The American Conservative Union Foundation (ACUF) is proud to present our 2018 Ratings of Congress. Our Ratings have served as the gold standard for holding Congress accountable for 48 years. These Ratings of Congress—and our Ratings of all 50 state legislatures—are initiatives of ACU Foundation’s Center for Legislative Accountability. In all, every year we rate about 8,000 elected officials across 101 legislative chambers across the country.
As a 501(c)(3) educational endeavor, these Ratings serve as a retrospective analysis to explain to voters, the media, scholars, and activists how lawmakers view the role of government in an individual’s life, and how consistently each lawmaker applies conservative principles when casting votes.
We wait until the previous session is adjourned before we finalize the bills to be included in our scorecard. During last year’s session of Congress, our conservative revolution endured historic obstruction to confirm Justice Brett Kavanaugh to the Supreme Court, a vote we have double-weighted due to its monumental impact on our nation’s judiciary for decades to come.
Senate Democrats also made another push for censorship with a vote to re-impose net neutrality, Obama’s hyper-partisan effort to add duplicative regulations at the FCC. We double-weighted this vote, too, signaling to Congress that conservatives will not allow the Left to violate our First Amendment rights.
The Left has renewed its commitment to advance socialism in their zeal to fundamentally transform America. With such an important fight ahead, it’s never been more important for our elected officials to understand the proper role of government. We hope these Ratings will empower Americans everywhere to engage in the defense of our conservative values and take action to preserve liberty.

SELECTING THE VOTES
ACU researches and selects a range of bills to evaluate a member’s adherence to conservative principles. We begin by defining conservatism (i.e., the political philosophy that sovereignty resides in the person). Next, we apply our understanding of the proper role of government (i.e., protecting Life, Liberty and Property). Then, we select bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: Second Amendment, religion, life, welfare, and education; and 3) national security: preserving our nation’s security by maintaining a strong national defense. The wide range of issues covered are designed to give citizens an accurate assessment of how Members of Congress view the role of government in an individual’s life.

1. PN 1341 Confirming Sam Brownback as Ambassador at Large for International Religious Freedom (Roll Call 23). This vote confirms Sam Brownback (ACUF Lifetime 92.2%) as the US Ambassador at Large for International Religious Freedom, whose duties include monitoring persecution and discrimination on a global scale through the Office of International Religious Freedom. ACU supported the confirmation of Brownback who, as a Governor, Senator and Representative of Kansas, compiled a strong voting record and demonstrated a commitment to conservative principles. The Senate voted to confirm Brownback on January 24, 2018 by a vote of 49-49, with Vice President Mike Pence (ACUF Lifetime 99.6%) voting “Yes” to break the tie.
2. S 2311 Banning Abortions of Pain-Capable Unborn Children (Roll Call 25). This bill, known as the Pain-Capable Unborn Child Protection Act, makes it unlawful to abort pain-capable unborn children. The bill states that unborn children are pain-capable at 20 weeks of pregnancy and provides exceptions if the abortion is necessary to save the life of the mother or if the pregnancy was the result of rape or incest. At this stage in a pregnancy, unborn babies react to touch, are fully formed and have beating hearts and functional brains. ACU believes abortion is a human tragedy, supports restrictions on the practice and supported this bill. The motion to invoke cloture (end debate) and advance the bill failed on January 29, 2018 by a vote of 51-46. (Sixty votes were required on legislation and a “Yes” vote supported the ACU position.)
3. HR 2579 Defunding “Sanctuary Cities” and Strengthening the Enforcement of Federal Immigration Laws (Roll Call 34). The Toomey (R-PA, ACUF Lifetime 92.8%) amendment to an unrelated health care bill establishes the Stop Dangerous Sanctuary Cities Act. Under the act, a portion of a state’s or local government’s federal funding is withheld if they fail to cooperate with federal immigration authorities or fail to comply with federal immigration law. ACU supports efforts to force states to comply with federal authorities as they perform their constitutional role in enforcing the nation’s immigration laws and supported this amendment. The motion to invoke cloture (end debate) and advance the amendment failed on February 15, 2018 by a vote of 54-45. (Sixty votes were required on legislation and a “Yes” vote supported the ACU position.)
