Motion by S. moon to adopt Resolution 2017-XX, and recommend that the City Council adopt the draft Ordinance as modified at the Planning Commission meeting, removing subsection 9.22.120 (C), which would have prohibited use of volatile solvents, and modifying section 9.22.070(A.4) to fix a drafting error referencing a limited number of applicant finalists.

ACTION REQUESTED:

1) Approve new exterior signage for the ‘Sacred Skulls’ Tattoo and Gallery

APPLICATIONS: The tenant of the building, Judicael Vales is requesting approval for a new

hanging sign above his entrance at 423 Broad Street. The building is owned by the Robert and

Phyllis Slack Trust.

REGULATORY CONSIDERATION:

17.68.080- Signs—Requirements and Restrictions (in the Historical District): No sign shall be

placed, erected, altered or relocated on any property within the historical district unless such sign is,

as to its exterior appearance, compatible with the Mother Lode type of architecture, and unless it

complies with all of the following requirements:

*This item was heard at the June 15 meeting with only two Commissioners present to take action. The City Attorney has advised that this action is invalid because a quorum was not established. Therefore it is necessary to re-consider this item and hold a new vote.

No sign shall be allowed except a sign, which identifies or advertises the business

conducted on the premises.

Each sign shall be affixed to a building, except that where the building is set back from

the street to such extent that a sign affixed to the building would not be within

reasonable view from the street, then a sign need not be so affixed, but may be located

in some other manner as the planning commission shall approve.

No single sign shall exceed twenty-four square feet in area

The aggregate area of all signs of any one business entity shall not exceed twenty-four

square feet; provided, however, that a single business entity having public customer

entrances on two or more sides of a building may treat each such side as a separate

entity.

RECOMMENDED ACTION: In order to approve this application the following finding must be

made:

A. That the exterior appearance of the proposed signage is consistent with the Mother Lodetype of architecture (17.68.080).

CONDITIONS OF APPROVAL

i. No neon is permitted.

ii. No banners are permitted.

iii. Owner authorization shall be submitted to City Planner prior to work.

iv. The sign shall be located at least 8 feet from the sidewalk to the bottom of the

sign.

v. The decision of the planning commission may be appealed to the city council

not later than fifteen (15) days after this final action or decision. Any work

during this period is at the applicant’s own risk.

relocate their existing business to 210 Main Street.

SIGN PROPOSAL:

Bob and Peggy Wright, tenants of the building at 210 Main Street, owned by the Susan Tensely Trust

are proposing to erect a one-sided sign to hang between the two existing awnings. The sign will be

similar in design to the previously approved sign at 110 York Street, using the same font, color scheme,

and “ice cream cone” graphic.

REGULATORY CONSIDERATION:

17.68.080- Signs—Requirements and Restrictions (in the Historical District)

No sign shall be placed, erected, altered or relocated on any property within the historical district unless

such sign is, as to its exterior appearance, compatible with the Mother Lode type of architecture, and

unless it complies with all of the following requirements:

No sign shall be allowed except a sign which identifies or advertises the business conducted

on the premises.

Each sign shall be affixed to a building, except that where the building is set back from the

street to such extent that a sign affixed to the building would not be within reasonable view

from the street, then a sign need not be so affixed, but may be located in some other manner

as the planning commission shall approve.

No single sign shall exceed twenty-four square feet in area

The aggregate area of all signs of any one business entity shall not exceed twenty-four

square feet; provided, however, that a single business entity having public customer

entrances on two or more sides of a building may treat each such side as a separate entity.

FINDINGS: In order to approve this application, the following finding must be made:

A. That the exterior appearance of the proposed signage is consistent with the Mother Lode type of

architecture (17.68.080).

PLANNING COMMISSION ACTION:

After discussion and hearing from the public, the Commission can make a motion to approve the sign

application, with the following conditions as agreed to by the applicant:

1. No neon is permitted.

2. No banners are permitted.

3. Nevada City contracts with the Nevada County Building Department for issuance of permits.

The County will not issue permits unless the plans have been stamped and approved by Nevada

City. Therefore, prior to issuance of a building permit, submit three sets of plans to Nevada City

Planning Department, along with the filing fee applicable at the time of filing. The plans will be

reviewed by the City Planner and City Engineer for consistency with the approval and will

require their signatures.

