RESOLUTION NO.

WHEREAS, to help defray all the necessary and reasonable

expenses to successfully hold and manage the 2013 Barangay &

Sangguniang Kabataan Electio11S and to ensure that the said electionsare 110nest, orderly, peaceful, a11d credible, the COlTI111issio11 enacted

Resolution No. 9739;

WHEREAS, Resolution No. 9739 sought to irnplernel'lt Section

50 of tIle Omnibus Election Code, Sectiol1 8 of Republic Act No. 9164

as arnel1ded by Section 4 of Republic Act No. 9340, and Section 532 (c)

il1 relation to Section 329 of tl1e Local Governn1ent Code;·

WHEREAS I reports froIn the various field offices of the

Con11l1ission indicate the unwil lingness and desistance of local

governll1el1t units in cOll1plying with Resolution No. 9739 for various

reasons;

WHEREAS, the insufficiency of the funding set aside by the

National Government for the conduct of the 2013 Barangay &

Sangguniang Kabataan Elections makes it imperative that such

amounts set aside by mandate of the foregoing laws be collected from

tIle local goverllll1ent units; and

WHEREAS,. Section 51 of tIle Otnnibus Election Code

COInll1al1.ds tllat vio lation o f Section 50 constitutes a pro11ibited ac t

Wllich shall be prosecuted and pellalized in accordance with the

provisions of tIle Orrmiblls Election Code.

NOW, THEREFORE, tIle COll1ll1ission En Bane, by virtue of tIle

powers vested in it by the COl1stitution, th e Omnibus Election Code,

Repllblic Acts Nos. 9164 and 9340, the Local Governll1ent Code, and

all l)tller pertinent statutes, rules, and regulations, hereby

RESOLVES to ISSUE tIle following guidelines for the

implell1entation of Resolution No. 9739:

(1) A ,111etnOrandulll of agreel11ent with tIle Departll1ent

of th e Interior an d Local Gover111nellt is not a

tnandatory requiretnent, and neither is it necessary,

to i:mplel11ent and enforce Resolution No. 9739.

(2) Local government. units must submit their

contril->utions as required by Resolution No. 9739 not

later than 18 October 2013.

(3) The COl11rnission, througll its field officials, silall

endeavor to collect the amounts required by

Resolution No. 9739 witilout regard to whether tIle

Sangguniang Kabataan Electiol1S w ill be postponed

or not, since tIle directive' ullder Section 50 of the

Oll1nibus Election Code is not limited by th e

postponel11ent of tIle Sal1ggul1iang Kabataan

Elections, and il1 addition, Section 8 of Republic Act

No. 9164 as alllenlied by Section 4 of Republic Act

No. 9340 is clear tllat the COIl1lllission's

appropriations Il1ay be augl11ented by an am.ount not

exceeding te n per cell(Llnt (10%) of tIle Sanggunia11g

I(abataa11 funds reserved pursuant to Section 532 (c)

of Republic Act No. 7160.

(4) Local governll1ent officials in-charge of the funds or

accountC;lble for such funds as set aside by the lawwho continue to desist, be unwilling, or disinclined

to cOlllply with Resoltltion No. 9739, or those w11o,

witl10ut sufficient or justifiable reason, neglect or

refuse to COInply with Resolution No. 9739 after due

delTIand or request, shall be charged with a l l

elect ion offense pursuant to Section 51 of the

OInnibus Election Code, in addition to proper

administrative action and otller crinles for whicll the

local governl11ent official or person concerned may beliable for.

Let the Project Director of tIle Project Managen1el1t Office for

tIle 2013 Barangay & Sangguniang Kabataan Elections, the Finance

Services Departnlent, and the respective Regio11al Election Directors

of the COll1lTIission ill1pletnent this Resoltltiol1.

TIle Education and Information Depa,rhnent of the COlllmission

is 11ere11y directed to cause tIle publication of t11is ResolLltiol1 in two (2)

daily newspapers·of general circulation.
