    I. INTRODUCTIONREAD THIS!

    Concordance is a powerful litigation support program. The Concordance trial versionis a full working version of the program. DO NOT INSTALL THIS PROGRAMUNTIL TOLD TO DO SO BY YOUR INSTRUCTOR. When you are ready toinstall the program, follow the instructions as described in Section III.

    II. USING THE CONCORDANCE HANDSON EXERCISES

    The Concordance Hands-On Exercises contain step-by-step instructions. Each exer-cise builds on the previous one, so please complete the Hands-On Exercises in order.

    Concordance comes with sample data, so you should be able to utilize many featuresof the program.

    III. INSTALLATION INSTRUCTIONS

    You will download a 30-day trial from the Concordance website. You will need todownload the free trials for bothConcordance 10 and Concordance Image 5 (twoseparate installations are required). Go to http://www.lexisnexis.com/concordance-downloads/ and click the link for the free trial. Follow the instructions provided onthe website to download the trial versions of Concordance and Concordance Image.

    IV. INSTALLATION TECHNICAL SUPPORT

    If you have problems installing the trial version of Concordance, support is availablefrom the manufacturer. Its website instructs users to contact [email protected] or call 800-421-8398.

    GETTING STARTED

    Introduction

    Throughout these exercises, information you need to enter into the program will bedesignated in several different ways:

    Keys to be pressed on the keyboard are designated in brackets, in all caps,

    and in bold (e.g., press the [ENTER] key).

    Movements with the mouse pointer (cursor) are designated in bold and italics(e.g.,point to File on the menu bar and click).

    Words or letters that should be typed are designated in bold (e.g., type TrainingProgram).

    Information that is or should be displayed on your computer screen is shownin bold, with quotation marks (e.g., Press ENTER to continue.).

    Specific menu items and commands are designated with an initial capitalletter (e.g., click Open).

    OVERVIEW OF CONCORDANCEConcordance is a powerful litigation support program. Concordance includes a num-ber of features, which give you the ability to enter, organize, track, and search variousdocuments. In addition, Concordance can store document images and create and at-tach electronic notes to transcripts and other electronic documents.

    BASIC LESSON

    LESSON 1: INTRODUCTION TO CONCORDANCE: ANOVERVIEW

    This lesson introduces you to Concordance litigation support programs. It explainsbasic information about the Concordance interface.

    1. Start Windows. Then, double-click the Concordance icon on the desktopor click the Start button, point to Programs or All Programs, point tothe LexisNexis Folder, point to the Concordance folder, and then click onConcordance 10.When you start Concordance, you will see the Concordancereview screen with the Workspace tab open (see Concordance Exhibit 1).From this screen you can create a new case, open an existing case, and accessother options. When learning Concordance, it is easiest to start with a casethat already has documents entered into the program. Two sample cases comewith the trial version of Concordance (Cowco and Calfco). To add a case toConcordance, click Open database.See Concordance Exhibit 1. In the Opendialog box, click Desktop in the left pane. Then select Concordance 10 Data

    folder and click Open; then select the Database folder and click Open.Atthis time, we want to open the Cowco database, so select Cowco and clickOpen.The Cowco database is now loaded into Concordance. Notice that thereare now two tabs in the review window (Workspace and Cowco) and that thefirst Cowco document is now visible in the review window. See ConcordanceExhibit 2.

    2. At the top of the Concordance window is the Standard toolbar. SeeConcordance Exhibit 2. You can change the view in the review screen by clickingdifferent icons. The default view is the Browse view. Notice that the Browse viewbutton is selected. Other views include Table view, Edit view, and Review view.See Concordance Exhibit 2. It is also possible to see two views at the same time.Click the Table view button.Now the review screen shows both the documentand a table view of all of the documents in this database. See Concordance

    Exhibit 3. Clicking the Review button allows you to see the results of a searchquery. Clicking the Edit button allows you to edit the document information.Click the Browse, Table, Edit, and Review view buttons separately and invarious combinations to see the different views available in the review screen.With any two Standard toolbar buttons selected, click View on the menu bar,select Split Screen, and then click Left-Right to see the two screens side-by-side. Click View on the menu bar, select Split Screen, and then click Top-Bottom to return the review screen to a top and bottom view.

    3. In the bottom left corner of the Concordance window is the Dynamic toolbar.See Concordance Exhibit 3. Click the Next document button(a blue right-facing arrow). Document 2 is now displayed in the review screen. Click the Lastdocument button(a blue right-facing arrow with an end bar). Document 203(the last document in the database) is now displayed in the review screen. Clickthe Previous document button(a blue left-facing arrow). Document 202 is nowdisplayed in the review screen. Click the First document button(a blue left-facingarrow with a blue bar). Document 1 is now displayed on the review screen.

