Motion by Blanchard to adopt Resolution # 121 approving Minnesota Department of Highway Plans for the improvement of Truck Highway # 35W within the limits of the Village of Mounds View and to adopt Resolution # 122 approving Minnesota Department of Highways special provisions identified as S.P. ' 6284-23,30 for the improvement of Truck Highway # 35W, within the limits of the Village of Mounds View. Seconded by Crane. 5 Ayes.

The Engineer had given his recommendation to approve both resolutions.

Motion by Sullivan to adjourn. Seconded by Crane. 5 Ayes. -- .,

The regular meeting of the Mounds View Village Council was called to order by Mayor Crane at 8:00 P.M., April 22,1963, at 2401 Highway # 10.

Meeting called to order by Mayor Crane @ 8:00 P.M.

Assessment hearing for water projects 1962-2 and 1962-3 opened by Mayor Crane.

Hodges entered at 8:05 P.M.

The Engineer presented copies of the figures used in determining the cost of the project and explained the reasons for the various costs for 1962-2. Front footage $2.67, Service Connection $108.63 Total project cost was $ 19,737.84.

The Clerk was instructed to notify the County Auditor, upon submission of the assessment role, of the change in assessment figures which now show total amount due.

The Mayor called three times for objections to the assessment. There were no objectors.

The portion of the hearing regarding project 1962-2 was closed by the Mayor. v

Motion by Hodges to adopt the assessment roll for water . , .'. /"- V project 1962-2 as presented. Seconded by Sullivan. 5 Ayes.

The Attorney explained the prepayment privileges and stated that the 30 day period would end on May 23, 1963.

The Engineer explained the costs of the 1962-3 project stating that the higher cost was due in the most part to the water problem$ encountered by the contractor. Front foot cost $4.26, Service Connection $ ~30.91. Total project cost was $32,783.98.

Mr. George Jackson, 8300 Highway # 8, stated that he felt the cost to him was quite excessive and requested a reduction in asse8sed~ footage. His land is unplatted farm land and there were no connection~ lines to his property. After much discussion, the Council determined that the land would probably be developed along the lines of the property across from his and therefore decided to adjust his assessable frontage to 200 feet.

The Attorney was instructed to prepare an agreement for Mr. Jackson to sign. Said agreement to be to the effect that property would only be subdivided as property across from it.

The Mayor called three times for obj'9ctors to the assessment There were no objectors. The Mayor closed the hearing.

Mr. Jack Bell requested that the Council seriously try to set up a Municipal Court in Mounds View either as a joint Municipal Court

__ or alone if necessary. - - Mr. Blanchard and Mr. Sullivan were appointed to figure out cost estimates for Council study and to contact the New Brighton Council for,. po.s..sible ~ joint court.

Mr. James Moinicken, 7200 Knollwood Drive requested a special permit to allow his unlicensed cars to remain on his property.

)1 The Police Department will investigate this and no action will

be taken until after the next regular meeting.

Mr. D. R. Mueller requested approval of a preliminary plat for subdivision. After much discussion the following action was taken:

Motion by Blanchard to approve preliminary plat for D. R. Mueller subject to dedication of 30feet along the South side for the North ~ of Woodale Drive~ from Fairchild to Red Oak Drive and for the extension of Longview dedication to South end of sub-division. Seconded by Malvin. 5 Ayes.

Mr. D.R.Mueller requested streets(Red Oak. and Longview) water service and storm sewer on this sub-division.

The Engineer was instructed to prepare preliminary report on these requests.

The Civil Defense Director, Mr. Jackson, requested some proof of insurance coverage for the Civil Defense men while working for the Village. Mr. Sullivan will investigate and report to the Council.

Mayor Crane reported that scales for weighing trucks were available for village use andpurchage of them would be an unnecessary

expense to the Village.

The Clerk was instructed to notify the firm that the Council would give favorable consideration to the relocation1of said building, but feels that this is a matter to be settled by those concerned and not the Council.

The next meeting of the Ramsey County League of Municipalities will be held at the Mounds View Village Hall on April 24,1963.

A letter from Mr. D.R. McFadden, acting District Engineer for the Highway Department regarding extension of County Road H was read and filed.