4. PN 367 Confirming Russell Vought as Deputy Director of the Office of Management and Budget (Roll Call 40). This vote confirms Russell Vought as Deputy Director of the Office of Management and Budget. The position plays a critical role in carrying out the president’s policy agenda government-wide. ACU supported the confirmation of Vought, who has fought for the principles of limited government and fiscal responsibility throughout his career. The Senate voted to confirm Vought on February 28, 2018 by a vote of 49-49, with Vice President Mike Pence (ACUF Lifetime 99.6%) voting “Yes” to break the tie.
5. S 2155 Reforming Devastating Banking and Lending Regulations under Dodd-Frank (Roll Call 54). This bill modifies some of the devastating regulations imposed on the financial sector through an Obama-era bill known as Dodd-Frank, which resulted in 22,000 pages of new regulations. Some of the reforms under this bill include regulatory relief for both small and large banks, reduced red tape on mortgage lending, and other revisions to encourage capital formation. ACU believes no business is “too big to fail,” supports expanding consumer access to credit and eliminating regulations under Dodd-Frank that have shuttered numerous banks, especially small lenders and credit unions, and supported this bill as a step in the right direction. The Senate passed the bill on March 14, 2018 by a vote of 67-31.
6. SJ Res. 57 Repealing an Obama-Era Rule that Harms Indirect Auto Lending (Roll Call 75). This resolution invokes the Congressional Review Act to overturn an overreaching Obama administration rule that limited the ability of auto dealers to offer discounted-rate auto loans to customers. Specifically, the rule related to indirect auto lending and compliance with the Equal Credit Opportunity Act. ACU supports the overturning of this Obama-era regulation that has stifled the free market and increased the cost of auto loans and supported this resolution. The Senate passed the resolution on April 18, 2018 by a vote of 51-47. (A “Yes” vote supported the ACU Position.)

7. SJ Res. 52 Re-Imposing “Net Neutrality” Regulations on the Internet (Roll Call 97). This Democrat-led resolution invokes the Congressional Review Act to re-impose Obama-era “net neutrality” regulations on the internet. These regulations, which were overturned by Chairman Ajit Pai and the Federal Communications Commission, are price controls that prohibit ISPs from charging different rates for faster service or blocking websites. ACU supports an internet free of government interference, which has allowed it to thrive since its conception, and opposes heavy-handed government regulations, such as net neutrality, which have favored some companies while placing over 1,000 small ISPs at a competitive disadvantage, and opposed this resolution. The Senate passed the resolution on May 16, 2018 by a vote of 52-47. This vote was double-weighted due to the fact it would allow government to retake control of the internet, a remarkable driver of innovation and free speech.
8. HR 5515 Providing Congressional Oversight of the Committee on Foreign Investment (Roll Call 123). The Toomey (R-PA, ACUF Lifetime 92.8%) amendment to the National Defense Authorization Act establishes congressional oversight of the rulemaking authority of unelected bureaucrats within the Committee on Foreign Investment in the United States (CFIUS). Under the bill, all major regulations (including those with an economic impact of $100 million or greater) are required to be approved by Congress before their enactment. Additionally, CFIUS must submit to Congress a written report that contains data, economic studies and cost-benefit analysis justifying the implementation of any new regulation. ACU supports increasing government transparency and checks on the rulemaking power of government agencies and supported this amendment. The Senate defeated the amendment on June 14, 2018 by a vote of 35-62.
9. HR 5895 Strengthening Property Rights by Repealing the “Waters of the United States” Rule (Roll Call 138). The Lee (R-UT, ACUF Lifetime 99.5%) amendment to the Energy and Water Appropriations Act repeals the Obama-era “Clean Water Rule: Definition of ‘Waters of the United States,’” which provided unelected bureaucrats within the Environmental Protection Agency (EPA) carte blanche authority to interpret the definition of a “navigable waterway.” As a result, the EPA had expanded its jurisdiction to regulate nearly any water source, including ponds, ditches and even puddles. ACU Foundation’s Center for 21st Century Property Rights is a leading voice on this issue and works to ensure the constitutional rights of all landowners are protected from government overreach. ACU opposes the unconstitutional action taken by the Obama administration, supports strengthening property rights and supported this amendment. The Senate tabled (defeated) the amendment on June 21, 2018 by a vote of 62-34. (A “No” vote supported the ACU position.)
