company does not need to keep Cal/OSHAinjury and illness records.
This exemption also applies if your com-panys Standard Industrial Classification (SIC)code is included in Table 1 of Article 2 of theregulations adopted by Californias Division of
Labor Statistics and Research and enforced byCal/OSHA.
Employers are responsible for providing asafe and healthful workplace for their employees.The role of the federal Occupational Safety andHealth Administration (OSHA) is to assure thesafety and health of U.S. workers by setting andenforcing standards; providing training, outreach
and education; establishing partnerships; andencouraging continual improvement in work-place safety and health.
OSHA or the U.S. Bureau of Labor Statisticsmay ask you to participate in a random survey toprovide records as detailed in the provisions ofSection 14300.41 or Section 14300.42.
Form 300, 300AThe Form 300 is used to record, or log all
injuries and illnesses, except those that have beendetermined to be first aid only. Typically, theForm 300 is not posted because there may beemployee privacy issues involved.
As an employer, you are not to include theemployees name for specific injuries or illnesseslisted in Section 14300.29(b)(7), such as needlesticks, HIV infection, hepatitis, sexual assault andothers. In addition, an employee suffering froman injury or illness not listed as a privacy issuemay request that his/her name not be entered onthe log.
When the 2010 Census form arrives for yourhousehold next month, you may wonder whythe U.S. Census Bureau counts the number of
people in our nation every decade. The answersmay surprise you.
First and foremost, the Constitution of theUnited States mandates a counting of everyperson living in all 50 states, the District ofColumbia, Puerto Rico, and the U.S. IslandAreas. This includes people of all ages, racesand ethnic groups whether a citizen or non-citizen. The purpose of the census is primarilyto reapportion the seats in the U.S. House ofRepresentatives based on population. Censusdata are also used to draw state legislativedistricts. In addition, census data are used todetermine the locations for schools, housing,child-care and senior centers, shopping centers,businesses, roads, bridges and much more.
Another important application of the dataincludes distribution of more than $430 billionin federal funds every year for the next ten years.
That means an accurate count of our populationcan result in significant improvements in thequality of life in our community. According to
our local Census Bureau Partnership Specialist,Dolores Gallegos, every person counted is worth$1,400 per year. If a person is missed, they wontbe counted again for ten years. That means thatour community will miss out on $14,000 overthe next decade. For every 100 people that arenot counted, we lose $1.4 million over the nextten years.
Census forms will be mailed in mid March.Completing the form is easy, important, safe andeveryone counts. This census form is one of theshortest in U.S. history. It has only ten ques-tions and should take less than ten minutes tocomplete.
By law, all census data is completely confiden-
tial. The Census Bureau cannot share respon-dents answers with anyone, including otherfederal agencies and law enforcement entities for72 years. However, you can request a certificate
of past census to use as verifi-cation of your age, residenceor kinship. This information
could help you apply for apension, establish citizenshipor obtain an inheritance.
In May, census takers will begin visitinghouseholds that do not return their questionnaireby mail. The Bureau will add over a milliontemporary workers to complete the 2010 Census.Local census officials have informed me they arestill recruiting workers in our area. If you arelooking for a job, call 559-802-4470.
The 1990 Census indicated the City ofTulares population was 33,249. In 2000, it was43,994. The most recent estimate is 58,506.What will the actual tally be when the resultsof the 2010 Census are delivered in December?Will it be an accurate number?
Achieving a complete and accurate 2010Census is in our hands. I encourage everyoneto make the census part of their civic duty. It isgood for you and good for our community.

Independent Contractor Withholding:Frequently Asked QuestionsWhat is independent contractorwithholding?
Companies, public agencies, and non-profitsmust subtract 3 percent off the top of all pay-ments they make to independent contractorsfor California services rendered and remit the 3percent to the Franchise Tax Board.
Why isnt it like employeewithholding?
Employee withholding is handled throughan employers payroll process. Independentcontractor withholding affects payments owed tooutside service providers for services rendered.
What payments would be affected?
Almost all payments to service providers who
receive a Form 1099-MISC. Payments to cor-porations arent affected, unless for medical andhealth care or attorneys fees.
Who are independent contractors?Independent contractors are a host of self-
employed individuals and businesses, rangingfrom small businesses and entrepreneurs to largefirms. Examples include: builders, real estateagents, computer programmers, accountants,automotive mechanics, attorneys, medical doc-tors, and engineers.
When do independent contractorspay taxes?
They pay their taxes throughout the year
through quarterly estimated tax payments. If
they dont and underpay, they are subject to pen-alties. Because of recent budget agreements, inde-pendent contractors must pay 70 percent of theirtaxes by June of each year for the next two years.
Why are independent contractor taxburdens greater than employees?
Independent contractors are not on anyonespayroll. They are self-employed and may haveemployees of their own. Independent contrac-tors are businesses and are taxed as businesses.They pay more kinds of taxes than employees,such as self-employment taxes and local businesstaxes. They must also pay taxes not only on apersonal level, but also on business income, pur-chases and property.

