1. DISCLAIMER

1.1 The information contained in this Bid Document or subsequently provided to the Insurance

Company/(ies), whether verbally or in documentary form by or on behalf of the IRCTC or

any of their employees or advisors, is provided to the Insurance Company/(ies) on the terms

and conditions set out in this Bid Document or any other terms and conditions subject to

which information is provided.

1.2 This request for Bid document is not an agreement and is not an offer or invitation by IRCTC

to any party other than the Insurance Company/(ies) who are qualified to submit their

proposals to IRCTC in response to the tender.

1.3 The objective of the Bid document is to provide the prospective Insurance Company/(ies)

with all the relevant information to assist him for formulation of proposals or bids.

1.4 The bid document may not be apposite for all persons interested in bidding as it is not

possible for the IRCTC or any of their employees or advisors to take into consideration the

financial and investment objectives, financial situation as well as specific needs of each party

who reads or uses this Bid document.

1.5 The prospective Insurance Company/(ies) should conduct detailed analysis and study for

authenticating the accuracy and completeness of the information provided in the Bid

document and wherever necessary obtains independent opinion from appropriate sources.

1.6 The IRCTC, their employees and advisors make no representation or warranty and shall incur

no liability under any law, statute, rules or regulations about the accuracy, reliability or

completeness of the bid document.

1.7 The IRCTC may in its absolute discretion, but without being under any obligation to do so,

update, amend or supplement the information in this Bid document. However all such

amendments will be uploaded on website as well as informed to all Insurance Company/(ies)

who have purchased the tender document.

1.8 The issue of the Tender Documents does not imply that IRCTC is bound to appoint the

successful Insurance Company as the Insurer, as the case may be, and the IRCTC reserves the

right to reject or any of the Insurance Company/(ies) or Bids or not to award the Contract

without assigning any reasons whatsoever.

1.9 Each Insurance Company shall bear all its costs associated with or relating to the preparation

and submission of its Bid including but not limited to preparation, copying, postage, delivery

fees, expenses affiliated with any demonstrations or presentations which may be required by

the IRCTC or any other costs incurred in connection with or relating to its Bid. All such costs

and expenses will be borne by the Insurance Company/(ies) and IRCTC and its employees

shall not be liable in any manner whatsoever for the same or for any other costs or other

expense incurred by the Insurance Company/(ies).

1.10 The information contained in this Tender is being provided by IRCTC for the limited purposes

of enabling the Insurance Company/(ies) to participate and submit a Bid in response to this

Tender to engage Insurance Company/(ies) for OVERSEAS TRAVEL INSURANCE of

passenger of IRCTC‟s Corporate Traveler and tourists utilizing outbound tour packages of

IRCTC for a period of two years (2 years) extendable once by one year (1 year). In no

circumstances shall IRCTC, or its respective advisors, consultants, contractors, servants

and/or agents incur any liability arising out of or in respect of the issue of this Tender, or the

Bidding Process.

1.11 This Tender may not be appropriate for all persons, and it is not possible for IRCTC, its

employees or advisors to consider the investment objectives, financial situation and

particular needs of each party who reads or uses this Tender. The assumptions,

assessments, statements and information contained in this Tender may not be complete,

accurate, adequate or correct. Each Insurance Company should therefore, conduct its own

due-diligence, investigations and analysis and should check the accuracy, adequacy,

correctness, reliability and completeness of the assumptions, assessments, statements and

information contained in this Tender and obtain independent advice from appropriate

sources.

1.12 Nothing in this Tender shall be construed as legal, financial or tax advice. IRCTC will not be

liable for any costs, expenses, however so incurred by the Insurance Company/(ies) in

connection with the preparation or submission of their Bid. IRCTC reserves the right to amend

this Tender or its terms and any information contained herein or to cancel the Bidding Process

or altogether abandon the Project at any time by notice, in writing, to the Insurance

Company/(ies). Further, it may in no event be assumed that there shall be no deviation or

change in any of the herein-mentioned information.

1.13 IRCTC may, in its absolute discretion but without being under any obligation to do so, update,

amend or supplement the information, assessment or assumptions contained in this Tender.

1.14 Laws of the Republic of India are applicable to this Tender.

2. PREAMBLE

2.1 Indian Railway Catering and Tourism Corporation Ltd. (IRCTC) is a Public Sector Enterprise

under Ministry of Railways and was incorporated as an extended arm of the Indian Railways to

upgrade, professionalize and manage the catering and hospitality services at station and on

trains & other locations, to promote &provide Rail and Land packages, development of budget

hotels, special packages, domestic air packages, out bound packages, Tourist trains, tour

packages by trains/ coaches. Information & commercial publicity and global reservation

systems.

2.2 IRCTC handles around 70 corporate houses PAN India, FIT and several outbound packages to

destinations like Dubai, Singapore, Malaysia, Bhutan, Europe, Australia, China, Nepal,

Srilanka etc. In order to provide OVERSEAS TRAVEL INSURANCE abroad to our business

and leisure traveler going abroad, IRCTC intends to take OVERSEAS TRAVEL INSURANCE

cover for the passengers.

2.3 IRCTC tourism portal www.irctctourism.com provides a range of travel & tourism services to

customers including All Inclusive Rail tour Packages, Tourist Trains, Holiday packages

(Outbound, Domestic & Inbound), Hotels.

2.4 IRCTC provide air ticket through its app &website www.air.irctc.co.in .

2.5 Beside the Rail Passengers market, IRCTC has entered into Air Ticketing segment &

successfully managing 60+ Ministries, PSU‟s & Departments.

2.6 Overseas Air Travel business for IRCTC includes outbound business travel through corporate

travel business, Leisure travelers & outbound tourists etc. IRCTC intends to provide Overseas

Travel Insurance to all these business and leisure travelers.

3. NOTICE INVITING TENDER

Bid reference no.: 2019/IRCTC/ TOURISM/ OVERSEAS TRAVEL INSURANCE/PART I.

Indian Railway Catering and Tourism Corporation (IRCTC) invites Open E tender for Engagement of

Insurance Companies registered with IRDA for OVERSEAS TRAVEL INSURANCE of passenger of

IRCTC‟s Corporate Traveler‟s, tourists utilizing outbound tour packages or FIT‟s of IRCTC for a

period of Two years (2 years) extendable once by One year (01 Yr) on sole discretion of IRCTC

subject to satisfactory services and resolution of the claims on time, along with fulfillment of terms and

conditions & on mutual agreement.

The successful Insurance Company shall be intimated about the award of the work. The bids shall

remain open for acceptance for 120 days from the date of opening of bid.

IRCTC reserves the right to reject any/ all bids without assigning any reason and shall not be bound to

accept lowest offer.

4. Eligibility Criteria:-

Non Life Insurance company (General Insurance Companies) recognized &

registered by Insurance Regulatory Development Authority (IRDA) are

eligible for participation.

(Company needs to submit copy of valid registration & renewal receipt as

applicable with IRDA).

5. INSTRUCTIONS TO THE INSURANCE COMPANY/(IES) (TENDERER)

1) General:

a. Date & Time of to which offers will be received: latest by 1500 Hrs. on or before

04.03.2020.

b. Date & Time of Opening of Bid: 1515 Hrs. on 04.03.2020.

