Subject: 2017-2018 Strategic Plan Update

Issue The presentation tonight it to just do a short check-in on the 2017-2018 Strategic Plan.

Background As the Council remembers, we created a two-year Strategic Plan after a retreat in February 2017, and presented that to the Council in July 2017. In February 2018, we did a review of 2017 and a preview of 2018, adding some additional strategic goals for this year.

As we reach the 75% point of the two-year cycle for 2017-2018, I’d like to briefly check-in with the Council with an update. I really don’t expect the Council to try to add additional items to this Strategic Plan at this point in time, but just react to where we are and how we are doing. I have incorporated the 2018 goals added in February 2018 into the Strategic Priorities, and have updated accomplishments, as well, to the best of my ability.

Conclusion No action is required with this item, as it is for discussion purposes.

3) Gene Lehner ParkCommunity Development Director Abel presented the packet item dated May21, 2018.Highlights included:

The playground is proposed to be replaced as part of the 2018 ParksCapital Improvement Plan.

With the new playground equipment, the park would need to be incompliance with ADA.

To bring the park into ADA compliance, this would be an additional costthat was not budgeted for.

There was discussion on bringing the park up to ADA compliance.

Mayor Whalen suggested that the City apply for the Hennepin County Sports grant to help pay for the playground equipment and use the allocated funds to help pay for the ADA compliancy.

There was discussion on moving a different park forward to this year’s project list and not do anything at Gene Lehner Park this year, moving it to next year’s project list.

There was discussion on the condition of the existing playground equipment and whether it is a safety concern.

Peters stated the City should put together a plan to make the park ADA compliant. Consensus of the Council is to hold off doing any park project this year, apply for the grant from Hennepin County, save the money that was allocated this year and use it next year. Council directed Staff to start on a feasibility study to see what would be needed to make Gene Lehner Park ADA compliant, including a possible with a site plan with a playground pad.

2) MSAS 101 / Special Assessment Policy City Engineer Hornby overviewed the power point presentation that was included in the Work Session packet dated May 21, 2018. Highlights included:

Community Development Director Abel presented the staff report found in the City Council Packet dated May 21, 2018. He overviewed the proposed Ordinance that would prohibit Short-Term rentals.

Highlights included: “Vacation Rental” or “VRBOs” (vacation rental by owner) involve the

lodging of guests in traditional single-family neighborhoods, usually in typical single family homes.

The draft Ordinance 453 would add language to the City Code clarifying the existing prohibition on the use of residential property for the commercial purpose of short term rentals.

Early in 2017, The Council first discussed this topic at a work session meeting. In early 2017, there was no action taken at that time. Recently, short term rentals have been brought to the attention of the Council and again it was discussed at a February 2018 work session. Council directed staff to begin working on a draft ordinance regarding the prohibition of short term rentals. On March 26, 2018, the draft ordinance was presented to the Planning Commission. They continued the Public Hearing to their next meeting on April 23, 2018. At that meeting, 17 people spoke during the Public Hearing.

Planning Commission recommended to the City Council to Adopt Ordinance No. 453 with a vote of 4-3. They also recommended giving the existing property owners the opportunity to close out the 2018 rental season.

There are potentially 19 homes being used as short term rentals. Council directed staff at the May 7, 2018 to bring back an Ordinance that

will still prohibit Short term rentals with some exceptions.

City Attorney Batty overviewed the new proposed ordinance. He did recommend a minor wording change to Section 1(b) (3c) Enforcement, stating that a short-term rental of any dwelling may be a public nuisance. Mayor Whalen had concerns with how someone would comply with the residency

compliance. She does not want to create an Ordinance for the use of only one resident. She stated that if the new proposed ordinance would be adopted and the council decided to change it at a later date, all of the owner-occupied short-term rentals would be grandfathered in. She is in favor of the original ordinance that was proposed at the May 7, 2018 meeting with an implementation date of December 31, 2018. Mortenson has concerns with safety issues. She is in favor of the original Ordinance that was proposed at the May 7, 2018 meeting with an implementation date of December 31, 2018. Molitor commented on the potential devaluation of property values if the city allowed short-term rentals. He is in favor of the original Ordinance that was proposed at the May 7, 2018 meeting with an implementation date of December 31, 2018. Tschumperlin had concerns with house swapping. He would still like to see an owner-occupied provision in the ordinance. He also agreed that the original Ordinance that was proposed at the May 7, 2018 meeting with an implementation date of December 31, 2018 would be the better of the two ordinances with adding “may constitute a nuisance” in the wording of the enforcement section of the Ordinance. Motion by Molitor, seconded by Mortenson to Adopt Ordinance No. 453 that was originally presented at the May 7, 2018 council meeting, adding the verbiage to Section 1(b)(3c) to include “may constitute a public nuisance….” or similar language.

