Many people upset with Federalists, felt A&S Acts violated the Const. & discriminated

Jefferson tried to bring public together & lead “Revolution of 1800” to restore Republican ideals

1) Changed tax system (customs duties and land sales)

2) Reduced size of Executive3) Shrank size of army and navy (but

founded West Point and later started a navy buildup due to the Barbary Wars in Mediterranean)

1802 – Spain closed port of New Orleans. Then made secret treaty with France to return land

April 1803 –Jefferson sent 2 people to

negotiate purchase of New Orleans, Napoleon sold entire territory for $15 million, doubling size of nation.

President did not have Constitutional authority to purchase land. Jefferson & supporters decided it was inherent power of president.

Increased conflict with natives in territory.

May 1804 – Meriwether Lewis led expedition from St. Louis to Pacific, Clark was 2nd in command, group of 50 people

- Sacagawea – Shoshone interpreter & guide- Reached Pacific in November 1805 Identified boundaries and many new species of plants

& animals 1805, Zebulon Pike traveled 2,000 miles looking for

source of Mississippi, then Southwest

Judiciary Act of 1801 – Feds passed before Jefferson became president so Adams could appoint more judges (Midnight Judges)

Adams left office, so they were unable to take office

  William Marbury sued Jefferson’s Secretary of

State James Madison for refusing to deliver his paperwork, used Judiciary Act of 1789 as basis.

Q: What was the decision of the Supreme Court and how did it relate to the system of checks and balances?

John Marshall (Adams’ Sec of State who had failed to deliver commissions) was now Chief Justice

SC decided that Judiciary Act of 1789 was unconstitutional – Const. does not give Supreme Court the power to force Executive Branch to deliver paperwork

Affirmed judicial review and showed checks & balances worked.
