Dorothy H. Matzke

Dorothy Matzke Named To Commission Governor,J. J. Exon has announced the appointment of Dorothy H.

Matzke of Lincoln to a six year term as a member of the Nebraska Real Estate Commission.

Mrs. Matzke is the first person to be appointed under a provision of an amendment to the Real Estate License Act recently enacted by the Le.gislature. The Act now provides for an additional commission member who is appointed at large and who must have been a licensed salesperson for not less than three years.

Dorothy Matzke has been licensed as a salesperson since 1971 and is associated with Woods Bros. Realty, Inc. in Lincoln. She is the first woman to serve as a member of the Commission.

She is a graduate of the University of Nebraska at Lincoln with a B.S. degree in Home Economics and is a member of Phi Upsilon Omicron and Omicron Nu, home economics honoraries, and Past President of the University of Nebraska Home Economics Alumni.

Her professional and civic activities include serving on the Lincoln Public Schools Advisory Committee for Vocational Education, Board of Directors-Child Guidance Center, and State Education Committee-Ne­braska Realtors Association. Dedicated to volunteer work she is active in her church, and has served as a volunteer with such worthy causes as the Madonna Home, Meals on Wheels, March of Dimes, Prescott school library and as a Den Mother in the Cub Scout program.

Televised Course ''Real Estate Principles

and Practices''

Scheduled

The television course, "Real Estate Principles and Practices," is scheduled for broadcast on the Nebraska Educational Television Network beginning Monday, No­vember 6, 1978.

The University of Nebraska-Lin­coln (UNL) Division of Continuing Studies SUN course is being pre­sented with the cooperation of. the departments of Real Estate and Land Economics at the University of Nebraska at Omaha and the UNL Department of Finance.

Television segments of the course were made possible through a grant by the Nebraska Real Estate Com­mission to the UNL Division of Continuing Studies, and a matching loan to the Division by the Univer­sity of Nebraska Foundation.

From The Director's Desk 4 RULES AND REGULATIONS HEARING NOTICE

At 1 :30 P .M. September 18th a public hearing will be held in Room 1113, State Capitol Building for the purpose of considering changes in the Rules and Regulations relating to the Real Estate License Act.

A hearing will also be held for the purpose of considering new Rules and Regulations relating to the Nebraska Real Estate Appraiser Act. A verbatium copy of the proposed changes and proposed new rules is published elsewhere in this issue. In addition to this notice, a similar notice has been published in 17 daily newspapers throughout Nebraska with the hope that all interested persons will know about the hearings and have an opportunity to be heard.

The proposed new rules relating to the Real Estate Appraiser Act were published and considered at a prior time but because of technical reasons, it was not possible to complete the adoption of the Rules at that time. The technical matter has been corrected by legislation and hence, the reason for again considering the proposed new rules.

If you have any opinions relative to the proposed rule changes or proposed new rules, please attend the hearing.

SALESPERSON APPLICATIONS Education requirements under the provisions of LB 361, recently

enacted by the Legislature, require all applicants for real estate salespersons' licenses to furnish evidence of completion of two courses in real estate subjects, approved by the Commission, composed of not less than 60 class hours of study or in lieu thereof, correspondence courses approved by the Commission.

It should be understood that the courses must have been successfully completed prior to the time at which applicants file applications. Filing deadlines cannot be met on the basis that applicants are taking courses which will be completed at some future time. Applications cannot be accepted without the education information.

programs supplement printed ma­terials produced by the Department of Independent Study in the Divi­sion. The televised programs will be shown each week on Mondays at 9 p.m., with a repeat telecast on Saturdays at 10:30 a.m. Programs will continue through December 16.

Recent legislation passed by the Nebraska Legislature requires indi­viduals entering the real estate profession to complete two courses in real estate subjects before they may qualify for licenses. Dean Gessner said the television course will give potential real estate sales­persons opportunity to partially meet the licensing requirements through home study.

Individuals may take the course on either a credit or non-credit basis. Those wishing 3 semester hours credit must pay a tuition fee of $75 plus $40 for the course instructional kit. The non-credit fee is $25, plus $40 for instructional materials. Individuals wishing to take the course for the purpose of

meeting real estate education re­quirements must take the course for credit.

In addition to the television programs and home study materi­als, faculty services will be available to all enrolled students (credit or non-credit) by calling the toll-free number 800-7 42-7 421.

The television components for the course are being produced at the facilities of the Nebraska ETV Network in Lincoln. A team of faculty members from the U niver­sity of Nebraska Lincoln and Omaha campuses are currently working on the project. The team includes real estate professors Dr. Don Nielsen and Dr. Wayne Wilson of UNO, and Dr. Mahlon Sorenson, instructor for finance at UNL.

