There are many things that people talk about that are coveredby the 80/20 rule. In pari-mutuel wagering it is 80% of themoney is wagered by 20% of the people.

However, for the Presque Isle Downs race season, 20% of theraces have been run, but there are still 80% remaining.

80% of our time during the race week is devoted to doing theeveryday things it takes to make the show go, while 20% ofthe time is dedicated to solving problems (most of which arenot really problems).

The weather has been pretty cooperative, except for right nowas I am writing this note, there are Thunder Storms pendingand a Tornado has been spotted South of Erie. But that issomething we can’t fix no matter how we try.

STEROID POLICYThe Pennsylvania State Horse Racing Commission announces the follow-ing administrative policy for the period commencing October 1, 2008 withrespect to four steroids: boldenone, stanozolol, nandrolone and testos-terone. All other steroid use remains banned.1. Voluntary out of competition testing will be available under the terms

and conditions of Administrative Procedure Notice SHRC-2008-01.2. The following policy applies to boldenone, stanozolol, nandrolone and

testosterone in females and gelded males. Testosterone andNandrolone in intact males is treated separately in Paragraph 3.

Any test result at plasma concentrations below 100 picograms per milli-liter will be considered a negative test result.Any test result at plasma concentration levels at or above 100 picogramsper milliliter will be sanctioned as an Offense as described in Paragraph 4.3. With respect to testosterone and nandrolone levels in intact male

horses:I. Testosterone:

At Presque Isle Downs, Inc. (PIDI), race day administration ofLasix may only be administered in accordance with thePennsylvania State Horse Racing Commission (PSHRC) direc-tive by a third party service provider, at PIDI it will be Dr. MelBeard.

Dr. Beard ensures that the Lasix will be adminstered at alltimes consistent with the time frame, dosages, and otherrequirements of the PSHRC. Dr. Beard is licensed and in goodstanding with the Commission.

Dr. Beard will prepare proper documentation on the dailyadministration of Lasix and provide a copy of such documen-tation to PIDI and the PSHRC as required. The cost is $20 perhorse, with the payment billed directly out of the HorsemenAccounts.

For horses stabled on the grounds, Lasix is administered atthe horse’s current stall location and the trainer or an agent ofthe trainer must be with the horse at the time of administra-tion. “In Today” signage will be posted on the stall doors ofhorses once they are treated.

Horses shipping in to race are required to arrive to the receiv-ing barn 30 minutes prior to the treatment deadlines, andupon arrival, the trainer or an agent of the trainer must staywith the horse and be present at the time of treatment.

No private practitioners are allowed in the horse’s stalls afterthe administration of Lasix on race day.

Procedures may be updated from time to time at the direc-tion of the PSHRC.

Substances of therapeutic value.A foreign substance of accepted therapeutic value may be administered as prescribed by a

veterinarian when test levels and guidelines for its use have been established by theVeterinary-Chemist Advisory Committee of the National Association of State RacingCommissioners and approved by the Commission.

(1) Only one approved nonsteroidal anti-inflammatory drug (NSAID) may be present in thebody of a horse while it is participating in a race. The presence of more than one NSAID at anytest level is forbidden.

(2) The test level of phenylbutazone under this section may not be in excess of two micro-grams (mcg) per milliliter (ml) of plasma.

(3) The test level of oxyphenbutazone under this section may not be in excess of two micro-grams (mcg) per milliliter (ml) of plasma.

(4) The administration of furosemide shall be permitted for the prophylactic treatment ofa confirmed bleeder under the conditions and guidelines set forth in § 163.305 (relating tobleeder list), and with the approval of the Commission veterinarian.

In order to avoid a positive test, the Commission encourages all horsemen participating inracing within this Commonwealth to come into compliance with the 2 micro-gram level bySeptember 15, 2010.NO BUTE FOR TWO YEAR OLDS.

