5562/95 and 798/95. Collector made an enquiry and froze the bank accounts of the main accused, Mansukh Patel.

• Took Rs.15 lakhs as bribe from M/s. Mamadev Silk Mills Pvt Ltd for sanctioning them a loan of Rs.3.6 crores. The Mill has created properties worth Rs.80 lakhs only as against the loan of Rs.3.6 crores. As a ‘Bonus’ Mr. Jadeja enjoyed a tour to Singapore, and other luxuries at the cost of Mamadev Silk Mills. The anti Corruption Bureau investigated this. But the investigation officer (PI) was transferred. Three PI’s till now have been transferred.

• Alleged to have taken a bribe of Rs.3 lakhs from Sahayog Restaurant for sanctioning a loan to them.

• He is involved in many cases of taking bribes and has caused the corporation loss of crores of rupees, while the corporation is not able to pay salaries of its employees.

• Named as accused in Citizens’ Tribunal. I.K.Jadeja monitored riots from Police Bhavan, Gandhinagar and prevented them from taking action.

14. Shri Jethabhai Bharvad MLA Shahara (121) BJP

Allegations: • Was imprisoned in Sabarmati jail and was involved in breaking out of it. • Involved in threatening people, booth capturing and bogus voting in earlier elections. • Involved in purchasing land at very low rates by threatening land owners. • Involved in murder and rape of Ms. Bijal Joshi of Ahmedabad 11 years ago. • Many criminal cases are pending in Shahera and Ahmedabad Court. • During the last election, he had called anti-social elements from out side Gujarat State and

created an atmosphere of terror by moving around in vehicles carrying AK-56 and other deadly weapons in village Rena, Morva, Gokalpura, Ujda, etc and indulging in booth capturing and bogus voting. Entered into confrontation with the DSP, the Collector and Police and ultimately surrendered himself. He has been charge sheeted in the session Court of Panchmahal district and the case is pending before the court.

• FIR No. 76/2002 of 24.3.2002 under IPC 143, 147, 148, 149, 332, 353, 186, 336, (rioting with deadly weapons, endangering life and safety of people, provoking a riot), BP Act 135/1 filed by Senior PI NR Jadhav of Gomtipur Police Station that mobs clashed with each other at Mariam Bibi Ni Chali where two persons were killed. Vaghela was named as one of the accused

• By his own admission, some of the cases have been filed by the police themselves, even though he belongs to the ruling party. Ashwinbhai Wankar of the BJP also admits that Vaghela is charged with murder under IPC section 302

• Charged with rioting and causing death of three persons under IPC 302 (murder) • Spent 108 days in jail after his arrest on March 31, 2002, moved three bail applications and

is currently out on bail • Was booked by the Police under PASA, but this was later revoked by the Government • On March 22, one case was filed against him, and on March 30, three additional cases were

filed against him. Accused in the carnage and killings in Moto Vankarvas, Sutharwada, Ashoknagar, Popatiawad, Maniarwada, Jhulta Minara and Nagpurwala in Chali areas of Ahmedabad. Complaint says he led a mob of 3000 people carrying firearms, acid bulbs, petrol bombs, swords and knives

Happened on 23.10.1998 and the case is still pending. Fifty five (55) neighbours of the woman sent a letter in support to the authorities.

• Helped his son’s father in-law in occupying Government land illegally for operations of Patel Stone Company. They have cut trees illegally and have extracted more than 3000 T of stone illegally without paying any royalty.

• Involved in many cases of threatening people with revolver and in some murder cases. • Involved in purchase of detonators, explosives from unauthorized sources and could potentially

be charged under the Explosives Act • Threatened and evicted 13 families and made them homeless so as to occupy their land. • Alleged to extort ‘hapta’ from various factories near Morbi including from Maharaja Salt Works

and Ganesh Benzo Company • Misbehaviour and use of abusive language against Government officials • Several stories about his alleged criminal activities have appeared in local newspapers.

• After that Mr Shankarbhai fired from his gun/revolver at Gulam Jelani Gulam Rasul Shaikh and Gulam Nabi Kalubhai Shaikh. While these two injured were being taken to the hospital in a jeep, the driver had to stop the jeep on the road near Lohana Wadi as an electric pole was put on the road as a barrier. The mob started throwing stones and the driver ran away leaving the jeep. Both the injured persons were beaten again. Some how Gulam Nabi Shaikh managed to escape. Later on he was taken to the hospital by police. Mr Gulam Jelani was in the jeep and the mob burnt him with the jeep.

On 14-9-1982 at around 8.00 pm the accused and his brother Mangalsinh while drunk and armed with Dharias, abused, assaulted, and threatened to murder Makabhai Motibhai Gohil of Mevli village.

• FIR No. I 79/83 at Savli PS under IPC 147, 148, 149, 307 (attempt to murder and rioting) and Bombay Police Act Section 135. Charge subsequently changed to murder (Section 302) of IPC) as the victim later died. Mr.Khumansinh was detained for ten months. Appeal is pending in the High Court of Gujarat. The accused along with 5 others formed a gang armed with deadly weapons like Iron Bars, stick, spear, etc, on 11-10-1983 caught hold of a candidate for Panchayat elections, Parvatsinh Surabhai Solanki, beat him and injured him with a motive of killing him. The victim died afterwards.

• FIR No.III 128/89 dt 22.3.89. On 22.3.89 (Holi) Mr.Khumansinh was caught in drunk condition by a police head constable. Case registered under Sec CB(I)(B) of Bombay Prohibition Act and Sec 110 of Bombay Police Act.

On 13-1-94, on Savli – Mevli Road a Tempo was taking passengers, so the police lodged a complaint. On this the driver tempo owner and his other driver friends agitated against this action of police and went to report to Mr.Khumansinh who was in office. The police also went there at that time. Mr.Khumansinh came out of the office and asked the agitating drivers of the tempo to beat the police and started speaking filthy words to police and himself beat them by blows.