2) The E tender will be available on www.irctc.com, www.tenderwizard.com/IRCTC, &will be

submitted & received electronically only www.tederwizard.com/irctc.

3) To participate in the E- Tender, it is mandatory for the Insurance Company/(ies) to register

themselves with M/s ITI without any payment on the website www.tenderwizard.com/IRCTC and

obtain User ID & password which is required for submitting the tender. It may please be noted for

submission of bid, Class- III digital signature will be required. Fresh registration is not required if

already registered

4) The applicant should upload complete set of documents in support of Eligibility Criteria.

5) Corrigendum/Addendum to this Tender, if any, will be published on website

www.irctc.com,www.tenderwizard.com/IRCTC, No newspaper press advertisement shall be issued

for the same.

7) The digital signature of the Insurance Company on the E- tender form will be considered as

confirmation that the Insurance Company has read, understood and accepted all the documents

referred to in the tender documents. No deviation is accepted.

8) Before tendering the Insurance Company/(ies) are requested to carefully examine the Tender

Documents, Terms & Conditions of Assignment, Specifications and if there should be or appear to

be any ambiguity therein they should immediately refer the matter to IRCTC for clarification.

9) The Tender shall contain a name with designation, an address, Tel. No. and Fax No. for serving

notices required to be served to the Insurance Company in connection with the Tender.

10) The Tender shall accompany the documentary proofs for qualifying requirements. Documents not

required as part of the Tender should not be provided.

11) The Tender is not transferable

12) The intending Insurance Company/(ies) are advised to study the document carefully and acquaint

themselves with the conditions therein as they shall govern the operations and shall form an integral

part thereof.

13) At any time prior to the bid submission date, IRCTC may, for any reason, whether at its own

initiative or in response to clarifications requested by the Insurance Company/(ies), modify the bid

document through the issuance of Corrigendum/Addendum, which will be uploaded in the IRCTC

website www.irctc.com not later than 4 days in advance to the last date for submission of tender,

and shall be binding upon them. In order to give the Insurance Company/(ies) reasonable time

where a Corrigendum/ Addendum is issued, or for any other reason, IRCTC may, at its discretion,

extend the bid submission date.

14) The validity of the bid must be for a minimum120 days from the date of opening of bid.

15) Any failure on the part of Insurance Company to observe the prescribed procedure and any attempt

to canvass for the work shall render the insurance company‟s bids liable for rejection.

16) IRCTC reserves the right to award contract to any successful Insurance Company at its discretion

and this will be binding on insurance companies.

17) IRCTC may terminate the Contract if it is found that the Insurance Company is black listed or

debarred by any of the Government Department/IRDA/Institution/ Local Body/ Municipality/

Public Sector Undertaking, etc. or submitted wrong undertaking or given any false information in

the tender document.

18) IRCTC reserves the right to reject any/ all bids including the highest bid or withdraw the tender at

any stage without assigning any reasons. Nothing contained herein shall confer right upon a

Insurance Company or any obligation upon IRCTC.

19) All Insurance Companies are hereby cautioned that conditional offers with deviations from the

tender conditions and other requirements stipulated in this document is likely to be rejected as non-

responsive and will not be considered in tender evaluation and award of work.

20) The policy shall be interpreted as per the common English Language.

21) Compliance to the conditions mentioned in the bid documents is required. The bid shall be duly

signed and stamped by an authorized signatory of the Insurance Company.

6. SCOPE OF WORK

Provision of Overseas travel insurance cover to travelers going abroad through corporate travel

services or outbound travel of IRCTC to cover all travel, medical and accidental risks as per below

coverage-

7. SELECTION OF THE SUCCESSFUL INSURANCE COMPANY

The Insurance Company would be selected through a transparent bidding process. Technical bid

would be evaluated at first based on the response to our pre-decided minimum eligibility criteria as

per Annexure A. Financial bid of only those insurance companies will be accepted who qualify the

qualifying criteria.

The successful Insurance Company would be selected from the Insurance Company/(ies), who are

found L1 as per the Total point calculation.

The selection of the Insurance Company will be done as per following methodology –

7.1 OPENING OF BID

The bid will be opened on 04.03.2020 at 1515 Hrs.(IST) at Indian Railway Catering and

Tourism Corporation Limited, M-13 Punj House, Connaught Place, New Delhi-110001, and

the same would be taken up for evaluation of the responses received by IRCTC.

The Insurance Company/(ies), or their authorized representatives, would be permitted to attend

the opening of the tenders. The representatives must carry a letter of authority from the

authorized signatory of the Insurance Company or any other valid document, authorizing them

to attend the tender opening, failing which they will not be permitted to participate in this

process.

7.2 EVALUATION CRITERIA

The Bids would be evaluated on the basis of Eligibility criteria & L1 offers submitted by them.

IRCTC reserves the right at its sole discretion to seek information, documents etc. from the

Insurance Company/(ies), as it may consider necessary for the purpose of evaluation of the bid.

In case of tie between Insurance Companies with regard to same premium quotes, then the

successful Insurance Company will be selected on the following factors for the FY 2018-19:-

a) Highest settlement rate

b) Highest Net Worth

8. TERMS AND CONDITIONS

8.1 IRCTC will provide documents as per requirement to the insurance company.

8.2 IRCTC Corporate Office will finalize the premium amount with Insurance Company. Selected

Insurance Company will deal with all the IRCTC offices.

8.3 IRCTC will pay premium amount in advance against the number of insurance covers requested

from the insurer.

8.4 Insurance policy will cover all the passengers travelling abroad through IRCTC for business,

corporate travel or leisure travel.

8.5 Premium will be calculated on the basis of coverage and premium amount fixed as per

Insurance Company selected.

8.6 Insurance policy will cover the various Risk cover as per benefits mentioned in Table A Age

Limit- Table B in Scope of work.

8.7 The insurance coverage of tourist will start from the date of policy start and for the duration on

the policy.

8.8 First information of incident will be given by e-mail/phone/sms/whatsapp etc. and documents

as per requirement will be sent on mail for any claims. The same must be settled with traveler

directly.

8.9 The insurance company must provide Cancellation terms and charges. Procedure for cashless/

claims and number of days required for claim settlement, Nodal officers list – India and abroad

8.10 Price negotiation

As it is not the general norm for IRCTC to carry out price negotiations following evaluation of

the Commercial Bids, the Insurance Company/(ies) are advised to submit their best quotes in

response to tender. IRCTC however, reserves the right to carry out negotiations in exceptional

cases with the Insurance Companyr.

8.11 Validity of Prices

a) The price quoted by the Insurance Company will be valid after the mandate is awarded

and till the validity/expiry of the agreement.

b) The price offered should remain firm until the completion of the contract. No request

for increase in price for the services shall be entertained during this period.

8.12 Validity of the contract

Selected insurance Company at discretion of IRCTC will enter into a contract for Two years

extendable by One year on discretion of IRCTC & on mutually agreed terms and conditions.

8.13 Agreement

In case of acceptance of Bid by IRCTC, the Insurance Company shall be required to execute

the Service Level Agreement between IRCTC and selected Insurance Company within 2 weeks

from the date of receipt of LOA. Failure to do so shall lead to may invite suitable action by

IRCTC.