4. All improvements shall substantially comply with the exhibits presented to the Planning

Commission.

5. Property owner authorization shall be submitted to City Planner prior to erection of the sign.

6. A Planning Commission member may be appointed as a Liaison to assist the applicant with any

minor modifications to the permit, if needed.

7. Any contractor involved in the project shall have valid Nevada City business license on file.

8. The decision of the planning commission may be appealed to the city council not later than

fifteen (15) days after this final action or decision. Any work during this period is at the

applicant’s own risk.

‘Windham Cream (HC-6),’ also selected from the Benjamin Moore historical color palette. The

Review and provide direction on the applicant’s conceptual plan to lift the existing house, re-orient it 180 degrees, and restore it.

BACKGROUND / DISCUSSION: John Sullivan is currently in escrow on the property at 505 Nursery Street. The residence is depicted on the 1898 Sanborn Map, though Sullivan believes it dates back to at least the mid-1800s.

The site is overgrown with trees and shrubs and the house is in severe disrepair. Sullivan is proposing to make substantial improvements, including lifting the house and re-orienting it 180 degrees so that the side facing Nihill Street is facing Nursery Street. The structure is considered legal, non-conforming as the garage is situated nearly, directly on the property line along Nursery Street. The re-orientation may still require some encroachment into the setback area, though the encroachments will likely occur in different locations. If the re-orientation does require additional setback encroachment, a Variance request will need to be submitted. Because the restoration and re-orientation will involve exterior changes, the proposal will also be subject to Architectural Review. REGULATORY CONSIDERATIONS:

Variance: Pursuant to Section 17.88.030 of the City Municipal Code A Variance request can only be approved when the Commission can make a finding that there are “special circumstances applicable to the property, including size, shape, topography, location, or surroundings, [that] the strict application of [site development standards] deprives the property of privileges enjoyed by other properties in the vicinity and under identical classification.” A finding must also be made that a Variance does not constitute a special

privilege inconsistent with the limitations upon other properties in the vicinity and zone and a project may be conditioned as necessary to make that finding.

Architectural Review: The Planning Commission, in their role as the Architectural Review Committee, is required to review proposals for the erection or exterior alterations of any structure, or the remodel, demolition, or razing of any structure. Findings must be made that the structure is generally compatible with Nevada City style architecture and compatible with the surrounding neighborhood. Legal Non-Conforming Structure: Pursuant to Municipal Code Section 17.76, no non-conforming building may be enlarged or substantially altered except when the alteration is for a minor addition to a non-conforming single-family residence, so long as the specific findings can be made as outlined in Section 17.76.020, and listed below. Staff has included an analysis in italics immediately following each finding as it relates to the subject property. 1. The single-family residence being altered, remodeled or accessory building added to was

constructed prior to December 27, 1973, the date of the original adoption of the zoning ordinance;

2. The proposed addition will not increase the existing floor area of the structure being altered by more than twenty percent (in the case of the construction of a new accessory building, there is no size limitation);

3. The nonconformance of the existing residence is based on existing setback encroachments and/or lot area, lot width or lot frontage deficiencies;

4 No portion of the proposed new addition or new accessory building will encroach into the setbacks currently required by this title in the base or combining district regulations;

5. The property is used expressly for a single-family dwelling use and the base zoning district is R1 or R2, and no conditional uses, such as guest houses, second housing units or bed and breakfast uses exist on the property.

RECOMMENDATION: No action is being requested at this time. Mr. Sullivan is seeking general guidance on the conceptual proposal before he closes escrow. In guiding the applicant, staff recommends that the Planning Commission advise as to how a specific proposal might meet the Architectural Review requirements and the findings for the Variance and the alteration of a legal non-conforming structure, if necessary.

BACKGROUND: At recent public meetings, both the Planning Commission and City Council have

heard impassioned public testimony regarding the need for affordable housing in our community.

