Whilemostvisualartworksarefixedbytheirverynature(e.g.,asculpture,apainting,oradrawing),therearesomeworksthatmaynotbesufficientlyfixedtowarrantregistration.Specifically,theOfficecannotregisteraworkcreatedinamediumthatisnotintendedtoexistformorethanatransitoryperiod,orinamediumthatisconstantlychanging.
Mostvisualartworkssatisfythefixationrequirement,becausethedepositcopy(ies)oridentifyingmaterialsubmittedwiththeapplicationusuallyindicatethattheworkiscapableofbeingperceivedformorethanatransitoryduration.However,thefactthatuncopyrightablematerialhasbeenfixedthroughreproductiondoesnotmaketheunderlyingmaterialcopyrightable.Forexample,aphotographofafireworksdisplaymaybeacopyrightablefixationofthephotographicimage,butthefireworksthemselvesdonotconstitutecopyrightablesubjectmatter.Similarly,atextualdescriptionoftheideaforapaintingmaybeacopyrightablefixationofthetext,butitisnotafixationofthepaintingdescribedtherein.
Asageneralrule,applicantsdonothavetosubmitanoriginaloruniquecopyofavisualartworkinordertoregisterthatworkwiththeOffice.Inmostcases,applicantsmaysubmitphotographsorotheridentifyingmaterialsthatprovidetheOfficewithasufficientrepresentationordepictionoftheworkforexaminationpurposes.
Whencompletinganapplication,applicantsshouldaccuratelyidentifytheworkthatisbeingsubmittedforregistration,particularlywhensubmittingidentifyingmaterial.Forexample,iftheapplicantintendstoregisterasculptureandsubmitsaphotographofthesculptureastheidentifyingmaterial,theapplicantshouldexpresslystate“sculpture”intheapplication.Otherwise,itmaybeunclearwhethertheapplicantintendstoregisterthephotographorthesculptureshowninthephotograph.
Beforesubmittingidentifyingmaterialforapublishedvisualartwork,applicantsshoulddeterminewhethertheworkissubjecttothebesteditionrequirement.Asageneralrule,anapplicantshouldsubmitthe“bestedition”iftheworkwaspublishedintheUnitedStatesonorafterJanuary1,1978.Thecriteriausedtoidentifythebesteditionofaparticularworkarelistedinthe“BestEditionStatement,”whichissetforthinAppendixBtoPart202oftheOffice’sregulations.ItisalsopostedontheOffice’swebsiteinBestEditionofPublishedCopyrightedWorksfortheCollectionsoftheLibraryofCongress(Circular7b).Forspecificdepositrequirementsfordifferenttypesofvisualartworks,seeChapter1500,Section1509.3.

AstheSupremeCourtnoted,adesignetchedorpaintedontothesurfaceofaguitarmayhavepictorialorgraphicqualities.“Ifthatentiredesignisimaginativelyremovedfromtheguitar’ssurfaceandplacedonanalbumcover,itwouldstillresembletheshapeofaguitar.Buttheimageonthecoverdoesnot‘replicate’theguitarasausefularticle.”Id.Instead,thedesigncouldbeconsideredatwo-dimensionalworkofartthatsimply“correspondstotheshapeoftheusefularticletowhichitwasapplied.”Id.Andifthatdesignissufficientlycreativeitcouldbeprotectedasappliedart.

Toregisteranarchitecturalwork,applicantsshouldchecktheboxmarked“architecturalwork”intheAuthorCreatedfieldwhencompletinganonlineapplicationorintheNatureofAuthorshipspacewhencompletingapaperapplication.Ifanapplicantsubmitsanarchitecturaldrawingorblueprintandcheckstheboxfor“technicaldrawing,”theregistrationwillcoverthediagrams,illustrations,andaccompanyingtextcontainedwithinthatdrawing,butitwillnotcoverthebuildingorotherstructuredepictedinthatdrawing.Foradditionalinformationconcerningthisissue,seeSection923.1.
Anapplicationmaycoveronlyonearchitecturalwork,regardlessofwhethertheworkispublishedorunpublished.TheU.S.CopyrightOfficewillnotregistermultiplearchitecturalworksasagroupofrelatedworksorasanunpublishedcollection.Iftheapplicantintendstoregistervariationsonasingleplan,suchasaplanfortracthousing,theapplicantmustsubmitaseparateapplicationforeachhousemodelwithallaccompanyingfloorplanoptions,elevations,andstylesthatareapplicabletothatparticularmodel.37C.F.R.§202.11(c)(2).
