After reviewing our transactions for 2011, I am pleased to report some encouraging signs that our market is beginning to adjust to the new reality. at begs the question: what is the new reality? If one were to ask the reason for this dramatic change, I would be hard pressed to pin point the exact cause but rather proffer a few suggestions. e hard work and dedication of our eight full- time, experienced commercial brokers, each with their own area of expertise, backed up by a strong support staff has played an important role in the turn around. We have also seen a greater acceptance of the new market paragon by sellers (including banks and landlords). is new attitude combined with the significant amount of ‘bored cash’ sitting on the sidelines and the availability of all-time low interest rates for owner occupiers have no doubt played an important role in our banner year. e somewhat bad news is if you are an owner of real estate, your overall investment has taken a substantial decrease in value. However, real estate needs to be considered a long term investment and if one agrees with this perspective, I am of the firm opinion that the future can only get brighter. Will this level of activity be sustained throughout the coming year? e opinions are varied but a common trend for our community suggests that until employment figures improve our market will be subjected to the whims of the global market, the unresolved European debt crisis and of course the upcoming presidential election. Welcome back to the Ian Black Real Estate Property Guide! After reviewing our transactions for 2011, I am pleased to report some encouraging signs that our market is beginning to adjust to the new reality. That begs the question: what is the new reality? Commercial real estate is currently inexpensive by historical standards. Rents and sales prices are in most cases back a generation. The good news is that there is significant activity in the market. Our transaction volume has nearly tripled from 2010 and the pipeline is looking good for the first quarter of 2012. If one were to ask the reason for this dramatic change, I would be hard pressed to pin point

the exact cause but rather proffer a few suggestions. The hard work and dedication of our eight full-time, experienced commercial brokers, each with their own area of expertise, backed up by a strong support staff has played an important role in the turn around. We have also seen a greater acceptance of the new market paragon by sellers (including banks and landlords). This new attitude combined with the significant amount of ‘bored cash’ sitting on the sidelines and the availability of all-time low interest rates for owner occupiers have no doubt played an important role in our banner year. The somewhat bad news is if you are an owner of real estate,

your overall investment has taken a substantial decrease in value. However, real estate needs to be considered a long term investment and if one agrees with this perspective, I am of the firm opinion that the future can only get brighter. Will this level of activity be sustained throughout the coming year? The opinions are varied but a common trend for our community suggests that until employment figures improve our market will be subjected to the whims of the global market, the unresolved European debt crisis and of course the upcoming presidential election. Solar energy: The logical choice

The four basic factors in evaluating the affordability of a property have always been principle, interest, taxes and insurance. In recent years smart buyers are also asking one more important question: Energy costs! Energy costs associated with a home or office building are often overlooked and can create a problem after the purchase. New buildings are built to the latest energy code or have a LEEDS rating which can give the buyer some guidance. Older buildings can

be retrofitted with energy efficient appliances and renewable energy devices to bring the annual energy use to an insignificant amount. There are various incentives from the government and utilities which can make the investment in energy savings cost effective. A history of electric bills included in the listing information can be a very positive sales advantage. Title insurance — why use a title agent

Obtaining title insurance and having a competent title agent complete an accurate title search is a vital component for acquisition or financing of real property, especially for transactions involving distressed properties. Title insurance protects a buyer against financial loss from title defects in real property. This article is meant to underscore the importance of both buyers and sellers hiring a competent title agent to write title insurance. While title review is a major component in due diligence for buyers, it may be less obvious as to why a seller should also undertake an equally diligent review.

A very simple but potentially costly mistake would be for the buyer’s title agent to overlook a lien on the property. If the seller proceeded to close on property without paying off a mortgage lien not discovered by the buyer’s title agent, then the seller could be in breach of the warranty deed, as most deeds require the seller to warrant that the property is being conveyed free of all encumbrances. If this issue is discovered after closing, the seller could be involved in a protracted and expensive lawsuit against the buyer and the lender. By the time the lien is discovered, the seller may have spent the closing proceeds and would be personally liable to the lender to pay off the lien, especially if a personal guaranty had been executed. While the buyer would have a title policy to shield the buyer, the seller would have no such claim under the buyer’s title policy.

This situation could result when a seller allows a buyer to choose the title agent, effectively giving the buyer control (whether the agent is competent or not), to the detriment of the seller. Buyers and sellers obviously want to keep closing costs low; however, allowing a party to control who reviews and completes the title work could cause costly mistakes that result in significant adverse financial consequences. Distressed properties have an increased risk of title and lien issues, given that these properties are in danger of going into foreclosure or being put up for sale because the owner has defaulted on mortgage payments. Given these risks, it is even more crucial that a title search (and the subsequent title policy) be completed and issued by a competent title agent.

Why do changes in the home loan world benefit me? It is no secret that the residential mortgage world has had to completely reinvent itself after its failure over the last few years. Often, with the best of intentions, an over re-engineering takes place that does not fix the problem. Instead these changes can complicate the situation for those that were not part of the challenge to begin with. This has happened to some degree with secondary market lending. The foundation for secondary market standards is set by Government Sponsored Enterprises (GSE’s) which effectively failed and had to be put into receivership by the U.S. Government

during this financial crisis. As a result, it has become very difficult to get a simple loan at as favorable rates as one might think due to the various interpretations of lenders working within a system with moving targets. Since The Penny Hill Group (who at the top of the market closed $300 million with JP Morgan Chase) has a very financially complex and sophisticated client profile, they wanted to insulate their clientele from as much of this fall out as possible. Now, the answer is simple. Joining Insignia Bank… We (the Penny Hill Group) are now able to offer so much more to our clients. Instead of having the products and guidelines of one big bank, we are able to offer our clients over seven different conduit loan providers, in addition, to Insignia Bank’s portfolio programs. This gives us different product types, different rates, and different guidelines (as each

lender interprets the GSE regulations differently). In addition, we have the individual, service oriented attention that a small community bank can offer where every customer is provided Private Banking Services. Insignia Bank offers true portfolio loans with guidelines outside of the secondary market GSE driven requirements for standard “vanilla” loans. In addition Insignia offers their clients construction loans, lot loans, “resort and condo-tel” lending, loans to Canadian borrowers, and other complex lending scenarios (property or client related). Insignia Bank is “well capitalized” and therefore able to customize product offerings needed in the local market. These products create an environment where mortgage lending becomes satisfying and helpful. It is rewarding to make a difference!
