Enclosed please find two completed EPA Forms 7610-29, "Phase n NOx Averaging Plan" for thecalendar year 2003. The plans identify the boilers that FirstEnergy is including in two separate NOx averagingpools for the FirstEnergy System

Pursuant to 40 CFR Part 76 Section 76.11(d)(1)(i)(C), the rule mandates, for all NOx averaging plans,that where the units in an averaging plan show that they meet the group compliance requirement, then all unitsin the averaging plan are deemed to be in compliance with their individual unit alternative contemporaneousemission limitations and annual heat input limits.

STEP 3

Read thestandardrequirements

(1) The designated representative of each affected s:lurce and each affected unit at thesource shall:

(i) Submit a complete Acid Rain permit application I: including a compliance plan} under40 CFR part 72 in accordance with the deadlines :: pecified in 40 CFR 72.30; and(ii) Submit in a timely manner any supplemental info mation that the permitting authoritydetermines is necessary in order to review an Aci<: Rain permit application and issueor deny an Acid Rain permit;

(2) The owners and operators of each affected SOLI rce and each affected unit at thesource shall: .

(i) Operate the unit in compliance with a complet!: .Acid Rain. permit application or as.':Jperseding A~id R~in-'per~it issued by the-permlltlng authorjty; and(/I) Have an Acid Rain Permit. '

Monitorina Reauirements

,(1) The owners and operators and, to the extent appli~able, designated representative ofeach affected source and each affected unit at the sou'ce shall comply.with the monitoringrequirements as provided in 40 CFR part 75.(2) The emissions measurements recorded and repor ed in accordance with 40 CFR~part75 shall be used to determine compliance by the IJnitMth the Acid Rain emissionslimitations and emissions re.duction requirements for sulfur dioxide and nitrogen oxides.under the Ac.id Rain Program, --

(3) The requirements .of 40 9F~ pan 75 shall not aft, ~ct the resp°!1sibility of the ownersand oper~tors to monitor em!sslons of o~her pollutant:» or other emissions characteristicsat the .unit~ und~r other applicable requirements of tile Act and other provisions of theoperating permit for the source. ..-

Sulfur Dioxide Reauirements

(1) The owners and operators of each source and eGI:h affected unit at the source shall:(i) Hold allowances, as of the allowance transfer deadline, in the unit's compliancesubaccount (after deductions under 40 CFR 73.34(1:», or in the compliance subaccountof another affected unit at the same source t: I the extent provided in 40 CFR73.35(b)(3), not less than the total annual emissic 1S of sulfur dioxide for the previous

- : calendar year from the unit; and(ii) Comply with the applicable Acid Rain emissiori s limitations for sulfur dioxide.

(2) Each ton of sulfur dioxide emitted in excess of thE: Acid Rain emissions limitations forsulfur dioxide shall constitute a separate violation of :he Act.(3) An affected unit shall be subject to the requiremer ts under paragraph (1) of the sulfurdioxide requirements as follows:

(i) Starting January 1, 2000, an affected unit undE! r 40 CFR 72.6(a)(2); or(il) Starting on the later of January 1, 2000 or tt!: deadline for monitor certificationunder 40 CFR part 75, an affected unit under 40 ': ;FR 72.6(a)(3).

(4) Allowances shall. be held in, deducted from, or tral1sferred among Allowance Tracking'System accounts in accordance with the Acid Rain I: 'rogram.(5) An allowance shall not be deducted in order to c:'Jmply with the requirements underparagraph (1) of the sulfur dioxide requirements prior to the calendar year for which theallowance was allocated.(6) An allowance allocated by the Administrator undE: r the Acid Rain Program is a limitedauthorization to emit sulfur dioxide in accordance with the Acid Rain Program. Noprovision of the Acid Rain Program. the Acid Rain per nit application, the Acid Rain permit,or an exemption under 40 CFR 72.7 or 72.8 and no r rovision of law shall be construed tolimit the authority of the United States to terminate c: r limit such authoriz:ation.(7) An allowance allocated by the Administrator unc: er the Acid Rain Program does notconstitute a property right.