10. HR 2 Reducing Fraud and Strengthening Work Requirements to Receive Government Assistance (Roll Call 141). The Kennedy (R-LA, ACUF Lifetime 78.6%) amendment to the Agriculture Improvement Act of 2018 (i.e., farm bill) helps encourage self-sufficiency by making reforms to the Supplemental Nutrition Assistance Program (SNAP). Some of these reforms to the food stamp program include updating photo identification requirements and strengthening work and job training requirements for single, work-ready adults without children. ACU supports strengthening work and job training requirements for welfare, which encourages self-sufficiency and reduces intergenerational poverty and supported this amendment. The Senate tabled (defeated) the amendment on June 28, 2018 by a vote of 68-30. (A “No” vote supported the ACU position.)

11. HR 2 Reducing Cronyism in Agricultural “Checkoff” Programs (Roll Call 142). The Lee (R-UT, ACUF Lifetime 99.5%) amendment to the Agriculture Improvement Act of 2018 (i.e., farm bill) makes numerous reforms to “checkoff” programs within the U.S. Department of Agriculture. These programs force all producers of agricultural products to pay into a fund for industry promotion. The programs are rife with cronyism and oftentimes reduce competition between producers, particularly at the expense of small businesses. Some of the reforms under the bill include the establishment of uniform standards that prohibit anti-competitive activity within the programs, as well as measures that prohibit employees and agents of checkoff boards from engaging in activities that pose a conflict of interest. ACU opposes checkoff programs and supports this measure to reduce corruption and increase transparency and supported this amendment. The Senate defeated the amendment on June 28, 2018 by a vote of 38-57.
12. S 1182 Extending the National Flood Insurance Program (Roll Call 173). This bill extends government control of the National Flood Insurance Program through November 30, 2018. The program is over $20 billion in debt, and the extension lacks any reforms, including reforms to ensure flood maps are updated and that insurance premiums reflect actual risk. ACU believes flood insurance should be provided by the private sector and opposes this program, which discourages flood prevention measures and forces taxpayers to subsidize the risk of select property owners, and opposed this bill. The Senate passed the bill on July 31, 2018 by a vote of 86-12.
13. HR 6147 Preventing Overregulation by the FDA in the “Milk” Industry (Roll Call 177). The Lee (R-UT, ACUF Lifetime 99.5%) amendment to a multi-agency appropriations bill prevents the Food and Drug Administration (FDA) from inappropriately interfering in the marketplace. Specifically, the amendment prohibits the FDA from enforcing a rule that prevents producers of plant-based products (such as almond milk) from using the word “milk” in its branding (e.g., “almond milk”). The FDA claims its rule is necessary to protect consumers from confusion, but consumers are not confused about whether almond milk comes from a cow. Instead, the FDA’s action is an example of government favoring certain companies over others. ACU supports a free and competitive marketplace and opposes unnecessary interference designed to restrict competition and supported this amendment. The Senate defeated the amendment on August 1, 2018 by a vote of 14-84.
14. HR 6147 Protecting Residents from DC’s Replacement of the Obamacare Individual Mandate (Roll Call 179). The Cruz (R-TX, ACUF Lifetime 98.3%) amendment to a multi-agency appropriations bill prohibits any money appropriated to the District of Columbia from funding the District’s health care insurance individual mandate. The amendment is in response to actions taken by the District to establish its own individual mandate after the Obamacare financial penalty for lacking insurance was zeroed out under the Tax Cuts and Jobs Act of 2017. ACU has long opposed Obamacare and its costly provisions, such as the individual mandate, and supported this amendment. The Senate tabled (defeated) the amendment on August 1, 2018 by a vote of 54-44. (A “No” vote supported the ACU position.)