The Agreement entered by IRCTC at its discretion will be for Two years extendable by One

year on mutually agreed terms and conditions.

8.14 Indemnity:

The Insurance Company/(ies) hereby agrees to indemnify and shall keep indemnified and hold

harmless, IRCTC and its directors, officers and employees from and against all and any claims,

demands, losses, damages, penalties, expenses and proceedings connected with the

implementation of his contract or arising from any breach of non-compliance what so ever by

the company or any of the persons deployed by it pursuant hereto of or in relation to any such

matter as aforesaid or otherwise arising from any act or omission on their part, whether willful

or not, and whether within or without the premises.

8.15 Laws governing the Contract

a) This contract shall be governed by the laws of India for the time being in force.

b) This contract shall be governed Irrespective of the place of performance or place of

payment under the contract, the contract shall be deemed to have been made at New

Delhi.

c) Jurisdiction of Courts - The Courts of New Delhi shall alone have jurisdiction to

decide any dispute arising out of or in respect of the contract.

8.16 Termination

IRCTC reserves the right to terminate the agreement after giving the Insurance Company two months

notice in writing of its intention to terminate without assigning any reason whatsoever for it.

Notwithstanding what is stated herein above, either party shall have the right to terminate the

agreement forthwith by giving two months notice in writing addressed to the other party at his last

known address, in case of occurrence of the following events, and the other party fails to remedy the

breach within a period of 15 days thereof:

i. Breach of any terms or conditions of this agreement by a party to the agreement.

ii. If any party commits violation of any applicable laws or regulations;

iii. If the Insurance Company becomes insolvent or goes into compulsory liquidation.

iv. If the Insurance Company, in the opinion of IRCTC, has engaged in corrupt or fraudulent

practices in competing for or in executing this Contract.

v. If the Insurance Company submits to IRCTC a false statement which has a material effect on

the rights, obligations or interests of IRCTC.

vi. If the Insurance Company places itself in position of conflict of interest or fails to disclose

promptly its conflict of interest to IRCTC.

vii. If the Insurance Company fails to provide the quality services as envisaged under the contract.

Reasons for the same would be recorded in writing. In such an occurrence IRCTC shall give a

written advance notice before terminating the Contract of the Insurance Company.

viii. In case of wilful default or non compliance of terms and conditions of the agreement or failure

to Insurance Company, IRCTC will have the right to terminate the contract. The decision of

IRCTC in this regard shall be final.

ix. The performance of Insurance Company shall be reviewed on the basis of disposal of claims

and services offered during the period. In case the efforts of the Insurance Company appear to

be lagging behind considerably, IRCTC reserves the right to terminate the contract after serving

a show cause notice of 15 days and the decision of IRCTC shall be final in this regard.

x. The contract will be terminated after the approval from Corporate Office IRCTC

8.17 Effect of termination

Notwithstanding any other rights and remedies provided elsewhere in the agreement, on

termination of this agreement:

i) Neither party shall make any representation in a manner so as to induce any third party to believe

that the other party to this agreement continues to be associated with it, in any manner whatsoever.

ii) Neither party will be eligible to claim to any amount as loss or compensation for the termination of

the agreement.

iii) The expiration or termination of the agreement for any reason whatsoever shall not effect any

obligation of either party having accrued under the agreement prior to the expiration or termination

of the agreement and such expiration or termination shall be without prejudice to any liabilities of

either party existing at the date of expiration of the agreement.

8.18 Force Majeure

IRCTC shall not be liable to the Insurance Company in respect of any breach of the terms and

conditions due to any event or circumstances beyond its reasonable control.

8.19 Arbitration

In the event of any dispute or difference arising under these conditions of contract or in

connection with this contract (except as to any matters, the decision of which is specifically

provided for by these conditions) the same will be resolved by Arbitration, as per the

provisions of „The Arbitration and Conciliation Act – 1996.‟ The venue of the Arbitration

shall be New Delhi. All questions, disputes and or differences arising under or in connection

with this agreement or in touching or relating to or concerning the services, shall be referred

to the sole adjudication of the officer/officers or persons nominated by the Chairman

&Managing Director/IRCTC, whose decision in this regard shall be final.

The Insurance Company will follow all prevailing labour laws and regulations. The agreement

between IRCTC and Insurance Company shall not create any contractual relationship between

the insurance company‟s own staff or its Insurance agents and IRCTC. IRCTC shall not be the

“principal employer” in case of employees/staff engaged by the insurance Company. If any

proceedings are instituted against IRCTC regarding non - compliance of any labour law, then

the Insurance Company would be liable to make good all the loss occurring to IRCTC as a

result of those proceedings including the cost of defending the proceedings.

All disputes shall be subject to the jurisdiction of courts at New Delhi.

8.20 Penalty clause:-

The Insurance Company shall at all times ensure that his performance is satisfactory, failing

which IRCTC shall be at liberty to get the affected work done through any other Insurance

Company, at the risk and cost of the Insurance Company. In such cases IRCTC shall be at liberty

to carry on the work under this agreement through any other Insurance Company directly for the

work and all expenses incurred on this account shall be at the sole risk and responsibility of the

selected Insurance Company and shall be recovered from the selected Insurance Company.

Any delay from the stipulated schedule would invite a penalty of Rs.5000/- per day in respect of

each of the items of work as enumerated in the Scope of Work indicated above. In case of

underperformance and undue delays in performance by the insurance company besides other

action, including blacklisting of the insurance company, as may be deemed fit by IRCTC.

8.21 Payment Clause:

1) IRCTC will pay premium amount in advance against the number of insurance covers

requested from the insurer. The advance payment would be made against performa invoice

submitted by the insurer.

2) The insurer will raise final invoice to the concerned Zonal Office/Corporate Office, Delhi on

monthly basis for reconciliation of advance paid and final invoice submitted.

3) The Bill should be submitted in duplicate. The bill should contain details of SAC Code/GST

number of the insurance company /GST NO of IRCTC on the bill.

4) Any balance payment if due will be made, after all required verifications, by electronic

transfer of funds to the account of the concerned insurance company in Indian Rupees only.

5) Any due payment, if to be made by the insurer to IRCTC shall either be transferred to IRCTC

A/c or be adjusted from next premium to be paid by IRCTC.

6) The GST/TDS or any applicable Tax component shall be paid as per actual. The liability to

pay the GST/TDS or any other Taxes etc shall at all times will be liability of the insurance

company only.

7) For facilitating Electronic Transfer of funds, the selected insurance company will be required

to indicate the name of the Bank & Branch, account No. (i.e. bank name, IFSC Code and Bank

A/c No.) and also forward a cheque leaf duly cancelled, to verify the details furnished. The

same need to be updated in case of any changes to IRCTC.

8.22 The selected Insurance Company will have to submit the letter of acceptance and execute an

agreement with IRCTC within 15 days of the issue of LOA from IRCTC.

9) Common General Exclusion

9.1 Routine physical or other examination where there is no indication of impairment of common health

or any kind of planned treatment or travelling for the purpose of obtaining treatment.

9.2 Suicide, attempted suicide or wilfully self-inflicted injury or illness, mental disorder, anxiety /

stress / depression / nervousness, venereal disease, alcoholism, drunkenness or drug abuse.