Excess Emissions Reauirements

(1) The designated representative of an affected unil that has excess emissions in anycalendar year shall submit a proposed offset plan, a~i required under 40 CFR part 77.(2) The owners and operators of an affected unit 1 hat has excess emissions in anycalendar year shall:

(i) Pay without demand the penalty required, and pc: y upon demand the interest on thatpenalty, as required by 40 CFR part 77; and(ii) Comply with the terms of an approved offset pi; In, as required by 40 CFR part 77.

(1) Unless otherwise provided, the own~rs and opera1:)rs of the source and each affecteduni~ at the source shall keep on site at the source eal:h of the following documents for apenod of 5 years from the date the document is creclted. This period may be extendedfor c~u.se, at any time prior to the end of 5 years, in writing by the Administrator orpermitting ,.. .,

(i) The certificate of representation for the designatl: d representative for the source andeach affected unit at the source and all documen I s that demonstrate the truth of thestatements in the certificate of representation, ir accordance with 40 -.CFR 72.24;provided that the certificate and documents snail be retained on site at the sourcebeyond such 5-year period until such qo~Ymen1:; are superseded because of thesubmission of a new certificate of represer tation changing the designatedrepresentative;(ii) All emissions monitoring information, in accordilnce with 40 CFR part 75, providedthat to the extent that 40 CFR part 75 provides fol' a 3-year period for recordkeeping,the 3-year period shall apply.(iii) Copies of all reports, compliance certificatiollS, and other submissions and allrecords made or required under the Acid Rain Pr(: gram; and,(iv) Copies of all documents used to complete an f cld Rain permit application and anyother submission under the Acid Rain Program or' 0 demonstrate compliance with therequirements of the Acid Rain Program.

(2) The designated representative of an.affected .s(ur~ and e~ch affected unit. at th.esource shall submit the reports and compliance certifil:ations required under the Acid RamProgram, including those under 40 CFR part 72 sub, )art I and 40 CFR part 75.

Liability

(1) Any person who knowingly violates any requirenlent or prohibition of the Acid RainProgram. a complete Acid Rain permit application. all Acid Rain permit. or an exemptionunder 40 CFR 72.7 or 72.8. including any requirem !nt for the payment of any penaltyowed to the United States. shall be subject to enforc; ~ment pursuant to section 113(c) ofthe Act.(2) Any person who knowingly makes a false. I naterial statement in any record.submission. or report under the Acid Rain Pro!; ram shall be subject to crimin.:..:enforcement pursuant to section 113{c) of the Act a,d 18 U.S.C. 1001.(3) No permit revision shall excuse any violation 0.: the requirements of the Acid RainProgram that occurs prior to the date that the r,evisic: n takes effect. . .(4) Each affected source and each affected unit shall meet the requirements of the ACIdRain Program. . = - --

Emission Limitations

Each affected unit in an approved averaging plan is in compliance with the Acid Rain emission limitation forNOx under the plan only if the following requirements are met:

The owners and operators of a unit governed by an approved averaging plan shall be liable for any violationof the plan or this section at that uhit or any other unit In the plan, Including liability for fulfilling the obligationsspecified In part 77 of this chapter and sections 113 and 411 of the Act.

Termination

The designated representative may submit a notification to terminate an approved averaging plan, inaccordance with 40 CFR 72.40(d), no later than October 1 of the calendar year for which the plan isto be terminated.

The number of allowances actually held by an affected source in a unit account maydiffer from the number allocated by U.S. EP A. This situation does not necessitate arevision to the unit S02 allowance allocations identified in this permit (See 40 CFR72.84).

3. Nitrogen Oxides (NOx) Requirements

Pursuant to rules 3745-103-55 through 3745-103-67 of the Administrative Code, theOhio EP A approves a NOx emissions averaging plan for this unit, effective for calendaryear 2003, and a NOx standard emissions limitation plan for this unit, effective forcalendar years 2004 through 2007. Under the averaging plan, this unit's NOx emissionsshall not exceed not exceed the annual average alternative contemporaneous emissionlimitation of 0.37 Ib/mmBtu, and this unit shall not have an annual heat input less than8,271,900 mmBtu. Under the standard plan, this unit's annual average NOx emissionsrate, determined in accordance with 40 CFR Part 75, shall not exceed the applicableemission limitation, under Paragraph (A)(l) of rule 3745-103-57 of the AdministrativeCode, of 0.45 Ib/mmBtu for tangentially fired boilers.