Community Development Director Abel presented the staff report found in the City Council Packet dated May 21, 2018. He overviewed the application for the CUP and Variance. Highlights included:

The City Council reviewed this request at their May 7, 2018 meeting. There was a vote of 3-2 to deny the lakeshore setback variance and a vote of 4-1 to deny the conditional use permit.

Motion by Mortenson, seconded by Molitor to adopt Resolution No. 85-18 DENYING a Conditional Use Permit and a Lakeshore Setback Variance from 75 feet to 20.4 Feet to allow the Construction of a Ground Mounted Solar Energy System at 7091 Halstead Drive.

Motion carried 4-0. Absent: Bruce. c) Res. No. 86-18 Approve Professional Services Agreement for the 2018 Mill and

Overlay Improvements, CP 02-18 City Engineer presented the staff report found in the City Council Packet dated May 21, 2018. He overviewed the service that will be provided for the 2018 Mill and Overlay Improvements.

Highlights included: The following roadways for the 2018 Mill and Overlay Project will be: Burl Oaks

Court, Burl Oaks Drive, Hunters Court, Pheasant Crossing and Glacier Court. Additional improvements include: replacing the existing pavement and concrete

Proposed fees for Preparation of Bid Documents and Bidding Services are an hourly not to exceed basis in the amount of $24,100. Proposed fees for Construction Services are hourly estimated to be $27,200. The total proposed fee for the preparation of Bid Documents, Bidding Services, and Construction Services is estimated at $51,300.

There was discussion about the ADA compliancy at City Hall.

There was discussion on the sidewalk on the east end of City Hall and whether it should remain a sidewalk or possibly put in a small retaining wall. There was discussion on how the cost of the services would be divided up amongst the different funds, to make sure they are allocated correctly.

Motion by Mortenson, seconded by Tschumperlin to adopt Resolution No. 86-18

Authorizing preparation of plans, specifications, bidding, construction and professional services for the 2018 Mill and Overlay Improvement Project and Appurtenant Work with an estimated cost of $51,300.

Issue:

Each election year, the City Council is required to enter into Polling Place Agreements with the property owners where elections are to be conducted.

Background:

The City of Minnetrista has established four (4) precincts and is using Minnetrista City Hall for Minnetrista Precinct 2A and the Minnetrista Police Training Facility for Minnetrista Precinct 4A.

The City has, in the past, used two additional non-municipal buildings for the other two precincts. Freshwater Community Church, Minnetrista Precinct 3A and Westonka School Administrative Office, Minnetrista Precinct 1A both meet all statutory requirements and is ADA compliant.

Discussion:

The City has sent letters to both Freshwater Community Church and Westonka School District requesting the use of their location to conduct elections for the Primary Election on August 14, 2018 and the General Election on November 6, 2018.

Staff recommends entering into the Polling Place Agreements with both Freshwater Community Church and Westonka School District for the use of their facilities on both election days.

Fiscal Impact:

The City does not compensate these locations for the use of their buildings. Freshwater Church and Westonka Schools donate the use of their buildings.

Issue: The City Council adopted Ordinance 453 on May 21, 2018. Ordinance 453 prohibits the use of property within the City for short term rentals. The ordinance is two pages in length and would be rather expensive to publish in its entirety. An ordinance must be published in the official city newspaper before it can become effective. MN Statutes allows for publication by title and summary in the case of lengthy ordinances. Staff has prepared the attached resolution which includes a clear summary of the intent and effect of Ordinance 453. Authorizing publication by title and summary will save the city on the cost of publication.

As discussed by the City Council, Ordinance 453 will take effect after publication for all new short term rental properties. Those properties previous noted in past staff reports will be allowed to continue until January 1, 2019.

