GENERAL PROVISIONS

Section 6-2.1 Purpose. ThepurposeofthisSubpartistoassureasanitary,healthfulandsafeenvironmentforthepublicwhenusingbathingbeaches.

6-2.2 Definitions.

(a) Bathingbeachshallmeanabathingplace,togetherwithanybuildingsandappurtenances,andthewaterandlandareasusedinconnectiontherewith,atapond,lake,streamorotherbodyoffreshorsaltwaterwhichisusedforbathingorswimmingwiththeexpressorimpliedpermissionorconsentoftheownerorlesseeofthepremisesorwhichisoperatedforafeeoranyotherconsiderationorwhichisopenlyadvertisedasaplaceforbathingorswimming.

(b) Sanitarysurveyshallmeanasurveyandanevaluationofthecontributorywater-shedandbathingareaforexistingandpotentialsourcesofpollutionandsafetyhazards,includingbutnotlimitedtosoilconditions,underwatertopography,watermovement,submergedandotherhazardousobjects,waterdepthindivingarea;seasonaloranticipatedwaterlevelvariations,andwaterquality.

(c) Permit-issuingofficialshallmeantheStateCommissionerofHealth,thehealthcommissionerorhealthofficerofacityof50,000populationorover,thehealthcommissionerorhealthofficerofacountyorpart-countyhealthdistrict,theStateregionalhealthdirectorordistrictdirectorhavingjurisdiction,oranycountypublichealthdirectorhavingallthepowersanddutiesprescribedinsection352ofthePublicHealthLaw.Thepermit-issuingofficialmaydesignateadditionalpersonstoactinhisbehalftoissuepermitsrequiredbythisSubpart.

(d) Bathingshallmeantobecomepartiallyortotallyimmersedinwaterandshallincludeswimming,wadinganddiving,butshallexcludefishing,scubadivingandsurfboarding.

(e) Adequateshallmeansufficienttoaccomplishthepurposeforwhichsomethingisintended,andtosuchadegreethatnounreasonablerisktohealthorsafetyispresented.Aniteminstalled,maintained,designedandassembled,anactivityconductedoractperformed,inaccordancewithgenerallyacceptedstandards,principlesorpracticesapplicabletoaparticulartrade,business,occupationorprofession,isadequatewithinthemeaningofthisSubpart.

(f) UniformCodeshallmeantheNewYorkStateUniformFirePreventionandBuildingCode,9NYCRRSubtitleS,ChapterI.

(g) Aquaticsupervisorystaffshallmean,effectiveMay15,1993,anindividualpossessingthequalifications,asfoundinsection6-2.20,forSupervisionLevelsI,II,IIIorIV.

(h) EffectiveMay15,1993,supervisinglifeguardshallmeananindividual,atleast18yearsofage,whopossessesasminimumqualifications,SupervisionLevelIIb,andhasatleasttwoseasonsofadequatelifeguardingexperience.

(i) PublicAccessDefibrillation(PAD)programshallmeanaprogramthatcomplieswithsection3000-bofthePublicHealthLaw,includingtheavailabilityofanautomatedexternaldefibrillator,theidentificationofanemergencyhealthcare

provider,thedevelopmentofacollaborativeagreementandsuccessfulstaffcompletionoftrainingintheoperationofanautomatedexternaldefibrillator.

6-2.3 Application.

(a) TherequirementsofthisSubpartshallapplytoallbathingbeaches,except:

(1) thoseownedand/ormaintainedbyanindividualfortheuseoffamilyandfriends;and

(2) those,excludingoceanbeachesinNassauCounty,SuffolkCounty,andNewYorkCity,thatareownedandoperatedbyacondominium(i.e.,propertysubjecttotheArticle9-BoftheRealPropertyLaw,alsoknownastheCondominiumAct),apropertycommonlyknownasacooperative,inwhichthepropertyisownedorleasedbyacorporation,thestockholdersofwhichareentitled,solelybyreasonoftheirownershipofstockinthecorporation,andoccupyapartmentsfordwellingpurposes,providedan“offeringstatement”or“prospectus”hasbeenfiledwiththeDepartmentofLaw,oranincorporatedorunincorporatedpropertyassociation,allofwhosemembersownresidentialpropertyinafixedordefinedgeographicalareawithdeededrightstouse,withsimilarlysituatedowners,adefinedbathingbeach,providedsuchbathingbeachisusedexclusivelybymembersofthecondominium,cooperativeapartmentprojectorcorporationorassociationandtheirfamilyandfriends.

(b) Section6-2.5ofthisSubpartshallnotapplytobathingbeachesmaintainedandoperatedaspartofatemporaryresidenceorchildren’scamppropertysubjecttotheregulationsofSubpart7-1or7-2ofthisTitle.

6-2.4 Enforcement.

(a) Permitsandplacarding.

(1) OperationofabathingbeachwithoutapermitisaviolationofthisSubpart.Thepermit-issuingofficialmayorderanybathingbeachoperatingwithoutapermittocloseandremaincloseduntilthefacilityhasobtainedanddisplaysavalidpermit.

(2) Theenforcementproceduresdelineatedinsections12,12-a,12-b,16,308,309,1303-1305and1308ofthePublicHealthLawmaybeused,asappropriate.Whereapublichealthhazardisfound,thebathingbeachshallbeplacardedtoprohibituseuntilthehazardiscorrectedinordertoprotectthepublichealthorsafetyofbathers.Whenaplacardisused,itshallbeconspicuouslypostedatallentrancesleadingtothebathingbeach.Theplacardshallstatetheauthorityforitsplacementandindicatethatconcealment,mutilation,alterationorremovalofitbyanypersonwithoutpermissionofthepermit-issuingofficialshallconstituteaviolationofthisChapterandthePublicHealthLaw.

(3) Within15daysofplacardingofafacility,theoperatorofsuchfacilityshallbeprovidedwithanopportunitytobeheardandpresentproofthatcontinuedoperationofthefacilitydoesnotconstituteadangertothepublichealth.Thehearingshallbeconductedbythepermit-issuingofficialorhisdesignatedhearingofficer.

(4) Thepermit-issuingofficialorhisdesignatedrepresentativeshallinspectthepremises,withintwoworkingdaysofnotificationthatthehazardhasbeeneliminated,toremovetheplacardsafterverifyingthecorrection.