Policy on Alkalinizing SubstancesADMINISTRATIVE POLICY NOTICE SHRC-No.2010-01.SUBJECT: Policy on Alkalinizing Substances.EFFECTIVE DATE: July 15, 2010.WHEREAS, in accordance with §§201 (a) and 202 (a) of the Race Horse Industry Reform Act(4 P.S. §§325.201(a) and 325.202(a)), the Pennsylvania State Horse Racing Commission(“Commission”) has general jurisdiction and authority over all thoroughbred horse racingactivities in the Commonwealth; andWHEREAS, consistent with its statutory authority and in accordance with 58 Pa. Code §163.302 (a), the Commission is charged with protecting the integrity of horse racing, guardingthe health and safety of the horse and safeguarding the interests of the general public andracing participants though the prohibition or control of drugs, medications or substances for-eign to the natural horse; andWHEREAS, in accordance the authority and powers of the State Board of Stewards set forthin 58 Pa. Code §163.340 (i) and §163.452(e) of the Commission’s regulations, the Stewardsauthorize the State Veterinarians to take samples of saliva, urine or blood from horses as des-ignated by the Stewards or the Commission and make the examinations and tests that maybe required by the Stewards and the Commission; andWHEREAS, on May 13,2010, at its monthly meeting, the Commission unanimously estab-lished and adopted the proposed Policy on Alkalinizing Substances; andNOWTHEREFORE: The use of agents or substances that elevate the horse’s TC02 level abovethose existing naturally in the untreated horse at normal physiological concentrations isstrictly prohibited.

BLEEDER PROGRAM1. When starting for the first time in this jurisdiction a bleeder horse shipped into this state

from another jurisdiction must comply with the criteria established by the PennsylvaniaState Horse Racing Commission to qualify for the bleeder program. A current certificatesetting forth the qualification as a bleeder must be presented to the CommissionVeterinarian no later than the scheduled lasix treatment time.

2. A horse placed on the Bleeders list shall be ineligible to race for ten days following thefirst incidence of bleeding; thirty days for the second incidence; ninety days for a thirdincidence and shall be barred from racing following a fourth incidence.

3. BLEEDER MEDICATION: Lasix shall be administered no less than 2 cc.’s (100 mg) formore than 10 cc.’s (500 mg).

4. ASSOCIATION VETERINARIANS: The Chief Veterinarian may delegate to AssociationVeterinarians the same authority as Commission veterinarians regarding the certificationof bleeders.

Attention Horsemen:When using Methocarbomal in conjunction with Bute it is possible the rec-ommended withdrawal time of 48 hours for Methocarbomal is inaccurate.The latest research indicates a minimum of 72 hours should be used if usingin conjunction with Bute. Please adjust your prerace treatments accordingly.

BLEEDER PROGRAM1. When starting for the first time in this jurisdiction a bleeder horse shipped into this state

from another jurisdiction must comply with the criteria established by the PennsylvaniaState Horse Racing Commission to qualify for the bleeder program. A current certificatesetting forth the qualification as a bleeder must be presented to the CommissionVeterinarian no later than the scheduled lasix treatment time.

2. A horse placed on the Bleeders list shall be ineligible to race for ten days following thefirst incidence of bleeding; thirty days for the second incidence; ninety days for a thirdincidence and shall be barred from racing following a fourth incidence.

3. BLEEDER MEDICATION: Lasix shall be administered no less than 2 cc.’s (100 mg) formore than 10 cc.’s (500 mg).

4. ASSOCIATION VETERINARIANS: The Chief Veterinarian may delegate to AssociationVeterinarians the same authority as Commission veterinarians regarding the certificationof bleeders.

Substances of therapeutic value.A foreign substance of accepted therapeutic value may be administered as prescribed by a

veterinarian when test levels and guidelines for its use have been established by theVeterinary-Chemist Advisory Committee of the National Association of State RacingCommissioners and approved by the Commission.

(1) Only one approved nonsteroidal anti-inflammatory drug (NSAID) may be present in thebody of a horse while it is participating in a race. The presence of more than one NSAID at anytest level is forbidden.

(2) The test level of phenylbutazone under this section may not be in excess of two micro-grams (mcg) per milliliter (ml) of plasma.

(3) The test level of oxyphenbutazone under this section may not be in excess of two micro-grams (mcg) per milliliter (ml) of plasma.

(4) The administration of furosemide shall be permitted for the prophylactic treatment ofa confirmed bleeder under the conditions and guidelines set forth in § 163.305 (relating tobleeder list), and with the approval of the Commission veterinarian.