15. HR 6157 Defunding Planned Parenthood and Abortion Providers (Roll Call 191). The Paul (R-KY, ACUF Lifetime 96.6%) amendment to a multi-agency appropriations bill prohibits federal money from funding entities that perform abortions, such as Planned Parenthood. ACU believes abortion is a human tragedy, supports restrictions on the practice and supported this amendment. The Senate defeated the amendment on August 23, 2018 by a vote of 45-48.
16. PN 2259 Confirming Brett Kavanaugh as Justice of the Supreme Court (Roll Call 223). This vote confirms the nomination of Brett Kavanaugh as Associate Justice of the Supreme Court of the United States. The nomination is in response to the retirement of Justice Anthony Kennedy who was nominated by President Ronald Reagan and served 30 years on the court. ACU supported the nomination of Kavanaugh, an ardent defender of the Constitution and equal rights under the law with an outstanding track record as a United States Circuit Judge for the District of Columbia, and supported his confirmation. The Senate confirmed Kavanaugh on October 6, 2018 by a vote of 50-48. The vote is double-weighted due to the crucial role he will play in upholding the Constitution as a lifetime member of the Supreme Court. While not voting, Senator Lisa Murkowski (R-AK, ACUF Lifetime 57.7%) was recorded as opposing and Senator Steve Daines (R-MT, ACUF Lifetime 85.7%) was recorded as supporting, based upon the declared positions of both members.

17. SJ Res. 63 Prohibiting Low-Cost Alternatives to Obamacare (Roll Call 226). This Democrat-led resolution invokes the Congressional Review Act to prevent consumers from purchasing short-term limited duration insurance plans, which are low-cost alternatives to Obamacare. Specifically, the bill overturns a rule by Department of Health and Human Services that exands the sale of these plans, that are exempt from many of the costly mandates under Obamacare, such as the mandate to cover “essential health benefits.” ACU supports efforts to bypass Obamacare and provide consumers with greater freedom to purchase the health care plans that best fit their needs and opposed this resolution. The Senate defeated the resolution on October 10, 2018 by a vote of 50-50.
18. PN 2117 Ensuring Judicial Nominees are Confirmed to the Federal Bench (Roll Call 258). This roll call confirms Jonathan A. Kobes as the Circuit Judge of the United States Court of Appeals for the Eight Circuit. The vote is significant considering Senator Flake (R-AZ, ACUF Lifetime 93.1%) attempted to blackmail the Senate and oppose all judicial nominees until a bill protecting the Mueller Investigation was brought to a vote. ACU supports Kobes and other judicial nominees who have demonstrated a commitment to defending the Constitution and supported this nomination. The Senate confirmed Kobes on December 11, 2018 by a vote of 50-50, with Vice President Mike Pence (ACUF Lifetime 99.6%) voting “Yes” to break the tie.
19. SJ Res. 64 Suppressing Free Speech through Donor Disclosure Rules (Roll Call 260). This Democrat-led resolution invokes the Congressional Review Act to limit free political speech by requiring certain tax-exempt organizations to collect and make available to the Internal Revenue Service the names and addresses of their contributors. Specifically, the resolution nullifies the Department of The Treasury rule that protects donor identity (“Returns by Exempt Organizations and Returns by Certain Non-Exempt Organizations”). ACU opposes efforts to chill free political speech through donor intimidation and opposed this resolution. The Senate passed the resolution on December 12, 2018 by a vote of 50-49.
20. S 756 Reforming the Criminal Justice System – First Step Act (Roll Call 271). This bill, known as the First Step Act, makes numerous reforms to the criminal justice system to reduce costs, responsibly lower incarceration rates and improve public safety. The bill focuses on reforming sentencing, inmate rehabilitation and prison safety. The ACU Foundation’s Nolan Center for Justice was a leading force behind the passage of the bill and engages in other federal and state-based initiatives. ACU supports efforts to reduce recidivism and reform our criminal justice system, which has the highest incarceration rate in the world, and supported this bill. The Senate passed the bill on December 18, 2018 by a vote of 87-12.