Recommended Action: Motion to adopt Resolution No. 77-18 authorizing the publication of Ordinance 453 by title and summary.

CITY OF MINNETRISTA COUNTY OF HENNEPIN STATE OF MINNESOTA

AN ORDINANCE PROHIBITING SHORT-TERM RENTALS WITHIN THE CITY OF MINNETRISTA

THE CITY OF MINNETRISTA HEREBY ORDAINS:

Section 1. The City Council of the City of Minnetrista hereby amends Chapter V, Section 505.07 of the Minnetrista City Code by adding a new subdivision 16 to prohibit short-term rentals within the City as follows:

Subd. 16. Short-term rentals.

(a) Definitions. In addition to the definitions contained in Section 505.01 of this Code, thefollowing definitions shall apply to this subdivision.

(1) Operator means the person or enterprise, or its agent, who is the owner of adwelling, which is being offered for rent to transients, whether such person’s ownership interest in the property is as the owner, lessor, lessee, sub-lessee, mortgagee-in-possession, licensee, or any other interest. Where the operator performs their functions through a rental agent, the managing agency or the rental agent has the same duties as the operator hereunder.

(2) Rent means the compensation, in money or other consideration, given in exchangefor the occupancy, use, or possession of real property which is charged, whether or not received, of property.

(3) Short-term rental means any temporary occupancy of a dwelling that is offeredfor rent to a transient for fewer than thirty (30) consecutive calendar days.

(4) Transient means any person who, at their own expense or at the expense ofanother, exercises occupancy or possession, or is entitled to occupancy or possession, by reason of any rental agreement, whether in writing or otherwise, concession, permit, right-of-access, option to purchase, license, time-sharing arrangement, or any other type of agreement for a period of fewer than thirty (30) consecutive calendar days.

(b) Short-term rentals prohibited.(1) Purpose. The City finds that short-term rentals constitute a commercial use of

residential property, which conflict with the fundamental character of residential zoning districts, disrupt the residential character of neighborhoods, and have a negative impact on the livability of residential neighborhoods. The City further finds that, while short term rentals are prohibited under the current provisions contained in the City Code, an ordinance amendment clarifying those regulations is necessary. The City has received complaints from residents regarding short-

term rentals, including but not limited to complaints related to noise, over- occupancy, and illegal parking. To ensure adequate housing options for residents, preserve the residential character of the City’s residential districts, preserve property values, and reduce land use conflicts, the City determines, in furtherance of the public health, safety and general welfare, that it is necessary to limit short-term rentals to hotels, motels, lodging establishments, and similar accommodations which are appropriately licensed, zoned, and which have the appropriate infrastructure and services for such short-term use.

(2) Prohibition. Short-term rental of any dwelling to a transient for less than thirty(30) consecutive calendar days in a residential zoning district is prohibited. State licensed hotels,motels, and lodging establishments located in areas where permitted by the City’s land useregulations are allowed, pursuant to all applicable law and rules.

(3) Enforcement.

a. An owner, operator, tenant, or occupant of any building or property inviolation of the provisions of this section may be charged and found guilty of amisdemeanor and may be held responsible for the cost of enforcement in additionto penalties.

b. The City may exercise any and all remedies at law or in equity to ensurecompliance with this section. All unpaid costs, charges and penalties may becertified as a special assessment levy against the property.

c. The City hereby further declares the short-term rental of a dwelling mayconstitute a public nuisance pursuant to Section 1510.07 of the Minnetrista CityCode. The City may take actions to abate such nuisance pursuant to Section 1510of the Minnetrista City Code and applicable state law.

(c) Implementation. In an effort to minimize the disruption of the adoption of this ordinance,the City shall not take any enforcement actions related to short-term rentals until December 31,2018.

SECTION 2. This ordinance shall take effect following its adoption and publication.

Overview: Matthew Mosher (the “Applicant”) has made an application for a variance from the required 75 foot lakeshore setback to allow for a lakeside home addition to be constructed 72 feet from the lakeshore on the property located at 4595 Merrywood Lane (the “Property”).