Mr. Don Hodges presented the financial statement from the Little League. (on file) Mr. Sullivan to notify president of said organization to make requests for monies before October 1, 1963 to enable us to budget properly for this worthwhile activity.

The minutes of the Lakeside Park Commission were read and filed.

The Clerk was instructed to prepare specifications for the County Engineer for repairs to Eastwood Road, North end of the Village.

Minutes of the Planning Commission were read and filed.

Motion by Malvin to hire Dan Gross-2175 Sherwood Road as part time custodian at a salary of $1.50 per hour. Seconded by Sullivan.

Mr. Skiba reported on a closed corporation cock at 7060

( ) Kn.o~lwood Drive. This was referred to the Engineer for collection of bill from Clark and Moore to open same. This was part of Lamettis project and is still under bond.

Motion by Sullivan to allow Engineer to do required work for staking of drainage area near Bronson and Groveland Road at no expense to the Village. Seconded by Malvin. 5 Ayes.

The Engineer reported that after testing soil in Hillview Park tbat it was his opinion that a sump drainage system would not work in the Hillview Park.

The Engineer presented a preliminary drainage system f or Hillview Park that would cost approximately $3,000, but Mr. Hodges stated that this was not the system that was discussed at the last meeting. The Engineer will present another open-ditch drainage proposal to follow Long Lake Road.

The Engineer showed drawing incorporating future village storm sewers with the Judicial Ditch #1 for future construction.

A resolution modifying certain assessments was presented by the Attorney. Motion by Crane to adopt Resolution # 123 Seconded by Blanchard. 5 Ayes.

The Attorney reported that after much investigation he could \ find no authority or grounds for allowing D. W. Hickey Company a l larger amount of money tha~ the firm bid for Pump and Well House #2.

{The firm had requested the Council to increase the amount as a portion of their work had not been figured in the bid.}

The Council agreed property to the contractor stipulations:

1. Engineer will set grade level in relation to proposed frontage road.

2. Inspection will be made to determine if grade has been maintained after completion of removal of fill.

Motion by Blanchard to pay bills submitted totaling $5,409.67. Seconded by Sullivan. 5 Ayes.

Motion by Blanchard to approve licenses subject to Bonds and Insurance from applicants. Seconded by Sullivan. 5 Ayes.

Motion by Crane to issue temporary permit to Mr. Boe 2111 Terrace Drive for storing of vehicle in violation of Ordinance # 92 until April 25, 1963. Seconded by Sullivan. 5 Ayes.

The Clerk presented copies of the C.P.A. Audit to each Council member and to the Village Attorney.

The Clerk was directed to make copies of the C.P.A. letter of recommendation of bookeeping practices for each councilman.

The next agenda meeting will be May 6, at 5:00 P M.

The Clerk was instructed to notify the Ladies Auxiliary to VFW Post 6889 that their request for the meeting hall on Tuesday evening was denied because of other uses for the hall on that night.

Motion by Malvin to adjourn. Seconded by Blanchard.

Mr. Frank Geer representing the Cross of Glory Lutheran Church raised several questions regarding the late hook-up fee. Motion by Blanchard to set public hearing for the extension of water service and the improvement of roads in the Mueller Addition based on the Engineers preliminary report. Hearing to be May 27, 1963 at 9:00 PM. Seconded by Sullivan. 4 Ayes.

Motion by Sullivan to approve final plat for Mueller Addition and authorize Clerk and Mayor to sign same. No building permits will be issued prior to arrangements for financing of public improvements in addition. Seconded by Blanchard. 4 Ayes.

A f ormal request was filed with the Clerk requesting water and street improvements in Mueller Addition.

Malvin entered at 9:45. P.M.

) Mr. Jim Olson, Fiscal Agent, will present his complete

report and rec ommendation to the Council at the Agenda Meeting on May 20, 1963 at 5:30 P.M.

Motion by Sullivan to have the Village Treasurer contact Ramsey County relative to getting an advance on taxes collected by them for the Village. Seconded by Blanchard. 5 Ayes .

The Engineer presented the second preliminary plan for drainage of Hillview Park. (on file)

A copy of a letter from the Engineer to Ramsey County requesting work on Village roads was read and filed.

