Nainital: The Uttarakhandhigh court on Monday heldthat both the state and the cen-tral governments are obligatedto bring back migrants to Utta-rakhand because their funda-mental rights under Article 21of the Constitution may be vio-lated if they are left stranded.

The division bench ofChief Justice Ramesh Rang-anathan and Justice Alok Ku-mar Verma held that the obli-gations of the state and Centreto bring back the labourers canbe traced to Article 21 since itrelates to their life and liveli-hood. “As the fundamentalrights of these persons, underArticle 21 of the Constitution

of India, may possibly be vio-lated if they are not broughtback to the state immediately, and provided the much-neededfood and shelter, both the cen-tral and state governments areobligated to forthwith bringback these persons toUttarakhand,” the bench saidin itsorder.

Speaking to TOI, SK Man-dal, the counsel appearing for petitioner Preetam Singh, said the HC’s decision is a landmark. “I don’t think anyHC in India, till now, haslin0ked the migrant crisis inthe country to the fundamen-tal rights. Therefore, the deci-sion by the HC is a guaranteethat they will surely bebrought back and the govern-ment can’t use any excuseagainst it,” Mandalsaid.

HC: Leaving migrantsstranded violates rights

India’s most influential Is-lamic seminary, DarulUloom Deoband, on Mon-

day issued a fatwa asking allMuslims to offer prayers andcelebrate Eid at home thisyear in keeping with the ex-tended national lockdown.Delhi-based author and histo-rian Rana Safvi sees this Eidas a “humanitarian event”rather than a festival.

Qari Fazlur Rahman, wholeads Eid prayers on Kolkata’sRed Road every year, believesadapting to a new normaldoesn’t mean the sanctity ofthe festival will be lost.

Heading into the last weekof Ramzan amid the Covid-19pandemic, India’s 172 millionMuslim population is prepar-ing for – and reconciling itselfto – a most unusual Eid bereftof all the usual trappings suchas huge prayer congregations, ceaseless shopping, social vis-its and the inviting warmth of

an Eid Milan embrace. On social media groups,

messages like “no newclothes, just wear your bestclothes” are being circulated ,urging people to fill the festivevoid with the spirit of giving. The suggestions range frompaying a needy child’s schoolfee or someone’s rent to help-ing a lockdown-hit trader re-vive his business.

In homemaker SuboohiAlvi’s Lucknow home, the

special Eid sewaiyan won’t bejust for friends and family.“We will make sewaiyan fordistribution among those whohave gone through much dis-tress in the past two monthsand can’t afford a decent Eidfeast,” she said.

Like many households,Mumbai-based Muzaffar Ka-limullah’s family has decidednot to do any Eid shopping. “Iam using the money to help afew relatives affected badly bythe lockdown. We have decid-ed to wear old clothes thisEid,” said Kalimullah, an ex-ecutive with a private firm.

In Srinagar, MuzaffarShah has but one request – theadministration should allowmutton shops to open ahead ofEid. “If not anything, a goodEid feast will make up for allthat we will miss out on thistime,” he said.
