ARTICLE 1PURPOSE

1.01 The purpose of thisAgreement is to establish andmaintain collective bargaining relations betweenthe Company and its employees employed withinthe bargaining unit described in Article 3 of thisAgreement and to provide a mechanism for thepromptandequitabledispositionofgrievances,asperArticle7and8ofthisCollectiveAgreement.

ARTICLE 2DEFINITIONS

2.01 Theword“employee”shallmeanapersonemployedwithin the bargaining unit described inArticle 3 ofthisAgreement.

2.02 The phrase “probationary employee” shallmean anemployee who has not completed the probationaryperiodprescribedinthisAgreementandwhohasnotacquiredseniority.

2.03 The phrase “seniority employee” shall mean anemployeewhohascompletedtheprobationaryperiodprescribed in this Agreement and who has beenretained in the employ of the Company followingcompletion of the probationary period andwhohasacquiredseniority.

2.04 WheneverthesingularormasculineareusedinthisAgreement, thesameshallbeconstruedasmeaningthe plural or the femininewhere the context or thepartiesheretosorequire.

2.05 TheCompanyandtheUniondonotandwillnot,asamatterofpolicy,discriminateagainstanyemployeebecauseofrace,creed,colour,sex,nationaloriginormembershipintheUnion.

2.06 Hourly leadworkersselectedby theCompanyshallleadanddirecttheworkforceandberesponsiblefor:

1. Trainingemployeeswhennecessary

2. Ensuring that directions of the supervisor arefollowed

3. Coordinatingworkasrequired

4. Checkingworkforqualityandquantity

5. Reportingnecessaryinformation

6. Performingnecessarymanualduties

Leadworkersshallnotnormallyreplaceanemployeein a classified job unless a replacement is notavailable. It isagreedandunderstood leadworkerswillnotissuedisciplinetootheremployees.

ARTICLE 3RECOGNITION

3.01 The Company recognizes the Union as the solebargainingagentofallemployeesoftheCompanyintheTownships of Chatham-Kent, Leamington, saveand exceptForemen and persons above the rank ofForeman,SecurityGuards,personsemployed in thegrowing and harvesting of agricultural products,OfficeandSalesStaff,QualityAssurancePersonnel,PollutionControlPersonnel,RetailSalesPersonnel,and students employed during the school vacationperiods.

ARTICLE 4UNION SECURITY AND UNION DUES

4.01 All seniority employees who are members of theUnion shall remainmembers of theUnion. A newemployeeshallbecomeamemberoftheUnionuponcompletionof theprobationaryperiodprescribed inthisAgreement.

4.02 Theunionexpresslyagreesthatnoseniorityemployeewill bedeniedmembership in theUnion except forthenon-paymentofUniondues.

4.03 (a) TheCompanywilldeductuniondues,assetfromtimetotimebytheUnion,fromthepayofeachseniorityemployeewhoisamemberoftheUnion,ashereinbeforeprovided,whensoauthorizedbysuchemployee,inwriting,onaformacceptabletotheCompany.Suchdeductionsshallbemademonthlyon theemployees’ lastpayperiodeachcalendarmonthandtheamountsodeductedshallbetransmittedtotheUnionbeforethe10thdayofthefollowingcalendarmonth.

(b)Per theInternationalConstitution,allemployeeswhoareintheUnionandwhohaveworkedanyhourswithinthecalendarmonth,willpayUniondues.

4.04 (a) There shall be elected or selected one (1)Stewardfromeachshift(day/afternoon),ineachDepartment, for a total of two (2) from eachDepartment.AStewardmusthaveatleastthree(3)yearsofsenioritywiththeCompany.

(b) The Union’s Negotiating/Grievance Committeeshallbecomprisedofone (1)member from thebargainingunit at large, plus theChiefStewardandtheAssistantChiefSteward.

4.05 The Company will not recognize any employee asa Steward until it has received written notice fromtheUniontothiseffect. TheUnionwill informtheCompanyinwriting,ofanychangesinthenamesoftheStewards.

4.06 (a)It is acknowledged that Stewards have theirregular duties to perform as employees andthat such duties must be performed in thesame manner and to the same extent as otheremployees.AStewardshallnotleavehisregularduties without receiving permission from hissupervisor.ThesupervisorwillnotunreasonablyrefusetograntaStewardpermissiontoleavehisregular duties for a reasonable length of time,without loss of pay, in order to perform any ofthedutiesrequiredtobeperformedbyaStewardpursuanttotheprovisionscontainedinArticle7ofthisAgreement.

(b) The Chief Steward or his designate shall have Union leave with pay from their existing classification for the purpose of Joint Committees, grievance meetings, investigations, and requested meetings with management. This leave will be restricted to (5) hours per week, any extension to this time must be mutually agreed to by both parties, such agreement will not be unreasonably withheld.

TheChiefStewardorhisdesignateshallhavetheprivilegeofworkingon theday shift. The rateof pay shall be determined by his classificationheldprevious to theeffectivedateof thatChiefStewardposition.

4.07 Notwithstanding the other provisions of thisAgreement, in the event of a layoff, Stewards (toincludetheAssistantChiefSteward)willbethelasttobelaidoffwithintheirDepartmentandontheshiftwhere they exercise their seniority, provided theyhave the ability, willingness and qualifications tosatisfactorilyperformthejobstobedone.

The Chief Steward will be the last to be laidoff provided he has the ability, willingness andqualificationstosatisfactorilyperformthejobstobedone.

4.08 The Company will provide an office to the UnionforexclusiveuseoftheUnion.TheBusinessAgent,Vice-President and/or President of the Union willnotbedeniedaccesstotheCompany’spremisesforthepurposeofconductingUnionbusinessregardingemployeesoftheCompany,providedpriornotificationis given to the Human Resources Manager, or hisdesignate,andhisapprovalisobtained.

4.09 (a)Itistheintentofthiscontractthatapersonactinginasupervisorycapacityshallnotbepermittedtoperformanyworkthatisperformedbyemployeescoveredbythiscontract,exceptasfollows:

i) intheinstructionortrainingofemployees.

ii) intheperformanceofnecessaryworkwhenscheduled work is interrupted as a resultof any emergency situation, includingbreakdownsorforreliefwork,noneofwhichdeprivesanyemployeeofemployment.

iii) in supervisory training which does notdepriveanyemployeeofemployment.

iv) inexperimentalworkwhichdoesnotdepriveanyemployeeofemployment.

v) in the installation of equipment or newprocesses to the extent required to train orinstruct employees which work does notdepriveanyemployeeofemployment.

(b) The Company will analyze all project work to determine which projects may have the potential to be performed by bargaining unit employees in lieu of subcontracting said work. This analysis will include the cost and scope of the project, the equipment required, the availability of qualified employees, time constraints, and whether the project is to be bid on a time and material basis.

TheCompanywill notify the Chief Steward ofanyplannedprojectworkandmeetwithhiminadvanceof tender to informof scheduledworkandthestatusofworkinprogress.

4.10 Duringthetermsofthisagreement,neitherpartyshallenterintoanyagreementorcontractwitheachotherwhichconflictswithorhastheeffectofchanginganyofthetermsofthisagreement.

Thepartiesmay,however,agreebetweenthemselvesto clarify existing contract provisions or to addressandreachagreementconcerningmattersnotcoveredbythisagreement.

AnymutualagreementreachedbetweentheCompanyand the Union will be documented and signed byofficialsofbothpartiespriortoitsapplication.

4.11 TheCompanywillsupplytotheUnion,onanongoingbasisalistofemployeeswho:

(a) have successfully completed their probationary period

(b)areterminatedorhavelosttheirseniority

ARTICLE 5MANAGEMENT RIGHTS

5.01 The Union acknowledges that it is the exclusivefunctionoftheCompanyto:

(a) maintainorder,disciplineandefficiency;

(b) hire,direct, assign, classify, re-classify, transfer,promote,demoteandlayoffanyemployeewhoissubjecttotheprovisionsofthisAgreement;

(c) suspend, discharge or otherwise discipline anyemployeewhoissubjecttotheprovisionsofthisAgreement,subject to therightof theemployeeconcernedtolodgeagrievanceasprovidedhereinand subject to the provisions herein containedwithrespectthereto;

(d) determine the kinds and locations of machinesandtoolstobeused,processesofmanufacturing,engineering and designing of its products,processing and production methods, control ofmaterialsandpracticestobeincorporatedintheproductsproducedandtheextension,limitations,curtailmentorcessationofoperations;and

(e) make and alter from time to time rules andregulationstobeobservedbyemployees,whichrules and regulations shall not be inconsistentwith the express provisions of this agreement;and will be discussed with the Union prior toimplementation.

5.02 Without restricting or limiting the generality ofthe foregoing, the Company retains all rightsnot specifically relinquished or modified by thisAgreement.TheCompanyshallexerciseitsrightsinamannerthatisfair,reasonableandconsistentwiththetermsofthisagreement.

ARTICLE 6STRIKES AND LOCKOUTS

6.01 There shall be no strike or lock-out so long as thisAgreementcontinuestooperate.

6.02 Theword“strike”andtheword“lock-out”shallbeasdefinedintheLabourRelationsAct.

ARTICLE 7GRIEVANCE PROCEDURE

7.01 A Grievance shall be defined as any differenceor dispute between the Company and anyseniority employee of the Company regarding theinterpretation, application or administration of thisAgreement, includinganyquestionsas towhetheramatterisarbitralandanallegationthatthisAgreementhasbeenviolated.Seniorityemployeesshallprocesstheir grievances in themanner andwithin the timelimits prescribed in thisArticle and inArticle 8 ofthisAgreement. Onceacceptedasagrievance, thisgrievanceshallbethepropertyoftheUnion.

7.02 Anytimelimitreferredtointhisarticleand/orArticle8of thisAgreementwithinwhichanyproceduresisrequired to be taken or within which a decision isrequired to be delivered orwithinwhich awritten notice is required to be given are mandatory andmayonlybeextendedbywrittenmutualagreementbetweentheCompanyandtheUnion.