WHEREAS, on August 20, 2015, the PTHA/HBPA filed a Verified Petition pursuant to 1 Pa. Code §35.18 seeking an amendment, wavier and/or deletion of 58 Pa. Code, §163.262(a) relating to the condition of a horse in the event of a successful claim and;

FINAL ORDER

WHEREAS, on August 26, 2015, the Commission issued a Rule to Show Cause to the Executive Secretary as to why the interim relief requested by the Verified Petition should not be granted and; WHEREAS, on August 26, 2015, the Executive Secretary did not object to the special interim relief request by the PTHA/HBPA and on August 27, 2015, this Commission issued its “Order Scheduling Hearing and Request for Special Interim Relief” in the above matter and; WHEREAS, on September 22, 2015, the Commission conducted a hearing on the Verified Petition at which it received testimony and a presentation from various entities regarding above Verified Petition. The Commission held the record open for two weeks thereafter to receive any further comments or documents from any interested person. No comments or documents were received; WHEREAS, based upon the averments in the Verified Petition, the oral and documentary presentation, the Commission finds that the equities and public interest and the best interests of animal welfare, horsemen and the integrity of thoroughbred racing weigh heavily in favor of granting the final/permanent relief and: AND NOW THEREFORE, this 17th day of November 2015, upon consideration of the Verified Petition and subsequent administrative record in this matter before this Commission, Petitioners’ request for relief in the form of a waiver and amendment of the Commission regulation at 58 Pa. Code, §163.262(a) is herby GRANTED. Pending a final regulatory revision in accordance with the Commonwealth Documents Law, the Commission’s regulation at 58 Pa. Code, §163.262(a) shall be waived, amended and interpreted as follows: a.) In the event a horse dies during a claiming race or is euthanized on the racetrack during a claiming race, any claim made on that horse will be declared void; b.) In the event that a horse is vanned off the racetrack after a claiming race, that horse will be taken to the test barn for no longer than one (1) hour from post-time of the race. The successful claimant for such horse may declare the claim void at his/her election within one (1) hour of post-time of the race, except that the claim may not be declared void if the horse was vanned off the track due solely to heat stroke or bleeding from the nostrils, as determined by the Commission veterinarian. In the event the successful claimant exercises his/her discretion to declare the claim void, the horse will be returned to the custody of the original owner who entered the horse in the claiming race. c.) If a horse is placed on the Veterinarian’s List within one hour of post-time of the race after having been taken to the test barn under its own power or otherwise without assistance for evaluation by the Commission veterinarian, the successful claimant may declare the claim null and void at his or her election. Except that, the claim may not be declared null and void if the horse is placed on the Veterinarian’s List due solely to heat stroke or bleeding from the nostrils, as determined by the Commission veterinarian. In the event the successful claimant exercises his/her discretion to declare the claim void, the horse will be returned to the custody of the original owner who entered the horse in the claiming race. POLICIES & REGULATIONSAll trainers will cooperate with the Racing Secretary and/or the StallSuperintendent in the moving of horses for consolidation purposes of thebackside in order to utilize the stabling facilities to the fullest extent.Positively NO DOGS or OTHER ANIMALS are permitted on grounds.No bedding other than straw is permitted.No yearlings are permitted on the grounds at any time.Substitute races will be used at the discretion of the Racing Secretary.Owners and Trainers are advised that unless delinquent Jocks mounts are sat-isfied, Foal Papers will not be released.The Pennsylvania Racing Commission has prohibited the use of turned downor any bent shoe at all Pennsylvania tracks.Trainers and authorized agents, when entering horses, are solely responsiblefor claiming Registered PA-Bred Preference. In the event such preference isnot declared at time of entry, such preference shall be forfeited.Registered PA-Breds will have preferred starter status in all non-restrictedovernight races. It is hereby agreed that Presque Isle Downs & Casino shall NOT be liablefor, and that the owner and/or lessees of the horse will indemnify andhold harmless Presque Isle Downs & Casino against all responsibility, lia-bility or claim of injury or damage to any person, horse or other propertyof the undersigned, or of any other person, or his or their agents, employ-ees or associates, caused by the horse, or agent of the employees of theundersigned, or by any other person, including employees, agents of Presque IsleDowns & Casino, whether by negligence or otherwise, on the premises ofPresque Isle Downs & Casino.All trainers shall carry compensation insurance covering all of theiremployees. This paragraph is intended to include all individuals employedby trainers in the training and racing of horses. All concessionaires shallcarry compensation insurance covering all their employees.All common areas and shedrows to the middle of roads will be subject toinspection by management or Stall Superintendent. All areas are to beraked and cleaned.All first time starters must have a minimum of three (3) satisfactory pub-lished workouts, one being within the last thirty (30) days, and beapproved from the starting gate. An O.K. RECEIVING BARN RULES1. No Trainer competing on consecutive days may bring more horsesthan those which are for that day’s race card, unless prior arrangementshave been made with the Stall Superintendent.