Under the averaging plan, the actual Btu-weighted annual average NOx emission rate forthe units in the plan shall be less than or equal to the Btu-weighted annual average NOxemission rate for the same units had they each been operated, during the same period oftime, in compliance with the applicable emission limitations under rules 3745-103-57,3745-103-58, or 3745-103-59 of the Administrative Code, except that for any earlyelection units, the applicable emission limitations shall be under rule 3745-103-59 of theAdministrative Code. If the designated representative demonstrates that the requirementof the prior sentence as set forth in paragraph (D)(I)(b)(i) of rule 3745-103-63 of theAdministrative Code is met for a year under the averaging plan, then this unit shall bedeemed to be in compliance for that year with its alternative contemporaneous annualemission limitation and annual heat input restriction.

In addition to the described NOx compliance plans, this unit shall comply with all otherapplicable requirements of rules 3745-103-55 through 3745-103-67 of the AdministrativeCode, including the duty to reapply for a NOx compliance plan and requirementscovering excess emissions.

The requirements in this permit are designed to meet Title IV of the Clean Air Act andthe corresponding regulations of U.S. EPA and Ohio EPA. This source is also required tomeet any applicable requirements of3745-14-01 through 3745-14-11 of the OhioAdministrative Code.

Statement of Basis

In accordance with Ohio Revised Code Section 3704 and Titles IV and V of the CleanAir Act, the Ohio Environmental Protection Agency issues this permit pursuant to OhioAdministrative Code Chapters 3745-103 and 3745-77.

The number of allowances actually held by an affected source in a unit account maydiffer from the number allocated by U.S. EPA. This situation does not necessitate arevision to the unit 802 allowance allocations identified in this permit (See 40 CFR72.84).

3. Nitrogen Oxides (NOx) Requirements

Pursuant to rules 3745-103-55 through 3745-103-67 of the Administrative Code, theOhio EP A approves a NOx emissions averaging plan for this unit, effective for calendaryear 2003, and a NOx standard emissions limitation plan for this unit, effective forcalendar years 2004 through 2007. Under the averaging plan, this unit's NOx emissionsshall not exceed not exceed the annual average alternative contemporaneous emissionlimitation of 0.55 Ib/mmBtu, and this unit shall not have an annual heat input greater than519,087 mmBtu. Under the standard plan, this unit's annual average NOx emissions rate,determined in accordance with 40 CFR Part 75, shall not exceed the applicable emissionlimitation, under Paragraph (A)(2) of rule 3745-103-59 of the Administrative Code, of0.46 Ib/mmBtu for dry bottom wall-fired boilers.

Under the averaging plan, the actual Btu-weighted annual average NOx emission rate forthe units in the plan shall be less than or equal to the Btu-weighted annual average NOxemission rate for the same units had they each been operated, during the same period oftime, in compliance with the applicable emission limitations under rules 3745-103-57,3745-103-58, or 3745-103-59 of the Administrative Code, except that for any earlyelection units, the applicable emission limitations shall be under rule 3745-103-59 of theAdministrative Code. If the designated representative demonstrates that the requirementof the prior sentence as set forth in paragraph (D)(1)(b)(i) of rule 3745-103-63 of theAdministrative Code is met for a year under the averaging plan, then this unit shall bedeemed to be in compliance for that year with its alternative contemporaneous annualemission limitation and annual heat input restriction.

In addition to the described NOx compliance plans, this unit shall comply with all otherapplicable requirements of rules 3745-103-55 through 3745-103-67 of the AdministrativeCode, including the duty to reapply for a NOx compliance plan and requirementscovering excess emissions.

The requirements in this pennit are designed to meet Title IV of the Clean Air Act andthe corresponding regulations of U.S. EPA and Ohio EPA. This source is also required tomeet any applicable requirements of 3745-14-01 through 3745-14-11 of the OhioAdministrative Code.