7.03 (a)Step 1

A seniority employee having a grievance shallfirst take the matter up with their supervisoreitherdirectlyorthroughtheirstewardandfullydiscloseall information related to thegrievancethattheUnionandCompanyhaveknowledgeofat the time within five (5)working days of thetimewhenthecauseofthegrievanceoccurred.Ifthegrievanceisnotsatisfactorilyresolvedwithinfive(5)workingdays,thegrievanceshallthenbesubmittedinwritingtotheDepartmentManager

within two(2)workingdaysof thesupervisor’sresponse.

Step 2

The Department Manager shall deal with thegrievanceanddeliver their answer inwriting totheChiefStewardnotlaterthanthree(3)workingdaysafterthereceiptofthegrievance.

Step 3

Ifthegrievanceisstillnotsatisfactorilyresolved,the union will request in writing, a meetingbetweenthegrievor(s),wheredeemednecessary, the Chief Steward, Grievance Committee, DepartmentManagerand the HumanResourcesManager. Such request to be made not laterthen (5) working days after the receipt of thewritten response of the Department Manager. ThereuponthegrievanceshallbeplaceduponanagendaforconsiderationataconferencebetweenManagement and the Grievance Committeewhichwillbescheduledonthe2ndWednesdayofeachmonthtoattemptaresolveofalloutstandinggrievances. TheCompany shall deliver its finaldecision inwriting to theGrievanceCommitteewithinfive(5)workingdaysafterthemeeting. Ifthemeetingisdelayedlongerthan15daysfromthescheduleddatewithoutthewrittenconsentoftheunion,thegrievanceshallbedeemedruledinfavourofthegrievorandshallbepaidthenextpayperiodwherepossible.Suchdeemedrulingshallbe non-precedent setting. The union’s writtenconsent to extend the abovenotedmeetingwill

notbeunreasonablywithheld.

(b)If there is a grievance award, it shall go to themostseniorgrievor(s).

TheCompanyandtheUnionshallfullydiscloseall facts upon which they rely at a Step 3conference.

7.04 In the case of a grievance alleging the improperdischarge of a seniority employee, the dischargedemployeemay submit their grievance in writing tothe Human Resources Manager, or their designate,as provided in Step 3 of sub-article 7.04 of thisAgreement, within five (5) business days after thedateoftheirdischarge.ThereaftertheprovisionsofStep3shallapply.

7.05 If the written decision of the Human ResourcesManager,orhisdesignate,asprovidedforinStep3ofsub-article7.04ofthisAgreement,isnotsatisfactoryto the employee and/or the Grievance Committeeandprovidedthegrievancehasbeenprocessedinthemannerhereinbeforelaiddown,withinthetimelimitsprescribed,thegrievancemaybetakentoarbitrationinaccordancewithArticle8ofthisAgreement.

7.06 Bywayofillustration,butnotbywayoflimitation,thefollowingshallconclusivelybedeemedtobejustcausefordischarge:

(a) theftordestructionoftheCompany’sproperty;

(b) carelessnessendangeringthesafetyofothers;

(c) neglectofduties;

(d) unauthorizedabsenteeism;

(e) insubordination;

(f) fighting,ordisorderlyconduct;

(g) consumption of intoxicants or non-prescriptiondrugswhileonthejob;

(h)beingunder the influenceof intoxicantsornon-prescriptiondrugswhileonthejob;

(i) bringing intoxicants or non-prescription drugsontotheCompanypremises;and

(j) being in possession of intoxicants or non-prescriptiondrugsonCompanypremises.

7.07 No grievance may be submitted to arbitration asprovidedinArticle8ofthisAgreementwhichisnotfiledorprocessedwithinthetimelimitsprescribedinthisarticle.

7.08 Atanystepofthisgrievanceprocedure,theExecutiveBoardoftheLocalUnionshallhavethefinalauthorityin respect to any aggrieved employee covered bythis Agreement, to decline to process a grievance,complaint, difficulty or dispute further, if, in thejudgment of the Executive Board, such grievanceor dispute lacks merit or lacks justification underthe terms of thisAgreement, or has been adjustedor justified under the terms of this Agreement tothe satisfaction of the Executive Board. Once theaggrieved employee has been notified either bytheirStewardor theUnionRepresentative that theirgrievanceisbeingdroppedbecauseoflackofmerit,

the aggrieved employee has fifteen (15) business days to appeal that decision by sending a letter totheUnionPresident requesting toappearbefore theUnionExecutiveBoard.

ARTICLE 8ARBITRATION

8.01 (a) Either party may, subject to Article 7 of thisAgreement,notifytheotherpartyinwritingofitsdesire tosubmitagrievance toarbitration. Thenoticeshallbedeliveredbythepartydesiringtosubmit the grievance to arbitration to the otherpartywithinten(10)workingdaysafterthedateon which the Human Resources Manager, orhis designate, delivered the written decision asprovided in sub-article 7.04. Such notice shallalsocontainthenameoftheparty’sappointeetotheBoardofArbitration.

(b)Whereitismutuallyagreedbetweenthepartiesasinglearbitratormaybeused

8.02 Following the receipt of the notice as provided insub-article8.01,thepartyreceivingthenoticeshall,within ten (10) calendar days following receipt ofsuchnotice,informtheotherpartyofthenameofitsappointeetotheBoardofArbitration.

8.03 The two appointees so appointed shall, withintwenty(20)calendardaysoftheappointmentofthesecond of them, appoint a third person who shallbe the Chairperson of the Board ofArbitration. Ifthe party receiving the notice as provided in sub-

article 8.01 fails to appoint an appointeewithin thetimeprescribedinsub-article8.02,or,ifthetwo(2)appointeesfailtoagreeuponaChairpersonwithinthetimeprescribed,theappointmentshallbemadebytheMinister of Labour forOntario upon the request ofeitherparty.

8.04 The Board ofArbitration shall hear and determinethematterandshallissueadecision,inwriting,andthedecisionisfinalandbindinguponthepartiesanduponanyemployeeaffectedbyit.ThedecisionofamajorityoftheBoardofArbitrationisthedecisionoftheBoardofArbitrationbut, if there isnomajority,thedecisionoftheChairpersonshallgovern.

8.05 TheBoardofArbitrationshallnothavejurisdictiontoalter,addto,subtractfrom,modify,amendorchangeanyoftheprovisionsofthisAgreementortosubstituteany newprovision for any existing provision, or tomake any decision which is inconsistent with anytermorprovisionof thisagreement,or todealwithanymatterwhichisnotcoveredbythisAgreement.

8.06 The Company and the Union shall each bear theexpensesandfeesoftheirrespectiveappointeetotheBoardofArbitrationandtheCompanyandtheUnionshalleachpayonehalf(1/2)oftheexpensesandfeesoftheChairperson.

ARTICLE 9SENIORITY

9.01 An employee shall be considered a probationaryemployeeuntilhehasworkeda totalofninety(90)actual days, consecutive or intermittent, within

anyperiodofone (1) calendaryear.Aprobationaryemployee shall have no seniority. A probationaryemployee who is retained in the employ of theCompany following completion of the probationaryperiod, aforesaid, shall acquire seniority, shall thenbecome a seniority employee and his name shallbe added to the seniority list with a seniority datewhich is thefirstdateworked in thatcalendaryear.Article7and8ofthisAgreementarenotapplicabletoaprobationaryemployeeandthesearticlesarenotavailable to the Union on behalf of a probationaryemployee.

9.02 The Company will prepare and post seniority lists,everysix(6)calendarmonths,whichlistswillincludethenameofeachseniorityemployee,thatemployee’sclassification, that employee’s department, thatemployee’s shift, when applicable, and thatemployee’s seniority date. A copy of the senioritylistswillbesenttotheUnionoffice.

9.03 (a)SeniorityshallbedeterminativeonlyasexpresslyprovidedinthisAgreement.

(b) Seniority means length of continuous servicewith the Company. It entitles the employee topreferenceincasesofdecreaseorincreaseoftheworkingforceinaccordancewithArticle10.02.

9.04 An employee shall lose his seniority and hisemploymentshallbeterminatediftheemployee:

(a) quits,resignsorretires;

(b) fails to report for work or fails to notify the

Company for two (2)consecutiveworkingdayswithout supplying a reason satisfactory to theCompanyforsuchfailure;

(c) islaidoffandnotrecalledforaperiodofthirty-six(36)months;

(d) hasbeenlaidoffandfailstoreturntoworkwithinfive(5)workingdaysafterrecallbytheCompany;providedthatnoticeofrecallwhichhasbeensenttotheemployeebyregisteredmailathisaddressontherecordsoftheCompanyshallconclusivelybedeemedtohavebeenreceivedbytheemployeeonthefifth(5th)dayafteritwasmailed;

(3) is discharged and not reinstated pursuant tothe provisions of the grievance and arbitrationprocedurescontainedherein;

(f) overstays a leave of absence granted by theCompany without notifying the Company andwithout supplying a reason satisfactory to theCompanyforsuchfailure;

(g) engagesingainfulemploymentwhileonleaveofabsencefromtheCompany;or

(h) leavesworkwithoutobtainingaleaveofabsence,unlesstheemployeesuppliesareasonsatisfactoryto the Company for not obtaining a leave ofabsence.

9.05 (a)Seniority will be applied on a “departmentalbasis” and each seniority employee will beclassified as amember of one of the following

(b) Intheeventthatlay-offoccursinanydepartmentemployees’ seniority rightswillbeappliedonaplant wide basis in accordance with sub-article10.02, in that the seniority employee displacesthelowestseniorityemployeewithinthegeneralclassificationregardlessofdepartmentorshift.

9.06 (a) The appointment, selection or promotion ofany employee to a position not subject to theprovisionsofthisAgreementisnotcoveredbythisAgreement.Ifaseniorityemployeeisappointed,selected or promoted to a positionwhich is notsubject to the provisions of thisAgreement andis later transferredback toapositionwithin thebargaining unit described in Article 3 of thisAgreement, such employee shall return to thebargaining unit with all of the seniority whichthatemployeehadatthetimeofhisappointment,selectionorpromotionandsuchemployeeshallbecreditedwithadditionalsenioritywithrespectto the time he was not employed within thesaid bargaining unit, provided he returns to thebargainingunitwithinone(1)yearfromthetimeofhisappointment,selectionorpromotion.