Background: Staff met with the Applicant and Andy Johnsrud, from Lecy Brothers, to discuss possible improvements to the side of the home facing the lake. The meeting took place in advance of the Applicant owning the Property. At the meeting, the Applicant was informed that a variance would likely be required to pursue any addition onto the lakeside of the home. With this understanding, the Applicant proceeded to purchase the Property in April of 2018. The Applicant has worked with Lecy Brothers to develop a proposal that has been scaled back as much as possible to minimize the variance request.

Variance Request: City Code Section 505.05 Subd. 9 allows the City to issue variances from the provisions of the zoning code. A variance is a modification or variation of the provisions of the zoning code as applied to a specific piece of property. A variance is only permitted when:

a. The variance is in harmony with the general purposes and intent of thisordinance.The purpose and intent of the city’s zoning ordinances is to ensure the orderly andharmonious development of property and to minimize the conflicts amongdifferent land uses while protecting the general health and welfare of the residentsof the city. While the variance request is from the required lakeshore setback, theproposed addition does not encroach upon the riparian view shed setback whichprotects the lake views of neighboring properties. Protecting neighboringproperty owner’s lake views is important in ensuring orderly and harmoniousdevelopment which is part of the general health and welfare of the residents.

b. The variance is consistent with the comprehensive plan.An element of the Comprehensive Plan is the protection of natural resources andneighborhood design and views. Effective land use planning requires acomprehensive understanding of the physical features, natural resources, andenvironmental limitations of the land. The natural environment of Minnetrista ishighly valued by its residents and is considered superior in its quality anddiversity. Minnetrista’s superior environmental qualities are evident, and the needto protect and preserve these qualities is equally evident. The proposed variancedoes not result in impacts to any steep slopes or require the removal of anysignificant trees. A 72 foot setback is not uncommon in Minnetrista and thatdistance should also protect the lakeshore. The proposed variance also does notimpact neighboring property owners views as the proposed addition is wellbehind the riparian view shed setback.

A variance may be granted when the applicant establishes there are practical difficulties in complying with this ordinance. Practical difficulties, as used in connection with granting a variance, means:

1. The property owner proposes to use the property in a reasonable manner notpermitted by this ordinance.This factor means that the landowner would like to use the property in a particularreasonable way but cannot do so under the rules of the ordinance. It does notmean that the land cannot be put to any reasonable use whatsoever without thevariance. The Applicant is proposing an addition onto the lake side of theexisting home. The purpose of the proposed addition is to enhance the currentlayout and functionality of the home and to improve the livability of the home,which is a reasonable manner.

2. The plight of the landowner is due to circumstances unique to the propertynot created by the landowner.The uniqueness generally relates to the physical characteristics of the particularpiece of property, that is, to the land and not personal characteristics orpreferences of the landowner. When considering the variance for a building toencroach or intrude into a setback, the focus of this factor is whether there isanything physically unique about the particular piece of property, such as slopingtopography or other natural features like wetlands or trees. A physical limitationof the Property is the location of the existing home. The existing home does notcurrently meet the required lakeshore setback, which is a unique situation the newhomeowner’s did not create themselves.

3. The variance would not alter the essential character of the locality.Under this factor, consider whether the resulting structure will be out of scale, outof place, or otherwise inconsistent with the surrounding area. The proposedaddition will maintain a home that is consistent is size and massing to that of

homes on either side of the Property. The proposal will keep the design and aesthetics expected of a home on Lake Minnetonka.

Neighborhood Comments: Notices were sent out to all property owners within 500 feet of the subject property prior to the public hearing held by the Planning Commission. At the public hearing on May 29, 2018, no one was presented to speak on the applicant and staff has not received any comments to date from neighboring property owners regarding this request.

Planning Commission Recommendation: At their May 29, 2018 meeting, the Planning Commission reviewed the Applicant’s variance request. After reviewing the staff report and associated attachments and holding the required public hearing, the Planning Commission made a motion to recommend the City Council approve the requested lakeshore setback variance at 4595 Merrywood Lane based on the findings of fact in the staff report and subject to the following conditions:

1. The Property must be developed in accordance with the approved plans assubmitted with the variance application;

2. The Applicant obtain all necessary permits and approvals from the City and otherapplicable entities with jurisdiction over the Property prior to any construction;

3. Any required grading should maintain existing drainage patterns or improve theexisting drainage of the lot and adjacent lots;

4. The Applicant are responsible for all fees incurred by the City in review of thisapplication; and

5. The variance approval is valid for one year from the date of approval and willbecome void and expire unless a building permit has been issued for the site.