9.3 Self-exposure to needless peril (except in an attempt to save human life), engaging in any criminal

or illegal act.

9.4 Pregnancy, resulting in childbirth, miscarriage, abortion, or complication arising out of any of the

foregoing not related to any accident.

9.5 Experimental, unproven or non-standard treatment.

9.6 Treatment by any other system other than medicine (also known as Allopathy).

9.7 Delay of baggage in India.

9.8 Loss or damage to the insured's passport due to confiscation or detention by customs, police or any

other authority.

9.9 Loss which is not reported to the appropriate police authority within 24 hours of the discovery of

the loss, and for which an official report has not been obtained.

9.10 Loss due to the insured's failure to take steps to guard against the loss of passport.

9.11 Any Medical Expenses incurred before the policy inception and beyond the expiry of Policy Period Any claim

relating to events occurring before the commencement of the Trip covered hereunder and any time

after the completion of the Trip (or at any port at the Country of Residence of the Insured for a

International/Overseas policy) mentioned hereunder.

9.12 A claim which is fraudulent in any respect, or if any false declaration has been made or used in

support thereof or if any fraudulent means or devices are used by the Insured or any one acting on

his behalf to obtain any benefit under the Policy or if the loss or damage is occasioned by the willful

act, or with the connivance of the Insured.

9.13 In so far as it relates to the covers the Insured:

a. A pre-existing medical condition present prior to availing the plan and any complication

arising out of such condition for which care, treatment or advice was sought from a medical

practitioner.

b. Is receiving, or is on a waiting list to receive, specified medical treatment declared in a

Medical Practitioner‟s report or certificate

c. Has received terminal prognosis for a medical condition.

d. Travelling for the purpose of obtaining treatment.

e. Is taking part in a naval, military or air force operation

9.14 Of Involvement or participation of Insured directly or indirectly in murder, or criminal assault

or the like.

9.15 Claim under any of the mentioned covers that are results of war and warlike occurrence or

invasion, acts of foreign enemies, hostilities, civil war, rebellion, insurrection, civil commotion

assuming the proportions of or amounting to an uprising, military or usurped power, active

participation in riots, confiscation or nationalisation or requisition of or destruction of or

damage to property by or under the order of any government or local authority;

9.16 Any claim arising from damage to any property or any loss or expense whatsoever resulting or

arising from or any consequential loss directly or indirectly caused by or contributed to or

arising from:

a. Ionizing radiation or contamination by radioactivity from any nuclear fuel or from any

nuclear waste from the combustion of nuclear fuel or

b. The radioactive, toxic, explosive or other hazardous properties of any explosive nuclear

assembly or nuclear component thereof.

9.17 Any claim arising out of sporting activities such as in aviation / ballooning / while mounting

into or dismounting from traveling in any balloon or aircraft other than as a passenger (fare

paying or otherwise), or while engaging in any other hazardous activity/ adventure sports or if

the insurer involves in the training or participation in competitions of professional or semi-

professional sports persons, unless declared beforehand and agreed by the Insurance Company

subject to additional premium being paid and incorporated accordingly in the Policy.

9.18 Any claim relating to Hazardous Activities, unless specifically covered in the Policy.

9.19 Payment of compensation in respect of Illness/ Injury arising or resulting from the Insured

committing any breach of law with a criminal intent.

9.20 Any claim not meeting the deductible amount or time excess mentioned against the cover of the

Policy Schedule.

9.21 Any Out-patient treatment expenses.

9.22 Any loss or damage of Contents including valuables and personal money (cash) of the Checked-

In Baggage.

9.23 If the Insured shall be involved as either principal or accessory or is in any way involved in

causing/planning the Hijack.

9.24 Property belonging to the member of Insured family or employer or deemed by law to be of insured

employer/employee.

9.25 Any routine dental treatment or consultation.

9.26 Loss or damage caused by direct or indirect involvement of the Insured and/or Insured‟s

domestic staff in the actual or attempted Burglary.

10. Common Policy terms & Inclusions

10.1 Personal Accident - is a sudden, unforeseen and involuntary event caused by external, visible and

violent means.

Inclusions:- The Insurance Company will pay the Sum Assured under Personal Accident Section specified in

the Schedule if the Insured sustains Accidental Bodily Injury during the course of the Insured

Journey and such Bodily Injury within 12 months of the date upon which it was sustained is the sole

and direct cause of the-

i. Insured‟s death

ii. Permanent Total Disablement

iii. Permanent partial disablement

10.2 Medical Expenses:-Means those expenses that an Insured Person has necessarily and actually

incurred for medical treatment on account of Illness or Accident on the advice of

a Medical Practitioner, as long as these are no more than would have been

payable if the Insured Person had not been insured and no more than other

hospitals or doctors in the same locality would have charged for the same

medical treatment

Inclusions:- If an Insured Person contracts an Illness or suffers an injury due to an accident, that

occurs whilst the Insured is on a trip during the Policy Period and which solely and

directly requires the Insured Person to be Hospitalized, the Insurance Company shall

indemnify the Insured for Reasonable and Customary Charges incurred by the Insured

for the Emergency Hospitalization or Day Care Treatment and such medical treatment

should be undertaken on the written advice of a medical practitioner.

In no case shall the Insurance Company be liable for the expenses incurred by the

Insured at his Country of Residence without prior approval from the Insurance

Company/ASP/TPA.

However, the Insurance Company may, at its sole discretion, even allow the Insured to

avail the treatment for said Injury/Illness (only if medically necessary and prescribed in

writing by treating Medical Practitioner) in the Country of Residence of the Insured, if

the treatment for the said injury/illness has already begun at the place where the said

injury/illness was sustained. In such cases, the Insurance Company shall compensate the

Insured for the Medical Expenses incurred by the Insured, for a maximum of 30 days,

from the date of return to the Country of Residence of the Insured or policy expiry date,

whichever is earlier.

The overall liability of the Insurance Company, under this circumstance shall not

exceed the amount, had the treatment been undertaken at the place where the

Injury/Illness was sustained or the maximum Sum Insured under this cover, whichever

is less.

Payment under this cover would be subject to the following:

i) The Hospitalization or Day Care Treatment is for Medically Necessary Treatment

and is commenced and continued on the written advice of the treating Medical

Practitioner.

ii) The Insured Person is admitted to the hospital or undergoes Day Care Treatment

within 7 days of occurrence of the Accident

iii) Overall liability to make any payment under this Cover would be limited to against

the mentioned cover in the Policy Schedule.

iv) The Deductible/co-pay amount as mentioned against this Cover mentioned in the

Policy Schedule shall be applicable.

The Insurance Company shall reimburse the Hospitalization expenses for:

i) Accommodation, boarding and nursing expenses;

ii) Diagnostic, test and / or examination charges, ambulance charges.

iii) Physician, surgeon, anesthetist fees;

iv) Cost of medicines provided by the Hospital / purchased from a registered pharmacy

other than the Hospital as prescribed in writing by the Medical Practitioner

attending the Insured;

10.3 Medical Evacuation:- Means immediate transportation of the Insured suffering an Injury or Illness to

the nearest Hospital where appropriate medical treatment can be obtained,

Scenarios which necessitates the Medical Evacuation of the Insured are:

i. Current hospital where Insured is taking treatment is not equipped enough or lack

facilities to carry out further treatment of the Insured

ii. Insured suffering an Injury or Illness is stuck or stranded in a remote area which lacks

Hospital and the Insured has to be transported to the nearest Hospital on an

Emergency basis.