(b) Readmission after one (1) year of a non-unionmemberwillbedeterminedbymutualagreementbetweentheUnionnegotiatingcommitteeandtheCompany.SuchreadmissionwillnotbesubjecttotheprovisionofArticle7and8ofthisAgreementandarenotapplicabletosuchemployee

ARTICLE 10LAYOFF AND RECALL PROVISIONS APPLICABLE TO ALL EMPLOYEES

10.01 Intheeventoflayoff, thefollowingprocedureshallapply:

(a) TheDepartment, the classification and the shift(whereapplicable)withinwhich the layoff is tooccurwillbeidentified.

(b)Allprobationaryemployeesemployedwithinthatclassification,onanyshiftandinanydepartment,wheretheyarepresentlyemployedwillbelaidofffirst.

(c) If, all probationary employees as identified insub-article 10.01 (b) are laid off, then seniorityemployees within that classification, thatdepartment, shallbe laidoff in inverseorderofseniority, provided the employees retained havethe ability, willingness and qualifications tosatisfactorilyperformthejobstobedone.

(d)Inthecaseoflayoff,theemployeesofthePackand Cook Departments will exercise their seniorityrightsintheseareasfirst.

10.02 (a)A seniority employeewho has been laid off, inaccordancewithsub-article10.01(d)shallhavethe right to displace the most junior seniorityemployee in the General classification, on aplantwidebasis(asdescribedinsub-article9.05)normally within one (1) working day unlessprevented from doing so because of operatingcircumstances.Theforegoingiscontingentuponsuch employee having the ability, willingnessand qualifications to perform the work of theemployeewhomheseekstodisplace.

(b) The method of crewing, in order to fulfill theobligations of Article 10, are prescribed inSchedule “B” which is attached to and whichformspartofthisAgreement.

10.03 Whenoperationalcircumstancesmakeitnecessarytomove employees from their scheduled departments,the company may assign those employees to otherdepartments for the remainderof thatday,providedtheyhavetheabilityandqualificationstoperformthework.

10.04 In the event that there is insufficient skilled workavailable, theCompanymay retain atworkpersonswhoareclassifiedtoperformsuchskilledworkforone(1)workingday,and,duringsuchperiodofretention,such persons will be permitted to perform worknormally done by other employees notwithstandingthatotheremployeeswhohavehighersenioritythanthesepersonsretainedarelaidoff.

10.05 Recallshallbeintheinverseorderoflayoff,providedtheemployeesrecalledhavetheclassificationability,

willingness and qualifications to satisfactorilyperformthejobstobedone.

10.06 Probationaryemployeesshallhavenorecallrights.

ARTICLE 11SHIFT TRANSFER

11.01 A seniority employee will have the privilege oftransferring from one shift to another on an annualbasis,withinhisdepartment,subjecttotheconditionshereinaftercontained.

11.02 Application for shift transfer, within a department,willbeacceptedbetweenSeptember1standSeptember14thofeachyearinwriting.ApplicationformswillbesuppliedbytheCompany.Theemployeewillobtainand drop off the completed forms at the HumanResourceDepartment.

The Company will view all applications and posta list of the employees transferring andwhere theyare transferring to, for a period of two (2) weeks.Employeeswhoareaffectedwillhaveone(1)weektoeitherdeclassifyortransfer. UponcompletionofthelastprocesstheCompanywillnotifytheaffectedemployeesnolaterthanNovember15thofeachyearinwriting.

11.03 The privilege of transferring from one shift toanother will only apply to production personnelwhoseseniorityrightsapplytooneofthefollowingDepartments:

11.04 Aseniorityemployeewillbegrantedhisfullseniorityrights on the shift towhichhe is transferredwithinthe department wherein his rights apply uponcommencementofthefollowingcalendaryear.

11.05 Aseniorityemployeewhotransfersfromoneshifttoanothershift inaccordancewith thisarticle,willbetransferredonaoneforonebasis. Themost junioremployee in the same classification as the personwhoistransferringshiftswillbereassignedtofillthevacancycreatedbythetransfer.

11.06 (a) If the seniority of an employee whose shift is transferred in accordance with this article is identical to an employee who is presently on the shift to which such employee transferred, seniority will be determined by plant wide order number (i.e. the employee with the lower number is more senior on the shift).

(b) Following a complete tabulation of these shift transfers, the Company and the Union will review the position of each transfer to ensure the most junior employee is displaced prior to a senior employee displaced out of his/her shift

(c) Article 11.01 to 11.06 does not apply to probationary employees if the Company schedules employees in a two (2) week rotation cycle.

(d) Maintenance will still be required to rotate as per the Maintenance schedule.

Seniorityemployeeshavetherighttotransfershiftsatanytimethroughoneoftwooptions.Whereavacancyoccurs on a shift, and the Company determines itrequiresreplacement,a jobpostingshallbecreated.Employeesmaypostintothatvacancyprovidingtheypossesstheseniority,skills,ability,andqualifications.

Secondly, employees who wish to switch shifts ona mutually agreeable basis may do so providingthey both possess seniority, classification, skills,ability, and qualifications, and approval is grantedby the Company. The Company will not deny anyreasonable request formutual transfer.TheTransferofshiftsmustoccurwithin30days.

ARTICLE 12DEPARTMENT TRANSFER

12.01 A seniority employee will have the privilege oftransferring from one Department to another on anannual basis, subject to the conditions hereinaftercontained.

12.02 Applications for department transfer, within adepartment will be accepted between the 1st ofSeptemberandSeptember14thofeachyearinwriting.ApplicationformswillbesuppliedbytheCompany.TheemployeewillobtainanddropoffthecompletedformsattheHumanResourceDepartment.

The Company will view all applications and posta list of the people transferring and where theyare transferring to, for a period of two (2) weeks.Employeeswhoareaffectedwillhaveone(1)week

12.04 Aseniorityemployeewillbegrantedhisfullseniorityrights in the Department to which he transferredupon commencement of the following calendaryear. He will be offered work in the Departmentin his classification and consistent with his ability,willingness and qualifications to satisfactorilyperformthejobstobedone.

A seniority employee, who transfers from onedepartmenttoanotherinaccordancewiththisArticle,will be transferred on a one-for-one basis. Themost junior employee in the same classification asthe personwho is transferring departments,will bereassignedtofillthevacancycreatedbythetransfer.

12.05 Iftheseniorityofanemployeewhoistransferredinaccordancewiththisarticleisidenticaltoanemployeewho is presently in the department to which suchemployeetransferred,senioritywillbedeterminedbyplantwideordernumber(i.e.theemployeewiththelowernumberismoreseniorinthedepartment).

12.06 Followingacompletetabulationofthesedepartmenttransfers, the Company and the Union will reviewthepositionofeachtransfertoensurethemostjunioremployee is displaced prior to a senior employeedisplacedoutofhis/herdepartment.

ARTICLE 13JOB POSTING

13.01 When the Company determines a requirement to post a permanent vacancy, it shall post notice of the vacancy for a period of five (5) working days in order to allow seniority employees to apply. All postings and the names of the successful applicants will be posted on the job posting bulletin boards and copies will be given to the Chief Steward.

13.02 The requirements of the posted position will be seniority, qualifications, skill, experience and ability of the applicant(s) to satisfactorily perform the requirements of the job.

13.03 If no applications are received from seniorityemployees or if none of the applicants is awardedthe posted vacancy, theCompanymay then fill thevacancyinsuchmannerasitdetermines.

13.04 Anemployeewhoisamemberofaclassificationotherthan the General classification and who no longerwishes to remain a member of that classificationmust advise the Company of this fact, in writing,betweenthe1stdayofSeptemberandthe14thdayofSeptemberinanyyear.Asofthe1stdayofJanuaryinthefollowingyear,suchemployeewillnolongerbesoclassifiedandwillbeclassifiedasamemberofthe

GeneralClassification.

13.05 An employee who is awarded a posted position inaccordance with the provisions of this article andwho,athisoptionorat theoptionof theCompany,is not retained in the posted position, following atrial period of twenty (20) working days, will betransferredback to thedepartmentand theshiftandtheclassificationwherehewasworkingimmediatelypriortobeingawardedthepostedpositionandhewillbeallocatedworkinthatdepartmentandonthatshiftandtheclassificationinaccordancewithhisseniorityand his ability, willingness and qualifications tosatisfactorilyperformthejobstobedone.

(a) On successful completion of the trial period, theCompany and the Union will sign-off that theemployeehasbeenadequatelytrainedandisabletoperformthedutiesoftheposition.

(b)Whiletrainingwiththepersonwhoregularlyhasdonethejob,thetraineecannotbebumpedfromthatpositionbyothermoresenioremployees.

(c)Thetraineecanperformtheworkindependentofthe trainer. If there is a layoff the trainermustperform duties that do not displace anotheremployee.

(d)TheCompanyandtheUnionmayagreetoextendthetrialtrainingperiod.

(e)The employeewill be paid the applicable gradeuponsignedqualification.

13.06 TheClassificationrateofpayforthepostedposition

will be adjustedon thefirst dayworked in that jobfollowingthetrialperiod.

13.07 Notwithstanding anything contained in this Articleor in thisAgreement, the following provisionswillapply:

(a)Allpostingswillbeawardedassoonaspossibleand when jobs are filled, successful bidderswill receive necessary training to competentlyperformthedutiesofthejobunderthedirectionof a qualified person until completion, withoutdepriving other classified employees in thatclassificationoftheirseniorityrights.

(b)The wage rate of a newly created job will be determined by a committee consisting of equal numbers of Union and Company representatives. In the event concensus cannot be reached, the issue will be referred to mediation/arbitration as per the collective agreement.

(c)The Company will systematically train employees to be qualified to work in other positions. Employees will be entitled to participate in a “sign-up sheet” to volunteer for positions to be trained; if no volunteers the Company will assign training based on the needs of the business, and will assign the employee in reverse seniority order.

(d) The Company is willing to appoint one management person to work with the Chief Steward to write the Job Safety Analysis with

assistance of employees in those departments. The Union will promote and support the successful completion of the above by assisting in the communication of this process.

13.08 Employees as defined in Article 13.07 (c) will only replace permanent classified employees in their absence, except as provided in section 4.09 (b).