A resident on Fairchild Avenue will be advised by Mr. Skiba that his present curb stop is in the location he requested and there would be a new connection charge for a new curb stop.

The Engineer reported on the following items: 1. Corporation stop IT'issing on Knollwood Drive. Bill for

same sent to Lametti Construction. 2. Peat on north side of Hillview project and conditinn

of Oakwood Park will be watched and reported on at regular meetings. 3. The surfacing of the Hillview project will be checked

against the contract and report made at next meeting. \ The matter of a blocked drainage ditch in Jackson-Hillview

( ) area will be taken care of under authorization given to Mr. Skiba,

Motion by Sullivan to hire additional employees t o assist in cleaning above mentioned ditch. Wages to be $1.50 per hour. Seconded by Blanchard. 5 Ayes.

The Council approved the request of the Skelly Oil Company to omit the shrubbery from the plans for their station on Gr oveland and Highway # lOa

Motion by Blanchard to concur with the Building Inspectors r ecommendation and allow construction of a screen house at 7940 Gre enfield Avenue. Seconded by Crane. 5 Ayes .

Mr. Skiba was directed to notify owner of home at 7630 Spring Lake Park Road that approval of water system for his home will be denied until .drainfield in his front yard is moved further fr om wat'er line.

A notice will be published advising the citizens that a permit is required before water service is to go from curb stop to home.

A letter from the League of Minnesota Municipalities re­garding action contemplated by State Legislature was read:

The Police report f or April was read and filed. A letter from the Chief of Police regarding Officer Kardell

was read and filed. Motion by Crane to concur with Police Chief and Police Commission recommendation and raise Officer Kardells salary t o $100.00 per month. Seconded by Malvin. 5 Ayes.

Motion by Crane to advertise for two men to read all water meters between June 15 and June 30, 1963, at 25¢ per meter. Clerk's Office to hire. Seconded by Blanchard. 5 Ayes o

Mr. Sullivan~gave a brief report on a meeting with members of the Council of the Village of New Brighton regarding a joint munici pal court and requested that the full council and Village Attorneys attend a meeting on June 19. 1963 8:00 P.M. at the New Brighton Village Hall. (If time is O.K. call Mayor Sweezo)

Motion by Crane to refund t o Mr. Moe $250.00 placed with the Village as a bond for his house moving. Seconded by Sullivan. (See minutes of September 24, 1962 ) 5 Ayes.

The Attorney f or the contractor of Pump House # 2 will be ) at the next regular meeting.

The street lighting contract was returned to the Council by the Attorney with his approval of contract.

The minutes of the Lakeside Park Commission were placed on file.

The assessment for the land purchased for completion of Hillview Road project was referred to the Attorney.

A copy of a summons and complaint against the electric contractor on water utility building was referred to the Attorney.

The Mayor reported that bids were opened and contracts let for 35W, with work to begin June 3, 1963.

PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW

The regular meeting of the Mounds View Village Council was called to order by Mayor Crane at 8:00 P.M. May 27, 1963 at 2401 Highway # 10.

Mayor Crane opened the public hearing to rezone lots 16 J through 22, Block 5, Pinewood Terrace # 2 from R-IA to B-3. This

( \ property located on the North side o~ HiQhway # 10, Ea~t o~ Edgewood )Drive to be used for a ballroom, med~cal center and dr~ve-~n rest aurant. Mr. Eastman, the owner of the property,explained that

future development of this area could only be in commercial building. He proposed to build a ballroom 120' by 150' with wings. He introduced Mr. E.L. (Bud) Rademeker who intends to manage the ballroom. Mr. Milt Stole explained the Planning Commission Views - this area more purpoiefully used as B-3.

Mayor Crane asked for comments from any person favoring or opposing this rezoning.

Mr. Ernest Gustafson - 2225 County Road I - in ·favor of rezoning this would increase the value of his property across the street.

Mr. Wendall Erickson - 5319 St. Stephens - in favor of Industry recommended screening with a strip of land between commercial and residential zones.

Mr. John Radway, 5336 St. Stephens - in fav·or of conditional and partial zoning and objected to complete rezoning of entire area.