Inclusions:- The Insurance Company shall indemnify the Insured for the Reasonable and Customary

Charges, incurred for an ambulance or any other Emergency transportation and

evacuation services, including necessary medical care en-route, forming part of the

treatment for any Illness contracted or Injury sustained whilst on Trip during the Period

of Insurance provided that such costs are certified and authorized by the Assistance

Service Provider / Us / TPA / In-house claim processing team of the insurance

Company. The transportation expenses shall be limited to transporting the Insured from

the place of contracting/sustaining Illness/Injury to the nearest appropriate Hospital /

Country of Residence as decided by the Assistance Service Provider / Us / TPA / In-

house claim processing team of the Insurance Company and the cost of transportation to

a special clinic, if this is medically necessary and prescribed in writing as such by a

physician. The Insurance Company‟s liability would not exceed the Sum Insured

amount mentioned against this cover in the Policy Schedule hereto.

10.4 Repatriation of Remains:- The costs incurred for transporting the remains of the deceased Insured

back to the Country/Place of Residence.

Inclusions:- In the unfortunate event of the death of the Insured due to Injury or Illness and/or

Sickness and/or Disease occurring or having first manifested itself during an Insured

Journey whilst on a Trip during the Period of Insurance, the Insurance Company shall,

reimburse the Nominee, the costs incurred for transporting the remains of the deceased

Insured back to the Country/Place of Residence of the Insured or, up to an equivalent

amount, for a local burial or cremation in the country/place where death has occurred

Covered expenses include, but are not limited to, expenses for: (a) embalming; (b)

cremation; (c) coffins; and (d) transportation

Benefits will not exceed the maximum shown in the Policy Schedule. All Repatriation

of Remains arrangements must be approved in advance by Insurance Company / Claims

Administrator of the Insurance Company.

10.5 Loss of Checked in / Hand baggage:- means the baggage entrusted by the Insured and accepted by a

Common Carrier/Public Carrier for transportation for which a baggage receipt is issued

to the Insured by the Common Carrier/Public Carrier. This shall exclude all the items

that are carried/ transported under a contract of affreightment. As soon as the checked-in

baggage is delivered by the Common Carrier/Public Carrier against surrender of the

receipt to the Insured, it shall be considered as Baggage and Personal Effects of Insured.

Inclusions:- If the Checked-In Baggage of the Insured is permanently lost whilst in custody of the

Common Carrier/ Public Carrier in relation to Trip covered, the Insured will be paid a

pro-rated sum insured of the Policy Schedule, for pieces of baggage lost. This shall

basically mean that if the Insured has entrusted more than one baggage in the authority

of common carrier/ Public Carrier, then in the event that all pieces of baggage are not

permanently lost, the benefit/claim payout would be made on a pro-rated basis

depending on the pieces of baggage checked-in. The coverage shall commence from the

time the Checked-In Baggage is entrusted to the Common Carrier/ Public Carrier and a

receipt obtained, and shall terminate on delivery by the Common carrier/ Public Carrier.

The cover shall in no case exist beyond the point of delivery by the Common Carrier/

Public Carrier at the arrival terminal/ exit gate.

The cover shall be applicable individually and independently in case of Trip involving

multiple destinations en-route. Even in the event of more than one incident of loss of

Checked-in Baggage during the Trip, the Insurance Company‟s overall liability shall be

limited to the overall Sum Insured

CONDITIONS APPLICABLE TO COVER - LOSS OF CHECKED-IN BAGGAGE

1. The insured must report any Loss, theft or deprivation of Baggage to either the local

police or the common carrier/ Public Carrier as soon as reasonably practicable and get

a confirmation of the same.

2. Any amount paid under the claim of „Delay of Checked-in baggage‟ regarding the

same piece of baggage will be deducted from the claim amount payable to insurer

under the claim of „Loss of Checked-in baggage‟

3. The Insurance Company‟s liability to make payment shall not arise until liability is

admitted and paid by the Airline in the form of compensation, supported by

documentary proof issued by Airline.

4. In case of the same baggage being covered under any other insurance, the policy will

contribute its ratable proportion.

10.6 Delay of Checked Baggage:-

Inclusions:- The Insurance Company shall pay to the Insured, the amount as a fixed allowance in

case the Insured shall encounter a delay in receipt of his/ her Checked-In Baggage due

to any reason, at the instance of the common carrier/ Public Carrier including

misdirection and mislaying beyond the minimum time as mentioned against the cover as

Deductible of the Policy Schedule from the time of arrival of the Common Carrier/

Public Carrier whilst on a Trip covered hereunder

The cover shall be applicable individually and independently in case of Trip involving

multi destinations en-route. In event of more than one incident of delay of Checked-In

Baggage during a Trip, the Insurance Company's overall liability shall be limited to loss

suffered by the Insured for only one of such incidents of delay of Checked-in Baggage,

or any other number of such instances as specified in the Policy Schedule. The amount

mentioned is for a single event of delay in case of a Single Trip or Two instances in case

of a Round Trip or the number of incidences as specified in the Policy Schedule,

irrespective of pieces of baggage delayed.

10.7 Hijack - Means any unlawful seizure or exercise of control, by force or violence or threat of

force or violence and with wrongful intent, of the Common Carrier/Public Carrier in

which the Insured is traveling.

Inclusions:- The Insurance Company shall pay the Insured a fixed amount as mentioned in the

Policy Schedule for every day spent by the Insured under hijack, in case the Common

Carrier/ Public Carrier in which the Insured is traveling as a fare paying passenger

forming a part of the Insured Trip shall be subject to Hijack. Compensation shall be

payable under this Cover provided that the Hijack is for more than 12 hours or for a

period more than specified number of hours, mentioned against the Cover as

Deductible in the Policy Schedule. Claim payout for one day shall be applicable also if

hijack has happened for more than 12 hours but less than 24 hours.

Insurance Company‟s liability shall not exceed the maximum number of days or the

maximum amount specified in the Policy Schedule.

Should death of the Insured occur during the period for which the Common Carrier/

Public Carrier with the passengers is held captive by the hijackers, such death of the

Insured shall be considered as a valid claim under Cover – „Personal Accident‟ under

the provision applicable to the death of the insured in an Accident. Such compensation

for death shall be independent of the Insured‟s eligibility for claim under this Cover.

10.8 Trip / flight Delay:-

Inclusions:- The Insurance Company shall pay a fixed amount to the Insured as specified in the

Policy Schedule if the departure of the scheduled common carrier/ Public Carrier is

delayed by more than the deductible duration specified in the Policy Schedule, at the

port at the Place of Origin of the Trip or any other port from where the Insured boards

the Common Carrier/Public Carrier within the Period of Insurance solely arising out of

and consequent upon any of the contingencies specified hereunder:

a) Delay of the Scheduled Common Carrier/ Public Carrier due to Inclement weather

at the port of origin or the port of destination

b) Delay of Common Carrier/ Public Carrier due to sudden strike or any other action

of the employees of the Common Carrier/ Public Carrier which disrupts services

c) Delay of the Common Carrier/ Public Carrier caused by equipment failure or

clearances of the Common Carrier/ Public Carrier

d) Delay of the Common Carrier/ Public Carrier caused by operational problems like

crew or staff scheduling issues etc.

e) Delay of the Common Carrier/ Public Carrier due to a Major Travel Event, Civil

Unrest, Riots or Commotion at the port of departure or the port of destination.

f) Cancellation or rescheduling of the flight at the instance of Common Carrier/

Public Carrier that causes delay.