ARTICLE 14HOURS OF WORK, OVERTIME AND WORKING CONDITIONS

14.01 A to 14.08 A refer to Phase 1 Continuous Shift

14.01AHoursofworkshallbescheduledbytheCompanyinaccordancewith its requirements. Vacation day will be considered as time worked. Theworkweekshallbedefinedasbeginningat12:00amonSunday,andconcludingonSaturdayat11:59pm.

EffectiveApril3,2011,oratadatetobeestablishedby the Company, (the Company will provide aminimumofthirty(30)daysnoticeofsuchachange):

i) Sanitation, or other functions as deemed necessary by the Company, will work scheduled twelve (12) hour shifts during the work week (shift is 12 hours in length with a 30 minute unpaid lunch). The work week for sanitation may include Saturdays and/or Sundays which will be considered part of the sanitation classification regular work week. Overtime will only be paid for hours in excess of 12 hours per day and/or 42

hours per week. The twelve (12) hour shifts will provide for a 45 minute lunch period (30 minutes unpaid, and 15 minutes paid) and two (2) fifteen (15) minute breaks.

ii) Productionfunctions,andmostmaintenanceemployees will move to a 42 (Forty Two)hourschedulecomprisedofthreeelevenandonehalf(11.5)hourshifts,andonesevenandonehalf(7.5)hourshift.

iii) Theeight andonehalf (8.5)hour shiftwillincludea30minuteunpaidlunchbreak,andtwofifteen(15)minutepaidbreaks.

iv) Thetwelve(12)hourshiftswillprovidefora45minutelunchperiod(30minutesunpaid,and 15minutes paid), and two fifteen (15)minutebreak.

v) Those employees selected for the twelvehourshiftschedulewillrotatetwoweeksofdays(ie7:00am–7:00pm),withtwoweeksofnights(ie7:00pm–7:00am)

vi) BothpartiesagreethatEmployeesscheduledfor a forty (40) hour week, eight (8) hourshifts, Monday through Friday, shall berequiredtoworktheirfirsttwo(2)hoursona Saturday or on a Sunday at their regularstraighttimerateofpay.

14.02 AAll overtime and premium pay assignments whichoccur in a Department on a Saturday, Sunday, orPaidHoliday,willbeassignedtoseniorityemployees

who have the classification, ability, willingnessand qualifications to satisfactorily perform thejobs to be done, prior to assigning such work toother employees. For the purposes of this article,employeeswhoareregularlyemployedinproductionareas doing production work will be given firstpriorityforovertimeandpremiumpayassignmentsinproductionareastodoproductionworkwhichoccursonaSaturday,SundayorPaidHolidays.

14.03 AAny employee who does not desire overtime andpremium pay assignments shall not be required toaccept such assignments provided the employeehas, prior to when the overtime and premium payassignments occur, filed a request, in writing, withhis supervisor tobeexcused from theovertimeandpremium pay assignments. However, recognizingthatproductionschedulesandotherfactorsmaymakeitimpossibletoapproveeveryrequest,itisrecognizedthat theCompanymayhave to limit thenumberofrequestswhichcanbeapproved.Inanyweek,onlytenpercent(10%)oftheemployeesonthesenioritylist, within a classification, shall, on a progressivebasis(i.e.,firstweek-firsttenpercent(10%);secondweek-secondtenpercent(10%);etc.)beeligibletomakesuchrequests. If, inanyweek,allemployeeswithintheclassificationwhoareeligibleforthatweekdo not make such a request, additional employeeson the seniority list,within the classification, up toatotaloftenpercent(10%)oftheemployeesintheclassificationwill,inaccordancewithseniority,thenbeeligibletomakesucharequest.

14.04 AAllovertimeandpremiumpayassignmentsscheduledby the Companymust beworked by the employeeassignedunlesstheemployeehaspermissionfromtheappropriateCompanyofficialtobeabsentfromwork.

14.05 AAllhoursactuallyworkedbyanemployeeinexcesseighthoursperdayonaneighthour shift andtwelve(12) hoursperday,MondaytoFriday,bothinclusive,shallbepaidforatoneandone-half(1-1/2)timestheemployee’s regular straight time of pay. Overtimeshall be paid to any employee for hoursworked inexcessof forty two (42 )hours inaworkweekorgreaterthantwelve(12)hoursinaworkshift.

14.06 AAll hours actually worked by an employee on aSaturdayoronaSundayshallbepaidforatoneandone-half(1-1/2)timestheemployee’sregularstraighttimerateofpay.

14.07 AIntheeventthatanemployeereportsforworkathisregular timeonhis regularshift,Monday toFriday,both inclusive, without having been previouslyadvisednottoreportforwork,hewillbegiventhree(3)hoursofworkathisregularstraighttimehourlyrateofpay. Ifnoworkisavailable,hewillbepaidtheequivalentofthree(3)hoursathisregularstraighttimehourlyrateofpay.Asaconditionofpayment,theemployeeshallperformanyavailableworkwhichheiscapableofperformingandwhichheisrequestedtoperform.

This shall not apply in the event of an interruptionofscheduledwork,becauseofconditionsoutof theCompany’s control. TheCompanywill, as soonaspossible,determineifworkcannotbemadeavailable

and will proceed immediately to notify all theemployeesaffected.

14.08 AThe following provisions apply to overtime andpremiumpayassignments:

(a) ExceptasotherwiseprovidedinthisAgreement,overtime and premium pay assignments willbe assigned firstly to seniority employees whoare currently working in the Department andon the shift where such overtime or premiumpay assignments occur, provided they havethe classification, ability, willingness andqualifications to satisfactorily perform the jobstobedone,priortoassigningsuchworktootheremployees.

Eligibility for this overtime will be establishedby an employee actually working on their lastscheduled shift to be entitled to Saturday andSunday overtime and Monday paid holidayovertime. An employee actually working on aThursdaywillbeentitledtoFridaypaidholidayovertimeaswellasthatabove.

Followingtheaboveprocedure,ifitisfoundthereare insufficient employees available within adepartmentwhereinovertimeworkandpremiumpayassignmentsarerequired,theadditionalworkwillbeassignedtoseniorityemployeeswhosignthevoluntaryovertimesheetforthatdepartment.

TheovertimesheetwillbemadeavailableeveryMondayandtakendownattheendoftheshiftonWednesdaynightduringtheweekwhenovertime

willoccur.

Volunteers for such overtime will be selectedby plant wide seniority provided they have theabilitytoperformthejobstobedone.

(b) Intheeventthatovertimeisscheduledinadvanceofaregularshift,suchovertimewillbeassignedtothoseemployeeswhoarescheduledtoworkinthatDepartment on the same following shift ofwork.

(c) NotwithstandinganythingcontainedinthisarticleorthisAgreement,shouldovertimeorapremiumpayassignmentoccurfollowingashift,itwillbeassignedtothoseemployeeswhoperformedthoseduties on the shift immediately preceding theovertimeorpremiumpayassignmentoccurring,priortoassigningsuchworktootheremployeesand provided that such other employees havethe classification, ability, willingness andqualifications to satisfactorily perform the jobstobedone.Thisovertimewillnotinterferewithor displace those employees who are regularlyscheduled to work on the shift on which theovertimeorpremiumpayassignmentoccurred.

14.01 B to 14.08 B refer to Phase 2 Continental Shift

14.01 BHoursofworkshallbescheduledbytheCompanyinaccordance with its requirements. Vacation day willbeconsideredas timeworked.Theworkweek shallbedefinedasbeginningat12:00amonSunday,andconcludingonSaturdayat11:59pm.

The Company and Union will meet to determinethe frequency of rotation of shifts in the newconfiguration. The Company expects the need tomove to this schedule as production approachescapacityattheplant.

It isanticipated that the requirement tomove to thefullcontinentalschedulewillbeatathresholdof45operatingweeks out of 52.This calculationwill bemadeonarolling52weekschedule.

Ingeneralterms,employeeswillbeabletoworkupto80.5hoursinaregulartwoweekrotationorperiod(i.e. 46hours inweekone, and34.5hours inweektwo).Underthesecircumstances,overtimewillonlybe paid when an employee works in excess of 46hoursinagivenworkweek,greaterthan12hoursinagivenshift,orgreaterthan80.5hoursinatwoweekperiod.

ItismutuallyagreedbytheCompanyandtheUnion,thatintheeventthecontinentalworkweekdoesnotmaintain a threshold outlined in Article 14 of theCollectiveAgreement, theCompanywillmeetwiththeUniontodiscussalternativeworkingschedules.

TheCompany reserves the right tomaintainwhichshiftswillbeat the8.5hourshiftand12hourshiftconfiguration.

requestswhichcanbeapproved.Inanyweek,onlytenpercent(10%)oftheemployeesonthesenioritylist, within a classification, shall, on a progressivebasis(i.e.,firstweek-firsttenpercent(10%);secondweek-secondtenpercent(10%);etc.)beeligibletomakesuchrequests. If, inanyweek,allemployeeswithintheclassificationwhoareeligibleforthatweekdo not make such a request, additional employeeson the seniority list,within the classification, up toatotaloftenpercent(10%)oftheemployeesintheclassificationwill,inaccordancewithseniority,thenbeeligibletomakesucharequest.

14.04 B Allovertimeandpremiumpayassignmentsscheduledby the Companymust beworked by the employeeassignedunlesstheemployeehaspermissionfromtheappropriateCompanyofficialtobeabsentfromwork.

14.05 BAllhoursactuallyworkedbyanemployeeinexcessofeightandonehalf(8.5) hoursperdayonaneightandonehalfhourshiftortwelve(12)hoursperdayonatwelve(12)hourshiftshallbepaidforatoneandone-half(1-1/2)timestheemployee’sregularstraighttimeofpay.

14.06 BAll hours actually worked by an employee onscheduleddaysoffshallbepaidforatoneandone-half(1-1/2)timestheemployee’sregularstraighttimerateofpay.

14.07 BIntheeventthatanemployeereportsforworkathisregular timeonhis regularshift,Monday toFriday,both inclusive, without having been previouslyadvisednottoreportforwork,hewillbegiventhree(3)hoursofworkathisregularstraighttimehourly

rateofpay. Ifnoworkisavailable,hewillbepaidtheequivalentofthree(3)hoursathisregularstraighttimehourly rateofpay.Asaconditionofpayment,theemployeeshallperformanyavailableworkwhichheiscapableofperformingandwhichheisrequestedtoperform.