    4. Click the Goto button on the Dynamic toolbar(the fifth button from theleft). See Concordance Exhibit 3. The Goto dialog box opens. This allows youto select a specific document to view. In the Document textbox, type 123andclick OK. Document 123 is now displayed in the review screen. To return tothe first document, click the First button on the Dynamic toolbar.

    5. Click the Table view button on the Standard toolbar (if the Browse viewbutton is highlighted, click the Browse view button so that Browse view isno longer selected).Table view allows you to see the fields found in Browseview (e.g., BEGNO (Begin Number), ENDNO (End Number), DOCDATE(Document Date), and DOCTYPE (Document Type)). You can add, delete,and reorder the fields displayed in Table view. Click the down arrow to theright of the Table button and click Table layout. The Table Layout dialog boxopens. In the left Layouts pane, you can see the fields currently displayed inyour Table view. In the Available fields pane, you can see the full list of fieldsthat may be displayed in Table view. You will now add two additional fields tothe Table view. Click AUTHOR in the Available fields pane and drag it intothe Layouts pane. Click RECIPIENT in the Available fields pane and drag

    it into the Layouts pane.Click TAGS in the Available fields pane (you mayneed to scroll down in the Available fields pane) and drag it into the Layoutspane.(Note: You can also add a field by double-clicking on it.) Click OK inthe Table Layout dialog box.Your Table view now includes the AUTHOR,RECIPIENT, and TAGS fields. See Concordance Exhibit 4.

    6. It is possible to sort the information in Table view by any of the displayed fields.Click the DOCDATE column.(You may need to drag the column wider.) Thereshould now be a small upward-facing arrow next to the column name, which

    means the column data is in ascending order, and the first document should bedated 00/00/0000apparently this document does not have a date attached toit. Click the DOCDATEcolumn again. There should now be a small downward-facing arrow, which means the column data is in descending order, and the firstdocument should be dated 07/16/1984. To restore the data to its original sorting,click the BEGNO column so there is an upward-facing arrow.

    7. Within the Table view, there is a feature that allows you to see the relativefrequency of items in a particular field. For example, assume that you wantedto know how many documents were Authored by each Author. Right-clickanywhere in the AUTHOR column.A shortcut menu opens. Click Tally

    AUTHOR.The Tally pane opens on the left side of the Concordance windowand displays the Tally results. See Concordance Exhibit 5. You can see that the

    AUTHOR with the highest document count is Duck;D with 29. Click Printat the bottom of the Tally pane, select the appropriate printer, and click OK.

    8. Double-click on Duck;D in the Tally pane.The review screen now shows justthe 29 documents that list Duck;D as the AUTHOR. Assume that you wantedto review these documents in preparation for a deposition with the author. Youcan create a folder and tag these documents for future review.

    9. To view the Tags pane, click the Tags selector in the pane selector buttons on

    the left side of the Concordance window.The Tags pane opens. This is whereyou can create and manage the tags and folders used to store and organizedocuments. You will use this tool in Lesson 2.

    10. Concordance allows users to search for specific documents in a numberof ways. To access the search tools, click the Search pane selector buttonon the left side of the Concordance window. The Simple Search tool isdisplayed in the Search pane. See Concordance Exhibit 6. Within the SimpleSearch tool, you have the option to use one or more search terms. You mayalso customize your search by requiring that all of the search terms appear ina document (with all of the words), or by requiring that an exact phrase orset of words appear in a document (with the exact phrase), or by requiringthat at least one of the search terms appear in a document (with at least oneof the words), or by requiring that certain words not appear in a document

    (without the words).

    11. Click both the Browse and Table view buttons on the Standard toolbarso that both views are highlighted. Type cowin the text box under withall of the words. Click Search.Your search should produce 24 documents.(The status bar at the bottom right of the Concordance window will showDocument 1 [12] of 24.) See Concordance Exhibit 6. This means that you

    are looking at the first of 24 documents retrieved by your search. The numberin brackets indicates the document number. You can navigate among thedocuments by using the First document, Previous document, Next document,Last document, and Goto buttons in the Dynamic toolbar. You can alsonavigate within a document by clicking the Move to next hit button andMove to previous hit button (which look like bulls-eyes). See ConcordanceExhibit 6. Click the Move to next hit buttonand notice how the cursormoves to the next reference to cow. The search term is displayed in red.