The maximum liability of the Insurance Company under this Cover shall be the Sum

Insured as per the Policy Schedule. The Insurance Company's liability under this

Cover shall be limited to one delay encountered by the Insured for a single trip policy

and two delay instances in case of a round trip. For the purpose of this Cover, the

delay would be calculated as the difference between actual departure time and the

scheduled departure time of the Common Carrier/ Public Carrier. Actual departure

time is the time the Common Carrier/ Public Carrier leaves the Common Carrier/

Public Carrier station or air strip (wheels up) and departs. However, if the Common

Carrier/ Public Carrier informs the Insured regarding the delay in the departure atleast

6 hours or such time as mentioned in the Policy Schedule, in advance, then the

scheduled departure time would be considered as the revised time of departure as

communicated and not the initial departure time as mentioned

10.9 Personal Liability - Legal liability incurred by the Insured in his private capacity to pay Damages for

third party civil Claims arising out of Accidental Bodily Injury or Accidental

Property Damage occurring during an Insured Journey

Inclusions:- The Insurance Company shall indemnify the Insured, up to the Sum Insured of the

Policy Schedule, against legal liability to a third party arising during the Period of

Insurance or within 60 days from the Date of Expiry of Insurance as a result of :

a) Accidental Death or bodily Injury to any Third Party (Our liability in this case will

be limited to reasonable medical expenses incurred by the Third Party)

b) Accidental loss of or property damage to third parties

c) Accidental loss or damage to temporary holiday accommodation which is not owned

by insured arising on account of an Accident occurring whilst on a Trip anytime

during the Period of Insurance under the Policy for which claims shall be made on

the Insured by the third parties.

The Insurance Company shall also indemnify the Insured towards the cost of defense

incurred, with the consent of the Insurance Company. The Insurance Company‟s overall

liability, including the cost of defense for all claims during the Period of Insurance shall

not exceed the Sum Insured specified in the Policy Schedule.

10.10 Hospitalization daily Allowance - Means the amount and period specified in the Schedule

Inclusions:- If an Insured suffers an Injury due to an Accident or due to an Illness contracted whilst

on a Trip during the Period of Insurance, the Insurance Company shall pay to the

Insured a fixed daily compensation for a maximum number of days as specified in the

Policy Schedule for each continuous and completed period of 24 hours of

Hospitalization of Insured

i) The overall liability to make any payment under this cover is the maximum sum

Insured specified in the Policy Schedule, under this cover.

ii) The liability of the Insurance Company to make payment will only commence after

the Insured has been hospitalized for a period of more than 24 consecutive hours

10.11 Dental Treatment - Treatment carried out by a dental practitioner including examinations, fillings

(where appropriate), crowns extractions and surgery excluding any form of cosmetic

surgery / implants.

Inclusions:- The Insurance Company shall compensate the Insured for the Reasonable and

Customary Charges incurred for the Dental Treatment received by the insured to one or

more Sound Natural Tooth as a result of sudden acute pain and/or due to an accident,

provided the treatment shall commence within 24 hours of the time the acute pain first

occurs during a Trip abroad, undertaken within the Period of Insurance. In case of a

domestic travel, the Insurance Company will only compensate the Insured for

Reasonable and Customary charges incurred as a result of dental treatment on account

of accident occurring during the policy period, to relieve the Insured from acute pain.

Dental covers will be provided for Medically Necessary treatment of the tooth. Such

treatment should be provided by a Dentist qualified in practicing dentistry or dental

surgery, and the reimbursement for the medical expenses incurred shall not exceed the

Sum Insured for the coverage as mentioned in the Policy Schedule hereto.

10.12 Accidental death & dismemberment – common carrier

Inclusions:- Insurance Company shall pay to the Insured or nominee or legal heir of the Insured a

lump sum amount as mentioned in the Policy Schedule and up to the maximum

amount specified under this cover in case of Death, Permanent Total Disability or a

Permanent Partial Disability of the Insured arising out of and consequent upon an

Injury or accident encountered while the Insured is mounting into or dismounting from

or travelling in the Common Carrier/ Public Carrier as a passenger (fare paying or

otherwise) during the Period of Insurance.

Insurance Company will also cover disappearance of the Insured Person, following a

forced landing, stranding, sinking or wrecking of a common carrier/ Public Carrier

conveyance in which such Insured Person was known to have been travelling as an

occupant. It shall be deemed after 12 months, subject to all other terms and conditions

of this Policy that such person shall have died as a result of the accident. If at any time,

after the payment of the Accidental death benefit, it is discovered that the insured

person is still alive all payments shall be reimbursed in full to the insurance Company

10.13 Trip cancelation & Interruption

a) Trip cancelation –

Inclusions:-

The Insurance Company shall indemnify the Insured for the financial loss incurred by the

insured arising out of cancellation of the trip following unexpected events, upto before the

departure of the Trip solely attributable to and/or arising out of:

i) Sickness or injury which requires medical attention/consultation and the insured is

advised in writing by treating medical practitioner as unfit for travel. Death or imminent

death from an unforeseen illness or injury, quarantine of insured or any immediate

family member of insured or travelling companion of insured (insured in the policy for

the same itinerary and exact same trip duration)

ii) Personal contingencies like hijack, quarantine, kidnap etc. where the insured presence

required by judicial authority in the course of its proceedings during the period of

insurance.

iii) Natural Calamities of which insured were not aware at the time of purchase of the

policy like avalanches, landslides, floods, hurricanes, tornadoes, blizzards, cyclones,

volcanic eruptions, earthquakes, forest fire, tsunamis etc. at the place of residence of

insured or insured departure city or one of insured destination(s) as per itinerary.

iv) A Terrorism / Terrorist attack which occurs in insured place of residence or insured

departure city, or in a city which is a scheduled destination for Covered Trip provided

that the act of Terrorism occurs within 15 days prior to departure.

v) A Major Travel Event that prevents insured from travelling to one of insured

destination(s) in itinerary.

vi) In case of loss of passport due to theft/robbery/burglary etc. and reissue of new passport

has not happened prior to travel date.

vii) Advisory issued by the government of India not to travel or prevention of travel by

government of India.

Subject to the maximum liability of the Insurance Company as stated in the Policy

Schedule, the Insurance Company shall pay to the Insured:

1. The payments made for accommodation and travel in advance by insured which are

non-recoverable after initiation of cancellation of the same.