Conclusion: The City Council should review the staff report and the recommendation of the Planning Commission. After review, the City Council should establish findings of fact as they relate to the variance request. Possible findings of fact are as follows:

1. The requested variance is consistent with the purpose and intent of the city’szoning ordinances because it protects neighboring property owner’s lake viewswhich is important in ensuring orderly and harmonious development andcontributes to the general health and welfare of the residents of the city.

2. The requested variance is consistent with the city’s comprehensive plan because itdoes not impact the natural environment, specifically it does not require alteringany steep slopes or removal of any significant trees. The proposed variance alsodoes not impact neighboring property owners views as the proposed addition iswell behind the riparian view shed setback.

3. The Applicant proposes to use the Property in a reasonable manner because thepurpose of the proposed addition is to enhance the current layout and functionalityof the home and to improve the livability of the home.

4. The existing home does not currently meet the required lakeshore setback. Thispresents a unique circumstance and since the Applicant recently purchased theProperty with the home in its current location, the unique circumstance wasinherited and not created.

d. A specific written description of the proposal and how it varies from the applicable provisions of

Minnetrista City Code.

The code states a minimum 75' setback is required for this property. The existing home was apparently

built with a setback of 73.5' to the lake, while the existing deck has a 71.3' lakeside setback. The

proposed addition will encapsulate the existing deck area as living space with a slight "sliver" of area

beyond the deck, resulting in revised lakeside setbacks of 72.0 and 73.1.

e. A narrative regarding any pre-application discussions with staff, and an explanation of how the issue

was addressed leading up to the application for a variance.

Andy Johnsrud (from Lecy Brothers) and Matthew Mosher (the property owner) met with Nick Olson,

city planner, on January 18th, 2018, to discuss the property and proposed addition. This was prior to Mr.

Mosher purchasing the property on April 9, 2018. Based on this meeting the proposed addition was

scaled back to stay as much as possible within the confines of the existing deck area.

f Explain how the proposal is in harmony with the general purposes and intent of Minnetrista City Code

and how proposal is consistent with the current Minnetrista Comprehensive Plan.

The proposed addition, while allowing the property owner to take full advantage of this lake front

property, does not negatively impact the neighboring properties. Note that with the addition this home

remains well back of the "line of sight" from the neighboring properties. Matthew has spoken with both

of his adjoining neighbors and discussed the proposed changes to the house and received their verbal

agreement as they both welcome a new, permanent owner who will reside in the home (rather than

having renters occupy the house as was the case for the last several years).

g. Explain how there are practical difficulties in complying with Minnetrista City Code. Practical

difficulties means:

i. The property owner proposes to use the property in a reasonable manner not permitted by

Minnetrista City Code;

The homeowner is planning to invest a considerable amount to enhance the current layout and

functionality of the home to improve the livability of the home. The lake-side addition (and other

remodeling) will provide an updated home that will ensure years of enjoyment.

ii. The plight of the landowner is due to circumstances unique to the property not created by the

landowner; and

The existing structure does not meet current setbacks.

iii. The variance, if granted, would not alter the essential character of the locality.

The completed project will be in keeping with the homes on either side, and will not alter the

character of the locality.

h. Provide justification that the variance request is not based exclusively upon a desire to increase the

value or income potential of the parcel of land.

The purpose of the project is to take full advantage of the lot and lake views by incorporating a new

great room into the floor plan (while remodeling adjoining areas). This will both maintain and increase

the livability of the home.

i. Justify that the granting of the requested variance will not:

1} adversely affect the health or safety of persons residing or working in the neighborhood;

2) impair an adequate supply of light and air to adjacent properties;

3) be injurious to property or improvements in the neighborhood;

4) increase the congestion on public streets;

5) endanger public safety;

6} or substantially diminish or impair property values within the neighborhood.

The granting of the requested variance, for the project as proposed, will not change, impact or

diminish any of the six concerns listed above.

