THE FACTORIES ACT OF 1948: the act prohibits the employment of children below the age

of 14 years in any factory. the law also placed rules on who, when and how long can pre-adults

aged 15–18 years be employed in any FACTORY.

THE MINES ACT OF 1952: THE ACT PROHIBITS THE EMPLOYMENT OF CHILDREN

BELOW 18 YEARS OF AGE IN A MINE.

THE CHILD AND ADOLESCENT LABOUR (PROHIBITION AND REGULATION) ACT

OF 1986: THE ACT PROHIBITS THE EMPLOYMENT OF CHILDREN BELOW THE AGE

OF 14 YEARS IN HAZARDOUS OCCUPATIONS IDENTIFIED IN A LIST BY THE LAW.

THE LIST WAS EXPANDED IN 2006, AND AGAIN IN 2008. IN 2016, THE ACT WAS

AMENDED (NOT IN FORCE AS OF 30 JULY 2016) TO PROHIBIT EMPLOYMENT OF

CHILD BELOW 14 YEARS IN ALL OCCUPATION (EXCEPT FOR HELPING IN NON-

HAZARDOUS FAMILY BUSINESS AND OF CHILD ARTISTS IN THE ENTERTAINMENT

INDUSTRY AND SPORTS). FURTHER, ADOLESCENTS BETWEEN 14–18 YEARS WILL

NOT BE ALLOWED TO WORK IN HAZARDOUS INDUSTRIES AND PROCESSES.[36]

The Juvenile Justice (Care and Protection) of Children Act of

2000: This law made it a crime, punishable with a prison term,

for anyone to procure or employ a child in any hazardous

employment or in bondage.

The Right of Children to Free and Compulsory Education Act of

2009: The law mandates free and compulsory education to all

children aged 6 to 14 years. This legislation also mandated that

25 percent of seats in every private school must be allocated for

children from disadvantaged groups and physically challenged

Amendment bill 2016 The amendment prohibits the engagement of children

below the age of 14 in all occupations and processes so that they are able to enjoy their fundamental right to education under the Right of Children to Free and Compulsory Education Act of 2009. During school days, no family can employ its children for job.

EFFECTS OF AMENDMENT

If child is rescued from forced labour The government will give Rs 15,000 and add the fine from the employer to help the child’s rehabilitation.

The Child Labour (Prohibition and Regulation) Amendment Bill prohibits employment of children below 14 years of age in all occupations. But it allows adolescents (those between 14 and 18 years of age) to work in non-hazardous occupations and processes. They can work in family-run establishments like a grocery store but can’t work in a chemical factory.

“Family work” Does it mean that millions of children render in home-based

units of beedi rolling, bindi and bangle

production,agarbatti and papad making, zari and embroidery

work, packing and sticking labels,chappal making, handicrafts

and the manufacturing of several other products.

It is the kind of work that starts before and after school hours

until late in the night at the cost of children’s health until they

can no longer concentrate in the classroom or participate in

school and are branded as slow learners. Unable to straddle

both school and work, these children are forced to give up the

former.

Has the amendment achieved its goal

Regulation is going to be a big challenge, as it will be difficult to

determine whether a particular family is running an enterprise,

or whether some faceless owner has employed a single family

to circumvent the law. The fallout will be a higher dropout rate.

They may go to school for some years, concurrently work with

their families, and graduate to being full-time adolescent

workers, without completing elementary education