(b) Publichealthhazards.Anyofthefollowingviolationsarepublichealthhazardswhichrequirethepermit-issuingofficialordesignatedrepresentativetoorderimmediatecorrectionortoimmediatelyinstituteactionasprovidedinthelawandinthisSubpart:

(1) failuretoprovideadequatesupervisionofthebeachasprescribedinsection6-2.17ofthisSubpart;

(2) overheadelectricalwireswithin20feethorizontallyofthebathingbeach;

(3) failuretoprovidealllifesavingequipmentatbeach;

(4) useofunapprovedorcontaminatedwatersupplysourcesforpotablewateruse;

(5) failuretomeetwaterqualitystandardscontainedinsection6-2.15ofthisSubpart;

(6) theexistenceofsewageandwaste-waterdischargesinthebathingarea;

(7) failuretoproperlydelineateswimmingareaboundaries;

(8) failuretoprovidesignsindicatingswimmingisprohibitedwhenthebathingbeachisclosedorunsupervised;and

(9) anyotherconditiondeterminedtobeapublichealthhazardbythepermit-issuingofficial.

(c) Otherviolations.ViolationsofothersectionsofthisSubpartorofotherPartsofthisChapterarealsosubjecttoapenalty.

6-2.5 Permit for operation.

(a) Nomunicipality,person,groupofpersons,firm,corporation,association,organizationorinstitutionshalloperateormaintainorpermittheuseofanybathingbeachwithoutapermitfromthepermit-issuingofficialissuedsubjecttotheprovisionsofthisChapterandsuchadditionalsanitaryorsafetysafeguardsasmayberequiredbythepermit-issuingofficial.Thepermitshallbepostedconspicuouslyatthefacility.

(b) Applicationforapermitshallbemadetothepermit-issuingofficialatleast30daysbeforetheexpirationofapriorpermitoratleast30daysbeforetheopeningofanybathingbeach.

6-2.6 Variance and waivers.

(a) Variance.Thepermit-issuingofficialmay,onwrittenapplicationandafterreview,grantavariancefromaspecificprovisionofthisSubpartsubjecttoappropriateconditionswhichshallincludeatimescheduleforcompliancewheresuchvarianceisinharmonywiththegeneralpurposesandintentofthisSubpart,andwheretherearepracticaldifficultiesorunnecessaryhardshipincomplyingwithsuchprovision.

(b) Waiver.Thepermit-issuingofficialmaywaive,inwriting,anyoftherequirementsofthisSubpart,andincludethewaiverasaconditionofthepermittooperate,whenitreasonablyappearsthatthepublichealthwillnotbeendangeredbygrantingofsuchwaiverandadequatealternativeprovisionshavebeenmadetoprotectthesafetyofthebathersandthepublichealth.Acopyofthewaiveranddescriptionofthealternativeprovisionsshallbesubmittedbythepermit-issuingofficialtotheStateCommissionerofHealthatthetimeofissuance.Suchwaivershallremainineffectforaperiodoftime,concurrentwiththeoperatingpermit,unlesssoonerrevokedforcausebythepermit-issuingofficial.

6-2.7 Injury and illness incident reporting. Afullreportofanyinjuryorillnessincidentoccurringatabathingbeachshallbereportedbytheowner/operatortothepermit-issuingofficialwithin24hoursandrecordedinalogbook.Thisshallincludeallincidentsoccurringatabathingfacilitywhich:(a)resultindeath;(b)requireresuscitation;(c)requirereferraltoahospitalorotherfacilityformedicalattention;or(d)isabatherillnessassociatedwithbathingwaterquality.

SITE DEVELOPMENT, CONSTRUCTION AND MAINTENANCE

6-2.8 Approval of plans.

(a) Nomunicipality,person,groupofpersons,firm,corporation,association,organizationorinstitutionshallestablishorconstructorphysicallymodifyabathingbeachuntilplansandspecificationsaresubmittedto,andreceivetheapprovalof,thepermit-issuingofficial.AllplansshallbepreparedbyapersonlicensedbytheStateofNewYorktopracticeengineeringorarchitecture.

(b) Bathingbeachdesignstandards,ascontainedinsection6-2.19ofthisSubpart,shallbethebasisuponwhichallplansforbathingbeachesarereviewedandapproved.

(c) Plansforanypotablewatertreatmentorsewagetreatmentfacilitiestobeconstructedatabathingbeachshallbeapprovedpriortoconstructionbythepermit-issuingofficialorsuchagencyhavingjurisdictionforsuchplanapproval.

6-2.9 Construction compliance certificate. Theoperatorshallsubmit,priortoopeningnewfacilitiesorequipment,aconstructioncompliancecertificatetothepermit-issuingofficial.ThiscertificateshallbepreparedandsignedbyaprofessionalengineerorarchitectlicensedtopracticeinNewYorkState.Thecertificateshallincludeastatementthatthebathingbeach,thebuildingsandallappurtenanceshavebeenconstructedinaccordancewithapprovedplansandspecifications.

6-2.10 Approved bathing waters.

(a) Naturalorartificiallyformedbathingareasmustmeetthefollowingconditions:

(1) Asanitarysurveyverifiesthatthewatershedforthebeachwaterisfreeofsewageanduntreatedsewagedischarges,orthatknownwaste-waterdischargesorothercontaminationisdeterminedtonotadverselyimpactwaterqualityorbeachusebaseduponanhistoricalwaterqualitymodelforrainfallandbacteriologicalquality.

(2) Abathingbeachlocatedonthewatershedofalake,reservoir,streamorotherbodyofwaterusedasasourceofpublicwatersupplyshallbesooperatedasnottopolluteorcontaminatesuchsupplyandshallcomplywithallwatershedrulesorlocalregulationsineffect.

(3) Waterqualitystandardsspecifiedinsection6-2.15ofthisSubpart.

(4) Theswimmingandbathingareasareprovidedwithfloatlinestoclearlydesignatetheperimeter,theseparationofshallowanddeepareas,thewadingarea,thedivingareaanddropoffs,radicalchangesinslopeorunderwaterobstructions.ThisrequirementisnotapplicableatbeacheslocatedontheshoreofLakeErie,LakeOntario,LongIslandSoundortheAtlanticOcean,unlessrequiredbythepermit-issuingofficial.