    12. Type Utah Groves Farmin the text box under with the exact phrase.ClickSearch.Your search should produce two (2) documents. By adding the searchterm Utah Groves Farm, you reduced the pool of responsive documentsfrom 24 to 2.

    13. Type milkingin the text box under without the words.Click Search.Your

    search should produce one (1) document. By removing documents with the searchterm milking, you reduced the pool of responsive documents from 2 to 1.

    14. Click Allin the Standard toolbar to restore the full database of 203 documents.

    15. You can also search by using the Quick Search toolbar, which is located justbelow the Standard toolbar. Type cowin the Quick Search toolbar and click the

    green arrow.Your search should again produce 24 documents. You can see adrop-down list of your search history by clicking the downward-facing arrow atthe far right of the Quick Search text box. You can reproduce a specific searchby clicking on the number of the appropriate search.

    16. Concordance has a feature called Search Limiters. This feature allows youto limit your search to those within a specific field, such as AUTHORor DOCTITLE. This is accomplished by typing periods before andafter the desired field. In the Quick Search toolbars text box, type cow.DOCTITLE.(note the period before and after DOCTITLE). Click the

    green arrow.See Concordance Exhibit 7. Your search should producetwo documents and both should have the term cow in the title of thedocument.

    17. There is another way to conduct a search in Concordance. This is called FormSearch. Click Form Search in the Search pane.The Query by Example dialogbox opens. See Concordance Exhibit 8. There are four columns in this dialogbox. The Connector column allows you to add connectors between searchterms (e.g., adj adjacent, near, and, etc.). The default settings for the Whereto look and How to look columns are appropriate for most basic searches, sowe will not adjust those columns. The Look for column is where you enter thesearch terms.

    18. Type cowin the first row under Look for. Click the Search then Browsebutton.See Concordance Exhibit 8. The first of the 24 documents retrievedby this search now appears in the review screen. You can navigate among andwithin the retrieved documents as discussed earlier.

    19. Click Form Search in the Search pane.Type cow in the first row underLook for. Leave adj as the selection under Connector in the second row. Typemilkingin the second row under Look for. Click Search then Browse.Yoursearch should retrieve just one document; that document should now bedisplayed in the review screen. The search terms cow and milking shouldappear in red, and the terms should be adjacent.

    This concludes Lesson 1. To exit Concordance, click the Close button (small x) inthe upper right corner of the screen.You may also continue with Lesson 2 without

    exiting the program.

    INTERMEDIATE LESSON

    LESSON TWO: TAGS, FOLDERS, AND PRINTING

    Concordance gives you the opportunity to organize your records as you see fit. Youcan create labels (called tags in Concordance) to identify specific groups of recordsand you can place them in folders to facilitate later search and retrieval of the records.You can also print records in Concordance.

    1. Start Windows. Then, double-click the Concordance icon on the desktopor click the Start button, point to Programs or All Programs, point tothe LexisNexis Folder, point to the Concordance folder, and then click

    Concordance 10.When you restart Concordance, it displays the same screenthat was active when the program was closed. To reset Concordance, click theAll button on the Standard toolbar and then click the First document buttonin the Dynamic toolbar. Click the Browse view button on the Standardtoolbar.See Concordance Exhibit 1.

    2. Concordance allows users to organize documents by applying tags todocuments. Tags can also be used to facilitate searching for specific documentsor documents with specific characteristics. It may help to think of tags as

    labels that you can place on electronic files. Click Tags pane selector; the Tagspane opens. See Concordance Exhibit 9. Concordance comes with two tags:Bundle 1 and Bundle 2. You will now create a new tag, so right-click anywherein the Tags pane, select New in the shortcut menu, and then click Tag. A newtag appears in the Tags pane with the default name New Tagselected. Type

    3. Concordance also allows users to create folders; the tagged documents may thenbe placed in one or more of these folders. Again, it may help to think of theConcordance folders as just thatfolders. After you have tagged documents,you need to put those documents somewhere. Concordance allows you to makeas many folders as you need to store the documents. You will now create a newfolder, so right-click anywhere in the Tags pane, select New, and then clickFolder.A new folder appears in the Tags pane with the default name NewFolderselected. Type Reviewed andpress Enterto replace it. You have nowcreated a new folder. See Concordance Exhibit 9.

    4. Now you will create some additional tags under the folder labeled Reviewed.Right-click on the Reviewed folder, select New, and then click Tag.A new tagappears in the Tags pane with the default name New Tagselected. Type HotDocuments to replace it. Repeat this process two more times, creating tagsnamedPrivileged andWork Product. See Concordance Exhibit 9.