1. HR 4712 Protecting Children who Survive Abortion (Roll Call 36). This bill, known as the Born-Alive Abortion Survivors Protection Act, requires all health practitioners to immediately admit to a hospital any child who is born alive after an abortion is attempted and failed. Additionally, practitioners will face criminal penalties if they do not provide the same degree of care to children who survive abortion as they would any other child. ACU believes abortion is a human tragedy, supports restrictions on the practice and supported this bill. The House passed the bill on January 19, 2018 by a vote of 241-183.
2. HR 620 Reforming the Americans with Disabilities Act to Reduce Frivolous Litigation (Roll Call 80). This bill helps reduce frivolous litigation under the Americans with Disabilities Act (ADA) by providing businesses with an opportunity to fix a violation before a lawsuit may be brought against them for ADA noncompliance. Furthermore, the bill directs the Judicial Conference of the United States to develop an alternative mediation mechanism that promotes quicker resolutions of ADA disputes without costly litigation. ACU supports this measure to promote faster compliance to better meet the needs of people with disabilities while also reducing costly litigation, which enriches lawyers at the expense of both businesses and consumers, and supported this bill. The House passed the bill on February 15, 2018 by a vote of 225-192.
3. HR 1119 Ending the War on Coal through Regulatory Reform (Roll Call 101). This bill eases emissions regulations on power plants that generate electricity through the burning of coal refuse (a byproduct of coal). Under the bill, a coal refuse plant is only required to meet certain standards relating to hydrogen chloride or sulfur dioxide, as opposed to both. ACU supports all sources of energy and this approach to regulatory reform, which allows the nation’s 18 coal refuse plants to remain operational, and supported this bill. The House passed the bill on March 8, 2018 by a vote of 215- 189.
4. HR 5247 Providing Terminally Ill Patients the Right to Try Investigational Drugs (Roll Call 121). This bill provides terminally ill patients the right to try certain investigational drugs that have not yet fully completed all the clinical trials of the Food and Drug Administration (FDA) or been approved by the FDA for sale. ACU believes it is absurd to deny terminally ill patients the right to try potentially lifesaving drugs and supported this bill. The House passed the bill on March 21, 2018 by a vote of 267-149.
5. HR 4 Eliminating the Prevailing Wage Requirement on Federal Aviation Projects (Roll Call 157). This amendment to the Federal Aviation Administration (FAA) Reauthorization Act eliminates the prevailing wage rate on FAA-contracted projects, as established under the Davis-Bacon Act. ACU supports the full repeal of the Davis-Bacon Act, a Depression-era price control that drives up taxpayer costs by mandating that employees of government contractors be paid artificially high wages, and supported this amendment. The House defeated the amendment on April 26, 2018 by a vote of 172-243.
6. HR 4 Eliminating Rural Air Service Subsidies (Roll Call 162). The McClintock (R-CA, ACUF Lifetime 98.8%) amendment to the Federal Aviation Administration (FAA) Reauthorization Act eliminates the Essential Air Service Program. This program subsidizes airline flights from small airports to regional hubs. These flights are largely empty and cover distances quickly managed by car. ACU opposes the continued wasteful spending on a “temporary program” that was originally established 40 years ago to help the airline industry adjust to deregulation and supported this amendment. The House defeated the amendment on April 27, 2018 by a vote of 113-293.
7. SJ Res. 57 Repealing an Obama-Era Rule that Harms Indirect Auto Lending (Roll Call 171). This resolution invokes the Congressional Review Act to overturn an overreaching Obama administration rule that limited the ability of auto dealers to offer discounted-rate auto loans to customers. Specifically, the rule related to indirect auto lending and compliance with the Equal Credit Opportunity Act. ACU supports overturning this Obama-era regulation that has stifled the free market and increased the cost of auto loans and supported this resolution. The House passed the resolution on May 8, 2018 by a vote of 234-175.