2. Official cancellation charges of accommodation and travel tickets paid in advance of

a proposed journey, if any;

b) Trip Interruption –

Inclusions:-

If the below mentioned circumstances cause a disruption to Trip of insured:

A) If trip of insured is disrupted and insured have to shorten trip and return directly to the

Home Country or the Country/ Port of Origin of the trip, due to -

a) Major Travel event which prevents insured from continuing with Scheduled trip

b) Insured suffer a serious injury or serious sickness and receive medical advice to

discontinue the trip

c) The air craft or vessel on which insured are onboard is hijacked

d) Due to an unexpected death or injury or sickness of Close Relative of insured or

Travel Companion of insured

e) In case of loss of passport due to theft/robbery/burglary etc.

Or,

B) If trip of insured is disrupted and insured have to remain Overseas before returning

directly back to Home Country or the Country/ Port of Origin

a) Due to quarantine upon medical advice which prevents insured from continuing with

Scheduled Trip

b) Due to insured, Immediate family member of insured or Travel Companion of

insured being confined in a Hospital whilst Overseas for more than 5 consecutive

days, or where Hospital confinement is less than 5 days, upon medical advice against

travelling, thus resulting in insured being unable to return from scheduled trip.

c) In case of loss of passport due to theft/robbery/burglary etc. (Applicable only to

international travel).

Insurance Company will reimburse upto the limits as specified in the Policy Schedule for:

a) Non-refundable expenses for air, land or sea travel through a common carrier/ Public

Carrier for the cancelled part of the trip

b) Any additional costs/expenses on account of air (economy class fares unless

specifically mentioned by the treating doctor only), land or sea travel through a

common carrier/ Public Carrier resulting from amendment of the existing tickets or

booking of new tickets in case the existing tickets cannot be amended.

c) Hotel accommodation expenses, per day tariff not exceeding that of the same class of

hotel initially booked for stay in the location where the peril has occurred, in case trip

is disrupted and Insured is to remain overseas.

10.14 Trip rescheduling/ Connection Flt Delay

Inclusions:-

The Insurance Company shall indemnify the Insured up to the Sum Insured amount as

mentioned in the Policy Schedule in case of failure of the Insured to access the connecting

flight/connecting journey through Common Carrier/ Public Carrier as per schedule, any time

during the Trip within the Period of Insurance, arising out of and consequent upon the delayed

arrival of the earlier flight/Common Carrier/ Public Carrier caused by reasons beyond the

control of the Insured, provided that, no claim shall be payable hereunder incase such delay is

foreseen by the Insured or that the Insured could have reasonably become aware of such delay

in advance. The delayed arrival should solely be arising out of and consequent upon any of the

contingencies specified hereunder-

a) Delay of the Scheduled Common Carrier/ Public Carrier due to Inclement weather at the

port of origin or the port of destination

b) Delay of Common Carrier/ Public Carrier due to sudden strike or any other action of the

employees of the Common Carrier/ Public Carrier which disrupts services

c) Delay of the Common Carrier/ Public Carrier caused by equipment failure or clearances

of the Common Carrier.

d) Delay of the Common Carrier/ Public Carrier caused by operational problems like crew

or staff scheduling issues etc.

e) Delay of the Common Carrier/ Public Carrier due to a Major Travel Event, Civil Unrest,

Riots or Commotion at the port of departure or the port of destination.

f) Cancellation or rescheduling of the flight at the instance of Common Carrier/ Public

Carrier that causes delay.

The Insurance Company shall reimburse the Insured:

1) The official cancellation charges, if any, incurred by the Insured resulting from

cancellation of the ticket by the Insured in relation to the Missed Connecting Common

Carrier / Public Carrier.

2) Additional cost of transportation to proceed with the journey originally scheduled to

have been covered by the Missed Flight/Common Carrier/ Public Carrier, provided that,

such additional cost shall be in relation to the scheduled destination and not to any

different destination and provided that the additional cost shall be for tickets of the same

class and / or type as of the Missed Flight/Common Carrier/ Public Carrier. For the

purpose of this Cover, additional cost means difference between the actual charges

incurred to proceed with the journey originally scheduled to have been covered by the

Missed Flight/Common Carrier/ Public Carrier and the amount obtained towards refund

of the Missed Flight/Common Carrier/ Public Carrier

A fixed benefit amount equivalent to the Sum Insured would be paid to the Insured in

the event of Missed Connecting Common Carrier/ Public Carrier.

Provided also that the Insurance Company shall be liable under this Cover only in event

of Missed Flight/Common Carrier/ Public Carrier caused solely by the delay of the

flight / common carrier/ Public Carrier in which the Insured is travelling immediately

prior to the Missed Flight/Common Carrier/ Public Carrier.

The Insurance Company‟s overall liability for claims of all occurrences of Missed

Flight/Common Carrier/ Public Carrier during the Period of Insurance shall not exceed

the Sum Insured specified in the Policy Schedule.

10.15 Compassionate Visit/return

Inclusions:-

In the event of the Insured being Hospitalized consequent upon any Injury sustained and / or

Illness contracted during the period of insurance at any place that is a part of the Trip covered

hereunder, other than the City of Residence and if such Hospitalization shall in the written

opinion of the Medical Practitioner attending on the Insured extend beyond a period of 5

continuous days, the insurance Company shall reimburse:

a) The cost of economy class air ticket incurred by the Immediate Family Member/ another

family member or friend, in case immediate family member are not available, from and to

the Place of Origin or City of Residence of Immediate Family Member for rendering

special assistance to the Insured during the period of Hospitalization within the Period of

Insurance, provided that the Insured doesn‟t have any other source of assistance in the

country/ location of visit. The reimbursement for the expenses under this Cover shall be

only for one Immediate Family Member or friends, as applicable, of the Insured.

b) Cost of boarding and lodging of the visiting member at the location of visit.

Insurance Company‟s overall liability under this claim shall not exceed the total SI specified

against this cover of the Policy Schedule.

Provided that:

1. The Hospitalization has been advised by the Medical Practitioner attending on the Insured

and such Hospitalization is admitted under Cover-„Hospitalization Expenses for Injury‟

or Cover- „Hospitalization Expenses for Illness and Injury‟; and

2. The need of such special assistance is essential in the written opinion of the Medical

Practitioner attending on the Insured and recommended by him / her accordingly.

The Insurance Company‟s liability under this Cover, however, in respect of any one event

or all events of Hospitalization during the Period of Insurance shall not in total exceed the

Sum Insured as specified in Policy Schedule.

10.16 Financial emergency assistance:- a situation faced by the Insured wherein the Insured Person

accidentally looses all or a substantial amount of Money (money, travelers cheque, debit

card, forex card or credit cards etc. issued in favor of the Insured).

Inclusions:-

If the Insured has suffered a financial emergency following incidents like theft/ robbery/

burglary of luggage/ money or hold up as a consequence of which the Insured is left without

any Travel Funds (Including and not limited to cash, travellers‟ cheque, debit/credit card, forex

card) whilst on an Insured Trip, the Insurance Company shall provide a daily amount as

mentioned in the Policy Schedule. The claim payment would be made for the remaining

number of travel days upto a maximum of 7 days or as specified in the Policy Schedule. In

order for the Insured to be covered under this cover, the incident leading to the loss of money

should be reported to police within 24 hours of it occurring and obtaining a First Information

Report (FIR).