Members of both bodies expressed a desire for updated City policies that will incentivizes affordable

housing. With this direction in mind, staff has developed preliminary recommendations for a “Cottage

Development” Ordinance that will encourage small unit residences and provide some financial

incentives for developers.

Staff has had some difficulty findings a sample of such an Ordinance that would meet our community

needs. I have attached a similar Ordinance as adopted by Kirkland, WA, which appears to be a

prototype for some Oregon and Washington jurisdictions. However, staff’s recommended policies are

listed below and is an attempt to meet the needs expressed by our local community. Staff is seeking

further direction on policies the Planning Commission would prefer to see in a draft Ordinance to bring

before you in the coming month for a formal recommendation to City Council.

STAFF RECOMMENDED STANDARDS:

Chapter 17.80.240 COTTAGE DWELLING DEVELOPMENT ORDINANCE

17.80.240 A. Definitions:

1. Cottage Dwelling: A primary dwelling unit that is no larger than 800 square feet.

2. Cottage Dwelling Development: A group of four or more cottage dwelling units.

3. Commercial /Industrial Center: A group of no fewer than four commercial or

industrial zoned, parcels, including the LI, LB, GB, and EC zoning designations, that are developed for commercial use.

B. When a developer of housing proposes a housing development in any zoning

designation that allows medium-density residential development (R2 uses) the City of Nevada City, hereinafter called the city, shall provide the developer incentives for the production of units that do not exceed 800 square feet in size if the developer meets the requirements set forth below. Such a development shall be referred to as a

“Cottage Dwelling Development” and shall be a development meeting the following minimum criteria.

1. Shall be developed in groups of two units (no odd numbered developments), with a minimum 4-unit development size;

2. Shall include a covenant that restricts expansion of an individual unit above 800 square feet.

3. Shall include a covenant that prohibits use of a cottage dwelling for use as a hosted short-term rental.

4. Shall include a common space area available to residents of the development whereby any common building, if proposed, is clearly incidental in size and style to the cottage dwelling units;

5. Shall include a mechanism for the maintenance of all common areas (open space, parking areas, community buildings, etc.).

6. Shall incorporate energy-efficient design that meets the minimum Tier 1 building standard as outlined in the California Green Buildings Standard Code.

7. Any such development shall be subject to the following development standards:

8. Shall comply with the following parking standards:

a. 1 standard off-street parking space per unit under 500 square feet

b. 1.5 standard off-street parking spaces per unit over 500 square feet and under 800 square feet (rounded up to nearest whole number)

c. The above parking standards may be reduced by 25% when all of the following features are provided:

i. The cottage development is proposed within a half mile of a bus stop,

ii. Each unit of the cottage development is provided with a minimum of one on-site bicycle rack in a style that that allows a bicycle to be locked to the rack;

iii. Where safe pedestrian access is demonstrated via sidewalk or trail, without interruption except at intersection crossings, from the cottage development site to a commercial center or industrial center.

iv. The minimum number of accessible parking spaces are provided pursuant to the California Building Code.

9. Lot size, lot width, yard requirements, and height restrictions shall be the same as for the R2 zoning designation

10. Any such development is subject to applicable administrative permit procedures including the following:

a. Site Plan requirements pursuant to Section 17.88.010 of the City Municipal Code when new structures are proposed.

b. Architectural Review requirements pursuant to 17.88.040 of the City Municipal Code when new structures are proposed or when any exterior building alteration is proposed.

c. Subdivision requirements

C. The city offers the following incentives for any such Cottage Dwelling Development:

1. AB1600 Impact Mitigation Fees shall be applied to pairs of units as though they were one dwelling unit (does not apply to sewer or water hook-up fees);

2. Developments meeting the criteria above may occur at a maximum density of 16-units per acre.

PLANNING COMMISSION RECOMMENDATION:

Staff recommends that the Planning Commission, after hearing from the public and consideration,

provide staff with conceptual direction to draft an ordinance, which will then be reviewed by the

Planning Commission at a future date for formal recommendation to the City Council.
