Staff Presentation:
Mrs. White stated that based on sound planning practices, Planning staff recommended UP-11-21 be APPROVED with the stipulations as listed in the official agenda.
Proponent:
Robert Riddle, Riddle Associates, 530 Woodlake Circle, Suite 100, Chesapeake, Virginia, appeared before the Commission on behalf of UP-11-21 representing the applicant.
Opponent:
Pam Tigmo, 21389 Fitzgerald Drive, Ashburn, Virginia, appeared before the Commission in opposition to UP-11-21 representing herself.
The citizen who spoke in opposition stated that the fence was erected on her property and it needed to be removed. She also stated a landscape buffer was previously approved, on a prior application, and wanted that to be included in this application.

COMMISSION DISCUSSION:
Commissioner Van Laethem stated that the fence issue should have been resolved by the applicant and the adjacent property owner prior to the public hearing meeting. He also stated any buffering requirement from a previous application should be honored and should be of legal standing.
COMMISSION VOTE:
Commissioner Van Laethem moved that UP-11-21 be CONTINUED to February 8, 2012 Public Hearing. Commissioner Small seconded the motion. The motion was carried by a vote of 5-4. Commissioners Johnson, Kish, Gerloff and Bell voted against the motion.