RESOLUTION NO. 90-18

CITY OF MINNETRISTA

RESOLUTION APPROVING A LAKESHORE SETBACK VARIANCE OF 3 FEET FOR CONSTRUCTION OF AN ADDITION TO THE EXISTING HOME AT 4595

MERRYWOOD LANE

WHEREAS, the City of Minnetrista (the “City”) is a municipal corporation, organized and existing under the laws of the State of Minnesota; and

WHEREAS, the City Council of the City of Minnetrista has adopted zoning and subdivision regulations, per Chapter 5 of the Municipal Code, to promote the orderly, economic and safe development and utilization of land within the city; and

WHEREAS, Matthew Mosher (the “Applicant”) has made an application for a variance to reduce the required lakeshore setback from 75 feet to 72 feet for the construction of an addition to the existing home on the property generally located at 4595 Merrywood Lane (the “Property”) and which is legally described as:

Lot 1, Block 1, Martin Kyle Addition, Hennepin County, Minnesota; and

WHEREAS, on May 29, 2018, the Minnetrista Planning Commission considered the requested lakeshore setback variance, held a public hearing and, after consideration of the record before it, voted 6-0 in favor of recommending approval of the variance as submitted; and

WHEREAS, the City Council has reviewed the application, as submitted, and has made the following findings of fact:

1. The requested variance is consistent with the purpose and intent of the city’s zoningordinances because it protects neighboring property owner’s lake views which isimportant in ensuring orderly and harmonious development and contributes to thegeneral health and welfare of the residents of the city.

2. The requested variance is consistent with the city’s comprehensive plan because itdoes not impact the natural environment, specifically it does not require altering anysteep slopes or removal of any significant trees. The proposed variance also does notimpact neighboring property owners views as the proposed addition is well behind theriparian view shed setback.

3. The Applicant proposes to use the Property in a reasonable manner because thepurpose of the proposed addition is to enhance the current layout and functionality ofthe home and to improve the livability of the home.

4. The existing home does not currently meet the required lakeshore setback. Thispresents a unique circumstance and since the Applicant recently purchased theProperty with the home in its current location, the unique circumstance was inheritedand not created.

5. The requested variance will not alter the character of the locality because the proposedaddition will keep the home consistent in size and massing to that of the neighboring homes while maintaining the design and aesthetics of a home on Lake Minnetonka.

NOW, THEREFORE, BE IT RESOLOVED, that the City Council of the City of Minnetrista hereby approves the variance to reduce the required lakeshore setback from 75 feet to 72 feet on the property generally located at 4595 Merrywood Lane for the construction of an addition to the existing home, as submitted with the variance application, subject to the following conditions:

1. The Property must be developed in accordance with the approved plans as submittedwith the variance application;

2. The Applicant obtain all necessary permits and approvals from the City and otherapplicable entities with jurisdiction over the Property prior to any construction;

3. Any required grading should maintain existing drainage patterns or improve theexisting drainage of the lot and adjacent lots;

4. The Applicant are responsible for all fees incurred by the City in review of thisapplication; and

5. The variance approval is valid for one year from the date of approval and will becomevoid and expire unless a building permit has been issued for the site.

Issue:

Trees need to be planted around the new parking lot at Lisle Park located in the Hunters Crest neighborhood to help beautify the area and complete the landscaping plan that was approved by the City Council.

Background:

A new parking lot was installed at Lisle Park in 2016. During this process, some trees were removed and transplanted. The contractor was late in getting grass seed planted and the decision to plant trees was delayed until the turf was established. Now with the turf established and the irrigation system functioning, trees can be planted.

Discussion/Conclusion:

The City asked for quotes from three companies. The trees ask to quote for planting where 2 - 3” Hackberry, 3 - 2” Linden and 5 - 2” Elm. See chart below for installed pricing.

Conclusion:

Issue The City Council is being asked to approve a resolution for a conditional offer of employment for Mr. Robert Goodman as the Building Inspector for the City of Minnetrista. This position is being filled due to the vacation of the role by Mr. Chad Bartley.

Background The process to hire a Building Inspector began with advertising for the position on the City website and with the League of Minnesota Cities, which was posted as ‘Open until filled’. Four (4) applications were received, four (4) candidates were offered interviews, and three (3) applicants met with the panel for interviews on May 17, 2018. An additional application was received on May 21, 2018 and the applicant was interviewed on May 24, 2018. City Staff considered two (2) final applicants, with Mr. Robert Goodman emerging as the choice for hire.