The Mayor declared the hearing closed. Action by the Council will be delayed until later in this meeting.

Motion by Hodges to approve the minutes of May 13, 1963 meeting as presented. Seconded by Sullivan. 3 Ayes. Motion Carried.

At 9:00 P.M., Mayor Crane opened the Public Hearing for improvements of a Mounds View Water Main Extension, Street Grading, ~ haping and surfacing and the installation of surface drainange structure lor Red Oak Drive from County Road H-2 to 330' North of Woodcrest Drive dnd for Longview Drive from ·Red Oak Drive back to Red Oak Drive. This was petitioned by the owner, Mr. D. Mueller.

Mayor Crane asked for comments from those who favored or opposed this improvement.

) property on the East side of Red Oak Drive - stated he didn't object however it was too soon to decide at this time, would . need a couple of weeks to decide. The Engineer explained the estimated cost of this project and where the improvements would be constructed. Estimated water and road per front foot - $5.50. ($3.15 water, $1.35 road)

The petitioner, Mr. Mueller, stated that a two week recess would not adversely affect his plans. Mayor Crane delcared the hearing closed and that formal action would be delayed until the June 10 meeting. The Mayor asked Mr. Mueller to contact H. Schroeder, 5159 Long Lake Road and W. Karjalahti - 5092 Longview Drive to appear.

Mr. Malvin entered at 9: 15 p.m.

The Eastman rezoning hearing was reopened. Motion by Crane to rezone Lots 16 through 22, Block # 5, Pinewood Terrace # 2 to B-3 except the easterly 210'. This rezoning is subject to the application and the issuance of the building permit. Seconded by Hodges. 4 ayes. Motion Carried.

Request from A. E. Barrett, 8375 Groveland Road for a special use permit to allow him to park and live in a Mobile home to care for Mr and Mrs. Hanley. Motion by Malvin to approve permit for six months. Seconded by Sullivan. 4 Ayes. Motion Carried.

'). Request for special use permit by Carl W. Shellum, 8132 Long Lake Road to allow him to have two ponies and use a stable located less than 150' set back as required.

Motion By Crane to waive the requirements of Section 5.2-3E of Ordinance # 67 and issue a special permit for one year for two ponies as stated in application. Seconded by Sullivan. 4 Ayes. Motion Carried.

Request by V.F.W. Post Auxiliary # 6889 to use the Village Hall once a month, signed by Mrs. E. Pierce, 5372 St. Stephens Street, Mrs. M. Nelson - 5373 St. Stephens Street and Mrs. J. Schmid - 2119 Terrace Drive. The Council declared that Tuesday evening would interfer with Justice Court and recommended some other night.

Mr. Kuiken requested a permit t o park four sod trucks behind the house at the corner of Spring Lake Park Road and County Road J. The Council stated definite opposition to this request.

Mr. Fred J. Rudolph - 8084 Fairchild Avenue requests sub-division with one sub-standard lot becuase of the location of his house.

Motion by Malvin to accept the preliminary plot plan and sub-division request of F.J. Rudolph and allow Lot #3 to be 73' and to waive square foot requirements. Seconded by Hodges. 4 Ayes.

Mr. Milton Sawyer - 7151 Knollwood Drive stated he had water in his basement. The Council requested Engineer . to present

( \~lans for storm drainage in the area of Woodale Drive and County J~oad H-2, The Engineer should also submit an estimate of the State

Aid Funds available for Village use.

Mrs.Florence Peterson - 2277 Knoll Drive complained of the condition of Knoll Drive stating that there was sand in the street and areas of the street were broken up.

Mrs. Betty Wall, 5425 Quincy Street Director and Mounds View representative to the North Suburban Hospital District submitted a resolution to allow the City of Coon Rapids to detach from the North Suburban Hospital District. Motion by Malvin to adopt Resolution # 126 to allow Coon Rapids to detach from the North Suburban Hospital District. Seconded by Hodges. 4 Ayes. Motion carried.

Mrs. Eleanor Bacon - 2265 Highway # 10 requested the Council to allow Northern States Power to deliver wood chips to their residence. The Council approved permit. Mrs. Bacon also requested a ditch to be dug at the corner of Eastwood and County Road I to allow proper drainage. The Public Works department was directed to check area.