(b) Useofimpoundmentslessthanfouracresinareaforbathingpurposesshallbeprohibitedunless:

(1) theoperatorcandocumentcompliancewithsubdivision(a)ofthissection;or

(2) aminimumof100gallonsperpersonperdayofdilutionwatermeetingthestandardscontainedinsection6-2.15ofthisSubpartisaddedtoorflowsthroughtheswimmingandbathingarea.

6-2.11 Water supply. Thewatersupplyservingallplumbingfixtures,includingdrinkingfountains,lavatoriesandshowers,shall,aftertreatment,meettheapplicablerequirementsofPart5ofthisTitle.

6-2.12 Garbage; refuse. Adequateandsanitaryfacilitiesshallbeprovidedforthestorageanddisposalofgarbageandrefuse.Sanitarymethodsshallbeusedforthecollection,temporarystorage,handlinganddisposalofgarbageandrefuse.

6-2.13 Bathhouse and toilet facilities.

(a) General.Adequatetoiletandhandwashingfacilitiesmustbeprovidedforallbathingbeaches.Indeterminingthelocationoftoiletandhandwashingfacilitiesforoceanbeaches,factorswhichshallbeconsideredinclude,butarenotlimitedto,susceptibilityoftheareatoflooding,groundwaterdepthinthearea,andpotentialforshiftingofsanddunesanderosion.

(b) Wallsandfloorsofthebathhouseshallbefreefromcracksoropenjoints.Thefloorsshouldbewelldrained.

(c) Alltoiletfacilitiesanddressingroomsshallbeadequatelylighted,ventilatedandmaintained.

(d) Whenshowersareprovided,theyshallbesuppliedwithwateratatemperatureofatleast90degreesFahrenheitandnomorethan110degreesFahrenheitatarateofatleast1.5gallonsperminutepershowerhead.Thermostatic,temperingormixingvalvesshallbekeptingoodoperationtopreventscaldingofthebathers.

(e) Alltoiletfacilitiesshallbeprovidedwithsoap,papertowelsorelectricalhand-dryingunits,andcoveredwastereceptacles.Suitablesanitarynapkinreceptaclesshallbeprovidedintoiletfacilitiesusedbyfemales.

(f) Careofsuitsandtowels.Allbathingsuitsandtowelsfurnishedorrentedshallbewashedwithadetergentinhotwater,rinsedandthoroughlydriedaftereachuse.

OPERATION AND SUPERVISION

6-2.14 Operator responsibility.Theoperatorofthebathingbeachshallberesponsiblefor:(a)samplecollectionandanalysisofbathingwaters,whenrequiredbythepermit-issuingofficial,andassuringasafewaterquality;(b)controllingthedecorumandactivitiesatthebathingsite;(c)supplyingadequatesupervisorypersonnel;(d)reportinginjuries,deathsandcommunicabledisease;and(e)maintainingphysicalfacilities.

6-2.15 Water quality monitoring.

(a) Nobathingbeachshallbemaintainedoroperatedonanybodyofwaterwhenthewaterqualityisdeterminedbythepermit-issuingofficialtoconstituteapotentialhazardtohealthifusedforbathing.

Todetermineifthewaterqualityconstitutesapotentialhazardtohealthrequiringclosureofthebeach,thepermit-issuingofficialshallconsideroneoracombinationofanyofthefollowingitems:resultsofasanitarysurvey;historicalwaterqualitymodelforrainfallandotherfactors;verifiedspillordischargeofcontaminantsaffectingthebathingarea;andwaterqualityindicatorlevelsspecifiedinthissection.

(b) Samplecollectionandanalysiswhenrequiredforsurveillanceordesignpurposesshallbeinaccordancewiththefrequency,locationsandproceduresspecifiedbythepermit-issuingofficial.AllsamplescollectedfrombathingbeachesshallbeexaminedinlaboratoriespossessingStateDepartmentofHealthcertificationforwatersupplies.

(c) Bacteriologicalquality.Thefollowingbacteriologicalindicatorlevelsshallbeusedwhendeterminingacceptabilityofwaterqualityforbathingbeaches.

(1) Basedonasinglesample,theuppervalueforthedensityofbacteriashallbe:

(i) 1,000fecalcoliformbacteriaper100ml;or

(ii) 61enterococciper100mlforfreshwater;or

(iii)104enterococciper100mlformarinewater;or

(iv)235E.coliper100mlforfreshwater(E.coliisnottobe usedasanindicatorinmarinewater).

(2) Basedonthemeanofthelogarithmsoftheresultsofthetotalnumberof

samplescollectedina30dayperiod,theuppervalueforthedensityofbacteriashallbe:

(i) 2,400totalcoliformbacteriaper100ml;or

(ii) 200fecalcoliformbacteriaper100ml;or

(iii)33enterococciper100mlforfreshwater;or

(iv)35enterococciper100mlformarinewater;or

(v) 126E.coliper100mlforfreshwater(E.coliisnottobe usedasanindicatorinmarinewater).

(3) Whentheabovedescribedlevelsareexceeded,thepermit-issuingofficialshallcauseaninvestigationtobemadetodeterminethesourceorsourcesofpollutionand,alongwithotherfactorsdescribedinsection6-2.15(a)determineifthebeachshallbeclosed.

(d) Chemicalquality.Thewatershallbefreeofchemicalsubstancescapableofcreatingtoxicreactions,skinormembraneirritationstothegeneralpublic.

(e) Physicalquality.Physicalinspectionshallverifythatthewaterisfreeofdeposits,growths,oils,greasesorothersubstancesinthewatercapableofcreatingahealthorsafetyhazard.

(f) Biologicalquality.Algaeandaquaticvegetationshallbecontrolledsothatnohazardtobathersresult.Anychemicalusedtocontrolvegetationandalgaeshallnotbecapableofcreatingtoxicreactions,skinormembraneirritationswhenthebeachisinoperation.

6-2.16 Control of beach and water use.

(a) Allareasofanoperator’spropertythatareadjacenttothedesignatedpublicbeachareaandareaccessibletothepublicforentryintothewaterforbathingshallbesupervisedorpatrolledduringhoursofoperation.Bathingshallbeprohibitedwhererequiredsupervisionisnotprovided.

(b) Operatorsmustmaintainsignsstatingthehoursduringwhichpublicbathingisallowed,andthatbathingatothertimesisprohibited.

(c) Nomotorizedvehiclesexceptemergencyandmaintenancevehiclesshallbepermittedonthebeach.