The Insurance Company‟s liability under this Cover shall not be for more than one incident of

Financial Emergency during the whole Period of Insurance hereunder, irrespective of whether

the Policy is Single-trip Policy, Round-trip Policy or Multi-trip Policy. If the insured trip ends

prior to the specified no. of days, per day payout will be applicable only till the trip ends.

The Insurance Company shall not be liable for Financial Emergency arising out of any actions

on part of the Insured such as wager, lottery, gambling, betting, etc. Should it come to notice at

a later date after payment of compensation by the Insurance Company to the Insured that the

declaration of the Insured in connection with the Financial Emergency is false /

unsubstantiated; the Insurance Company shall be entitled to recover the sum paid hereunder in

addition to retaining its right of action against the Insured for damages.

There is a provision to credit the eligible amount in case of claim, in a pre-issued travel card or

any such financial instrument provided during policy issuance.

10.17 Loss of Passport:-

Inclusions:-

In the event the Insured loses or damages his/her original passport or international driving

license overseas due to robbery, burglary, theft or natural disasters etc. during the Trip covered

under the Policy, the Insurance Company shall pay to the insured a fixed benefit amount as

mentioned in the Policy Schedule

The Insurance Company's liability under this cover in relation to the loss shall be limited to the

Sum Insured specified in the Policy Schedule.

In event of more than one incident of loss during the period of Insurance, the Insurance

Company‟s liability shall be limited to only one such incident of loss.

10.18 Home Burglary/FIRE Insurance

A) Burglary (Home Contents)

Inclusions:-

The Insurance Company hereby agrees, subject to the terms, conditions and exclusions herein

contained or otherwise expressed herein, and subject to the maximum liability of the insurance

Company to pay to the Insured, at actuals, for any loss or damage sustained by the Insured

during the Period of Insurance caused by

i. Burglary of Contents of the Property insured and/ or

ii. Attempted burglary of the Contents of the property insured provided that the total liability of

the Insurance Company for such loss or damage shall not exceed the Sum Insured as stated

in the Policy Schedule.

The Insurance Company‟s liability under this Cover shall be limited as follows:

1. In case of damage due to attempted Burglary shall be limited to the amount actually payable

for repair or replacement of locks, damage to door, or windows, if any.

2. For settlement of claims under this Cover, the market value of the jewelry, gold ornaments,

silver articles and precious stones kept in the premises of the Insured shall be considered.

Maximum value of jewelry, silver articles, precious stones covered will be 25% of total Sum

Insured as specified in Policy Schedule.

3. The Insurance Company‟s liability for any claim for loss or damage shall be limited to the

inherent value of the metal or precious stones only, as the case may be, and will exclude any

additional value added thereon/attributable thereto due to the labour cost, transportation

expenses, etc.

B) Fire

Inclusions:-

In consideration of the Insured having paid to the Insurance Company the full premium

mentioned in the said Policy Schedule, the Insurance Company agrees, (Subject to the

Conditions and Exclusions contained herein or endorsed or otherwise expressed hereon) that, if

after payment of the premium the Property Insured described in the said Schedule or any part of

such Property be destroyed or damaged by any of the perils specified hereunder during the

period of insurance named in the said schedule, the Insurance Company shall pay to the Insured

the value of the Property at the time of the happening of its destruction or the amount of such

damage or at its option reinstate or replace such property or any part thereof

1. Fire

Excluding destruction or damage caused to the property Insured by

a. Its own fermentation, natural heating or spontaneous combustion.

b. Its undergoing any heating or drying process.

c. Burning of property Insured by order of any Public Authority.

2. Lightning

3. Explosion/Implosion

Excluding loss, destruction of or damage

a. To boilers (other than domestic boilers), economizers or other vessels, machinery or

apparatus (in which steam is generated) or their contents resulting from their own

explosion/implosion.

b. Caused by centrifugal forces

4. Aircraft Damage

Loss, Destruction or damage caused by Aircraft, other aerial or space devices and articles

dropped there from excluding those caused by pressure waves.

5. Riot, Strike and Malicious Damage

Loss of or visible physical damage or destruction by external violent means directly caused

to the property Insured but excluding those caused by

a. Total or partial cessation of work or the retardation or interruption or cessation of any

process or operations or omissions of any kind.

b. Permanent or temporary dispossession resulting from confiscation, commandeering,

requisition or destruction by order of the Government or any lawfully constituted

Authority.

c. Permanent or temporary dispossession of any building or plant or unit of machinery

resulting from the unlawful occupation by any person of such building or plant or unit

or machinery or prevention of access to the same.

d. Burglary, housebreaking, theft, larceny or any such attempt or any omission of any kind

of any person (whether or not such act is committed in the course of a disturbance of

public peace) in any malicious act.

e. If the Insurance Company alleges that the loss/damage is not caused by any malicious

act, the burden of proving the contrary shall be upon the Insured.

6. Storm, Cyclone, Typhoon, Tempest, Hurricane, Tornado, Flood and Inundation

Loss, destruction or damage directly caused by Storm, Cyclone, Typhoon, Tempest,

Hurricane, Tornado, Flood or Inundation excluding those resulting from earthquake,

Volcanic eruption or other convulsions of nature.

7. Impact Damage

Loss of or visible physical damage or destruction caused to the property Insured due to

impact by any Rail/ Road vehicle or animal by direct contact not belonging to or owned by

a. The Insured or any occupier of the premises or

b. Their employees while acting in the course of their employment.

8. Subsidence and Landslide including Rock slide

Loss, destruction or damage directly caused by Subsidence of part of the site on which the

property stands or Land slide/ Rock slide excluding:

The normal cracking, settlement or bedding down of new structures

a The settlement or movement of made up ground

b. Coastal or river erosion

c. Defective design or workmanship or use of defective materials

d. Demolition, construction, structural alterations or repair of any property of ground

works or excavations.

9. Bursting and/or overflowing of Water Tanks, Apparatus and Pipes

10. Missile testing operations

11. Leakage from Automatic Sprinkler Installations

Excluding loss, destruction or damage caused by

a. Repairs or alterations to the buildings or premises.

b. Repairs, Removal or Extension of the Sprinkler Installation.

c. Defects in construction known to the Insured.

12. Bush Fire

Excluding loss destruction or damage caused by Forest Fire.

PROVIDED that the liability of the Insurance Company shall in no case exceed in respect of

each item the Sum expressed in the said Schedule to be Insured thereon or in the whole the total

Sum Insured hereby or such other Sum or sums as may be substituted therefore by

memorandum hereon or attached hereto signed by or on behalf of the Insurance Company

10.19 PA Cover In India

Inclusions:-

The Insurance Company will pay the Sum Assured under Personal Accident cover in India

Section specified in the Schedule if the Insured sustains Accidental Bodily Injury during his

travel intended from home to airport on the day of overseas departure from India and on day of

his arrival back to India for his travel intended from Airport to home and such Bodily Injury

within 12 months of the date upon which it was sustained is the sole and direct cause of the-

i) Insured‟s death,

ii) Permanent Total Disablement,

Provided always that the policy will not pay under more than one of the foregoing sub

clauses in respect of the same accident and in excess of the amount stated in the schedule.

iii) The Insurance Company will be liable to pay 50% of the Sum assured stated in the schedule

in respect of the death of the insured Person if the insured person‟s age is under 18 years; to

be calculated at the time of effecting this insurance