This shall not apply in the event of an interruptionofscheduledwork,becauseofconditionsoutof theCompany’s control. TheCompanywill, as soonaspossible,determineifworkcannotbemadeavailableand will proceed immediately to notify all theemployeesaffected.

14.08 B The following provisions apply to overtime andpremiumpayassignments:

(a) ExceptasotherwiseprovidedinthisAgreement,overtime and premium pay assignments willbe assigned firstly to seniority employees whoare currently working in the Department andon the shift where such overtime or premiumpay assignments occur, provided they havethe classification, ability, willingness andqualifications to satisfactorily perform the jobstobedone,priortoassigningsuchworktootheremployees.

Followingtheaboveprocedure,ifitisfoundthereare insufficient employees available within adepartmentwhereinovertimeworkandpremiumpayassignmentsarerequired,theadditionalworkwillbeassignedtoseniorityemployeeswhosignthevoluntaryovertimesheetforthatdepartment.

TheovertimesheetwillbemadeavailableeveryMondayandtakendownattheendoftheshiftonWednesdaynightduringtheweekwhenovertimewilloccur.

Volunteers for such overtime will be selectedby plant wide seniority provided they have theabilitytoperformthejobstobedone.

(b) Intheeventthatovertimeisscheduledinadvanceofaregularshift,suchovertimewillbeassignedtothoseemployeeswhoarescheduledtoworkinthatDepartment on the same following shift ofwork.

(c)NotwithstandinganythingcontainedinthisarticleorthisAgreement,shouldovertimeorapremiumpayassignmentoccurfollowingashift,itwillbeassignedtothoseemployeeswhoperformedthoseduties on the shift immediately preceding theovertimeorpremiumpayassignmentoccurring,priortoassigningsuchworktootheremployeesand provided that such other employees havethe classification, ability, willingness andqualifications to satisfactorily perform the jobstobedone.Thisovertimewillnotinterferewithor displace those employees who are regularlyscheduled to work on the shift on which theovertimeorpremiumpayassignmentoccurred.

14.09 Anemployeewhowantspermissiontobeabsentfromwork,forareasonthatisknowntohimpriortothecommencementofhis scheduled shift,must receivepermission to be absent from his supervisor priorto the commencement of his scheduled shift. The

permissionofthesupervisorwillnotbeunreasonablyrefused.

Employees who leave and return during their shiftmustpunchoutwhenleavingandpunchbackinupontheirreturn.

14.10 If an employee isunable to report towork, for anyreason, he shall call the attendance line as soon aspossible,and,inanyevent,priortothecommencementofhisscheduledshift.Theemployeeshalladvisetheattendance linewhyhe isunable to report forworkandwhenheexpectstoreportforwork.

14.11 (a) Whenanemployeeisabsentduetoworkrelated injury/illness:

• the employee must be seen by a medicalpractitionerimmediatelyfollowinganinjury/illnesscausinganabsencefromwork.

• following this visit, the Company medicalreportformconfirminghisvisitationmustbereceivedbytheCompany

• such Company medical report form mustincludethetypeofinjury/illness,theexpecteddurationandthemedicalrestrictions,ifany.

(b) Whenanemployeeisabsentduetoanon-workrelated injury/illness for more than three (3)consecutiveworkingdays:

• themedicaldocumentationmustbereceivedby the Human Resources Manager, ordesignate, no later than one (1)week from

thebeginningoftheabsence;and,

• such medical documentation must includethe type of injury/illness and the expectedduration.

(c) Prior to returning towork, following an absencedue to injury/illness, theCompanymust receive,within a reasonable time period before theexpected return, the medical documentationidentifying the employee’s date of return andconfirming that such an employee can return toregularduties;or,

• if regular duties cannot be performed,the medical documentation must includespecific information identifying suchemployee’s medical restrictions in orderfor such employee to receive considerationfor modified work. The Company will,upon receipt of a completed medicaldocumentation, reimburse the employeethe cost of obtaining the completed form.The Company will issue payment uponsubmissionofareceipt.

(d) The Company shall notify the employee, chiefstewardand/orunionrepsofsuchareturntoworkinterviewwithinareasonableperiodoftimepriortotheinterview.

Return-To-Work Interviews, and any follow upmeetings established during the return-to-workinterview will be held with all workers whocannotperformregularduties,inaccordancewith

said“ReturntoWorkProcedures”.

14.12 Anymedical examination requested by the companyshall be promptly complied with by all employees.The Company shall pay for all such examinations.The Company reserves the right to select its ownmedical examiner or physician and theUnionmay,if in its opinion an injustice has been done to anemployee, have such employee re-examined at theUnion’sexpense.

14.13 Itshallbe thedutyofeveryemployeetoadvise theCompanyof his address and telephone number andany changes thereto in writing on the Companyprovided change of address form. If an employeefailstodoso,theCompanywillnotbeliablefortheemployee’sfailure toreceivenoticeof recalloranyothernoticeissuedtotheemployeebytheCompany.TheCompanywill send such changes to theUnionhallonanongoingbasis.

14.14 There shall be no pyramiding of any premiumpay,including but not limited to, overtime and paidholidaypay.

14.15 An employee who is called back to work aftercompleting his normal shift will be paid for allhoursworkedattherateofoneandone-half(1-1/2)times his regular straight time rate of pay, subjectto a minimum payment of three (3) hours of payat his regular straight time rate of pay. In order toqualifyfortheminimumpayment,theemployeemustperformsuchdutiesasareassignedtohim.

14.16 A. Phase 1 Continuous Shifts AnemployeewhoiscalledintoworkonaSaturday,

on a Sunday or on a PaidHolidaywill be paid forallhoursworkedat therateofoneandone-half (1-1/2)timeshisregularstraighttimerateofpay,subjectto a minimum payment of three (3) hours of payat his regular straight time rate of pay. In order toqualifyfortheminimumpayment,theemployeemustperformsuchdutiesasareassignedtohim.

B. Phase 2 Continental Shifts An employee who is called in to work on a their

scheduleddayoff oronaPaidHolidaywillbepaidforallhoursworkedat therateofoneandone-half(1-1/2) times his regular straight time rate of pay,subjecttoaminimumpaymentofthree(3)hoursofpayathisregularstraighttimerateofpay.Inordertoqualifyfortheminimumpayment,theemployeemustperformsuchdutiesasareassignedtohim

14.17 TheCompanywillmake reasonable efforts to trainandkeeptheiremployeesuptodateonnewequipmentbefore hiring new employees. The Company willcooperatewithemployeeswithrespecttonewideasandtechniques.

14.18 Where rotation systems are being used, allworkerswill follow said rotation unless they are preventedfrom doing so by their medical restrictions. TheCompanyandtheUnionwillmeettofurtherreviewjob rotation issues in an effort to improveupon thecurrentpractices.

14.19 An employee who replaces another employee on a

temporarybasiswillreturntotheirpreviouspositionuponthereturnofthatemployee.

ARTICLE 15SPECIAL PROVISIONS APPLICABLE TO THE SKILLED TRADES DEPARTMENT

15.01 (a)Notwithstanding anything contained in thisAgreement, the provisions in this article applyto employees employed in the Skilled TradesDepartment. Where there is a conflict betweenany other provision of this Agreement theprovisionsofthisarticleshallgovern.

(b)TheStockroomKeeperpositionisincludedintheSkilledTradesDepartment.Suchemployeewilldisplace employees on a plantwide basis uponlayoff.

15.02 SkilledTradesemployees,underthedirectionoftheproduction supervisor in the area towhich they areassigned,willperformthedutiesnecessarytoprovideproductionwiththesupportrequired.

15.03 The Company will pay Skilled Trades employees,including new hires, according to the job gradestructure, as outlined herein. Upgrading of SkilledTrades employeeswill be according to the positionheldwithin this job grade structure. (see chart nextpage)

15.04 All Skilled Trades Leaders will receive seventy-fivecents($.75)perhourinadditiontotheirregularstraighttimerateofpay.

15.05 ThesupervisoroftheSkilledTradesDepartmentwillscheduletheshiftsandtheassignmentstobecarriedout by each employee under their authority. Suchschedule of shifts will be made one (1) month inadvance.AnyadjustmentstothescheduleforentitledvacationoremergencyrequirementsmustbedirectedthroughtheDepartmentSupervisor.Supervisorswillprepare a listing for plant coverage as required bytheCompanyduring theChristmasandNewYear’sholidaybreakinadvanceofsuchperiod.

15.06 Prior to hiring new employees into the Skilled Trades Department, the Company will give consideration to employees in other Departments. Consideration will be based on potential success and the skill and abilities of the applicant. The Company will not be obligated to hire skilled trades apprentices from within the bargaining unit.

(a)Anemployeewillreceivetherateofpayaccordingto the Skilled Trades Job Grade Structure/PayScaleoutlinedinsub-article15.03.

(b) An employee who warrants continued training,asdeterminedbytheCompany,willcontinuetheBasicApprenticeship Training Program. Uponcompletion of this period, an employee willreceivetheprevailingcategorizedratesappliedtomembersoftheSkilledTradesDepartment.

(c) ItisagreedbybothpartiestothisAgreementthatanemployee,whohasbeengivenconsiderationunder this provision to transfer to the SkilledTrades Department, will retain the right totransfer back into the General Classification,withfullseniority,providedthatsuchapplicationfor transfer ismadebetweenSeptember1standSeptember 14th of each year andfiledwith theHumanResourcesDepartment.

(d) Also,shouldtheemployeewhotransferredtotheSkilledTradesDepartment not qualifywithin asix(6)monthperiodoftime,theCompanymaytransfer the employee back to the classificationthatemployeepreviouslyheld,withfullseniorityin the same Department and on the same shiftfromwherehecame.

15.07 A new employee hired into the Skilled TradesDepartmentwho is unable tomeet the standards ofperformance as determinedby theCompanyduringthefirst six (6)months of employment,will not beretainedintheSkilledTradesDepartment. Hewill,providedhoweverthathecompletedhisprobationaryperiod, be given the opportunity for work in theGeneralClassificationinanotherDepartmentontheshiftasdeterminedbytheCompany,providedthatheisable,willing,andqualifiedtodotheworkofferedtohim.Theemployee’sfirstdayofworkintheGeneralClassificationwillbehissenioritydateinthatgroup,providedhowever, that suchemployeeshall receivecreditforallpreviousseniorityforvacationpurposesonly.