Recently, The United Stated Department of Housing and Urban Development entered into an Affirmative Fair Housing Marketing Agreement with the Nebraska Real Estate Commission, a member agency of the National Association of Real Estate License Law Officials (NARELLO). The formal signing ceremony was held on July 7, 1978, and those attending included Mr. Lloyd Davis, Director of Voluntary Compliance, HUD, Washington, D.C., Mr. Nate Ruben, Acting Area Director, Omaha Area Office, Mr. Charles Jean-Baptiste, Director, Fair Housing/Equal Opportunity Division, Omaha Area Office, David G. Mitten, Robert K. Corn, Bernard W. Hardesty, Frank J. Wear, Commission Members, Robert H. Petersen, Counsel for the Nebraska Real Estate Commission, Mr. Paul Quinlan, Director, Nebraska Real Estate Commission, Mr. Allen ·J. Beermann, Nebraska Secretary of State and chairman of the Commission, and Governor J.J. Exon who witnessed the signing.

A press release issued by HUD on the occasion of the signing, reported in part as follows: "Real Estate License Law Officials, bein_g responsible for regulating the practices of individuals and organizations engaged as real estate agents within their respective jurisdictions, are in an advantageous position to promote the National Fair Housing Policy. The agreement has the dual objective of ensuring that all professional services of a licensed real estate agent/broker are equally available to all persons regardless of race, color, religion, sex, or national origin and ensuring that all newly licensed persons in the real estate business are informed of and held to their responsibilities under the fair housing laws. The agreement also evidences the commitment of the Nebraska Real Estate Commission to utilize its powers in achieving the objectives .of the agreement and provides for the sharing of information by HUD and the Commission. HUD will off er technical assistance to the Commission to further the agreement's objectives.

With the signing of the agreement, Nebraska has become one of the early states to adopt the National Affirmative Fair Housing Marketing Agreement for Real Estate License Law Officials."

Proposed Rules Nebraska Real Estate

Appraiser License Act

RULE NUMBER 1

A raisals minimum standards; documentation, disclosure and cer.tifi­ca ion re u1rements· ena ties.

1 written or ora appraisal, reporting an estimated value, shall be supported with written documentation or written memoranda which shall include but not be limited to the following:

(a) An identification and description of the property being appraised.

(b) The purpose of the appraisal and a definition of the value estimated.

(c) Information upon which the appraisal is based. (d) The effective date of the appraisal. (e) The reasoning supporting the value conclusion which may

include the Market Data Approach (Direct Sales Comparison Approach), the Income Approach and the Cost Approach. The exclusion of any of these three approaches must be explained.

(f) The final estimate of value. (g) All Special and limiting conditions, if any.

(2) It shall be deemed grounds for suspension or revocation for a licensed appraiser to omit any of the requirements provided in Section (1), from any appraisal report transmitted to a client without good cause. If, with good cause, any of the above requirements are not included in the appraisal report transmitted to the client, the appraiser shall clearly set forth within the appraisal report transmitted to a client a statement to the effect that the portion excluded or assumptions made are included in the appraiser's written appraisal or written memoranda which has been prepared and retained in the appraiser's file and which written appraisal or written memoranda shall be incorporated by reference and become an integral part of the appraisal.

(3) When a client requests that something less than a full and complete written appraisal report be prepared by an appraiser, the appraiser may accept such limited assignment provided that he complies with the following requirements:

(a) Prior to accepting such limited assignment, the appraiser must advise his client in writing that the assignment calls for something less than a full and complete appraisal report and that the appraisal report will, therefore, be qualified to reflect the limited scope of the assignment.

(b) The limited scope of the appraisal report must be set forth and described in the report.

(c) The contents of the appraisal report must be drafted in such a way that the report is meaningful and in such detail so that the limited nature of the report will not result in misleading the client or the public. (4) For the purposes of this Rule, the testimony of an appraiser

concerning the appraiser's analyses, conclusions or opinions concerning real estate shall be considered to be the equivalent of an oral appraisal report. An appraiser must comply with the specific reporting rules relating to oral appraisal reports when said appraiser testifies in a judicial proceeding with respect to any of said appraiser's analyses, conclusions or opinions concerning real estate.

(5) Each appraisal report must contain a certification by the appraiser charged with rendering the valuation which must include but not be limited to certifying that the appraiser:

(a) Has no present or contemplated future interest in the real estate that is the subject of the appraisal report.