(d) Noboating,waterskiing,fishing,orsurfboardingshallbepermittedinthebathingareaduringthehoursbathingisallowed.Separateareasfortheaboveactivitiesmaybedesignatedbyfloatinglinesandbuoys.

(e) Bathingatnightorduringelectricalthunderstormsisprohibited.

(f) Clearlyvisibledepthmarkingsshallbeprovidedatalldivingboards,platforms,piers,floatsandsimilarfacilities.Warningsignsstating“NoDiving”shallbeprovidedwherewaterdepthsarelessthaneightfeet.

(g) Divingshallnotbepermittedunlessminimumdepthsinaccordancewithprovisionsinsection6-2.19,item4.8.2,ofthisSubpartareprovided.

(h) Allplug-inelectricaldevices,suchasportableannouncingsystemsandradios,are

prohibitedwithin20feetofthewater.

(i) Batheruse.

(1) Themaximumnumberofbatherspermittedinthebathingwatersofabathingbeachshallnotexceedonebatherper25squarefeetofwatersurface.Inareasofwaterdepthgreaterthanfourfeet,atleast75squarefeetperbathershallbeprovided.

(2) Theoperatorshallberesponsibleforrestrictingusagesothatthemaximumcapacityisnotexceeded.

(3) Asignstatingthemaximumnumberofpersonswhomayusethebathingbeachatanyonetimeshallbepostedinaconspicuousplace.

(j) Glasscontainersshallnotbepermittedonthebeach.

6-2.17 Supervision – personnel and equipment.

(a) Personnel.

(1) (i) Whenabathingbeachispartofatemporaryresidenceoracampground,asdefinedinPart7ofthisTitle,theoperatormustprovideeitherSupervisionLevelI,IIb,IIIorIVaquaticsupervision.SupervisionLevelImustbeprovidedattemporaryresidenceoceansurfbeaches.WhenSupervisionLevelIIIorIVisselected,on-premiseCPRcertifiedstaffisnotrequired.Thetemporaryresidenceorcampgroundoperatormustnotifythepermit-issuingofficialinwritingofthesupervisionlevelselectedandatleast15daysbeforemakinganysubsequentchangestothesupervisionlevelselectedforeachbathingbeach.

(ii) WhenSupervisionLevelIIIorIVisselected,theoperatorofatemporaryresidenceorcampgroundbathingfacilitydescribedinparagraph(1)(i)ofthissubdivisionshallnotallowtheuseofthetemporaryresidenceorcampgroundbathingfacilitybypersonsotherthanregisteredovernightpatronsofthetemporaryresidenceorcampgroundandtheirguests.

(2) TheSupervisionLevelrequiredateachbathingbeach,otherthanthosedescribedinparagraph1ofthissubdivision,willbedeterminedbasedonthefollowing:

(ii) SupervisionLevelIIbisrequiredwhenanyofthefollowingarepresent:waterdepthwithinthedesignatedbathingareaisfivefeetorgreater;divingboards;flotationdevices(otherthanthosebearingaU.S.CoastGuardTypeI-IIIlabel);bottomconditionshazardoustobathers;aquaticamusements;bathingareaperimeteris50feetormorefromshore;beachbottomslopeissteeperthan1:8;slidesthatdischargeintothewater.

(iii)SupervisionLevelIVisrequiredwhenthewaterdepthwithinthedesignatedbathingareaislessthanfivefeetandthebathingareaperimeterislessthan50feetfromtheshore.

(3) Aquaticsupervisorystaffmustmeettherequirementsofsection6-2.20ofthisSubpart.WhenafacilityvoluntarilyprovidessupervisorystafforaSupervisionLevelexceedingthoserequiredbythissection,alltherequirementsofthisSubpartrelativetosupervisionareapplicable.

(4) Atleastoneaquaticsupervisorystaffpersonhavingatleasttherequiredsupervisionlevelshallbeprovidedforeach50yardsofbeachfrontorfractionthereofatbathingbeachesrequiredtouseSupervisionLevelsIandII.Sufficientaquaticsupervisorystaffmustbeprovidedforvisualsurveillanceoftheentirebathingarea(s)openforswimming.

(i) Atoceansurfbeaches,atleastoneSupervisionLevelIaquaticsupervisorystaffpossessingacurrentcertificateoftrainingintheoperationanduseofanautomatedexternaldefibrillatorapprovedbyanationally-recognizedorganizationorthestateemergencymedicalservicescouncilshallbepresentatallhoursofbeachoperation.Recordsofthetrainingshallbemaintainedavailableforreviewduringinspections.

(5) Additionalaquaticsupervisorystaffmayberequiredbythepermitissuingofficialwheneveritisnecessaryfortheprotectionofthebeachpatrons(bathers).Factors,includingbutnotlimitedto:beachshape;divingboarduse;patrondecorum,patronalcoholconsumption;and,bathingfacilitiesusedprimarilyforthedevelopmentallydisabledmaybethebasisforincreasedcoverage.

(6) TheaquaticsupervisorystaffatbeachesrequiredtohaveSupervisionLevelsI-IIIshallbeatthebeachfront,providingdirectsupervisionofthebathers.

(7) Theaquaticsupervisorystaffshallbeengagedonlyinactivitiesthatinvolvedirectsupervisionofbathers.Wheninstructionalactivitiesoccurandtheaquaticsupervisorystaffisalsoprovidingtheinstruction,additionalstaffmeetingatleastSupervisionLevelIIIrequirementsmustbeprovidedwhentheinstructionalactivitiesmaybereasonablyexpectedtodistractrequiredaquaticsupervisorystafffromdirectsupervisionofallbathers.

(8) BeachesrequiredtouseSupervisionLevelsIandIIaquaticsupervisorystaffshallprovideasupervisinglifeguardwhenthefacilityisrequiredtoprovidethreeormoreaquaticsupervisorystaff.

(9) Thefacilityoperatorshallberesponsibleforverificationofaquaticsupervisorystaffqualifications.Copiesofthecertificationsorotherdocument(s)showingpossessionofsuchqualificationsshallbekeptonfileatthesiteandmadeavailabletotheDepartmentuponrequest.

(10)AbathingbeachpermittedtouseSupervisionLevelIVshallcomplywiththefollowingbathingbeachuserules:

(i) Twoormoreadults(18yearsofageorolder)mustbepresentatthebeachwhenthebathingfacilityisinuse,withatleastoneadultonthebeachfront.