The final steps are in process including the review of his references, driving record, and criminal history (backgrounding performed by the Minnetrista Police).

The terms of the employment offer for Mr. Goodman are outlined in the attached conditional offer of employment. If approved, we expect Mr. Goodman to begin his full-time employment in the next couple of weeks.

The 2018 starting rate of pay being offered is $26.50/hour for an annual total of $55,120.00 with a start date of June 5, 2018.

Per City of Minnetrista policy, you will serve a one-year (1) probation period, with performance reviews at six-months and at one-year of employment. Upon a successful one-year performance review, you will be eligible for a change in job status from “probationary” employee to “full-time” employee and a 2% increase. In subsequent years, your annual performance reviews will be completed at the end of each calendar year, with a possible cost of living pay adjustment granted each January 1st beginning on January 1, 2019. This position is an hourly (non-exempt) position, non-unionized, and benefits eligible on the day of hire.

Issue City Staff wishes to end the long ordeal with a final payment for a driveway easement agreement that dates back to 2006 with Mr. Harry Stillwell, 970 Maple Crest Drive, Minnetrista, MN. This issue will hopefully come to a conclusion with the Council’s approval at the June 4, 2018 City Council meeting.

Background After describing to the City Council the long standing issue between Mr. Harry Stillwell, 970 Maple Crest Drive, Minnetrista, under the City Administrator’s Staff Report at the May 21, 2018, City Council meeting, there has been a different request made by Mr. Stillwell.

Mr. Stillwell would like to receive the low quotation amount of $3,725 (Plehal Blacktopping) in a cash payment versus a reimbursement by the City.

City Staff and the City Attorney have been involved in discussing this issue with Mr. Stillwell since our last Council meeting, and although this is not our normal or typical procedure (to payout in cash versus a reimbursement procedure), this is not a normal or typical situation for many reasons.

The issue has been ongoing since 2006, when the City, in exchange for granting an easement through Mr. Stillwell’s property for the Maple Crest Street and Utility project, agreed to pave his auxiliary driveway area back to its original status and correct all drainage functionality with the project. In 2007 the driveway was paved, but not to Mr. Stillwell’s liking, with the drainage issues persisting.

Additional attempts to correct the driveway and drainage took place in 2008 and 2009, but Mr. Stillwell still wasn’t satisfied, and never signed off on the documentation. This situation has remained unresolved since Mr. Stillwell contacted me last fall.

All the same factors will apply. (1) We will not issue a check to Mr. Stillwell without his signature on the proper legal documentation/release form(s) whereby he agrees that the City of Minnetrista has fulfilled any and all obligations regarding this matter, including, but not limited to the items detailed in both the Agreement dated April 13, 2007, and the Memorandum of Understanding from 2007; plus a new legal document to be prepared by Mr. Batty’s office. (2)

The cost to the City remains unchanged, a total of $3,725. The only thing that is changing is that we will be issuing a check to Mr. Stillwell now instead of at the end of a driveway repair that would be done on a reimbursement basis.

Conclusion As described earlier, City Staff and the City Attorney will work with Mr. Stillwell to have him sign a document that states the City has fulfilled all of our obligations in exchange for a cash payment in the amount of $3,725.

Our goal has been to end this issue with Mr. Stillwell, so paying him once his signature on the proper legal documentation/release form(s) is executed versus at the conclusion of a blacktopping process is irrelevant, in my opinion. Both Mr. Batty and I endorse this approach in this particular case, which will thankfully end this ordeal that has spanned a dozen years.

Recommended City Council Action: Authorize the City Administrator and City Attorney to prepare the legal documents/release form(s) for the signature of Mr. Harry Stillwell, 970 Maple Crest Drive, Minnetrista, whereby Mr. Stillwell agrees that the City of Minnetrista has fulfilled any and all of its obligations regarding the property easement from the Maple Crest Street and Utility project from 2006, in exchange for a cash payment in the amount of $3,725.

NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF MINNETRISTA, that the City Council authorizes the City Administrator and City Attorney to prepare the necessary legal documents/release form(s) for Mr. Stillwell to sign in return for payment of $3,725 to finally finish the easement agreement from about a dozen years ago.