8. HR 2 Reforming the U.S. Sugar Program to Expand Competition and Reduce Consumer Costs (Roll Call 193). The Foxx (R-NC, ACUF Lifetime 94.2%) amendment to the Agriculture Improvement Act of 2018 (i.e., farm bill) makes modest reforms to the U.S. Sugar Program, a Depression-era policy which is designed to enrich sugar producers through subsidies and reduced foreign competition, and results in artificially high sugar prices. Specifically, the bill favors the free market by eliminating the feedstock flexibility program for bioenergy producers and reforming the administration of tariff-rate quotas and program loan rates. ACU supports free trade and free markets and opposes the U.S. Sugar Program, which harms taxpayers and consumers and places U.S. sugar processing companies at a competitive disadvantage in the global market, and supported this amendment as a step in the right direction. The House defeated the amendment on May 17, 2018 by a vote of 137-278. The final farm bill failed to include any conservative reforms and was signed into law December 20, 2018.
9. HR 2 Reducing Fraud and Strengthening Work Requirements to Receive Government Assistance (Roll Call 195). The McClintock (R-CA, ACUF Lifetime 98.8%) amendment to the Agriculture Improvement Act of 2018 (i.e., farm bill) encourages self-sufficiency by requiring participation in work and job training programs for roughly 70 percent of work-ready adults in the Supplemental Nutrition Assistance Program (SNAP). This amendment changes the bill’s previous requirement that only 20 percent of work-ready SNAP recipients to participate. In addition to various other reforms, the amendment requires SNAP recipients who also receive job training to be verified as lawful residents of the country via the E-Verify system to ensure taxpayer resources are prioritized to U.S. citizens. ACU supports work and job training requirements that encourage welfare recipients to become self-sufficient and reduce intergenerational poverty and supported this amendment. The House defeated the amendment on May 17, 2018 by a vote of 83-330. The final farm bill failed to include any conservative reforms and was signed into law December 20, 2018.
10. HR 2 Easing Restrictions on the Sale of Unpasteurized Milk (Roll Call 201). The Massie (R-KY, ACUF Lifetime 90.2%) amendment to the Agriculture Improvement Act of 2018 (i.e., farm bill) prohibits federal interference with the interstate traffic of unpasteurized milk between states that allow its sale. ACU supports “food freedom” and expanding individual liberties, including the decision to consume unpasteurized milk, and supported this amendment. The House defeated the amendment on May 18, 2018 by a vote of 79-331.
11. HR 2 Strengthening Property Rights by Repealing the “Waters of the United States” Rule (Roll Call 203). The Banks (R-IN, ACUF Lifetime 92.3%) amendment to the Agriculture Improvement Act of 2018 (i.e., farm bill) repeals the Obama-era “Clean Water Rule: Definition of ‘Waters of the United States,’” which provided unelected bureaucrats within the Environmental Protection Agency (EPA) carte blanche authority to interpret the definition of a “navigable waterway.” As a result, the EPA had expanded its jurisdiction to regulate nearly any water source, including ponds, ditches and even puddles. ACU Foundation’s Center for 21st Century Property Rights is a leading voice on this issue and works to ensure the constitutional rights of all landowners are protected from government overreach. ACU opposes the unconstitutional action taken by the Obama administration, supports strengthening property rights and supported this amendment. The House passed the amendment on May 18, 2018 by a vote of 238-173. The final farm bill failed to include any conservative reforms and was signed into law December 20, 2018.
12. S 2155 Reforming Devastating Banking and Lending Regulations under Dodd-Frank (Roll Call 216). This bill modifies some of the devastating regulations imposed on the financial sector through an Obama-era bill known as Dodd-Frank, which resulted in 22,000 pages of new regulations. Some of the reforms under this bill include regulatory relief for both small and large banks, reduced red tape on mortgage lending and other revisions to encourage capital formation. ACU believes no business is “too big to fail,” supports expanding consumer access to credit and eliminating regulations under Dodd-Frank that have shuttered numerous banks, especially small lenders and credit unions, and supported this bill as a step in the right direction. The House passed the bill on May 22, 2018 by a vote of 258-159.