15.08 (a) EducationalCourses

The Company will sponsor company approvedcourses by reimbursing the employee fortuition fees and required course books afterthe successful completion of the course and byreimbursingmileagecosts.InordertoqualifyforreimbursementfromtheCompany,theemployeemust submit receipts confirming payment. TheCompanywillapplytheaboveinaconsistentandfairmannerwithallemployeeswithintheSkilledTradesDepartment.

(b)TheCompanyrecognizestheneedtokeepSkilledTrades department employees current on newequipmentandwillendeavourtodoso.

15.09A Overtime – Phase 1 Continuous Shifts

(a)When practical, overtime within the SkilledTradesDepartmentonaSaturday,SundayorPaidHolidaywill be offered to personnelwithin theDepartmentwholastperformedthesedutiesintheareaandontheregularshiftwheretheovertimeoccurs, provided such employeesbelong to thatareaandhavethequalificationstodothework.Ifthisovertimeisnotdesiredbythosewhoqualifyundertheaboveconditions,theovertimewillbeoffered to the personnel within that area, wholastperformedthesedutiesintheareawheretheovertimeoccurs,providedsuchemployeeshavethequalifications todo thework. Regular shiftshallmean1st,2ndor3rdshift.Forthepurposesof this sub-article and sub-article 15.10 “area”shallmeaneitherCook,PackagingorElectrical.

VacationswillbegrantedtomembersoftheSkilledTradesDepartmentinaccordancewiththeVacationswith Pay article in this Agreement. Provided,however, that during the period of June 15th toSeptember15thofeachyear,theCompanywillalloweach seniority employee from each area to be onvacationforaminimumofone(1)weekinthisperiodoftime.

15.11 (a) TheCompanywill provide each SkilledTradesEmployeewithfive (5) coveralls or shop coats.These will be replaced upon submission ofdamagedgarments.

(b) The Company will provide proper clothing forSkilled Trades employees who are required towork in the Cold Storage area. This clothingwillbe replaceduponsubmissionofadamagedgarment.

15.13 AseniorityemployeeintheSkilledTradesDepartmentwhowishestotransferfromoneareaoftheDepartmentto another area of the Department must makeapplicationforsuchtransfer,inwriting,totheHumanResources Department between September 1st andSeptember14thofeachyear.TheapprovalofanysuchrequestissubjecttotherequirementthattheCompanyhavetherequisitequalifiedpersonnelineachareaandto the requirement that there be an employee in theareaappliedtowhowilltransfertotheotherarea.Anemployeewho transfers in accordancewith this sub-article will be assigned duties in the new area uponcommencement of the following calendar year. Forthepurposesofthissub-article“area”shallmeaneitherCook,PackagingorElectrical.

15.14 A seniority employee in the Skilled TradesDepartment shall have the privilege to transfer intothe General Classification in another Department,with full seniority, provided that such applicationfor transfer is made between September 1st andSeptember 14th of each year and filed with theHuman Resources Department. An employee who

transfers into the General Classification of anotherDepartment, in accordancewith the foregoing, willbegrantedhisfullseniorityrightsintheDepartmentto which he transferred on commencement of thefollowing calendar year. The provisions ofArticle14oftheCollectiveAgreementdonotapplytosuchtransfer.Onlyoneemployeeperyearwillbeallowedtotransferinaccordancewiththeforegoing.Ifmorethanoneseniorityemployeeapplies,theonewiththegreatestsenioritywillbeallowedtotransfer.

15.15 Employees who are classified and/or back-upmaintenance employees who are required to bringtoolstoworktobeusedintheperformanceoftheirjobfunction,shall,ifsuchtoolsarelostorstolenoruponpresentationofsuchbrokenorworn-out tools (usedinperformanceinsaidjobfunction),shallreceiveanequivalentreplacementtoolfromtheCompany.Thisisprovided thatduecarehasbeen taken in thecareandsecurityofsuchtools.

InordertoreceivereplacementtoolseachmaintenanceemployeemustfirstestablishawrittenlistofrequiredtoolsintheirtoolboxandsuchlistmustbeapprovedbyaMaintenanceSupervisorandacopykeptintheemployee’spersonnelfile.

ARTICLE 16LEAVES OF ABSENCE

16.01 AleaveofabsenceforgoodandvalidreasonsmaybegrantedbytheCompanytoaseniorityemployeeuponwrittenapplicationbeingmadetherefore.PriortotheCompanyconsideringaleaveofabsencerequest,allvacationentitlementsforthatemployeemustbetaken

first,unlesstherequestforleaveisduetoadenialofrequestedvacationinaccordancewithsection24.07(c). Aleaveofabsence,ifgranted,shallbewithoutpay and benefits. A request for a leave of absencewillbeconsideredbytheCompanyonlywhensuchrequest is made in writing, specifying the reasontherefore and the duration of the leave of absencerequested.SuchwrittenrequestmustbedeliveredtotheCompanynotlessthatone(1)monthinadvanceof the commencement of the requested leave ofabsence; provided, however, that the provision foradvance noticemay bewaived by the Company incasesofemergency.

16.02 (a) The Company shall, when presented with arequestinwritingfromtheUnionatleastfour(4)weeksinadvanceofwhentheleaveofabsenceisto commence, grant a leave of absencewithoutpay toaSteward foraperiodnot toexceed ten(10) working days for the purpose of Unionbusiness such as conventions, delegations andseminars.The request shall state thepurposeoftheleaveofabsenceandthelengththereof.Themaximum number of working days which canbe taken in a year under this sub-article shallnot exceed twenty (20) working days in theaggregate inanyperiodof twelve (12)calendarmonths, excluding Executive, Membership andNegotiatingmeetings.

(b) The Company shall, when presented with arequestinwritingfromtheemployeeatleastfour(4)weeksinadvanceofwhentheleaveofabsenceistocommence,grantaleaveofabsencewithout

payforaperiodnottoexceedthree(3)yearstoa seniority employee who is elected to a full-time position with the Union. The employee’sseniorityshallcontinuetoaccumulateduringtheleaveofabsence.

Such employee will have the privilege tocontinuecontributionstothecompanyforbenefitcoveragesduringthisperiod.

16.03 An employee who has been granted a leave ofabsence shall not, during the period of the leave ofabsence,engageingainfulemploymentforanyotherperson, firm or corporation. The failure to complywith this provisionwill result in the termination ofthatemployee’semploymentwiththeCompany.

16.04 ThedecisiontograntornottograntaleaveofabsencerestssolelywiththeCompany.Therefusaltograntaleave of absence and/or any conditions imposed bytheCompanywithrespecttheretoshallnotbesubjectto the grievance and arbitration provisions of thisAgreement. In cases of emergency, a request forleaveofabsencewillnotbeunreasonablyrefused.

16.05 Whenaleaveofabsenceisrequested,theCompanywillgiveitsanswerwithinfive(5)workingdays.Inan emergency situation, the Company will give itsanswerasquicklyaspossible.

ARTICLE 17BULLETIN BOARDS

17.01 The Company will permit posting of notices ofemployee meetings or functions on bulletin boards

conspicuouslyplacedandprovidedforthatpurpose. TheCompanywill provide a locked glass enclosedunitforUnionnotices.

17.02 ACompanyofficialmustbeadvisedofnoticespriortoposting.

ARTICLE 18JURY DUTY

18.01 The Company shall grant a leave of absence to aseniority employee who is required to serve as ajurororwhoissubpoenaedtoappearinanycourtasawitness.TheCompanyshallpaytosuchseniorityemployee the difference between the employee’sregular straight time rate of pay and the paymentthe employee received for attending as a juror or asubpoenaedwitness.InordertoqualifyforpaymentfromtheCompany,theemployeemustsubmitproofof service and the amount of pay received. TheCompanywillnotlimittheemployee’srighttobepaidholidayorotherovertimeassignments.Itwillbetheemployee’sresponsibilitytoadvisehissupervisorandthelabourschedulerofhisdesiretoworkifrequiredbyWednesdayatnoon.Itisalsohisresponsibilitytocall for his schedule time if neededbefore the paidholidayorweekendovertime.

ARTICLE 19WAGES

19.01 Thewageratestobepaidtoseniorityemployeessaveand except seniority employees who are employedin the Skilled Trades Department, as prescribed in

Schedule“A”whichisattachedtoandwhichformspartofthisAgreement.

ARTICLE 20BEREAVEMENT LEAVE

20.01 In the event of the death of a seniority employee’sspouse or child, the Company will grant, uponapplicationmadebytheemployee,uptofive(5)daysleaveofabsence,withpayattheemployee’sregularstraighttimerateofpay,uptoandincludingthedayafterthefuneral,providedthatsuchdaysareregularworkingdaysuponwhichtheemployeewouldhaveotherwisebeenscheduledtowork.Tobeeligibleforpaymenthereunder,theemployeemust,ifrequestedby the Company, provide satisfactory evidence ofdeath.

Intheeventofthedeathofamemberofaseniorityemployees other immediate family, the Companywill grant, upon application made by the employee,up to three (3) days leave of absence, with pay atthe employee’s regular straight time rate of pay, upto and including the day after the funeral, providedthat such days are regularworking days uponwhichthe employee would have otherwise been scheduledto work. To be eligible for payment hereunder, theemployeemust,ifrequestedbytheCompany,providesatisfactory evidence of death. The phrase “otherimmediate family” shall conclusively mean mother,father,brother,sister,step-mother,step-father,mother-in-law, father-in-law, brother-in-law, sister-in-law,grandchild,grandmotherorgrandfatheroftheseniorityemployee.

21.04 It isagreed thatallseniorityemployeesshallbepaidafullregularday’spayattheemployee’sappropriatehourly rate for the above-mentioned Holidays A regulardayforthispurposewillreflecttheemployeescurrentshiftlengthandconfiguration.

21.05 Eligibility for the above named Holidays shall besubjecttothefollowingconditions:

(a) Theemployeewho is available forworkonhisscheduled shift preceding and following theHoliday, orwhen the employeehas the consentoftheCompanytobeabsent,but,notinexcessoffourteen(14)days.