    5. You will now create a personal folder for yourself. Right-click anywherein the Tags pane, then select New, and then click Personal folder.A newpersonal folder appears in the Tags pane with the default name PersonalFolder selected. Type your name (for example, Matthew Cornick) and

    press Enterto replace it. You have now created a personal folder. A personalfolder is private; only you can see its contents. The contents of other foldersmay be visible to other users. It is necessary to create and add at leastone tag for a folder, or it will not be saved when you close Concordance.

    Right-click on your personal folder, select New, then click Tag.A new tagappears in the Tags pane in your personal folders file tree with the defaultname New Tagselected. Type Personalandpress Enterto replace it. SeeConcordance Exhibit 9.

    6. You can apply tags to the results of a search query. For example, in the

    Cowco case, if it is determined that any document with the search termcow in it is a Hot Document, you could apply that tag to all documentsretrieved from that search. First, we must search for documents containingthe word cow. Click the Search pane selector button.Typecowin thetext box under with all of the words.Click Search.Your search shouldproduce 24 documents. Now click the Tags pane selector button.Assumethat the first document retrieved is Work Product and you want to tagit accordingly. Click the Table view button if necessary. Select the firstdocument in the Table view(BEGNO 00010019) and click the WorkProduct tag.A red check mark will appear next to the tag and the wordTAGwill appear on the status bar in the lower right portion of the screen.See Concordance Exhibit 10. Now assume that all of the documentsretrieved are Hot Documents and you want to tag them accordingly.

    Concordance allows you to tag multiple documents simultaneously. ClickTools on the Menu bar (above the Standard tool bar) and then click

    Manage Tags/Issues.In the Tag and Issue Management dialog box, click theTag Query in the Tags and Issues pane on the left. Then, in the Tag Querypane,click the plus sign (+) next to the Reviewed folder icon. This expandsits file tree. Now click Hot Documents to select it. Click Apply to Query. Inthe status bar at the lower right of the dialog box, it will indicate that 24 tagshave been applied. Click the Done button.See Concordance Exhibit 11.

    7. There are a number of print options within Concordance. On the Standardtoolbar, there is a Print button, which allows you to print all the records yousee in the review screen; there is also a Report button, which allows you to

    print the information available in the Table view. The easiest way of printinga single record is from the Browse view. With the first record from the searchyou just conducted open (BEGNO 00010019), select the Browse view buttonon the Standard toolbar, then click File on the Menu bar, and then clickPrint. See Concordance Exhibit 12. Click OK in the Print dialog box to

    print the record.Note, too, that the File menu has a Print preview option tosee what the printout will look like. Click the Next document button on theDynamic toolbar to go to the next record (BEGNO 00010031), then clickFile on the Menu bar, and then click Print preview. Click Close in the print

    preview screen.

    8. There is another way to print from the Browse view. Right-click in the Browseview and click Print record on the shortcut menu. Click OK in the Printdialog box to print the record.

    9. You can also print a report of the results of a query search like the one youjust conducted. To do so, click Print from the Standard toolbar.The Printdocuments dialog box opens. See Concordance Exhibit 13. There are fourtabs in the Print documents dialog box. On the Fields tab, you select thefields to be displayed in the report. For this exercise, you first need to click

    Remove all.This will move all the fields to the Available fields pane. Thenyou will add three additional fields (DOCTITLE, PAGES, and TAGS) fromthe Available fields pane to the fields that are displayed in the Selected fieldspane of the Print documents dialog box. Click DOCTITLE, then Select.Click PAGES, then Select. Click TAGS, then Select.See ConcordanceExhibit 13.

    10. Click the KWIC tab. KWIC is the abbreviation for Key Words In Context.(Key words is another way of saying search terms.) This will highlight thesearch term (in this example, cow) in the report. Make sure the box nextto Print key words in context (KWIC) is checked. Click the box next toDOCTITLE.

    11. Click the Formatting tab.The default settings are fine, so you do not need tochange anything. (By the way, the term widows refers to the lines of text leftat the bottom of a page when a record is split in two. The term orphans refersto the lines of text at the top of the next page.)

    12. Click the Print tab. Click the Print preview buttonto see a preview of theprinted images. The search term cow is displayed in red. Click Close in thePrint preview dialog box. Now click Print and then click OK in the Printerdialog boxto print the report.

    This concludes Lesson 2. To exit Concordance, click the Close button in the upperright corner of the screen.You may also continue with Lesson 3 without exitingthe program.