13. HR 3 Rescinding $15 Billion in Unspent Funds (Roll Call 243). This bill, known as the Spending Cuts to Expired and Unnecessary Programs Act (i.e., the “Rescissions Package”) rescinds roughly $15 billion in unspent funds that are sitting idle in various administration accounts. The rescinded funds include $4.1 billion for the Advanced Technology Vehicle Manufacturing Program, a subsidy to automobile manufacturers for the production of fuel-efficient vehicles. ACU supports this rare and modest attempt to reduce our out-of-control spending (Congress has not rescinded spending in nearly two decades) and supported this bill. The House passed the bill on June 7, 2018 by vote of 210-206.
14. HR 5895 Reducing Non-Defense Discretionary Spending by 1 Percent (Roll Call 251). The Blackburn (R-TN, ACUF Lifetime 95.7%) amendment to the energy and water appropriations bill calls for a 1 percent across-the-board cut in non-defense discretionary spending within the bill. ACU supports this modest spending cut, especially at a time the country’s budget deficit is approaching $1 trillion per year and the national debt is topping $22 trillion and supported this amendment. The House defeated the amendment on June 7, 2018 by a vote of 155-262.
15. HR 5895 Prohibiting Funding for the Justification of a Carbon Tax. (Roll Call 253). The Gohmert (R-TX, ACUF Lifetime 94.5%) amendment to the energy and water appropriations bill prevents any funds from being used to prepare, propose or promulgate any regulation or guidance related to the “social cost of carbon,” or the unforeseen risks predicted by proponents of climate change, including rising health care costs, destruction of property and reduced tourism. ACU opposes the misuse of taxpayer funds to advance a politicized global warming agenda and supported this amendment. The House passed the amendment on June 8, 2018 by a vote of 212-201.
16. HR 5895 Requiring a Semi-Annual Financial Audit of the GAO and the Mueller Investigation (Roll Call 254). The Meadows (R-NC, ACUF Lifetime 95.2%) amendment to the energy and water appropriations bill requires a semi-annual financial audit of the expenditures of the Government Accountability Office (GAO) of Independent Counsels, including the expenditures of the Robert Mueller investigation. The department previously underwent financial audits but the provision of law requiring audits was repealed in 2010. ACU supports close oversight of the expenditure of all taxpayer funds and efforts to increase government accountability and supported this bill. The House passed the amendment on June 8, 2018 by a vote of 207-201.
17. HR 4760 Enacting Comprehensive Immigration Reform (Roll Call 282). This bill includes many of the reforms to the nation’s immigration system offered by President Trump. The bill provides increased funding for border security, including a wall or barrier on the U.S. border with Mexico, and restricts state and local governments from enacting “sanctuary” policies that prevent the enforcement of federal immigration law. Additionally, the bill implements programs and deterrents to reduce illegal immigration, including E-verify and DNA testing to establish family relationships. Finally, the bill expands employment-based immigration while eliminating the diversity visa lottery program and limiting chain migration. ACU supports the overhaul of our broken immigration system and the further expansion of employment-based immigration and supported this bill as a step in the right direction. The House defeated the bill on June 21, 2018 by a vote of 193-231.

18. HR 6147 Prioritizing Government Land Maintenance instead of Land Acquisition (Roll Call 341). The Biggs (R-AZ, ACUF Lifetime 92.3%) amendment to a multi-agency appropriations bill transfers funds from the Bureau of Land Management land acquisition account to the National Park Service maintenance backlog account. The federal government owns roughly 28 percent of all the lands in the United States and the National Park Service’s deferred maintenance backlog currently tops $12 billion. ACU believes it is absurd for the federal government to continue to acquire land when it can’t manage the enormous land holdings already under its control and supported this amendment. The House defeated the amendment on July 18, 2018 by a vote of 172-237.
19. HR 6147 Reducing Unnecessary Spending – National Endowment for the Arts (Roll Call 345). The Grothman (R-WI, ACUF Lifetime 93.1%) amendment to a multi-agency appropriations bill reduces the appropriation for the National Endowment for the Arts by 15 percent. ACU supports reducing non-essential government spending, especially at a time when the nation is $22 trillion in debt and the private sector contributes billions of dollars to the arts, and supported this amendment. The House defeated the amendment on July 18, 2018 by a vote of 114-297.