(b) Anemployeewho is ill or injuredup to twelve(12) working days prior and/or following theHolidayshallbepaidfortheHoliday,providinghe supplies the Company with a Doctor’scertificateifrequired.

(c)In order to qualify for pay for the Holidays asabove, the employee’s scheduled working dayhereinbeforereferredtomustfallwithinten(10)workingdaysbeforeandwithinten(10)workingdaysafterthesaidHoliday.

(d) Forthepurposeofclausesa,b,andc,above,thedaysbetweenBoxingDayandNewYear’sDayshallnotbecounted.

21.06 Notwithstanding the provisions of this article, theCompany will not pay paid holiday pay to anyemployeewhohasbeenpaidWorker’sCompensation

forthepaidholiday.

ARTICLE 22VACATION WITH PAY

22.01 Seniority employees shall be entitled tovacation asprovidedinthisarticle.

22.02 Vacations shall be granted in the vacation yearfollowing thevacationyear inwhich itwasearned.For the purposes of this article, the vacation yearshallmeanthetwelve(12)monthperiodcommencingontheemployee’sdateofhireorontheemployee’sanniversary date of hire, as the case may be,and ending on the day preceding the employee’sanniversarydateofhire in the followingyear. Thephrase“dateofhire”shallconclusivelybeinterpretedtomeantheemployee’ssenioritydate.

22.03 All seniority employees with more than one (1)yearbut lessthanfive(5)yearsseniorityasoftheiranniversary date of hire in each year, shall receivetwo(2)weeksvacationwithpay.Vacationpaywillbefourpercent(4%)oftheemployee’stotalearningsinthetwelve(12)monthsprecedingtheemployee’sanniversarydateofhireineachyear.

22.04 Allseniorityemployeeswithmorethanfive(5)yearsseniorityasof theiranniversarydateofhireineachyear, shall receive three (3) weeks vacation withpay. Vacation pay will be six percent (6%) of theemployee’s totalearningsinthetwelve(12)monthsprecedingtheemployee’sanniversarydateofhireineachyear.

22.05 Allseniorityemployeeswithmorethanthirteen(13)yearsseniorityasoftheiranniversarydateofhireineachyear,shallreceivefour(4)weeksvacationwithpay.Vacationpaywill be eightpercent (8%)of theemployee’s totalearningsinthetwelve(12)monthsprecedingtheemployee’sanniversarydateofhireineachyear.

22.06 All seniority employeeswithmore than twenty-two(22) years seniority as of their anniversary date ofhireineachyear,shallreceivefive(5)weeksvacationwith pay. Vacation pay will be ten percent (10%)of the employee’s total earnings in the twelve (12)monthsprecedingtheemployee’sanniversarydateofhireineachyear.

22.07 (a) The Company will make every effort to grantvacations at times requested by the employees.However, recognizing thatproductionschedulesand other factors may make it impossible toapprove vacation, as requested, it is recognizedthat itmaybenecessary to limit thenumberofemployeeswhomay be on vacation at any onetimeortonotapprovevacationasrequested.

(b) TheCompany,will, to the extent possible, givepriority to employees’vacation requestbetweenJanuary 16th and July 14th of each year, on a“first-come-firstserve”basisallowingforaten(10)daywaitingperiod.Duringtheten(10)daysfollowingtheapplicationforavacation,shouldamoresenioremployeeapplyforthesameperiodof vacation, priority will be given to the moresenioremployee.Oncetheten(10)daywaiting

periodisover,ifthevacationrequestisgranted,no senior employee will be entitled to claimpriorityoveramorejunioremployeewithrespecttothevacationtimegranted.

(c) TheCompanywillrequireemployeestotakeupto two (2) weeks of their vacation entitlementduring scheduled shutdowns where possible.Such planned shutdowns will be posted byFebruary 1st of each year. If after February 1st changesarerequiredthatnecessitatedepartmentsworking,volunteerswillbesoughtbyDepartmentseniority first and then by plant seniority. Anyemployeewhose departments are not scheduledfor shutdowns will be required to take two (2)weeksofvacationduringeachcalendaryear.

IntheeventtheCompanycannotscheduleplannedvacation shutdowns employeeswill be requiredto schedule two weeks of vacation entitlementduring the calendar year. Where practicable,vacationswill be scheduledas requestedby theemployeesinemployeeseniorityorderuptoMay1, thereafter on a first come, first serve basis,except that efficient operationof the plant shallbethefirstconsiderationandtheCompanyshallassignvacationsonthatbasis.

In the event employees schedule vacation at timesother than scheduled shutdown periods thoseemployees will be entitled to utilize the scheduledtimeasvacationandwouldbeconsideredonlay-offduringscheduledshutdowns.

22.08 Vacation pay, uponwritten request by the employee,

will be paid by the Company, inminimum amountsoffive(5)dayspay,inthepayperiodfollowingsuchrequest. The appropriate forms are available in theHumanResourcesofficeandmustbesubmittedpriorto05:00pmonFridaystobeissuedthefollowingweek.VacationpaywillbepaidbytheCompanybythe15thofSeptemberineachyear.

ARTICLE 23HEALTH AND WELFARE

Thefollowingarticlesdonotapplytonewemployeeshired after April 1, 2011 unless specified. Newemployees in good standing shall be eligible for theprevailingCompanyFlexBenefitsplan.

23.01 SEMI PRIVATE - 100%ofthepremiumswillbepaidbytheCompanyforsemi-privatehospitalcoverageforall seniority employeeswhile in active employmentoftheCompanyandtheireligibledependents,wheresuchanemployeemakesapplicationtherefor.

23.02 LIFE INSURANCE - TheCompanywillpay100%of the premiums payable for life insurance for allseniorityemployeeswhileintheactiveemploymentof the Company where such employee makesapplicationtherefor,asfollows:

23.03 PRESCRIPTION DRUG PLAN - The Companywill pay 100% of the premiums payable for a“prescription only” drug plan ($3.00 co-pay) forseniorityemployeeswhileintheactiveemploymentoftheCompany,andtheireligibledependentswhere

such an employee makes application therefore.Lowestcostgenericdrugswillbeutilizedfirstunlessthephysicianindicatesnosubstitutionornogenericequivalentexists.

“Prescriptiononly”drugsdonotincludeanyitemthatcanbepurchased“overthecounter”.

23.04 VISION CARE - The Company shall provide, toallseniorityemployees,avisioncareplantoincludecoverageforemployeesandtheireligibledependentsas described in the Plan. Effective this vision careplanwillprovideamaximumreimbursementofthreehundred ($300.00) per eligible participant everytwenty-four(24)months.

23.05 It shall be the responsibility of the employees toensure theycomplywithall eligibility requirementsfor coverage under this article. The details of thecoveragearemorespecificallysetoutintheoriginalcontractforinsurancecoverage.

23.06 DENTAL PLAN - TheCompanywill pay into theUnited Food and Commercial Workers TrustedDentalPlan-Ontario,effectiveApril1,2007,thirtyone ($.31) per non-overtime hour worked by eachseniority employeewhile in the active employmentof the Company and their eligible dependents asdefined in thePlanwhere such an employeemakesapplication therefor. The Company’s contributionswillalso includecontributionspaidonvacationandpaidholidayhoursandwillbeforwardedtothisPlanwithinfifteen (15) days of themonth following themonthforwhichthecontributionsarebeingmade.

(i) Effective January 1, 2019. The Company agrees to add ten cents ($0.10) per non-overtime hour worked by each seniority employee while in the active employment by the Company.

23.07 WEEKLY INDEMNITY - The Company willpay 100% of the premiums payable for a WeeklyIndemnityPlanforeligibleseniorityemployeeswhileintheactiveemploymentoftheCompany.SubjecttothetermsandprovisionsofthePlan,coveragewillbeforaperiodoftwenty-nine(29)weekscommencingontheonehundredandtwentieth(120)dayofabsencefromworkandtheamountofcoverageshallbesixty-six and two-thirds percent (66-2/3%) of eligibleearningssubjecttoamaximumofthreehundredandtwentydollars($320.00)perweek.

23.08 To become eligible for the Company’s portion ofpremiums for the Health and Welfare coverages,seniority employees must have completed theirprobationaryperiodandmusthavereceivedforty(40)hoursofpayfromtheCompanyinanypayrollmonth.Inanymonthwherethereisatotalshutdownofany1(one)ormoreofthemajordepartments(Coated),thehoursrequiredtoqualifyforthecompanyportionofthebenefitscostwillbereducedby20hoursperweekof shutdownplantwide. Thehours creditedwill bebasedonthepayrollmonthsandthedaysoftheweekinwhich the payrollweek ends in amonthwill becreditedtothatsamemonth.Entitledvacationswithpayandspecifiedholiday,ifany,shallbeconsideredastimeworked.

23.09 (a) Any seniority employee who is absent from

work because of illness or injury or who hasbeenlaidoffbytheCompanyandwhowishestocontinuetoparticipateintheHealthandWelfarecoverageasprovidedinthisArticleasamemberof the Company’s group with respect to suchcoveragemaydoso,subject toall requirementsof thePlansandprovidedhecontinues tobeanemployeeoftheCompanyandcontinuestomeetalltherequirementsoftheplanandprovidedhepaystotheCompanytheamountofthepremiumpayment in advance of the premium due dates.This privilege does not apply to semi-privatehospitalization coverage. This privilege shallterminateontheexpiryoftwo(2)yearsfromthecommencementoftheillness,injuryorlayoff.

(b) AnyemployeewhoisbeingpaidE.I.SickBenefitsorWeeklyIndemnitybenefitswillqualifyfortheCompanypaidportionofthebenefitsplancost.

AnyemployeewhoisonWSIBwillqualifyforthe Company paid portion of the benefits plancostforamaximumofoneyearfromthedateofinjury.

23.10 PENSION PLAN - The Company will pay into the Canadian Commercial Workers Industry Pension Plan, on behalf of each seniority employee, the sum of one dollar and nineteen cents ($1.19) effective upon ratification for each non-overtime hour worked by each seniority employee, subject to a maximum of forty-eight (48) hours per week. Pension plan payments will be made for all hours worked at straight time contribution rates for all overtime hours worked up to an individual annual

maximum contribution of 2000 hours. These Company contributions will be remitted by the Company by the fifteenth (15th) day of the month following the month for which the contributions are being made. Entitled vacations with pay, if any, shall be considered as time worked.