2. Trainers competing on consecutive days are responsible for additionalbedding, and cleaning of stalls assigned to them (authorized beddingonly).

3. Horses in for work & go must be out of the Receiving Barn by Noon(12:00 p.m.) Saturday thru Thursday. No training on Friday.

4. Once a stall has been assigned, and a horse has occupied the stall, nochanging/switching of stalls will be permitted.

5. There will be no lending of Receiving Barn Tools, unless Receiving Barnpersonnel are present while tools are being used.

6. Only Receiving Barn personnel are permitted in the Barn Office, and noloitering around Barn Office.

7. No on loading / off loading of horses in front of, or around ReceivingBarn during training hours (7:00a.m. – 11:00a.m. Saturday – Thursday).

8. Trainers if there are any problems with the stalls please notify the Barnpersonnel.

9. Trainers, when arriving at the Receiving Barn (report in) to the BarnGuard for stall allotments during Racing Days and the Stable Gate forNon - Race Days.

10. No Ponies in the Receiving Barn unless prior arrangements have beenmade.

11. Trainers while assigned stalls in the Receiving Barn, the stalls and areaaround the stalls are to be policed of trash at all times.

12. No dumping of ice/water buckets inside the stalls, contents are to bedeposed of properly.

CLAIMING RULESEligible to Claim:1. An owner who has a thoroughbred(s) stabled in Pennsylvania: or,2. An owner who has started a horse at this meet,3. A new owner who has not held an Owner’s License in a racing jurisdic-

tion during the prior year to claim by obtaining an Open ClaimingLicense from the Commission andmust comply with certain other pro-cedures (See Rule 163.251).

All claims must be made in writing on forms and in envelopes furnished bythe Association and approved by the Commission. Both forms andenvelopes must be filed out completely, and must be substantially accu-rate, otherwise the claim will be void. The determination of what is sub-stantially accurate is within the sole discretion of the Stewards.Notwithstanding and designation of sex or age on the racing program orany racing publication, claimant is solely responsible for determining theage or sex of a horse claimed, prior to depositing the claim form. All claimsmust be deposited in the Claiming Box at least ten (10) minutes before posttime of the race with respect to which the claim is made.163.253 Number of claim. When a stable consists of horses owned by more thanone person, trained by the same trainer, not more than one claim may beentered on behalf of such stable in any race.163.254 Starting of a claimed horse. For a period of 30 days after the claim, aclaimed horse shall not start in a race in which determined eligibility price isless the 25% more than the price at which it was claimed. The claimed shallnot count, but the following calendar day shall be the first day and thehorse shall be entitled to enter whenever necessary so the horse may starton the 31st calendar day following the claim for any claiming price. This pro-vision shall not apply to starter handicaps in which the weight to be carriedis assigned by the handicapper.163.255 Sale or transfer of a claimed horse. When a horse is claimed, it shall not besold or transferred to anyone wholly or in part except in a claiming race, fora period of 30 days from the date of claim, nor shall it, unless reclaimed,remain in the same stable or under control or management of its formerowner or trainer for a like period. Further, it shall not race elsewhere untilthe end of the race season in progress or for period of 60 days, whichevershall first occur. The Commission shall have the authority to waive this ruleupon application and demonstration that such waiver is in the best interestof horse racing in the Commonwealth of Pennsylvania. Nothing in this ruleshall preclude any claimed horse from entering in any non-claiming stakerace.163.256 Applicability of other rules. When a horse is claimed at a recognizedmeet-ing under provisions which are at variance with the provisions of this sec-tion, title to such horse shall be recognized in Pennsylvania to follow therules of the meeting in which the claim was made, however, while racing inPennsylvania, shall adhere to Rule XII.