(ii) SupervisionLevelIVBathingBeachPersonnelshallbeonpremiseatalltimesthebeachisinuseandwillconductatleastonevisualbeachfront

checkpriortooperation/use.ThevisualcheckshallconfirmthebeachisincompliancewiththerequirementsofthisSubpart,includingsafetyequipmentandwaterconditions.Uponcompletionoftheseinspectionsthepersonnelsignsorinitialsthelog,andrecordsthetimeofinspectionandnumberofpersonsusingthefacility.Alogistobeprovidedandmaintainedbythefacilityoperatortorecordthetimeofperiodicinspection(s)andotherrequiredinformation.

(iii)Childrenlessthan16yearsofagemustatalltimesbeaccompaniedbyaparentorguardianorsimilaradultresponsiblefortheirsafetyandbehaviorwhileatthebathingfacility.

(iv)Afree,convenientlylocatedtelephonemustbeprovidedatthefacilitywithpostednumbersforthenearestemergencyservice(police,firedepartment,ambulance,hospital).

(v) Requiredsafetyequipmentmustbeprovidedatsite.

(vi)Warningsignsofaminimum36”x24”sizewithsafetyconditionsandmethodsforsummoningCPRcertifiedindividual,whenCPRtrainedstaffisrequired,mustbeposted.Thewarningsignmuststate:

• Twoormoreadults(18yearsofageorolder)mustbepresentatthebeachwhenthebathingfacilityisinuse,withatleastoneadultonthebeachfront.

• Childrenlessthan16yearsofagemustatalltimesbeaccompaniedbyanadultresponsiblefortheirsafetyandbehaviorwhileatthebathingfacility.

• Swimonlywithinthedesignatedbathingarea.

• Methodofsummoningon-premiseCPRstaff(onlywhereCPRtrainedstaffisrequired).

• Locationoffreetelephoneandnumberstocontact.

(vii)Thebathingfacilityoperatorshallprovidetoallpatronsawrittenstatementorbrochure.Onlypatronswhohavereceivedthisstatementmayusethebathingfacility.Thebrochureorstatementmuststateatleastthefollowing:

• NEVERSWIMALONE.Aminimumoftwoadults,18yearsofageorolder,mustbepresentwheneverthisswimmingfacilityisinuse.

• THEREISNOSUBSTITUTEFORADEQUATESUPERVISION.Childrenunder16yearsofagemustbeaccompaniedbyaparentorguardian.

• INANEMERGENCY,NOTIFYTHEFACILITYOPERATORANDCONTACTHELPASSOONASPOSSIBLE.Afreetelephoneisprovidedatthisfacility(definelocation).Telephonenumbersforthenearestemergencymedicalserviceareposted.

• Onlyusethisfacilityduringpostedhoursofoperationandswimonlyinthedesignatedbathingarea.

• Don’tdrinkalcoholandswim.

(b) Lifesavingequipmentandsafetylines.

(1) Lifesavingequipmentshallbereadilyaccessibleatallbathingbeaches.Minimumequipmentshallinclude:

(i) Afirstaidkit,whichmaybeanycommerciallyavailable24-unitkitor,asupplyofbandaids,bandagecompresses,andself-adheringgauzebandagesandapocketfacemaskorfaceshieldwithaonewayvalvetoassistwithCPR;

(ii) AtSupervisionLevelIandIIbbathingbeaches:onerescuetubeoratorpedobuoywithanattachedlineforeachlifeguardrequiredbythissection;arescueboardorlifeboatincompliancewithsection6-2.19item6.2.1(board/boatspecifications)andafullsizecommerciallyavailablespineboardoraspineboardsixfeetlongandaminimumsixteenincheswideprovidedwithstrapstoaidinimmobilizationofavictimandhandholds;

(a) Atoceansurfbeaches,atleastoneautomatedexternaldefibrillatorshallbeprovidedbytheoperatorandmaintainedon-site.ThebeachoperatorshallimplementaPADprogramasdefinedinsection6-2.2(i)ofthisSubpartandmaintainthefollowingrecordson-siteforinspection:

(1) Acopyofthecollaborativeagreementbetweenanemergencyhealthcareproviderandtheoceansurfbeachoperator;

(2) Acopyofthenotificationtotheregionalemergencymedicalservicescounciloftheexistence,location,andtypeofautomatedexternaldefibrillator;and

(3) Therecordsofautomatedexternaldefibrillatormaintenanceandtestingspecifiedbythemanufacturer’sstandards.

(iii)AtSupervisionLevelIVbathingbeachesortemporaryresidencebathingbeachesusingSupervisionLevelIIIinaccordancewithsection6-2.17(a)(1)(ii):OneU.S.CoastGuardapprovedringbuoyatleast18inchesindiameterfittedwithaquarterinchdiameterlinealengthof50feet,andareachingpole,15feetlong.

(2) Eachlifeguardstandshallbeequippedwithawhistleormegaphone,andanumbrellaorsunshade.

(3) Elevatedlifeguardchair(s)shallbeprovidedatalllevelIandIIbbeaches.Aminimumofonechairisrequiredforeach50yardsofsupervisedbeachfrontoratlocationsdescribedintheapprovedsafetyplanasrequiredbysection6-2.17(c).Elevatedlifeguardchairsshallbelocatedtoprovideaclearunobstructedviewofthebathingarea.Whereswimmingordivingispermittedmorethan150feetfromtheshoreline,lifesavingpatrolboatsoroffshorelifesavingstationsshallbeprovided.

(4) Safetyequipmentshallhaveitsfunctionplainlymarked,andshallbekeptinreadycondition.

(5) Floatinglinesshallmarktheboundariesoftheswimming,wadinganddivingareasinaccordancewiththeprovisionsofsection6-2.19,item4.7,ofthisSubpart.Swimmingshallbeprohibitedoutsidethemarkedarea.

(6) Abathingbeachwithconsistentactualbatheruseof500ormorebathersshallhaveandmaintainareadilyaccessiblebuildingforemergencycare.Thisbuildingshallbeequippedwithanadvancedfirstaidkitandaresuscitator.