    ADVANCED LESSON

    LESSON THREE: CONCORDANCE IMAGE

    1. Start Windows. Then, double-click the Concordance icon on the desktop

    or click the Start button, point to Programs or All Programs, point tothe LexisNexis Folder, point to the Concordance folder, and then click onConcordance 10.When you restart Concordance, it displays the same screenthat was active when the program was closed. To reset Concordance, click the

    All button on the Standard toolbar and then click the First document buttonon the Dynamic toolbar.Click the Browse button on the Standard toolbar.See Concordance Exhibit 1.

    2. Concordance Image allows you to see a document in its native format andprovides a variety of annotation tools. In Concordance, annotated content suchas redactions and document markups are automatically saved. Other parties,such as opposing counsel, are not able to see the redacted information or removeany markups. Concordance Image opens in a second window, which can beresized for viewing alongside the main Concordance window, thus allowing you

    to see both the Browse and Table views as well as the native format image. In thetrial version of Concordance, only the Calfco database has images that can bedisplayed in Concordance Image, so you need to add that database. Click Opendatabase in the Databases pane.See Concordance Exhibit 1. In the Opendialog box, click Desktop andthen select theConcordance 10 Data folder andclick Open. Select Database folder and click Open. Select CALFCO databaseand click Open.The Calfco database is now loaded into Concordance.

    4. There are three toolbars in the Concordance Image window: the Standardtoolbar (located along the top of the window under the Menu bar), theRedlines toolbar (located along the left side of the window), and theView toolbar (located along the bottom of the window). See ConcordanceExhibit 14. The Standard toolbar allows you to open, print, select, and resizedocuments, as well as gives you quick access to Concordance Image Help.The Redlines toolbar provides a variety of tools you can use to mark up(redline) an image during review. The View toolbar provides document andpage navigation tools.

    5. You will now explore the Standard toolbar. The first icon is the Openbutton. This is used to open documents that are not associated with thedatabase then in use. The trial version does not support this tool. The secondicon is the Print button; you will print an image from Concordance Image

    later in this lesson. 6. The third icon (looks like a mouse pointer) on the Standard toolbar is

    the Mark icon. This marks a section of the image to copy. The fourthicon is the Mark Zoom button. This allows you to zoom in on a specificportion of the image. With document BEGNO 00010004 still displayed inConcordance Image, click the Mark Zoom icon on the Concordance ImageStandard toolbar; then, using your mouse, click and drag the cursor todraw a rectangle around the last three paragraphs on the screen.Theselected area will appear as a magnified image. See Concordance Exhibit 15.Click the Pan button on the Standard toolbar(it has a hand icon). Yourcursor now looks like a hand. Click and drag the mousethe image moveswith the cursor.You can use this tool to navigate within a selected image.To restore the original document image, c lick the Fit to Height button

    7. The View toolbar allows you to navigate from image to image and within aselected image. Click the Next button on the Image View toolbar(a blackright-pointing arrow).The next page in the document now appears. The Firstbutton (a black left-pointing arrow with a bar) takes you to the first page in adocument, the Last button (a black right-pointing arrow with a bar) takes you

    to the last page in a document, and the Previous button (a black left-pointingarrow) takes you to the previous page in a document.

    8. Click the Next document button (a page icon with a right-pointing arrow)on the Image View toolbar. See Concordance Exhibit 14. The next documentin the Calfco database is now displayed. To return to the previous document,click the Previous document icon (a page icon with a left-pointing arrow).

    9. Click the Zoom in button (a blue plus sign icon) on the Image View toolbar.See Concordance Exhibit 14. The image will be magnified slightly. Click the

    Zoom in button four more times.The image magnification will increase withevery click. Click the Zoom out button (a blue minus sign icon) on the ImageView toolbar five times. The image magnification will decrease with every click.

    10. Click the Fit to width button (a magenta icon with horizontal arrows) onthe Image View toolbar.This changes the magnification so the entire width

    of the image appears. Click the Fit to height button (a magenta icon withvertical arrows) on the Image View toolbar.This changes the magnificationso the entire height of the image appears. Click the Rotate button (a red iconwith a turned arrow) on the Image View toolbar.The image rotates right90 degrees. To restore the original image view, click the Rotate button threetimes.See Concordance Exhibit 14.

    11. Now we will use the Redline toolbar in the Concordance Image window.With document BEGNO 00010004 displayed, click the Highlight button (ahighlighter icon) on the Redline toolbar.Move your mouse, to highlight the

    first paragraph of the letter.It is now highlighted in yellow. See ConcordanceExhibit 16. Right-click the highlighted area.A new shortcut menu opens. Inthe shortcut menu, click Change color.The Color dialog box opens. Choosea new color and click OK. Right-click the highlighted area again and clickDelete box. The highlighting will disappear. Click the Highlight button againto deselect the tool.