Mr. Ervin Herbst - 8180 Eastwood Drive request to rezone a p~rtion of land south of Highway # 10.

Motion by Crane to set a Public Hearing for June 10, 1963 \for Stella Skiba and Ervin Herbst subject to the receipt of list of )p~operty owners by May 30, as well as the receipt of application . ~nd fees. To be reioned from R-IB to B-3 for supper·club.. .

. The Planning Commission to.be requested to hold a special meeting before June 10, 1963. Seconded by Sullivan. 4 Ayes. Motion Carried.

The Fiscal report from :J. Olson was reviewed. Motion by Hodges to authorize the Clerk to advertise for bids for the Sale of Public Improvement Bonds for the amount of $130,000.00 at 7:30 p.m. for the 24th day of June. Seconded by Sullivan. 4 Ayes. Motion carried.

Motion by Crane to authorize the Village Treasurer to arrange a loan for $40,000.00 and authorize the Mayor and the Clerk to execute a warrent for that amount. This sum to be used to pay the Engineer for parital payment of sewer planning. Seconded by Hodges. 3 ayes, Malvin abstained because he had not been present during the discussion on this item.

Mayor Crane read the minutes of the Police Commission meeting of May 23. Motion by Crane that the Police car should not be used for routine messenger service except for money to the bank, election details or emergencies. The Clerk or other persons driving on errand should be authorized to collect .07 per mile. Seconded by Hodges. 4 Ayes. Motion carried.

\ The suggested need for malfeasance liability insurance for the Police Officers should be referred to the Deputy Clerk, Attorney Meyers, and Chief Grabowski for recommendations.

Mayor Crane reported that the entire Village had been sprayed against canker worms at a cost of $555.00.

(" )park. 2. Letter from Twin City Arsenal, in reference to sewer connection to their system, "No further commitment to any parties at this time. 1I

3. Proposed Ballroom Ordinance be referred to the June 3 Agenda meeting at 5:30 p.m., 4. Request received from Skelly Oil Company - fence for their station to be set back 15' from Groveland Road and 30' from Highway # 10. The Council agreed to this set back. 5. An incident where a youth bought a package of cigarettes from a ciagrette machine.

Donald Hodges reported the park schedules. Hillview Park was being leveled off and that the back stops were installed on Lambert and Greenfield Parks.

Perry Malvin reported that a Mounds View representative is needed on the Lakeside Park Commission.

Motion by Malvin to adopt Resolution # 127 relating to "Sanitary Sewer Disposal Plan 3-A as formulated; by the North Suburban Sanitary Sewer District.". Seconded by Crane. 4 Ayes. Motion Carried. Perry Malvin announced that the NSSSD Board of Trustees Public Hearing will convene the meeting at the Spring Lake Park School on May 28th, 8 :00 p.m. and will immediately recess the mee,ting and reconvene the same at the Blaine School. \. 1 John Sullivan reported receivirig" "the workmen's compensation insurance covering appointed officials. Sullivan answered questions about the removing of sand and filling of holes on Village streets,

Mayor Crane read a letter from Representative R.O.Ashbach thanking us for the telegram regarind Home Rule.

Letter from Chief Grabowski stating the Mounds View Police will patrol Lakeside Park during the odd hours.

Milt Stole read ' minutes of the Planning Commission meeting of May 21, 1963~ The Clerk's Office was instructed to write Mr. Joe Foley requesting him to appear at the next Planning Commission meeting.

Building Inspector, Chris Piehowski, reported on a condemned home on Long Lake Road and Hillview. The Council agreed with him that all requirements must be met before any person could live in it. Skiba reported that the Hillview ditch was cleaned.

Discussion by Skiba about doubtful office proceedings, about telephone calls being monitored, and about heavy work load. Motion by Sullivan to instruct the Clerk's Office to put a notice in the paper to hire an inspector, a journeyman plumber is desired on a fee bases for plumbing, heating, well and sewer work. Seconded

Clerk Blanchard is instructed t o review the inspectors report form and other office procedures. About telephone call, it is the duty of the Clerk's Office to find out who is on the phone and what information is requested so that the proper person is notified.

Recommended
