The State of Oklahoma is operating under a declared state of emergency (Executive Order 2020-7, as amended) as a result of the national spread of COVID-19. The Acting Secretary of the Commissioners of the Land Office resigned, effective, March 20, 2020 and selecting a suitable replacement in the manner anticipated by 64 O.S. § 1005(C) may be excessively delayed by the national health emergency. The Commissioners of the Land Office have the statutory authority to adopt and issue formal resolutions pursuant to 64 O.S. § 1012(B). Recommendation: To continue normal and uninterrupted operations of the Commissioners of the Land Office during the leadership transition and the ongoing state of emergency, the Assistant Secretary recommends delegating all authority, powers, and duties of the Secretary to the Commissioners of the Land Office to the Assistant Secretary to the Commissioners of the Land Office for a period of one hundred and eighty (180) days or until a new Secretary is appointed, whichever occurs first.

4. Consideration and Possible Action to Issue a Continuous Easement

Kingfisher County Commissioners District #2 has made an offer of $750 for a continuous easement for public highway and bridge improvements. Area requested is 0.289 acres, per provided survey. The offer was reviewed by Chris Foster and approved by Floyd Evans. Recommendation: The Director of Real Estate Management recommends approval of the continuous easement.

5. Consideration and Possible Action to authorize $50,000 in Capital Improvement Funds for Soil Conservation Projects
The initial approved funding request of $150,000 was depleted due to remediation of agricultural leases that were impacted in 2019 floods in southwestern Oklahoma.
The Real Estate Management Division is requesting an additional $50,000 from Capital Improvement funds on Soil Conservation work on agricultural leases. The funds will be used for water wells; new ponds; new terraces and waterways; and cedar, mesquite, and invasive species control.
Recommendation: The Director of the Real Estate Management Division recommends approval of the use of Capital Improvement Funds in the amount of $50,000 for soil conservation projects.

2. Secretary’s Comments
a. Distributions to beneficiaries for month of FebruaryActing Secretary Vawter informed the Commissioners that distributionsfor the month of February totaled $10,932,049, bringing the totaldistribution for FY2020 to date to $79,454,853.
b. CREC Broker Awards – Industrial Sale Transaction of the YearVawter noted that the CLO Had earned the award for Industrial Sale ofthe Year and praised the Real Estate Management team for their efforts.
Vawter informed the Commission of a grass fire that had affected 3500 acres of CLO lands, but said that with spring rains there should be no long term effects. He also stated that the agency was actively working on contingency plans which may be initiated in response to the Coronavirus crisis.
3. Request for Authorization for Special Distribution
Due to the continued decline in oil and gas lease bonus income, staff is projecting adecrease in distributable income for FY 2020. To partially offset this decline theSecretary requests authorization for a Special Distribution of $2.2 million from the 5-year rolling average fund.
Recommendation: The Secretary recommends authorization to distribute $2.2 millionfrom the 5-year rolling average fund.

Acting Secretary Vawter requested the Commissioners authorize a special distribution of $2.2 million from the 5-year rolling average fund. Governor Stitt questioned the source of these funds. Acting Secretary Vawter explained that it is funded with money not spent from the constitutionally allowed agency operations percentage. A MOTION was made by Commissioner Byrd and seconded by Commissioner Hofmeister to authorize the special distribution.

General Counsel Bennett Abbott presented a request for authorization to file FEAD lawsuits for non-payment of agricultural leases. He noted that the staff had been diligently working to collect the past due amounts without the necessity of filing suit and had been able to drop the total owed to approximately $1.58 million. A MOTION was made by Lt. Governor Pinnell and seconded by Commissioner Hofmeister to authorize the lawsuits.

5. Second Addendum to Commissioners of the Land Office of the State of Oklahoma Unsubordinated Commercial Ground Lease No. 101779 Contract No. 4307

This property is leased to the Oklahoma Department of Corrections as part of its prison farm system Oklahoma State Industries. In 2016, a permanent easement for a new highway was granted through this parcel, the total easement was for 31.03 acres. This easement area has been fenced and removed from the leased area and this Second Addendum formalizes the removal of that land from the leased area. Recommendation: The Director of Real Estate Management recommends approval of the Second Addendum.

A question was asked regarding the purpose of the expenditure to Centerpoint Energy Services Inc. Acting Secretary Vawter informed the Commission that it was payment for natural gas in connection with the CLO’s gas marketing program, which saved state agencies approximately $1 million last fiscal year. Consideration and Possible Action to Adopt and Issue a Resolution Delegating All Authority, Powers, and Duties of the Secretary of the Commissioners of the Land Office to the Assistant Secretary of the Commissioners of the Land Office for a Period of One Hundred and Eighty (180) Days or Until a New Secretary is Appointed, Whichever Occurs First The State of Oklahoma is operating under a declared state of emergency (Executive Order 2020-7, as amended) as a result of the national spread of COVID-19. The Acting Secretary of the Commissioners of the Land Office resigned, effective, March 20, 2020 and selecting a suitable replacement in the manner anticipated by 64 O.S. § 1005(C) may be excessively delayed by the national health emergency. The Commissioners of the Land Office have the statutory authority to adopt and issue formal resolutions pursuant to 64 O.S. § 1012(B). Recommendation: To continue normal and uninterrupted operations of the Commissioners of the Land Office during the leadership transition and the ongoing state of emergency, the Assistant Secretary recommends delegating all authority, powers, and duties of the Secretary to the Commissioners of the Land Office to the Assistant Secretary to the Commissioners of the Land Office for a period of one hundred and eighty (180) days or until a new Secretary is appointed, whichever occurs first.

Kingfisher County Commissioners District #2 has made an offer of $750 for a continuous easement for public highway and bridge improvements. Area requested is 0.289 acres, per provided survey. The offer was reviewed by Chris Foster and approved by Floyd Evans. Recommendation: The Director of Real Estate Management recommends approval of the continuous easement.

5. Consideration and Possible Action to authorize $50,000 in Capital Improvement Funds for Soil Conservation Projects
The initial approved funding request of $150,000 was depleted due to remediation of agricultural leases that were impacted in 2019 floods in southwestern Oklahoma.
The Real Estate Management Division is requesting an additional $50,000 from Capital Improvement funds on Soil Conservation work on agricultural leases. The funds will be used for water wells; new ponds; new terraces and waterways; and cedar, mesquite, and invasive species control.
Recommendation: The Director of the Real Estate Management Division recommends approval of the use of Capital Improvement Funds in the amount of $50,000 for soil conservation projects.