(c) Safetyplan.Operatorsofbathingbeachesmustdevelop,updateandimplementawrittenbeachsafetyplan,consistingof:proceduresfordailybathersupervision,injuryprevention,reactingtoemergencies,injuriesandotherincidents,providingfirst-aidandsummoninghelp.Atoceansurfbeaches,thesafetyplanshallbedevelopedinconsultationwithanindividualhavingadequateoceansurflifeguardingexperience.Thesafetyplanshallbeapprovedbythepermit-issuingofficialandkeptonfileatthebeach.Approvalwillbegrantedwhenallthecomponentsofthissectionareaddressedsoastoprotectthehealthandsafetyofthebathers,andtheplansetsforthprocedurestoinsurecompliancewiththisSubpart.

6-2.18 Operator and operating records.

(a) EachbathingbeachshallbeunderthesupervisionofacompetentoperatorwhoshallrequirethecarefulobservanceofsanitaryregulationsprescribedinthisPartandtherequirementsofthepermitissuedforsuchbathingbeach.

(b) Thebathingbeachoperatorshallmaintaindailyrecordsindicatingthedailynumberofbathersusingthebeach,numberoflifeguardsonduty,weatherconditions,waterclarity,theresultsofanywaterqualitylaboratoryreports,andreportedrescues,injuriesandillnesses.Uponcompletion,therecordsshallbemaintainedatthefacilityfor12months.Thepermit-issuingofficialmayrequiresubmissionofreportsatperiodicintervals.

6-2.19 Bathing beach design standards.

0.0 Introduction. Thesestandardsaretobeusedbypublichealthofficials,designengineersandarchitects,andtheownersandoperatorsofbathingbeachesforthedesignofnewormodifiedbathingbeachesregulatedbythisSubpart.Thesestandardsareenactedtoensureadequatedesignandestablishmentofbathingbeaches,reflectingcurrentsafetyandsanitaryrequirements.Thesestandardsareapplicabletoallbathingbeacheslocatedonponds,lakes,streamsorotherbodiesofwaterintheState.

1.0 Definitions.

1.1 Bathingbeachshallmeanabathingplace,togetherwithanybuildingsandappurtenances,andthewaterandlandareasusedinconnectiontherewith,atapond,lake,streamorotherbodyoffreshorsaltwaterwhichisusedforbathingorswimmingwiththeexpressorimpliedpermissionorconsentoftheownerorlesseeofthepremisesorwhichisoperatedforafeeoranyotherconsiderationorwhichisopenlyadvertisedasaplaceforbathingorswimming.

1.2 UniformCodeshallmeantheNewYorkStateUniformFirePreventionandBuildingCode,9NYCRRSubtitleS,ChapterI.

1.3 Adequateshallmeansufficienttoaccomplishthepurposeforwhichsomethingisintended,andtosuchadegreethatnounreasonablerisktohealthorsafetyispresented.Aniteminstalled,maintained,designedandassembled,anactivityconductedoractperformed,inaccordancewithgenerallyacceptedstandards,principlesorpracticesapplicabletoaparticulartrade,business,occupationorprofession,isadequatewithinthemeaningofthisSubpart.

2.0 Submission of plans.

2.1 General.Preliminaryplansandtheengineer’sreportshouldbesubmittedforreviewpriortothepreparationoffinalplans.Noapprovalforconstructionshallbeissueduntilfinal,complete,detailedplansandspecificationshavebeensubmittedtothepermit-issuingofficial(PIO)andareapproved.Documentssubmittedforformalapprovalshallcontainsufficientinformationtodemonstratetothepermit-issuingofficialthattheproposedbathingbeach,orimprovementsthereto,willmeetthedesignstandardsspecifiedinthissection,andshallinclude,butnotbelimitedto:

2.1.1 Detaileddescriptionofthewatershed,withlocationandidentificationofallpotentialsourcesofcontamination,includinganyanticipatedfuturedevelopment.

2.1.2 Locationofaccessroads,parking,buildings,watersupplies,sanitaryandstormsewers,electricalandtelephoneservicesandtheproposedfacilitiesrelativetoexistingfacilities.

2.1.3 Date,address,name,professionalseal,andsignatureofthedesigningengineerorarchitect.

2.1.4 Locationrelativetonearestpopulationcenterwithservicefacilities,suchasmedical,fireprotectionandcommunication.

2.1.5 Maximumandaverageattendanceandswimmerloads.

2.1.6 Source,quality,quantityandcharacteristicsofwater.

2.1.7 Areadesignations,bottomslopesandmaterials.

3.0 Sanitary survey report.Areportreflectingtheresultsofasanitarysurveyshallincludethefollowinginformation:

3.1 Watershedsupplyingbathingarea.Amapshalldepictthewatershed,includingbutnotlimitedtoexistingwaste-waterdischarges,landfillsorotherfacilitiesthatmayhaveanimpactonwaterquality,adjacentlanduseandmajorphysicalcontours,highways,etc.Theextentofthewatershedtobemappedshouldbebaseduponknowledgeofthecharacteristicsofthewatershed.Allpotentialsourcesofpollutionandwaste-waterdischargesmustbeshown.

3.2 Plotmaps.Amapdrawntoscale,showingtheactualbathingbeachlocation,dimensions,contours,existinglanduseandwastewaterdischargeswithin10,000feetoftheproposedbeach,unlessotherwiserequiredbythePIO.

3.3 Waterlevel.Seasonaloranticipatedwaterlevelvariations.

3.4 Sourcesofcontamination.Listingoftypeandsizeofexistingandpotentialsourcesofcontamination,volume,occurringonlywithspecificweatherconditions,andtheconcentrationofthematerialsintheeffluentthatmightadverselyaffectthebathingbeachwater.Thepotentialforcontaminationduringandafterstormeventsmustbeincluded.

3.5 Weatherandtopographicalinfluences.Prevalentwinddirectionduringbathingseason,rainfall,currentmeasurement,topography,orunusualfactors.

3.6 Bathingbeachwaterquality.Ahistoryofthebacteriologicalquality,pH,andtheturbidityoftheproposedbodyofwatershallberesearchedfromallpossiblesources.Theresultsofatleastonesetofrepresentativebacterialsamples,pHtests,andturbiditytestseachweekforaperiodofeightweeksshallbeincluded.Eightsetsofsamplesshallincludeatleastonesetafterheavyrainsconsistingofdailysamplesforafive-dayperiod.

3.7 Physicalandchemical.Thephysicalandchemicalqualityofbathingwater,includingobjectionablecolor,odor,tasteandothersubstancescapableofproducingunusualqualityproblems.Ahistoryofanyunusualqualityproblemsencounteredinthebathingwatershouldbeincluded.