One of the greatest challenges facing the
City of Tulare and its leaders is the promotion ofTulare as a great place to do business. This yearsLeadership Tulare team recently attended a semi-nar on economic development to learn aboutthe community activities related to helping busi-nesses prosper in the City of Tulare. The localorganizations responsible for facilitating the eco-nomic activities in Tulare include, The EconomicDevelopment Corporation (EDC), The City ofTulare, the Tulare County Workforce InvestmentBoard (TCWIB), The World Ag Expo, and TheCentral California Small Business DevelopmentCenter (SBDC).
The Economic Development Corporationsmission is to be the leader of economic develop-ment by attracting, supporting, and retaining
business and industry for the communities ofTulare County. Through various strategies, theEDC is able to attract new businesses to thearea. The EDC works closely with the City ofTulare to assist new businesses who are lookingto relocate by finding potential locations anddemonstrating the economic incentives of mov-ing to Tulare, such as tax incentives, work forceavailability, and favorable location of Tulare withhighway and rail access.
The Tulare County Workforce Investment
Board provides business resources and servicesfor local job seekers and employers. TCWIB isthe sponsor for the Tulare County EmploymentConnection. The Employment Connectionoffers free services to job seekers such as careercounseling, resume building, job searches,and training programs. For employers, theEmployment Connection can pre-screen employ-ment applicants and provide temporary officespace to support start up businesses.
Perhaps the most economically beneficialspecial event in Tulare is the annual World AgExpo held at the International Agri Center.Tulare County is the largest dairy county in theUnited States and the second largest agriculturecounty, which supports this event being held inTulare. The World Ag Expo is the largest annualevent of this type in the world. This years eventhad 1,600 exhibitors and vendors. Revenues tosurrounding businesses are projected to exceed$358 million during the three day event. Thetotal economic impact of the World Ag Expois estimated to be $1.2 billion within the geo-graphic area covering Fresno to Bakersfield, andthe Sierras to the coast.
The
CentralCaliforniaSBDCis a nonprofitorganiza-tion thatprovidesfreeone on one business counseling, training andtechnical assistance. Areas of consulting includestarting a new business, creating a business plan,obtaining financing, business structure, marketresearch and demographics, assistance with gov-ernment requirements, technology, and humanresources.
Finally, the EDC presented our group witha Tulare business prospect case study in whichwe were to develop a plan to bring the new busi-ness to Tulare. The class was divided into threeteams and each team made a presentation to apanel of staff from the Tulare County EDC. TheLeadership Tulare participants left the day sessionwith a greater appreciation and understanding ofwhat our local economic development agenciesdo for the City of Tulare.

Are you leaving out a key element to reachyour weight loss and fitness goals? Many peopleleave out resistance training in their fitnessroutines. I am going to discuss several reasonswhy everyone should train with resistance, anddebunk several myths associated with liftingweights. Resistance training is exercising to
increase your muscular strength andmuscular endurance by lifting weightsrepetitively with free weights, weightmachines, or bands.
There are many reasons whyeveryone should incorporate resis-
tance training into their fitnessroutine. Here is a short list of thepositives to weight training. It helpsto improve your physique, makesyou physically stronger, and improvesyour posture. Along with the visualeffects of weight training, here is a listof additional benefits:
Lowers your blood pressure
Increases your metabolism
Increases your bone density
Helps with your balance
Improves body fat
Decreases your risk of injury
Helps your body work more efficiently
After all of the benefits I listed for resistancetraining, you may wonder why more peopledont use it in their fitness plans or to loseweight. There are many myths and mysteriessurrounding resistance training that hold peopleback from incorporating it into their daily exer-cise plan. I am going to review several of themyths and debunk them for you.
Myth #1: (Women) I will get bigand bulky.
Truth #1: A major factor in massive musclegrowth is testosterone. Naturally women do nothave as much testosterone as men to producebulky muscles.
Myth #2: I dont want to buildmuscle because if I stop it will turnto fat.
Truth #2: Muscleand fat are two differ-ent types of tissue, somuscle cannot turnto fat.
Others reasonsthat people do not doresistance training arebecause they do notknow how, they areafraid of getting injured, or they are intimidated.These are all valid fears; whenever you are think-ing about incorporating resistance training into
your routine, seek out the help of a fitness pro-fessional. Remember the benefits of resistancetraining are worth the long walk from the cardioequipment into unfamiliar territory at the gym.

Aid for the holiday season. These projects andothers are in keeping with the Soroptimist orga-nizations mission to improve the lives of womenand children in local communities and through-out the world.