PRESIDENT CARTER APPOINTS ROBERT K. CORN

TO USO BOARD

President Carter announced the appointment of Mr. Robert K. Corn of Papillion, Nebraska to the USO Board of Governors, USO World Headquarters. Mr. Corn joins such notables on the Board as Joseph Robbie-Manufacturing General Partner of the Mianl.1 Dolphins, Donald Keough-Executive Vice President of Coca-Cola Co., Cary Grant, Edward J. Daly-President and Chairman of the Board of World Airways, and Ambassador John Davis Lodge.

The President, under the by-laws of the USO, is requested to name six persons to the Board, who then serve a three year term.

Mr. Corn said of his appointment, "I am very honored to be named to this position." He added, "I wi.11 proudly accept the challenge and the responsibility to assist the USO in whatever way I am able."

As a USO Board member, Mr. Corn will help set policy and program activities for USO world­wide operations. The USO, now in its 37th year, provides a wide-rang­ing program to meet the needs of over two million U.S. service people and their three million dependents.

From a network of over 100 centers worldwide, USO services include programs of informal coun­seling and referral, community in­volvement projects, intercultural understanding opportunities, help with emergency situations, and providing of the famous USO shows program to isolated bases.

Mr. Corn, by serving on the USO Board of Governors, demonstrates his strong support of the USO's volunteer effort to which he will add his time, energy and ideas.

(b) Has no personal interest or bias with respect to the subject matter of the appraisal report or the parties involved; Provided, if a statement, as required in a. and b. of Subsection 3, cannot be made, then such appraisal report must contain a clear statement disclosing all such personal interest or bias.

(c) Has or has not personally inspected the subject property. (d) To the best of the appraiser's knowledge and belief, the

statements of fact contained in the appraisal report, upon which the analyses, opinions and conclusions expressed therein are based, are true and correct.

(e) The appraisal report sets forth all of the limiting conditions, affecting the analyses, opinions and conclusions contained in the report.

(f) No person other than the signer of the appraisal report, except as otherwise acknowledged, prepared the analyses, opinions and conclusions concerning the real estate that are set forth in the appraisal report.

RULES AND REGULATIONS OF THE NEBRASKA REAL ESTATE COMMISSION PROPOSED RULE CHANGES

(New language has a line under it and deleted language has a line through it)

Rule 1, Section (4) be amended to read as follows: (4) Salesmen desiring to transfer to a broker's license must first file

with the Commission such application for a broker's license and appear for a written examination at a regular examination date.

(a) The words "have served actively", for one-year or two-years as the case may be, and as provided in Subsection (2) Section 81-885.13 of the Nebraska Real Estate License Act of 1973 shall mean that the applicant must have devoted his full-time to activities requiring the holding of a salesman's license or if less than full-time, for a period of time equal to one-year full-time or two-years full-time as the case may be.

(b) Courses of study provided in Sections 81-885.13 and 81-885.14 of the Nebraska Real Estate License Act of 1973 shall be courses of study approved by the Real Estate Commission and which are offered by (1) Nebraska accredited baccalaureate degree granting institutions and Nebraska or non-Nebraska institutions offering programs, and credits from which, can be transferred to an· accredited Nebraska baccalaureate degree granting institutions, (2) Nebraska Technical Community College, (3) duly licensed Proprietary Real Estate Schools and~ ill Special Institutes relating to real estate which Institutes are approved by the Real Estate Commission and when such Institutes are conducted in conjunction with institutions enumerated in (1) and (2) of this Rule; Provided, the Real Estate Commission may give credit for similar courses taken at similar institutions in other states.

Rule 2, Subsection 2 to be amended to read as follows: (2) Each broker when operating under a franchise trade name shall

clearly reveal in all advertising that he is the person which owns the entity using such franchise trade name. On and after July 1, 1979, any broker who operates under or uses a franchise name shall incorporate with the franchise name and logotype his own name; however, the broker's name may not oe less than 50 percent of the surface area of the entire combined area of both the broker's name and the franchise name or logotype.

Proprietary Schools Offer Courses

Under provisions of LB 361, recently enacted by the Legislature, Proprietary Real Estate Schools became eligible on July 22, 1978, to· instruct prescribed real estate courses to individuals who wish to qualify as applicants for salesper­son's and broker's licenses as re­quired by the Nebraska Real Estate License Act as amended by LB 361. Proprietary schools desiring to in­struct Commission approved courses may do so after they are approved by the Commission. Ap­proval requires, in part, that they (1) meet licensing requirements of the Nebraska Department of Edu­cation, (2) teach courses prescribed by the Commission, and (3) use instructors approved by the Com­mission.