3.8 Biological.Thebiologicalqualityofbathingareawater,includingobjectionablevegetation,infectioussnails,andpoisonousordangerousaquaticorganisms,shallbediscussed.

3.9 Fishing,boatingorcanoeing.Locationofboattraffic,marinasorboatdockagearea,anycanoeingactivityorfishing.

3.10 Auxiliarywatersource.Location,flowrateofauxiliarywatersourcetoaugmentlowflow.

4.0 Design. Thefollowingcriteriashallbeusedforestablishingabathingbeach:

4.1 Location.Thesuitabilityofthesiteshallbeestablishedbyasanitarysurvey.

4.2 Area.Thewatersurfaceareaofthebodyofwaterwherethebeachisdevelopedshallbeatleastoneacre.Whentheareaislessthanfouracresand100gallonsperbatherperdayofnaturalflow-throughinthebathingareaislacking,asourceofdilutionwaterofatleast100gallonsperbatherperdaymustbeprovidedwithminimumwaterqualitymeetingtheprovisionsofsection6-2.15ofthisSubpart.

4.3 Batheruse.Aminimumof25squarefeetofwatersurfaceperbathershallbeprovided.Atleast75squarefeetperbathermustbeprovidedintheareaoverfourfeetdeep.

4.4 Landarea.Atleast35squarefeetoflandareaperbathershouldbeprovided.

4.5 Bottomslopes.Fordepthsuptofourfeet,theslopeshallbeuniformandnotexceed1:10.Forgreaterdepths,theslopeshouldnotexceed1:3.

4.6 Bottommaterials.Thebottomuptoawaterdepthofsixfeetshallconsistofsand,peagravelorothersimilarmaterial.

4.7 Areadesignations.

4.7.1 Locationoflines.Markerlineswithbuoysshallbeprovidedatallbeaches,exceptGreatLakesoroceanbeaches,todesignatetheperimeter,theseparationofshallowanddeep-endareasatadepthofthreetofourfeet,thedivingarea,anddropoffs,radicalchangesinslopesorunderwaterobstructions.Aseparatewadingareauptotwofeetdeep,designatedbylines,shouldbeprovided.

4.7.2 Installation.Linesshallhavefloatsatfive-footintervalsandbesecurelyanchored,andhavebuoysnomorethan25feetapartandatpointswherelinesarejoined.

4.7.3 Depthmarkers.Clearlyvisibledepthmarkersshallbeprovidedatallthedivingboards,platformsandsimilarfacilities,togetherwithwarningsignsstating“NoDiving”wheredepthislessthaneightfeet.

4.8 Divingfacilities.

4.8.1 Platforms.Floatingdivingpiersandfixedplatformsshallbeconstructedwithavisible12-inchairspaceundermaximumfeasibleload.Thereshallbeaslittleunderwaterconstructionasisconsistentwithadequatesupport.Allbracesandstrutsshallbedesignedtoprevententrapmentofbathers.Forsolidflotationdevicessuchasfoamblocks,noairspaceisrequired.

4.8.2 Depths.Divingfromrafts,piersorotherplatformsshallbeprohibited,unlessaminimumwaterdepthofeightfeetisprovidedandmaintainedforadistanceofatleasttenfeetforwardofthedivingdirection.Foradivingboardorotherdevicethreeorlessfeetabovethewater,thedepthattheendofit,andfor12feetbeyondit,shallbe10feet.Forheightsabovewatergreaterthanthreefeet,thedepthsatthoselocationsshallbe12feetandtwentyfeetbeyondit.Nodivingdevicemorethan10feetabovewatershallbeinstalled.

4.9 Watercurrents.Watercurrentsinthebathingareashallnotexceedthreefeet/second.

4.10 Sewagedischarges.Nowaste-waterdischargesfromsewagetreatmentplants,combinedsewersorothersourcesshallbepermittedwithin750feetofthebathingbeach.

4.11 Waterquality.Bathingbeachesshallmeetthewaterqualitycriteriaforbacteriological,physicalandchemicalqualityspecifiedbelow.

4.11.1 Bacteriologicalquality.Basedonthemeanofthelogarithmsoftheresultsof5ormoresamplescollectedina30dayperiod,theuppervalueforthedensityofbacteriashallbe:4.11.1.1 2,400totalcoliformbacteriaper100ml;or4.11.1.2 200fecalcoliformbacteriaper100ml;or4.11.1.3 33enterococciper100mlforfreshwater;or4.11.1.4 35enterococciper100mlformarinewater;or4.11.1.5 126E.coliper100mlforfreshwater(E.coliisnottobeusedasan

4.11.2 Chemicalquality.Thewatershallbefreeofchemicalsubstancescapableofcreatingtoxicreactions,skinormembraneirritationstothegeneralpublic.

4.11.3 Physicalquality--waterclarity.Inallbathingareas,excepttheGreatLakesoroceanbeaches,itshallbepossibletoseeaneight-inchblack-and-whitediskinfourfeetofwater.Claritytestsshouldbeperformedatafourfootdepthinthebathingareaataminimumofthreedifferentlocations.Amapdepictingtestlocations,datesofsamplingandcurrentconditionsshouldbesubmitted.

4.12Electricalrequirements.

4.12.1WiringshallconformtotheNewYorkStateUniformFirePreventionandBuildingCode,9NYCRRSubtitleS,ChapterI,andtherequirementsoftheappropriateregulatoryagency.Acertificateshallbesubmittedforallnewelectricalwork.

4.12.2Overheadclearance.Nooverheadelectricalwiringshallpasswithin20feethorizontallyofthebathingbeachwaterline.

5.0 Bathhouse.

5.1 General.Adequatetoiletandhandwashingfacilitiesshallbeprovidedforallbathingbeaches.

5.2 Bathhousedesign.Floorsofthebathhouseshallbeofsmooth-finishedmaterialwithnonslipsurfaces,impervioustomoisture,cleanableandslopedatleastone-fourthinchperfoottodrains.Carpetingshallnotbepermittedinshowerandtoiletareasorotherareasreceivingbathers.Junctionsbetweenwallsandfloorsshallbecoved.Wallsandpartitionsshallbeofsmooth,imperviousmaterials,freefromcracksoropenjoints.Partitionsbetweendressingcubiclesshallterminateatleast10inchesabovethefloororshallbeplacedoncontinuousraisedmasonryorconcretebasesatleastfourincheshigh.Lockersshallbeseteitheronsolidmasonryorconcretebasesatleastfourincheshighoronlegswithbottomoflockeratleast10inchesabovethefloor.Lockersshallbevented.