The Foal Paper/Date Preference System will be used at Presque Isle Downs &Casino as described below. Trainers are responsible for Dates - Preference Datesmust be claimed at time of entry. A horse can have only one (1) Preference Date(Except for Z-Dates or where mentioned in Race Headings).1. Dates assigned will be of three types:

0-DATE: An “0” Date will be assigned to a horse whose foal papers are submit-ted to the racing office prior to the first day that entries are taken. Thereafter,an E-Date will be assigned when foal papers are deposited with the RacingOffice. Foal Papers MUST BE TURNED IN TO THE RACING OFFICE BY 3:00 P.M.MONDAY, MAY 16, 2016, to receive an “0” DATE.E-DATE: Foal papers turned into the Racing Secretary’s Office will receive anentry date for that day, if not coming off a scratch. Also, an E-Date (the day thatyou’re entering for) will be given to any horse entered into any Condition Bookrace. And, any horse running elsewhere after obtaining this date will lose theirPreference Date. It is the trainer’s responsibility to notify the Racing Office insuch instances.R-DATE: Horses which are drawn into races, and horses on the ALSO ELIGIBLELIST which draw in to races, will receive a RUNNING DATE corresponding tothe date on which they are to run.

2. In over-filled races, preference will be given to horses in the order of theirassigned preference dates, earliest date first. Horses having identical dates willbe chosen by lot, however, where ENTRY and RUNNING DATES are the same,the horse with the ENTRY DATE will have preference.

3. Horse with dates established which re-enter, but do not get in, will keep thedate previously established.

4. Horse on the ALSO ELIGIBLE LIST shall be permitted to draw into races in theorder of their dates.

5. Horses in the body of a race which scratch will lose their DATE, and must re-enter to receive an E-DATE or draw into the body of a race for an R-DATE.

6. A horse on the ALSO ELIGIBLE LIST will lose its date if a scratch card is submit-ted and its number drawn.

7. Any horse which has drawn or obtained a position in a race and enters againon the next day that entries are taken shall be termed an in-today horse and ifthe race in which the horse is entered overfills, the horse shall be given no con-sideration whatsoever with the exception of participation in a stakes race.

8. A horse which is a scheduled starter in a cancelled race will receive a Z-DATE,and will have preference the next time it is re-entered, unless the foal papersare signed out or the horse runs at another track.

9. Not more than one horse owned by the same person shall be drawn into anyovernight race to the exclusion of a single interest. Any trainer entering twohorses in an overnight race must prefer the horse with the best date.

10. Horse on the VET’S, STEWARD’S, STARTER’S or PADDOCK JUDGE’S LIST cannotre-enter until removed from such list.

11. Preference dates are transferred through changes in ownership and changesin trainer only after the proper transfer procedures have been completedthrough the Steward’s Office and delivered to the Racing Secretary’s Office.

12. Preference dates are good for any type of race or distance with the exceptionof Stakes and Handicaps, or where superseded by Z-Dates or Preference Clausesin race headings. Preference clauses in race headings will supersede Z-Dates. (Ininstance of office error, Preference will be determined at the discretion of theRacing Secretary.

13. Preference dates will not Supercede race conditions or Preference on any racesuch as; condition eligibility, winner’s preference, PA bred preference or anyother race condition or preference written for any race.

14. Foal Papers must be turned into the Racing Secretary’s Office no later than11:00 A.M. on the mornings that entries are being taken, to receive any con-sideration for E-DATES for that day’s draw of entries.

15. Should a horse’s papers be withdrawn from the Racing Office for just cause(i.e., tattooing, corrections, change of ownership or clarification, etc.), theRacing Secretary may determine the status of the Preference Date established.

16. You will lose your date when the Foal Papers are signed out of theRacing Office.

REMINDER: Foal Papers MUST BE TURNED IN TO THE RACING OFFICEBY 3:00 P.M. MONDAY, MAY 16, 2016, to receive an “0” DATE.