As we go to press, three schools have been approved. They are Randall School of Real Estate, 11117 Wright Street, Omaha, Nebraska 68144, Real Estate Academy, Inc., 10407 Devonshire Circle #135, Omaha, Nebraska 68114 and the Nebraska School of Real Estate, 942 No. 70th Street, Lincoln, Nebraska 68510. These schools have been approved to instruct Principles and Practices and Finance. There are other proprietary schools which have applications pending.

Other prescribed courses: Ap­praisal, Investments, Law and Management, will become available in September and proprietary schools will have the option to begin classes in these courses.

With proprietary schools offering courses, the options available to the citizens of Nebraska wishing to enter the Real Estate field have been further expanded. It is antici­pated that these schools will be a valuable addition in making college level real estate educational oppor­tunities even more readily avail­able.

Deputy Director For Education Named

Les Tyrrell has been named to the newly created position of Deputy Director For Education and began his duties on July 5th.

Les has been involved with public school education in Nebraska for the last ten years. He has served for the past six years in an administrative capacity for the Malcolm Public School System. From 1972 to 1976 he served there as Secondary Principal and from 1976-1978 as Superinten­dent of Schools.

Les was born and raised in Lincoln. He attended Lincoln Northeast High School and received his Bachelor's Degree in Education from the University of Nebraska-Lincoln in 1968. In 1972 he received a Masters Degree in Secondary Education with a specialization in Educational Administration and in 1976 received a Specialist Degree in Educational Administration, all from the University of Nebraska-Lincoln.

As Deputy Director For Education, he will have the responsibility of coordinating all of the Real Estate Education activities of the Commission, including developing and conducting Teacher Training Programs and the monitoring of Real Estate Courses.

Most Important Home Warranty Contracts Are Insurance Contracts

It has been interpreted by the Nebraska Department of Insurance that Home Warranty Contracts are, in fact, insurance contracts. Thus, the sale of Home Warranty Con­tracts come within the jurisdiction of the Department of Insurance and such contracts must be registered and approved by the Department of Insurance before they can be of­fered for sale in Nebraska.

Also, all persons offering such contracts for sale must be duly licensed as insurance agents by the Department of Insurance.

Any real estate broker or sales­person who may be attempting to sell Home Warranty contracts should cease their activities at once and desist from any further sales activity until they are certain that the Home Warranty Contracts they are offering are properly regis­tered, and that they are properly licensed to sell Home Warranty Contracts.

Annual Educational Workshops The Nebraska Real Estate Commission is pleased to announce that a series of Educational Workshops For

Licensees will be held in five Nebraska cities during the week of October 9-13, 1978. The Workshops will be conducted by Real Estate Commission Director, Paul Quinlan and Commission

Counsel, Robert H. Petersen. Each one day session will deal with many aspects of the real estate practice and will give special attention to listing contracts and purchase agreements. A portion of the program is designed around a theme of "Do you really know what's in the Listing Contracts and Purchase Agreements". Robert Petersen will examine the form and substance of listing contracts and purchase agreements and review important court decisions involving listing contracts and purchase agreements. Paul Quinlan will conduct a License Law section of the workshop which will include a comprehensive review of recent license law changes, and Rules and Regulations changes. The closing of real estate transactions and many of the problems arising from poorly handled closings also will be reviewed.

The Workshop tour will start at Scottsbluff, at the Scottsbluff Inn, on Monday, October 9th. The next session will be held in North Platte at the Ramada Inn, on Tuesday, October 10. On Wednesday, October 11th the Workshop will be held in Grand Island at the Ramada Inn and be followed by a Workshop in Omaha, on Thursday, October 12th at the Peony Park Ballroom, 8100 Cass Street. The final workshop will be conducted on Friday, October 13th at the Cooper /Lincoln Theater, 54th and 0 Streets, in Lincoln.

The following program sets out the Workshop schedule which will also include adequate time for audience participation. The Workshops will provide an opportunity for licensees to get any questions answered which they may have.

These Workshops are being sponsored and underwritten by the Nebraska Real Estate Commission and are open to all Nebraska licensees. There will be no charge for attending any of the Workshops, however, lunch will be available at the Workshop held in Omaha at a cost of $2.45 per person for those wishing to have lunch at the Workshop site.

Licenses having questions about this matter should contact the Nebraska De­partment of Insurance, P.O. Box 94699, Lincoln, Nebraska 68509.

During the first week of October, all licensees of record will be sent supplies for their use in renewing their licenses for 1979. Each year many of these notices are returned by the post office for the reason that the licensees have moved and did not notify the Real Estate Commission of their changes of address.

If you have moved recently, please forward your corrected address immediately so that we may correct the Commission records before we mail the notices.