5.3 Fixturerequirements.Anadequatenumberoftoiletandhandwashingfacilitiesshallbeprovided.

5.3.1 Fixtures.PlumbingfixturesandinstallationsshallbeinaccordancewiththeUniformCode.

5.4 Watersupply.Thesourceandqualityofwatersupplyservingtheplumbingfixtures,includingdrinkingfountains,lavatoriesandshowers,shallaftertreatmentmeettheapplicablerequirementsofPart5ofthisTitleforpotablewater.

5.5 Drinkingfountains.Wheredrinkingfountainsareprovided,atleastonedrinkingfountainforeach500feetdistanceorforevery1,000usersorfractionthereofshouldbeprovided.Thedrinkingfountainsshallbeofslantingjettypewithsurroundingguard,nonsubmersibleopening.Theseshallbelocatedataconvenientpointandshallbesuppliedwithaminimumof20psiadequatewaterpressure.

5.6 Waste-waterdisposal.Waste-waterfromabathhouseorrelatedfacilitiesshallbedischargedtoamunicipalseweragesystem,whenavailable.Ifnotavailable,thesubstitutesystemshallbeapprovedbytheStateCommissionerofHealthorsuchotheragencyhavingjurisdictionoversewageplanapproval.

5.7 Suitsandtowels.Wheretowelsand/orswimmingsuitsareprovided,facilitiesshallbeprovidedtolaunder,storeandsanitizetheseitemsaftereachusage.

5.8 Hosebibbs.Hosebibbswithvacuumbreakersmustbeprovidedwithinthebathhousetoenabletheentireareatobeflushedwitha50-foothose.

5.9 Ventilation.Allenclosedplaces,dressingrooms,showerroomsandtoiletsshallbeventilatedbynaturalormechanicalmeanstoprovideaminimumoftwoairchangesperhour.

6.0 Safety provisions.

6.1 Signs.ForbeachesusingSupervisionLevelIorIIbaquaticsupervision,whennolifeguardisondutyatabeach,alegiblesignorsignsstating“NoLifeguardonDuty--SwimmingProhibited”shallbeposted.Thesignshallbeaminimum36”x24”insize,withlettersatleasttwoincheshigh.“NoSwimming”signsshallbepostedatareasnotpermitted/approvedforbathingonpropertyadjoiningthedesignatedbathingareathatisownedorunderthecontrolofthepermitholder.

6.2 Lifesavingequipment.Lifesavingequipmentshallbeprovidedasrequiredinsection6-2.17(b)ofthisSubpart.

6.2.1 Boats/Boards.AnadequaterescueboardoranadequateboatshallbeprovidedatallbeacheswhereSupervisionLevelIorIIbaquaticsupervisionisrequired.

6.2.1.1 Wherebathingispermittedmorethan150feetfromthebathingshoreline,lifesavingpatrolboatsoroffshorelifesavingstationsshallbeprovided.Eachsuchboatshallbeatleast12feetlong,equippedwithpinoars,onelifepoleorshepherd’s-crooktypeofpolehavingbluntends,andoneringortorpedobuoyorrescuetubeandlifevests.Suchboatsshallbeusedforpatrol,searchandrescuepurposesonly.

6.2.2 Equipmentatlifeguardstation.

6.2.2.1 Elevatedlifeguardchairsshallbelocatedascloseaspracticabletothebathingareashorelinetoprovideaclear,unobstructedviewofthebathingarea.

6.2.2.2 Arescuetubeortorpedobuoywithsixfeetofline,orarescuecanwith500-foothaulingline.

6.2.3 Maintenance.Safetyequipmentshallhaveitsfunctionplainlymarked,andshallbekeptingoodrepairandinreadycondition.Bathersorothersshallnotbepermittedtotamperwithorusesuchequipmentforanyotherthanitsintendeduse,orremoveitfromitsestablishedlocation.

6.3 Communication.Atelephone(s)orothermeansofcommunication,withnumberspostedofnearestsquad,physician,ambulance,policeagencyandhospital,shallbeprovidedateachbeach.

6.4 Emergencycareroom.Everybathingbeachcapableofaccommodating500swimmersandbathersshallhaveareadilyaccessibleroomorareadesignatedandequippedforemergencycare.Suchroomshallbeequippedwithatleastthefollowing:runningpotablewater,acotorbed,withblanketsandsheets,advancedfirstaidsuppliesatleastequivalentto24units,andresuscitationequipment.

6.5 Solidwaste.Anadequatenumberofleak-proofsolidwastereceptacleswithself-closinglidsshallbeplacedinthebeacharea.

6.6 Dangerousobjectsonbeach.Glasscontainersshallnotbepermittedonthebeach.

6-2.20 Aquatic supervisory skill requirements.TheNewYorkStateDepartmentofHealthisresponsibleforreviewoftrainingcoursesand/orcertificationprogramstodetermineacceptability.

(a) SUPERVISIONLEVELI-SURFLIFEGUARD

(1) TheSupervisionLevelrequirementsforthislevelshalltakeeffectMay15,1994.

(2) Nopersonshallbequalifiedunderthissubdivisionunlesssuchperson:

(i) Hasaminimumageof16years;and

(ii) PossessesacurrentA.R.C.BasicLifeSupportfortheProfessionalRescuerCPRorequivalentcertification;thecertificationperiodmustnotexceedoneyear;and

(iii)Hasaminimumof20hours(24hoursiffirstaidskillsareincluded)oftrainingacceptabletotheCommissionercoveringthoseitemssetforthinthissubdivision(statedtimeperiodsdonotincludefinalexaminationtimeorconditioningswims).Suchtrainingandoceantestingmustbesatisfactorilycompletedpriortoassignmentatoceanfrontandthecertificationperiodoftrainingandtestingmustnotexceedthreeyears.

Thetrainingcourseandrecertificationprogramwillbedeterminedtobeacceptableif,afterareview,allthematerialssubmittedbytheprogramsponsoraredeterminedtobecompleteandsubstantiallymeettherequirementsofthissection.Instructorsshallhavesufficientexperienceandknowledgeinlifeguardingtoeffectivelycommunicatethesubjectmatterrequiredbythissection.