20. HR 6147 Ensuring Proper Application of the Endangered Species Act (Roll Call 350). This bill guarantees this problematic law is at least implemented correctly. Lamborn (R-CO, ACUF Lifetime 96.6%) amendment to a multi-agency appropriations bill helps ensure the proper application of the Endangered Species Act (ESA) by prohibiting the use of funds to enforce the provisions under the ESA for any species of plant or wildlife that has not undergone a five-year review of its protected status, as is required under the act. The amendment is intended to ensure that enforcement and taxpayer resources support only the protection of species truly endangered. The ACU Foundation’s Center for 21st Property Rights is a leading voice on this issue and others that deprive Americans of their Fifth Amendment rights. ACU opposes using the ESA as a means for seizing private land rights and supports close oversight and a significant reduction in the scope of the ESA, which has reduced development and infringed on the property rights of millions of Americans, and supported this bill. The House passed the amendment on July 18, 2018 by a vote of 213-201.
21. HR 6147 Eliminating Unnecessary Spending – “Environmental Justice” Grants (Roll Call 356). The Hice (R-GA, ACUF Lifetime 98.1%) amendment to a multi-agency appropriations bill eliminates funding for the Environmental Justice Small Grants Program of the Environmental Protection Agency (EPA). Funds for this program have often funded causes for political activism and purposes unrelated to the grant, including educational programs for “urban gardening” and the “negative consequences of automobile dependency.” ACU believes the American people are smart enough to figure out how to plant seeds without federal money and opposes the use of taxpayer funds for political advocacy and supports meaningful cuts in government spending, especially at a time when the nation is $22 trillion in debt, and supported this amendment. The House defeated the amendment on July 18, 2018 by a vote of 174-240.
22. HR 6147 Protecting Residents from DC’s Replacement of the Obamacare Individual Mandate (Roll Call 359). The Palmer (R-AL, ACUF Lifetime 98.0%) amendment to a multi-agency appropriations bill prohibits any money appropriated to the District of Columbia from funding the District’s health care individual mandate law. The amendment is in response to actions taken by the District to establish its own individual mandate after the Obamacare financial penalty for lacking insurance was zeroed out under the Tax Cuts and Jobs Act of 2017. ACU has long opposed Obamacare and its costly provisions, such as the individual mandate, and supported this amendment. The House passed the amendment on July 18, 2018 by a vote of 226-189.
23. HR 6147 Prohibiting the Post Office from Competing with the Private Financial Sector through Expansion of Services (Roll Call 362). The McHenry (R-NC, ACUF Lifetime 92.8%) amendment to a multi-agency appropriations bill prohibits the United States Postal Service from using any funds to expand its offerings of financial services and banking products. ACU supports meaningful reforms to the postal service to place it on a sound financial footing and opposes expanding its duties and competing with the private sector, especially considering fulfillment of its constitutional purpose is often returned to sender, and supported this amendment. The House defeated the amendment on July 18, 2018 by a vote of 201-212.

24. S 756 Reforming the Criminal Justice System – First Step Act (Roll Call 448). This bill, known as the First Step Act, makes numerous reforms to the criminal justice system to reduce costs, responsibly lower incarceration rates and improve public safety. The bill focuses on reforming sentencing, inmate rehabilitation and prison safety. The ACU Foundation’s Nolan Center for Justice was a leading force behind the passage of the bill and engages in other federal and state-based initiatives. ACU supports efforts to reduce recidivism and reform our criminal justice system, which has the highest incarceration rate in the world, and supported this bill. The House passed the bill on December 20, 2018 by a vote of 358-36.
25. S 3628 Extending the National Flood Insurance Program (Roll Call 500). This bill extends the National Flood Insurance Program through May 31, 2019. The program is over $20 billion in debt, and the extension lacks any reforms, including reforms to ensure flood maps are updated and that insurance premiums reflect actual risk. ACU believes flood insurance should be provided by the private sector and opposes this program, which discourages flood prevention measures and forces taxpayers to subsidize the risk of select property owners, and opposed this bill. The House passed the bill on December 21, 2018 by a vote of 315-48.