(i) Effective upon ratification the Company agrees that all Tier 2 employees currently enrolled in the JDI Pension Plan will transition to the CCWIP Plan by June 30th, 2015. All new hires will be enrolled in the CCWIP Plan. The JDI benefits plan will remain in force for all Tier 2 and new hires as soon as eligibility requirements are met.

(a) Effective upon ratification, the Company will create an additional premium paid to the employee of twenty four (24 cents) per hour to be designated as a CCWIPP employee contribution. The hourly premium will be applied to all bargaining unit members. There will be no pyramiding of this premium and the hours will be capped as per the existing collective agreement (23.10).

23.11 ThePlandocumentsforallSickandWelfareBenefitsprovidedunderthisagreementareanintegralpartofthecollectiveagreementandareherebyincorporatedby reference into it.Exactduplicatesof theseplanswillbeforwardedtotheUnion.

23.12 The Company will reimburse employees forchiropractic services to a maximum of $ 200 per

annum,providingthatadoctor’sreferralisobtained,andproofofsuchsubmitted.Thisbenefitwillapplytoemployeesonlyandnottheirdependents.

23.13 TheCompanyshallprovidearetirementseminarforeligibleemployeesoncepercalendaryear.

23.14 TheCompanywill pay 80% of the cost forHealth& Welfare coverage including semi privatehospitalization,lifeinsurance,prescriptiondrugplan,visioncareandweekly indemnityforallemployeeswho attain seniority after April 1, 2008 while inthe active employment of the Company, and theireligibledependentswhere suchanemployeemakesapplicationtherefore.

“Prescriptiononly”drugsdonotincludeanyitemthatcanbepurchased“overthecounter”.

23.15 The Company will administer a medical coverageplan for those employees and their dependantswhochoosetoretire.Retiringemployeeswillberequiredto make application for such coverage one monthpriortotheirplannedretirementdate.Employeeswhochoosetoparticipateinthisplanwillberequiredtopay100%ofthecostoftheplanpriortothefirstdayofeachmonthinordertoremainactiveinthemedicalcoverageplan.

ARTICLE 24COST-OF-LIVING-ALLOWANCE

24.01 Seniority employees who have completed theirprobationary period will be provided a Cost ofLivingAllowance in accordancewith the following

provisions:

(a) TheCompanyagrees toprovideCostofLivingAllowancedetermined in themannerand to theextent hereinafter set forth in accordance withchanges in the official Consumer Price Index,publishedbyStatisticsCanada (1981=100), andhereinafterreferredtoastheC.P.I.

(b) CostofLivingAdjustmentwillbemadeupwardor downward as hereinafter provided based onchangesintheC.P.I.butinnoeventwilladeclinein the C.P.I. below 136.4 provide a basis ofreductioninthewagerateshereinsetforth.

(c) Adjustments in the Cost of Living Allowanceshallbemadeatthefollowingtimes,basedonthefollowingC.P.I.:

ARTICLE 25HEALTH AND SAFETY

(b) The Company will supply copies of “Form 7”Compensation forms immediatelyandcopiesof“RestrictionsList”totheChiefStewardandtheCoChairoftheHealthandSafetyCommittee.

(c) The Company and the Union will work jointlytopromote thesafeoperationof theplant. Thecompany agrees to work with the Union toprovideeducationrelatedtothehealthandsafetyofitsemployees.

TheJointHealthandSafetyCommitteememberswillassistinthedevelopmentandcommunicationof safety regulations and safe work practices,and, in conjunctionwith the supervisor providethe necessary notification to employees whentheyobserveunsafeworkpractices,behaviouror

25.02 The Company will provide all seniority employeeswith a one time annual reimbursement of up to$95.00forthepurchaseofapprovedsafetyfootwear,uponsubmissionofareceipt.

Seniority employees in the Sanitation Departmentwill be entitled to an additional one time annualreimbursementofup to$95.00 for thepurchaseofadditionalapprovedsafetyfootwear,uponsubmissionofreceipt.

ARTICLE 26DURATION

26.01 ThisAgreementshallbecomeeffectivethe 1st day of April, 2014 and shall remain in effect until the 31st day of March, 2019.

26.02 EitherpartytothisAgreementmay,withintheperiodofninety(90)calendardayspriortothe 31st day of March of 2019 give notice in writing to the otherpartyofitsdesiretomakeanewagreement.

ARTICLE 27LABOUR MANAGEMENT COMMITTEE

27.01 TheCompanyandtheUnionrecognizethevalueofcooperation in the solutionofproblemscommon totherelationsbetweenthem.Forpurposeofimprovingsuch relations and reaching mutual understandingsas to the proper aims and objectives of each other,the joint labour-management committee shall beestablishedwithinthirty(30)daysaftertheexecutionof thisContract consisting of representatives of theCompany and the Union. Procedure:

1. Change of shifts requests will only be considered for requests within the same department.

2. Two employees have mutually agreed to change shifts within the same department (Cook, Pack, Skilled Trades)

3. Each employee must ask permission from their immediate supervisor in advance; both supervisors have to approve.

4. Requests can only be considered if both employees are on the schedule for the day being requested.

5. Employees’ classification and/or back up status cannot affect people who change shifts (as they already on the schedule according to their own seniority rights).

6. If both are on the schedule, the supervisor will consider the jobs to be performed, the qualifications, willingness, and ability of the employees switching to the other shift.

7. Eligible shift premium would be paid to the person who actually worked on the shift where shift premium was applicable.

9. Overtime following the shift would be assigned to the employee who actually worked on that shift were the overtime opportunity exists.

10. Saturday overtime would be assigned to the employee who actually worked the Friday shift where the overtime opportunity exists. (E.g. If overtime on the afternoon on Saturday, the employee who actually worked on the afternoon shift on Friday would be assigned).

11. Sunday overtime would be assigned to the employee who is scheduled for the Monday shift where the overtime opportunity exists.

12. Supervisor will notify Human Resources, in advance of any changes (for crew sheet purposes).

RE: 24 HOUR CREWING GUIDELINES

The following guidelines will be used effective April 17, 2000:

For Tomorrow’s Day and Afternoon Shift :

• Requirements to the Labour Scheduler by 10:00 am the day before

• Employees will be notified by 2pm to 4pm

If the company cannot reach the appropriate employee to come to work for tomorrow’s shifts, the next available Senior Employee will be contacted and scheduled in.

Changes in Shift/Department or job will now be communicated by “schedule change” postings. These changes will be posted in each plant by 2:00pm for the day shift and 4:30pm for the night shift. Any other changes will be communicated to the employee by telephone.

LAST MINUTE CREWING:

Because 24 hour crewing allows the scheduler to complete both day and afternoon shifts the day before, any changes in the scheduling after 2pm the day or on the day of the shift, will be done on a last minute crewing basis.

If production scheduling calls for a decrease/increase in crewing for a shift, the scheduler will call in/call off employees

In the case that a situation resulting in a plant/partial shutdown (i.e., Fire, breakdown, hydro outage, etc.), the Company will make every effort to notify the appropriate personnel.

In the case of bad weather (i.e. Snow Storm) the employees are advised to listen to the Local Radio Station CHYR FM 96.7 for details of possible shift cancellations.

If employees cannot be notified before the start of the shift, the Company cannot be responsible for employees reporting to work in these types of situations.

3. Schedule theSanitationemployees,bysenioritythatisworkinginthatarea(employeescurrentlyworkingintheirchosenareaandemployeesfromotherareascurrentlyworkinginthatareawheretheovertimewilloccur).

4. SanitationBandSanitationLeaderclassifications,not already scheduled for overtime, becomesavailableforovertime(regardlessofarea),basedonseniorityandclassification.

5. When thereare insufficientemployeesavailablefor overtime, employees will be scheduledstartingfromthelowestsenioritypersonholdinga Sanitation classification until a sufficientnumberofpersonnelarereached.

6. Ifthereisovertimeinmorethanonearea(CookorPack), at the same time, the above rules stillapply.Whenovertimeisfinishedinoneareafirst,thosepeoplecannotdisplaceotherareapersonnelworkingovertime;however,theymaybeaskedtostay(byseniority)asadditionalhelp.

7. To be eligible for overtime in an area, theemployeemusthavebeenscheduledinthatareabythesupervisor,andmusthaveworkedinthatareaforatleast50%ofthattimeinthatarea.

8. TheSupervisorwoulduseArticle14todetermineeligibilityforovertime.

A. The Company shall make its best efforts to schedule layoff(s) and shutdown(s) to begin after the commencement of a payroll month, or end prior to the close of a payroll month, in order to permit employees to work and report hours worked for the purposes of the Dental Plan.

B. If the Company cannot schedule in accordance with the above, the Company shall make its best efforts to schedule any and all employee training sessions during the shutdown period. When scheduled the employees undertake to make best efforts to attend said sessions to ensure that they have worked hours that can be submitted to the Dental Plan.

C. If the Company cannot schedule sessions or certain employees are unable to report credit for working hours as provided in par. B above, the Company shall continue to encourage and authorize eligible employees to schedule single vacation days during any shutdown period to permit those vacation hours to be submitted to the Dental Plan to ensure continuity of coverage.

D. If the Company is unable to supply a viable opportunity for eligible employees to credit hours

to the Dental Plan during a shutdown on the basis of the foregoing steps and if a total shutdown occurs in a month in which one of the CBA Paid Holidays, detailed in Article 21.01 of the CBA, is scheduled, notwithstanding the eligibility provisions of s. 21.05 of the CBA, the Company shall, for the purpose of Dental Plan contribution only, permit an employee to utilize a single Paid Holiday, which coincides with the shutdown period, as paid holiday hours credit to the Dental Plan in order to ensure continuity of dental coverage.

The foregoing process is intended for the sole purpose of assisting employees who would otherwise be required to self-fund the Dental Plan to continue their eligibility without interruption, and for no other purpose.

As discussed in Collective Bargaining on April 7th, 2015. You had requested that in the event that the CCWIPP stabilization plan requires an increase in Employee Contributions that the increase will be borne by the employee and the funds will be transferred from the existing COLA clause.

The Company agrees to assist in this reallocation of COLA funds as long as there are no incremental costs associated with the transaction.
